A register listing geographical indications protected in the territory; 2. An administrative process verifying that geographical indications identify a good as originating in a territory, region or locality of one or more states, where a given quality, reputation or other characteristic of the good is essentially attributable to its geographical origin; 3. A requirement that a registered name shall correspond to a specific product or products for which a product specification is laid down, which can only be amended by due administrative process; 4. Control provisions applying to production; 5. A right for any producer established in the area who submits to the system of controls to produce the product labelled with the protected name provided he complies with the product specification; 6. An objection procedure that allows the legitimate interests of prior users of names, whether those names are protected as a form of intellectual property or not, to be taken into account; 7. A rule that protected names may not become generic; 8. Provisions concerning the registration, which may include refusal of registration, of terms homonymous or partly homonymous with registered terms, terms customary in common language as the common name for goods, terms comprising or including the names of plant varieties and animal breeds. Such provisions shall take into account the legitimate interests of all parties concerned. ANNEX XVII-B CRITERIA TO BE INCLUDED IN THE OBJECTION PROCEDURE FOR PRODUCTS REFERRED TO IN ARTICLES 170(2) AND (3) 1. List of name(s) with the corresponding transcription into Latin or Georgian characters. 2. Information about the product class. 3. Invitation to any Member State, in the case of the EU, or third country or any natural or legal 425 persons having a legitimate interest, established or resident in a Member State in the case of the European Union, in Georgia or in a third country to submit objections to such protection by lodging a duly substantiated statement. 4. Statements of objection must reach the European Commission or the Georgian Government within three months from the date of the publication of the information notice. 5. Statements of objection shall be admissible only if they are received within the time-limit set out in point (d) and if they show that the protection of the name proposed would: (a) conflict with the name of a plant variety, including a wine grape variety or an animal breed and as a result is likely to mislead the consumer as to the true origin of the product; (b) conflict with a homonymous name and which would mislead the consumer into believing that products come from another territory; (c) in the light of a trademark's reputation and well-known and the length of time it has been used, be liable to mislead the consumer as to the true identity of the product; (d) jeopardise the existence of an entirely or partly identical name or of a trademark or the existence of products which have been legally on the market for at least five years preceeding the date of the publication of the information notice; (e) conflict with a name that is considered generic. 6. Tourists have growing interests to attend gastronomic food & wine events, festivals, fairs, farmers’ markets and tasting quality food products. Gastronomy tourism is being developed as a new tourism product. Previous researches proved that a number of traditional food and wine products protected by EU or national designation have not been successfully promoted and obtained recognitions in the domestic or foreign markets. This paper aims to justify that the typical, traditional local food & wine products, as relevant gastronomy tourism attractions, need to be scientifically re-examined before promotion. It suggests new ways of gastronomy tourism promotion based on improved territorial marketing portfolio, which can create evident value added for small and medium enterprises in the sector providing an advance to move from quality to excellence. The EU and Kosovo shall apply to processed agricultural products the duties listed in Annexes I and II to this Protocol respectively in accordance with the conditions mentioned therein, whether limited by a tariff quota or not. 2. The SAC shall decide on: (a) extensions of the list of processed agricultural products under this Protocol, (b) amendments to the duties referred to in Annexes I and II to this Protocol, (c) increases in or the abolition of tariff quotas. 3. The SAC may replace the duties established by this Protocol by a regime established on the basis of the respective market prices of the EU and Kosovo of agricultural products actually used in the manufacture of processed agricultural products subject to this Protocol. 2 ARTICLE 2 The duties applied pursuant to Article 1 of this Protocol may be reduced by decision of the SAC: (a) when in trade between the EU and Kosovo the duties applied to the basic products are reduced, or (b) in response to reductions resulting from mutual concessions relating to processed agricultural products. The reductions provided for under point (a) shall be calculated on the part of the duty designated as the agricultural component which shall correspond to the agricultural products actually used in the manufacture of the processed agricultural products in question and deducted from the duties applied to these basic agricultural products.

    The Scotch Whisky Regulations 2009 The Scotch Whisky Regulations 2009 (SWR) came into force on 23 November 2009. They replaced the Scotch Whisky Act 1988 and the Scotch Whisky Order 1990. Whereas the previous legislation had only governed the way in which Scotch Whisky must be produced, the SWR also set out rules on how Scotch Whiskies must be labelled, packaged and advertised, as well as requiring Single Malt Scotch Whisky to be bottled in Scotland from 2012. The following guidance is aimed at assisting those producing and selling Scotch Whisky, and those designing labels, packaging and advertising, to comply with new law. Checklists are included where appropriate. This guidance covers only the main provisions of the law; the Regulations should be referred to for the full detail.
