BEAVERCREEK TOWNSHIP BOARD OF TRUSTEES Regular Meeting Minutes June 22, 2020

CALL TO ORDER Board of Trustees Chair Debborah L. Wallace called the regular meeting of the Beavercreek Township Board of Trustees to order at 5:01 p.m., followed by the Pledge of Alliance. Those present were Trustee and Chair of the Board Debborah L. Wallace, Trustee and Vice Chair of the Board Tom Kretz,, who joined the meeting virtually, Trustee Jessica Dean, Fiscal Officer Ryan A. Rushing, Township Administrator J. Alexander Zaharieff, Fire Chief David VandenBos, Sergeant Chris Moore, Associate Economic & Zoning Administrator Max McConnell, Road Superintendent Tim Parks, Community Development and Risk Administrator and Fire Marshall Randy Grogean.

APPROVAL OF THE AGENDA Trustee Wallace asked if there were any changes and/or modifications to the agenda. Township Administrator Zaharieff noted that an Executive Session has been added to the agenda.

20200622-A: Trustee Dean made a MOTION to approve the agenda as modified, seconded by Trustee Kretz. Fiscal Officer Rushing called the roll: Trustee Kretz, yes; Trustee Dean, yes; Trustee Wallace, yes. Motion adopted.

ACCEPTING FISCAL OFFICE REPORTS 20200622-B: Trustee Kretz made a MOTION Accept the General Ledger Report, in the amount of $388,441.91, for the 06-17-20 payroll, seconded by Trustee Dean. Fiscal Officer Rushing called the roll: Trustee Dean, yes; Trustee Kretz, yes; Trustee Wallace, yes. Motion adopted.

20200622-C: Trustee Dean made a MOTION to approve Payment Listing Reports, in the amount of $218,477.98, for warrants through 06-17-20, seconded by Trustee Kretz. Fiscal Officer Rushing called the roll: Trustee Kretz, yes; Trustee Dean, yes; Trustee Wallace, yes. Motion adopted.

APPROVAL OF THE MEETING MINUTES 20200622-D: Trustee Kretz made a MOTION to adopt the June 1, 2020 Special Trustee Meeting Minutes and June 8, 2020 Regular Trustee Meeting Minutes, seconded by Trustee Dean. Fiscal Officer Rushing called the roll: Trustee Dean, yes; Trustee Kretz, yes; Trustee Wallace, yes. Motion adopted.

CITIZENS DESIRING TO SPEAK Trustee Wallace stated that this is the portion of the meeting in which citizens desiring to speak may do so.

Rick Clemans, Clemans Development, Arlington Place: In Arlington Place, concerned about letters dated June1 and June 11 about grass

He is concerned about the standards set for grass cutting by the Township. Mr. Clemans also stated about other locations in the Township that may be out of compliance with property maintenance and questioned why those properties were not also listed on the Trustees’ agenda for action.

Trustee Wallace thanked Mr. Clemans for attending and stated that property maintenance is an item later in the agenda for discussion.

OLD BUSINESS Being no Old Business, the Board moved to the next agenda item.

NEW BUSINESS 20200622-E: RESOLUTION HIRING ONE CAREER FIREFIGHTER Trustee Dean moved the adoption of the following RESOLUTION:

WHEREAS, the Ohio Revised Code §505.38(A) requires the Board of Township Trustees, in each Township with a fire department, to provide for the employment of firefighters as it considers best; and

WHEREAS, The Township has been awarded a “Staffing for Adequate Fire and Emergency Response” (“SAFER”) Grant, which provides partial funding for the employment of nine SAFER Grant-funded positions; and

WHEREAS, Resolution 20200113-V, passed by the Board on January 13, 2020, authorizes a staffing level of fifty-seven sworn firefighters; and

WHEREAS, the fire department is currently staffed with only fifty-six sworn firefighters; and

WHEREAS, the Board accepts the Fire Chief’s recommendation to immediately replace the vacancy.

