A RESOLUTION TO DENY GRIEVANCE NO. 17-008

Trustee ______moved the adoption of the following resolution:

WHEREAS, Grievance No. 17-008 was presented to the Board of Trustees by Justin Richards, a member of Beavercreek Professional Firefighters I.A.F.F. Local 2857; and

WHEREAS, the Board of Trustees has considered the merits of said Grievance and has determined that the Township appropriately applied the standards contained in the collective bargaining agreement between the union and the Township; and,

WHEREAS, the Board of Trustees hereby denies said Grievance in its entirety.

NOW THEREFORE BE IT RESOLVED THAT, the Board of Trustees of Beavercreek Township, Greene County, Ohio favorably passed the above Resolution.

FURTHER BE IT RESOLVED THAT, all formal actions of the Board of Trustees concerning and relating to the adoption of this resolution are being adopted at a duly called and authorized open meeting of the Board of Trustees on the date set forth above, such meeting being duly called pursuant to and in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code.

03/26/2018 5 of 48 PARK AGREEMENT

THIS AGREEMENT is between the Board of Trustees of Beavercreek Township, Greene County, Ohio. 851 Orchard Lane, Beavercreek, Ohio 45434 (“Board of Trustees”) and the Greene County Park District (“Park District”), 575 Ledbetter Road, Xenia, Ohio 45385.

WHEREAS, pursuant to Ohio Revised Code 505.26 the Board of Trustees of Beavercreek Township owns and operates five parks commonly referred to as Maxwell Park, Koogler Wetland Prairie Preserve, Pershing ‘Neatherton Park, Phillips Park and McCalmont Park (collectively referred to herein as the “Parks”) in the unincorporated portion of Beavercreek Township; and

WHEREAS, pursuant to R.C. 505.10(A)(5) when a township has title to real property, the board of township trustees, by resolution, may authorize the transfer and conveyance of that property to any other political subdivision of the state upon such terms as are agreed to between the board and the legislative authority of that political subdivision; and

WHEREAS, in an effort to reduce the expenses of the maintenance and operation of the Township Parks and in furtherance of consolidating the parks under one entity, the Beavercreek Township Board of Trustees wishes to transfer and convey the Township Parks to Greene County Park District, Greene County, Ohio and the Park District has agreed to accept said Township Parks under certain terms and conditions set forth below; and

NOW, THEREFORE, pursuant to the authority granted by the Ohio Revised Code to each party to this Agreement, and in consideration of the mutual covenants and promises set forth herein, the parties hereto agree as follows:

1. The Board of Trustees shall transfer and conveyance of the following parcels of property to the Park District:

a. Parcel number B03000200492006400, located at Shaw Lane, Beavercreek Township, Ohio 45385 and commonly known as Maxwell Park; (“Maxwell Park”);

b. Parcel number B030002002900043000, located at 2735 Beaver Valley Road, Beavercreek Township, Ohio 45432 and commonly known as Koogler Wetland Prairie Reserve (“Koogler Wetlands”);

c. Parcel number B42000600250010200, located at 2090 Dayton-Xenia Road, Beavercreek Township, Ohio 45432 and commonly known as Phillips Park (“Phillips Park”);

d. Parcel number L32000200310000400 and parcel number B03000200510002500, located at 1940 Indian Ripple Road, Sugarcreek Township, Ohio 45385 and commonly known as McCalmont Park (“McCalmont Park”);

Page 1 of 5 03/26/2018 6 of 48 e. Parcel number B03000200420001300 and B04000200420001400, located at 1101 Fairground Road, Beavercreek Township, Ohio and commonly known as Pershing ‘Neatherton’ Park (“Pershing Park”); and

However, in the event the first Park District Levy following the effective date of this Agreement is not certified by the Board of Elections as passed by Greene County voters in the general election, Phillips Park shall be transferred and conveyed back to Beavercreek Township Board of Trustees.