NOW, THEREFORE BE IT RESOLVED THAT the Board of Beavercreek Township Trustees, hereby hire the following individual as full-time, sworn firefighter and emergency medical technician, with contractual years of service beginning on June 22, 2020, at the prescribed rate of pay and benefits in accordance with the Beavercreek Professional Firefighters’ Collective Bargaining Agreement: Adam Roberson ...... EMT-basic pay step A ($20.13/hour)

FURTHER BE IT RESOLVED THAT the conditions of employment of these firefighters hired pursuant to the “SAFER” grant are consistent with those included in their individual offer letters; and

FURTHER BE IT RESOLVED THAT any transferred service credit, in accordance with Article 31 of the current Collective Bargaining Agreement does not count as years of service for the calculation of Article 12, Section 7 Longevity; and

FURTHER BE IT RESOLVED THAT all formal actions of the Board of Trustees concerning and relating to the adoption of this resolution are being adopted at a duly called and authorized open meeting of the Board of Trustees on the date set forth above, such meeting being duly called pursuant to and in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code. The motion was seconded by Trustee Kretz. Fiscal Officer Rushing called the roll: Trustee Dean, yes; Trustee Kretz, yes; Trustee Wallace, yes. Resolution adopted.

Trustee Wallace administered the Oath of Office to Adman Roberson: I hereby certify that we have on this date hired, ADAM ROBERSON, To the position of fulltime Firefighter of the Beavercreek Township Fire Department; said appointment is to take effect June 22, 2020.

I, Adam Roberson, being duly sworn, say that I will support the Constitution of the United States, and the Constitution of the State of Ohio, and will faithfully discharge the duties of Firefighter of the Beavercreek Township Fire Department, Greene County, Ohio.

ADMINISTRATOR Administrator Zaharieff spoke regarding the two public hearings regarding the motor vehicle tax and the next step required for approval.

Trustee Kretz noted that he was thankful for the citizens that attended the public hearings and voiced their concerns. He also noted that the motor vehicle license tax will help the community.

20200622-F: Trustee Kretz moved the adoption of the following RESOLUTION:

WHEREAS, the Board of Trustees of Beavercreek Township, Greene County, Ohio, recognize the importance of maintaining township roads and that the funds available for road maintenance remain stagnant while the cost of road maintenance is increasing; and

WHEREAS, Ohio Revised Code 4504.181 allows the Board of Trustees to levy an annual license tax upon the operation of motor vehicles on the public roads and highways in the “unincorporated area” of the township for the purpose of paying for the construction, reconstruction, improvement, maintenance, and repair of township roads, bridges, and culverts; the costs and expenses of enforcing and administering the license plate tax; for purchasing, erecting, and maintaining traffic signs, markers, lights, and signals; for purchasing road machinery and equipment; and for planning, constructing, and maintaining suitable buildings to house road equipment; and

07/09/2020 6 of 115 BEAVERCREEK TOWNSHIP BOARD OF TRUSTEES REGULAR MEETING JUNE 22, 2020 MEETING MINUTES WHEREAS, per Ohio Revised Code 4504.181, public notifications were published in the Dayton Daily News, the Township’s social media sites and website announcing two public hearings which were held on June 1, 2020, and June 8, 2020 to provide information and accept comments about a proposed $5.00 permissive motor vehicle license tax (additional township license tax); and

WHEREAS, three (3) residents from the Township appeared at the June 1, 2020 hearing and three (3) residents appeared at the June 8, 2020 hearing to voice their concerns and have their questions addressed and answered by the Board of Trustees;

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF BEAVERCREEK TOWNSHIP, GREENE COUNTY, OHIO THAT: Section 1. Pursuant to Ohio Revised Code 4504.181, an annual license tax is levied upon the operation of motor vehicles on the public roads and highways in the registration district known as the unincorporated area of Beavercreek Township, Greene County, Ohio. Section 2. Such tax shall be levied at a rate of five dollars and zero cents ($5.00) per motor vehicle on all motor vehicles the owners of which reside in the registration district known as the unincorporated area of Beavercreek Township, Greene County, Ohio. Section 3. The intent of this Resolution is to levy the full tax a township is allowed to annually levy under Ohio Revised Code 4504.181. Section 4: The Board of Trustees of Beavercreek Township, Greene County, Ohio, will enact a $5.00 permissive motor vehicle license tax which will take effect 30 days after adoption of this Resolution as the earliest date allowed by law. Section 5: All revenues realized by Beavercreek Township, Greene County, Ohio, pursuant to the Resolution is used only for the purpose allowed under Ohio Revised Code 4504.181. Section 6: That this Board of Trustees hereby finds and determines that all formal actions relative to the adoption of this Resolution were taken in an open meeting of this Board, and that all deliberations of this Board which resulted in formal action were taken in meetings open to the public in full compliance with applicable legal requirements, including Section 121.22 of the Ohio Revised Code.

Trustee Wallace seconded the motion to adopt the Resolution.

Trustee Dean mentioned that she feels that asking voters to pay an additional motor vehicle license tax and later requesting that they pass a levy for more money will not be accepted well by the community and feels like they should be asked for together with a larger levy or another means. It is for this reason why she expressed her desire to vote no.

Trustee Wallace responded that levies often do not request 100% of monies needed for future growth and that it puts the Township in a cycle of being behind on road improvements even with the license fee being requested.

GREENE COUNTY SHERIFF’S OFFICE Administrator Zaharieff presented the Beavercreek Township Sheriff Substation bi- weekly report and memo and turned the meeting to Sergeant Moore.

Sergeant Moore presented his report regarding questions asked by the Trustees at the last regular meeting.

Trustee Wallace appreciates the due diligence provided by Sergeant Moore’s report and responses.

Trustee Kretz requested a definition of C.I.T.

Sergeant Moore responded that C.I.T. stands for Crisis Intervention Training and explained a little bit about how officers are trained, especially related to mental health or drugs and alcohol.

Trustee Dean stated that she appreciates what the Sheriff’s department does for everyone.

Trustee Wallace asked for follow-up information for additional questions at the next trustee meeting: 1- How many response to resistance or use of force incidents has the Greene County Sheriff’s Department had in the last two years? 2- How many people have been paid by the Greene County Sheriff’s Department or the Greene County Commissioners for or because of response to resistance or use of force incidents? 3- Between the officers working in the jail or on patrol, how many have received disciplinary action based on the use of force?

Trustee Kretz asked that the information in response to those questions be answered only with regard to deputies who have been employed by Beavercreek Township.

Trustee Dean agreed with the request for information only regarding the township.

Sergeant Moore asked for a few clarifications regarding the questions asked.

HUMAN RESOURCES Administrator Zaharieff presented the bi-weekly activity report.

COMMUNITY DEVELOPMENT AND RISK Administrator Zaharieff presented the bi-weekly activity report and turned the meeting over to Community Development and Risk Administrator and Fire Marshal Randy Grogean, who turned it over to Max McConnell.

07/09/2020 8 of 115 BEAVERCREEK TOWNSHIP BOARD OF TRUSTEES REGULAR MEETING JUNE 22, 2020 MEETING MINUTES Max McConnell presented the process for property code enforcement and stated that many of the enforcement issues are citizen complaint driven. He stated that residents complained that grass was too long in certain areas and the enforcement process began by checking the lot. Letters were sent to those in violation, public notices were posted when the violation was not rectified, and owners were notified via letter that parcels would be declared a nuisance by Trustees and then Township would be able to mitigate situation at the owner’s expense. Mr. McConnell stated at this time, none of the lots schedule to be declared a nuisance by the Trustees are still in violation.

Administrator Zaharieff noted that enforcement of the nuisance code is primarily driven by complaints lodged by citizens.

Trustee Wallace addressed Mr. Clemans concerns to be sure that he understood the way nuisance code violations are brought about and appreciated his engagement with the Board.

Trustee Kretz mentioned that he believes all of the past four years where nuisance codes have almost had to be enforced, the violators have taken care of the issues prior to enforcement.

Max McConnell addressed the presentation of the zoning fee schedule and highway business overlay zoning district.

Administrator Zaharieff noted there will be a public hearing held regarding those items.

Fire Marshal Grogean thanked Trustee Kretz for the Knox box donation.

Trustee Kretz asked if staff will have proactive discussions with developers relative to activity for the second half of the year.

Mr. McConnell replied that there have been no meetings but there is movement in Nathaniels Grove and updated Trustees on current plans.