2. In exchange for the transfer of the Parks to the Park District, all maintenance, operations and improvements of the parks shall be the responsibility of the Park District.

3. The Park District hereby agrees to enter into an agreement with Beaver Creek Wetland Association which shall be grant permission for the following:

a. Phillips Park: i. Use of the barn for storage of equipment and materials need to maintain Beaver Creek Wetland Association’s conservation purpose. However, Beaver Creek Wetland Association shall be responsible for the equipment; ii. To perform necessary operations to control invasive plants using the necessary power equipment of the Beaver Creek Wetland Association; iii. To plant native species to replace any removed invasive plant species; iv. Have and maintain bluebird box monitoring program; v. Use of the park for Beaver Creek Wetland Association’s hikes and programs; vi. To monitor for problems that threaten the ecological integrity of the Park.

b. Koogler Wetlands: i. Build, repair and maintain over 1200’ of boardwalk and aggregate trails within the Wetlands to ensure trail access year round; ii. Assist with control of beaver dams; iii. Maintain trails, as needed; iv. To perform necessary operations to control invasive plants using the necessary power equipment of the Beaver Creek Wetland Association; v. To plant native species to replace any removed invasive plant species; vi. Use of the park for Beaver Creek Wetland Association’s hikes and programs;

Page 2 of 5 03/26/2018 7 of 48 vii. To monitor for problems that threaten the ecological integrity of the Park.

In exchange for the foregoing permissions, Beaver Creek Wetland Association shall hold the Park District, its officers, officials, employees and volunteers, harmless from any and all claims, injuries, damages, losses or suits including attorney fees, arising out of or in connection with the uses and permissions set forth above in Phillips Park and Koogler Wetlands.

4. The Park District agrees that the Agreement between the Board of Trustees and John Shawhan shall remain in force and effect for the calendar year 2018 for the purposes of allowing John Shawhan to continue to farm on Parcels (Parcels L32000200310000400 and B03000200510002500) for 2018 and for the payment of property taxes and other payments shall be prorated between the Park District and the Board of Trustees for 2018.

5. The Park District agrees that that Parks shall be used for park land and public recreational purposes in their entirety. In the event that the Parks, or any portion thereof, ceases to be used as park land and public recreational purposes, all rights title and interest in the Parks shall revert back to Beavercreek Township Board of Trustees.

6. The Park District agrees further that in the event the Park District desires to sell or otherwise transfer the Parks to any other entity or person, or the Greene County Park District no longer desires that any one or all of the Parks be used for park land and public recreational purposes, Beavercreek Township Board of Trustees shall have the first right to purchase the Township Parks listed herein for $1.00.

a. The Park District shall give the Board of Trustees written notice of its intention to sell or otherwise transfer its interest in any one or all of the Parks. Such notice shall state the terms and conditions under which the Park District intends to sell or otherwise transfer its interest. For thirty (30) business days following the giving of such notice, the Board of Trustees shall have the option to exercise its option to repurchase any one or all of the Parks.

b. If at the end of the thirty (30) business days following the giving of such notice, the Board of Trustees does not agree to repurchase the any one or all of the Parks, the Park District may sell or otherwise transfer its interest in any one or all of the Parks.

7. The effective date of this agreement shall be ______. This agreement shall be governed by and construed in accordance with the laws of the State of Ohio.

8. This Agreement shall not be assigned or conveyed to any other party without the express written consent of all parties to this Agreement. This Agreement shall be binding and inure to the benefit of the parties, their successors and assigns. No

Page 3 of 5 03/26/2018 8 of 48 Amendment or modifications to this Agreement shall be effective unless it is in writing and signed by the parties or their respective duly authorized representative.

9. The invalidity or partial invalidity of any portion of this agreement will not affect the validity of any other provision. In the event that any provision of this agreement is held to be invalid, the remaining provisions shall be deemed to be in full force and effect as if they have been executed by both parties subsequent to the expungement or judicial modification of the invalid provisions.