Trustee Kretz asked the department to reach out to developers to get more information for the second half of the year.

Administrator Zaharieff said that past meetings with developers were occurring but have been delayed due to COVID-19. He said that there are plans to reconvene soon.

INFORMATION TECHNOLOGY Administrator Zaharieff presented the bi-weekly activity report.

ROAD DEPARTMENT Administrator Zaharieff presented the bi-weekly activity report.

07/09/2020 9 of 115 BEAVERCREEK TOWNSHIP BOARD OF TRUSTEES REGULAR MEETING JUNE 22, 2020 MEETING MINUTES 20200622-G: Trustee Dean made a MOTION to approve purchase request (10817) to Stanley Steamer for annual floor maintenance at all four Fire Stations in an amount of $6,325; and to authorize the Township Administrator to sign for the Board, Trustee Kretz seconded. Fiscal Officer Rushing called the roll: Trustee Dean, yes; Trustee Kretz, yes; Trustee Wallace, yes. Motion adopted.

Trustee Wallace asked if staff would explain why a metal roof is recommended per a standard shingle roof.

Road Superintendent Parks replied that a metal roof promises longevity in comparison with the current roofing type.

Trustee Kretz asked if shingles were being removed or if the metal roofing would be placed on top.

Mr. Parks replied that the shingles will be removed. He also explained why he chose the quote that he chose.

Trustee Dean asked if the decking was to be replaced.

Mr. Parks replied that the decking would be replaced on the Coy House and that the 1981 building would be replaced as needed.

20200622-H: Trustee Kretz made a MOTION to approve purchase request #10818 to A.H. Sturgill for the roof replacement with a metal roofing system at 1981 Dayton-Xenia Rd. in an amount of $46,200; and to authorize the Township Administrator to sign for the Board, Trustee Dean seconded. Fiscal Officer Rushing called the roll: Trustee Dean, yes; Trustee Kretz, yes; Trustee Wallace, yes. Motion adopted.

20200622-I: Trustee Dean made a MOTION to approve purchase request #10819 to A.H. Sturgill for the roof replacement with a metal roofing system at the Coy House in an amount of $29,300; and to authorize the Township Administrator to sign for the Board, Trustee Kretz seconded. Fiscal Officer Rushing called the roll: Trustee Dean, yes; Trustee Kretz, yes; Trustee Wallace, yes. Motion adopted.

Trustee Dean said that a great job was done replacing all of the storm sewers and drain basins.

Administrator Zaharieff noted that the Township has received its first truck through the new fleet management program with Enterprise. The truck will be available for the Trustees to look at during the next Board meeting. Payments are not due until trucks are in service.

FIRE DEPARTMENT Administrator Zaharieff presented the COVID-19 report and bi-weekly activity report.

07/09/2020 10 of 115 BEAVERCREEK TOWNSHIP BOARD OF TRUSTEES REGULAR MEETING JUNE 22, 2020 MEETING MINUTES Chief VandenBos addressed that fortunately Beavercreek Township has not been a hotspot for COVID-19 cases and the area has not been impacted drastically. The stats of related cases and/or transport by the Fire Department are the same as reported at the last meeting.

Trustee Kretz asked about supplies for a second wave and asked if it is housed in multiple locations in case of another tornado.

Chief VandeBos replied that excess supplies are currently housed in the most secure area.

LEGAL ADVISOR Nothing to bring to the board’s attention at this time.

FISCAL OFFICER Fiscal Officer Rushing introduced a resolution for Trustee approval.

20200622-J: A RESOLUTION ESTABLISHED A PROCESS FOR THE CORONAVIRUS AID, RELIEF, AND ECONOMIC SECURITY ACT OHIO HB 481

Trustee Kretz moved the adoption of the following RESOLUTION:

WHEREAS, the Coronavirus Aid, Relief, and Economic Security Act, 116 Public Law 136, (the CARES Act) was signed into law by the President of the United States on March 27, 2020; and

WHEREAS, the Ohio General Assembly established a process for distributing funds provided by the “Coronavirus Aid, Relief, and Economic Security Act” in House Bill 481 of the 133rd General Assembly (HB 481); and

WHEREAS, HB 481 requires subdivisions receiving funds under Section 1 of the act, to pass a resolution affirming that funds from the County Coronavirus Relief Distribution Fund may be expended only to cover costs of the subdivision consistent with the requirements of section 5001 of the CARES Act as described in 42 U.S.C. 601(d), and any applicable regulations before receiving said funds; and

WHEREAS, Beavercreek Township is requesting its share of funds from the Greene County Coronavirus Relief Distribution Fund.

NOW THEREFORE, be it resolved that the Board of Trustees of Beavercreek Township affirms that all funds received from the Greene County Coronavirus Relief Distribution Fund pursuant to HB 481 be expended only to cover costs of the Township consistent with the requirements of section 5001 of the CARES Act as described in 42 U.S.C. 601(d), and any applicable regulations and guidance only to cover expenses that: (1) Are necessary expenditures incurred due to the public health emergency with respect to the Coronavirus Disease 2019 (COVID-19);

FURTHERMORE, in compliance with HB 481, be it resolved by the Board of Trustees of Beavercreek Township that the Beavercreek Township Fiscal Officer take all necessary action to: (1) On or before October 15, 2020, pay any unencumbered balance of money in the Beavercreek Township’s local coronavirus relief fund to the Greene County Treasurer; (2) On or before December 28, 2020, pay the balance of any money in the Beavercreek Township’s local coronavirus relief fund to the state treasury in the manner prescribed by the Director of the Ohio Office of Budget and Management; and (3) Provide any information related to any payments received under HB 481 to the Director of the Ohio Office of Budget and Management as requested. FURTHERMORE, in compliance with HB 481, be it resolved by the Board of Trustees that the Beavercreek Township Fiscal Officer shall be authorized and take all necessary action to: (1) Create a new fund to receipt any revenue and make any expenditure as it relates and is authorized by HB 481 and the CARES Act.

FURTHER BE IT RESOLVED THAT, all formal actions of the Board of Trustees concerning and relating to the adoption of this resolution are being adopted at a duly called and authorized open meeting of the Board of Trustees on the date set forth above, such meeting being duly called pursuant to and in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code.

20200622-K: SUPPLEMENTAL CERTIFICATE of RESOURCES AVAILABLE FEMA / 2019 TORNADO CLEANUP and RECOVERY

Trustee Dean moved the adoption of the following RESOLUTION:

WHEREAS, Beavercreek Township was struck by an EF3 tornado on May 27, 2019; and

WHEREAS, Beavercreek Township has applied for FEMA funds to assist with the Township’s cleanup and recovery efforts; and

WHEREAS, Beavercreek Township received a FEMA reimbursement check, in the amount of $255,093.87, on 06/12/2020, from the State of Ohio’s Department of Public Safety; and

07/09/2020 12 of 115 BEAVERCREEK TOWNSHIP BOARD OF TRUSTEES REGULAR MEETING JUNE 22, 2020 MEETING MINUTES WHEREAS, the Board of Trustees of Beavercreek Township wishes to accept these dollars from FEMA and deposit them into the Township’s Fund 2902, which is designated for FEMA Reimbursements: Local Emergencies; and

WHEREAS, these proceeds will increase the amount available for expenditures; and

WHEREAS, the Board of Trustees of Beavercreek Township further approves the filing of the attached Supplemental Certificate, with the Greene County Auditor’s Office, for these funds; and

NOW THEREFORE BE IT RESOLVED THAT, the Board of Trustees of Beavercreek Township, Greene County, Ohio favorably passed the above Resolution.

FURTHER BE IT RESOLVED THAT, all formal actions of the Board of Trustees concerning and relating to the adoption of this resolution are being adopted at a duly called and authorized open meeting of the Board of Trustees on the date set forth above, such meeting being duly called pursuant to and in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code.

Response to Resistance Reports The Deputies assigned to serve Beavercreek Township during the last two years have responded to, or self-initiated, approximately 27,515 calls for service. Of those calls, there were 108 arrests. There have been 6 incidents wherein a Use of Force was necessary on the part of the Deputy. All 6 incidents were resolved by only the display of a taser and/or display of firearm. In none of the cases were the taser or the firearm deployed.