10. This Agreement sets forth the entire agreement and understanding between the parties as to the subject matter contained herein and merges and supersedes all prior discussion, agreements, and undertakings of every kind of nature between the parties with respect to the subject matter of this Agreement. This Agreement may be executed in one (1) or more copies, each of which shall be deemed original.

IN WITNESS WHEREOF, the parties hereto have caused this Agreement to be effective on the date last signed.

PROCLAMATION

SUPPORTING PRESERVATION OF OHIO’S WATERWAYS ON THE OCCASION OF THE 50 YEAR ANNIVERSARY OF THE SCENIC RIVERS ACT

March 26, 2018

RESOLUTION NO. ______

WHEREAS, Ohio became a pioneer in the river preservation movement with the passage of the Ohio Scenic River Act of 1968, the nation's first scenic rivers act, which created a program to preserve and protect rivers throughout our state; and

WHEREAS, Ohio's rivers, creeks and streams provide locally accessible natural resources for environmental learning, appreciation and recreational opportunities as trails; and

WHEREAS, Ohio has approximately 60,000 miles of rivers and streams throughout our state including fourteen that' are officially designated as wild, scenic or recreational: the Ashtabula, Chagrin, Big & Little Darby, Kokosing, Little Miami, Mohican, Olentangy, Sandusky, Upper Cuyahoga, Conneaut, Grand, Little Beaver, Stillwater/Greenville and Maumee rivers; and

WHEREAS, the Ohio Department of Natural Resources and the Ohio Environmental Protection Agency have been essential partners in the effort to ensure the safety and protection of Ohio's water resources; and

WHEREAS, 2018 marks the 50th anniversary of the signing of the Ohio Scenic River Act and provides an opportunity to reflect on the progress that has been made to protect our state's scenic rivers and a chance to reaffirm our local commitment to preserving and protecting Ohio's natural resources so that they can be enjoyed and experienced by future generations.

NOW THEREFORE BE IT RESOLVED, the that the Board of Trustees of Beavercreek Township, Greene County, Ohio, in adopting this resolution, does hereby recognize the 50th anniversary of the OHIO SCENIC RIVER ACT and encourages all residents and visitors to join in the celebration of five decades of commitment to protecting our state's wild and scenic rivers.

IN PROCLAIMING 2018 AS “OHIO’S YEAR OF THE TRAILS”

March 26, 2018

RESOLUTION NO. ______

WHEREAS, Ohio has more than 3,500 miles of trail networks, the most of any state in the United States, and connecting trail segments is a powerful tool for economic and community development that should be actively facilitated; and

WHEREAS, outdoor trails are used for a variety of activities, including walking, hiking, biking, rolling, peddling, and horseback riding, and the many miles of trails that exist throughout Ohio have allowed countless individuals to reflect on the splendor of our natural world. Without a doubt, these pathways are not only a source of pride for the communities they serve, providing significant economic and environmental benefits, but are also an important feature in helping to improve the quality of life in our society by promoting healthy lifestyles via recreation and active transportation; and

WHEREAS, trails bring people together, as they not only connect physical locations but also represent the bonds that create communities. By highlighting the numerous trails in our state, we also praise the innumerable people who have helped make them a reality, and their efforts celebrate the beauty of the world around us by providing accessible and functional transportation to all people, regardless of age, background, or ability; and

WHEREAS, at a time when many communities seem more concerned with urbanization than with conservation, it is fitting that we salute the individuals who have served as the caretakers of our public resources. Through their hard work and enthusiasm, the citizens of Ohio have demonstrated an

unparalleled spirit of cooperation, and we applaud and support all those responsible for the success of these noteworthy trails that serve to repurpose land in valuable way.