• There were 4 incidents involving suicidal subjects. Each time, the subject was communicating suicidal threats and refusing to follow commands given by the responding Deputies. • The remaining 2 separate incidents involved felony level assaults and each time the suspect was believed to be armed and dangerous. Also of note, while these 2 incidents involved 2 Deputies assigned to Beavercreek Township, the incidents themselves actually occurred outside the Township limits when they responded to a request for mutual aid received from the Sheriff’s Office. Each incident was reviewed by GCSO Supervisory staff and GCSO Patrol Division Administrative personnel as per policy. In all cases, each Deputy’s actions were found to be in compliance with the Use of Force policies and procedures as detailed in GCSO General Order 1.3. Response to Resistance Lawsuits An inquiry was made as to whether there has been litigation involving the actions of a Deputy assigned to Beavercreek Township wherein the Sheriff’s Office and/or the Greene County Commissioners had been sued or paid monies as the result of a lawsuit within the last 2 years. There have been no lawsuits filed and no monies paid to settle any lawsuit involving Deputies assigned to Beavercreek Township. Response to Resistance Discipline No Deputy assigned to Beavercreek Township has been disciplined due to any Response to Resistance within the last 2 years.

07/09/2020 67 of 115 Rationale for Zoning Fee Schedule Changes (7/13/2020)

The Community Development and Risk Department has internally examined our Fee Structure document and ask the Trustees to amend it in the following ways:

1) Eliminate Fee for Temporary Sign Permits a. Due to the recent amendment of Article 20 (Signs) of the Township Zoning Resolution, the Township can no longer differentiate between “election” signs and other types of signs. As a department, we want to avoid being forced to charge residents and political candidates for displaying political signs. Our solution is to eliminate the fee associated with acquiring a Temporary Sign permit. In the past, the Department would have separate permit applications for “election” signs and charged no fee for these. Looking back at annual revenue generated from Temporary Sign Permit fees, the amount generated is roughly $200-$300 each year. The loss of these fee revenues, in our estimation, is an acceptable trade-off for allowing residents to express their political views without having to pay a fee to do so.

2) Separate the combined Pool/Fence permit and reduce the cost from $50 to $40 a. After bringing the Pool text amendment before the Board earlier this year, our Department has been working with residents to ensure that their pools are properly fenced in. In doing so, we discovered that the combined fence/pool permit structure has contributed to resident’s ability to build pools without surrounding fences. Our office will no longer issue pool permits without an associated fence permit. However, some residences have existing fences but would like to add a pool. The combined fence/pool permit structure does not meet their needs. By requiring a separate permit for both fence and pool, we have essentially increased the cost of the pool permit. So, we would like to reduce it to match the cost of a fence permit. In terms of expected overall revenue, we believe this will increase as the cost of both fence and pool permits will total $80 instead of only $50. However, this will lessen the cost to residents who only need a pool permit because they have an existing fence.

3) Increase the cost of a Use Compliance Permit from $75 to $100 a. In reviewing the amount of staff hours required to produce a Use Compliance Certificate (aka Zoning Certificate), our department found that several hours must be devoted to both research and writing the certificate. Each certificate must be tailored to the parcel for which it was requested. As such, the increase in fees is linked directly to the amount of staff hours required to complete these requests.

4) Remove the fees listed for copies of the Land Use Plan and Zoning Resolution a. Both of these documents are available online for download, and we do not anticipate the need to print them out on request. However, our department may still charge $0.25 per page for copies. If a resident insists on being provided a paper copy, we will still have a structure in place to recoup our costs in printing it for them. At $0.25 per page, the total cost to the resident for printing these documents will exceed $25.00.

The following graph compares the 2020 Residential Zoning Permits (new construction) as of 6/30/2020 to the past five years. Currently, the decline in new house permits compared to the same time last year is about 21% (62 vs. 49). If this trend continues throughout the year, we will finish with about 99 house permits, vs.126 last year. The number of total permits to date is greater than this time last year (226 vs. 191).

5 MEETINGS & OTHER ACTIVITIES:

ASSOCIATE ECONOMIC DEVELOPMENT & ZONING ADMINISTRATOR Zoning Activity - Communicated with ODOT to get their sign-off on a Commercial Sign permit issued near an ODOT right-of-way area (BZA Case #841) - Attended development meeting for the Indian Ripple/Alpha-Bell intersection with representatives from Ohio University and the County Engineer - Communicated with several developers who have been having issues keeping lots mowed. We came to some agreements about mowing schedules. Developers in the Township have been having trouble finding reliable lawn service contractors during the pandemic. - Attended the Regional Planning Full Committee session: The Highway Overlay zoning district language was recommended for adoption with no edits requested - Ensured public meeting notices were submitted for Trustee hearing of Highway Business district - Began work on updating the Neighborhood Build-Out chart in the Bi-Weekly Report. A new chart format and updated data will be in the following Bi-Weekly (7/27) - Working with Zoning Inspector to ensure a number of properties with un-fenced pools are working towards compliance. At this time, the major issue residents face is the high demand for contractors. - Worked with Germaine Honda to clear up an outstanding permit fee issue. Their new signs are now in compliance. - Worked with CD&R Director and Admin Assistant to notify the public of the Township’s Property Maintenance Code, and ensured that all public notice requirements are being met - Began discussion with Greg Thompson of Beavercreek Schools about the schools’ willingness to allow walking trails to connect Claiborne Greens neighborhood with Coy/Trebein location - With all zoning staff, suggested some changes to the Zoning Fee Schedule that reflect observations in permit processing over previous 5 months. Developed a “rationale” document to explain proposed changes.

Economic Development Activity - Researched Tax Increment Financing (TIF) options for Zone 3 of Stonehill Village PUD - Met with Flood Plain Administrator (Al Kuzma) to determine development viability of some parcels within the Township which are located near the Flood Way - Met with Ohio University representatives to discuss their Master Plan for the Research Park - Participated in a Rotary Club luncheon via Zoom - Participated in a Dayton Development Coalition webinar that may allow the Township to provide “Business Toolkits” to smaller employers. The kits include masks and sanitizer supplies as a free courtesy. - Conducted meeting between Dayton Development Coalition and the owners of the Valley Springs Farm PUD. We discussed statewide site selection opportunities and encouraged the owners to create a number of marketing materials that the site selectors are looking for. We also discussed what kinds of site improvements may be made to improve the site’s attractiveness to site selectors.

The following graph compares the 2020 Fire Protection plans reviewed as of 6/30/2020 to the past five years. Eighteen (18) Fire Protection Plans were reviewed in the month of June. The Fire Prevention Bureau is seeing an increase in the submittal of fire protection plans for review due to the reopening of businesses from the Covid-19 crisis.

Permits: Two Fire Protection Permits were issued for the period between June 18, 2020 and July 8, 2020.

Note: Fire protection applications, plans and fees are submitted to the Fire Prevention Bureau for evaluation in accordance with the Ohio Building Code. Comments are then submitted to Greene County Building Regulations to be included in their review of the same plans.

This is one of 5 items that were identified during testing that will not allow the aerial to be certified. Three of the items a category one repairs that need to be addressed to place the unit back in-service, the other two will need to be repaired to receive certification. The other two category one repairs are cracks to welds on both front stabilizer mounting plates, staff is currently working on how these can be addressed. The two items that are category 2 can be addressed in-house by staff. The annual testing is required be NFPA 1911-chapter 22 performance testing of aerial devices. 1.2. 1.2 Need: This purchase is a future budgeted need. 1.3 Requirements: This request will assist in compliance with the Township’s 2014 Performance Audit, NFPA 1221 (2019 edition) The Standard for Fire Department Communications Systems, and ISO standards for communications and fire station alerting

While the current system is functional, the upgrade will be required to add new stations to the system. Motorola has identified components that have a longer than normal lead time for acquisition because of COVID-19. 3 COVID-19 Impact 3.1 Known Cases According to Greene County Public Health, there are currently 27 isolated or quarantined cases in Beavercreek. They have removed 58 previous cases from the list.

3.2 Service Impact Currently, the fire department has not experienced any service impact due to the pandemic. Call volume remains down approximately 14% YTD from 2019.