NOW THEREFORE BE IT RESOLVED that the Board of Trustees of Beavercreek Township, Greene County, Ohio, in adopting this resolution, designate the year 2018 as “Ohio’s Year of the Trails” and encourage all citizens to take advantage of their local and regional trail networks, do their part to further enhance Ohio’s trail networks, and pay tribute to everyone who has labored to maintain and enlarge these public amenities.

1.2 Need: This request is to fill an identified need 1.3 Requirements: This request meets the requirements of OAC 4123:1-21-02, Personal Protective Clothing and Equipment for Structural Firefighting. It also complies with NFPA 1971: Standard on Protective Ensembles for Structural Fire Fighting and Proximity Fire Fighting and NFPA 1851 Standard on Selection, Care, and Maintenance of Protective Ensembles for Structural Firefighting and Proximity Firefighting.

1.4 Budget Reference: Cost Center/Program Area: Fire Gear (5712) Object Code: Capital Equipment (740) 2018 Budget: Goal 5712.2 (p. 80) 1.5 Explanation: By the end of this fiscal year, 20 sets of existing turnout gear will reach their mandated 10-year end of life, per NFPA. This gear will need to be replaced because each member (except chief officers) is issued two sets of turnout gear, one primary and one backup. These two sets are used because firefighters may change their gear up to 3 times a month for decontamination following , training, extrications, or incidents where they come into contact with hazardous (including bio-hazard) materials. Generally, gear is issued to firefighters every 5 years, with the newer set becoming the primary and the older set becoming the backup.

Required testing could cost up to $1500 per set, over its 10-year life cycle. It is also anticipated that in 2019 there will be a request for up to 35 sets of gear replacement due to a large purchase of gear in 2009.

1.9 Disposal: Gear that is end-of-life, but otherwise serviceable, will be decommissioned and marked for use by members of the Explorer program, in training and non-hazardous work areas. All other gear will be disposed of in accordance with NFPA standards and Township policy and practice.

2.2 Need: This request is an immediate need 2.3 Requirements: This request is required to maintain current emergency dispatch protocol and technical support. Priority Dispatch is a fire department requirement for dispatching services, in partial fulfillment of the 2014 Township Performance Audit Recommendation #30. Maintaining current protocols is one of the required elements to be eligible for International Academy of Emergency Dispatching (IAED) accreditation for the dispatch center. Accreditation is a long-term goal for the emergency dispatching process.

2.4 Budget Reference: Cost Center/Program Area: Dispatch (5350) Object Code: Contracted Services (360) 2018 Budget: Budgeted item (p. 53) 2.5 Explanation: This is the annual service agreement for the maintenance for the Pro QA software. The software covered by this agreement include emergency medical dispatching (EMD), emergency fire dispatching (EFD) and Aqua, the quality control software. The agreement covers protocol updates, technical support and training. In the past the cost has been under $2,500 and has not come before the Board. The addition of EFD in 2017 has raised the cost of the service agreement over $2,500, requiring Board approval. The initial purchase of EMD and Aqua in 2012, resolution

3 Notice of Increased Cost of Approved Trailer Modifications At the Board’s meeting on 2017-12-11, the Trustees approved the purchase of a boat, motor, and trailer for the fire department’s water rescue program. In the Agenda Packet, pages 48-50 listed the rational for our request to purchase a boat, motor, and a new trailer that would also carry the Kubota. It was noted in the explanation:

“The Township Maintenance Department will perform modifications to the trailer by adding racks and brackets necessary to haul the boat along with the ATV. The Township Maintenance Department has estimated a cost of $500 for fabrication material which will be charged to the fire department’s apparatus cost center at the time of modification through the maintenance department.”

The actual, completed fabrication material cost totaled $1,010.77. The initial $500 estimate, provided by maintenance was based on a basic rack design. However, once fabrication began, and all the components were on hand, the project was more complicated than originally estimated. For example a roller was added to aid and protect the boat while loading and unloading and the cart for the motor needed to be much more substantial than the original design.