3.3 Fire Department Exposures As of this date, BTFD has only made three known COVID19 transports. To date, there have been no COVID-19 service exposures to on-duty crews.

3.4 COVID19 Testing In addition to previous asymptomatic testing for first responders, several local physician’s groups are now offering COVID19 antibody testing.

3.5 Regional Coordination Greene County Fire Chiefs are now meeting on a biweekly, or as needed basis. Montgomery County Fire Chiefs are meeting monthly. Fire department staff meet regularly with Greene County Fire Chiefs, EMA, Public Health, healthcare networks and Montgomery County Fire Chiefs to coordinate efforts and information sharing. Issues commonly discussed include PPE preservation, healthcare system capacity, local COVID-19 cases and impact, and mutual aid staffing and response.

3.6 Contingency Planning There have been no changes since the last Board meeting. The fire department has developed 3 contingency plans for addressing anticipated impacts due to the pandemic.

Personal Protective Equipment (PPE) depletion The fire department has identified several strategies, as advocated by the CDC and the State Department of Health, for preservation of PPE, including reducing number of personnel interacting with patients, reuse of PPE, decontamination of PPE (i.e. Battelle), and use of non-traditional PPE. To date, all of these measures have been enacted. Staffing depletion The fire department has identified several strategies to address potential staffing shortages, including overtime and order-in staffing, cancellation of approved leave, modified shift assignments, and alternate work schedules.

Trustee ______moved to adopt the following resolution:

WHEREAS, the Ohio General Assembly enacted Ohio House Bill 481 (HB 481) creating and distributing the Coronavirus Relief Fund (CRF) in response to the COVID19 Pandemic; and

WHEREAS, the Beavercreek Township Board of Trustees passed Resolution 20200622-I to accept disbursements of the of the CRF and create a new fund – Fund 2905 COVID19 Relief Fund – to receipt any revenue and make expenditures for the CRF as prescribed by HB 481; and

WHEREAS, on June 26, 2020 the Fiscal Officer sent a copy of Resolution 20200622-I to the Greene County Auditor and the State of Ohio; and

WHEREAS, on July 1, 2020 the Fiscal Office received its disbursement from the CRF from the Greene County Auditor totaling $103,213.93; and

WHEREAS, the Beavercreek Township Board of Trustees desires to utilize these available resources for the proper public use;

NOW THEREFORE BE IT RESOLVED THAT, the Beavercreek Township Board of Trustees, Greene County, Ohio resolve:

SECTION I: Fund 2905 – COVID19 Relief Fund is certified to have $103,219.93 in revenue.

SECTION II: Pursuant to Section 5705.36 of the Ohio Revised Code, the Fiscal Officer shall file an amendment to Beavercreek Township’s Official Certificate of Available Resources to supplement this amount by the same.

--PUBLIC HEARING NOTICE-- BEAVERCREEK TOWNSHIP TRUSTEES ZONING COMMISSION CASE # 814

The Beavercreek Township Trustees will hold a public hearing on Monday, July 13, 2020, scheduled to begin at 6:00 p.m. or as soon as possible thereafter. The meeting will be held in the Community Room, lower level of Fire Station #61, located at 2195 Dayton-Xenia Rd., Beavercreek, Ohio 45434.

The purpose of the hearing is so the Trustees may review and act on one or more proposed amendments to the Beavercreek Township Zoning Resolution being proposed by the Zoning Commission. The proposed amendment(s) would change create a new zoning district classification known as the Highway Business Overlay District. No parcels will have their zoning classification altered at this time. The Zoning Commission triggered action by the Trustees via Zoning Commission Case #814.

Article 9: HBO - HIGHWAY BUSINESS OVERLAY DISTRICT

9.1 Purpose

The purpose of the Highway Business Overlay District (HBO) is to establish special design standards that are unique to properties with visibility from US Route 35 (US-35). The standards are created specifically to address the unique existing and desired physical, architectural, and commercial characteristics that are inherent to this particular area in order to:

1. Benefit the property owners within and adjacent to the district; 2. Allow for uses that serve the community, as well as the region. 3. Guide appropriate change that will enhance the character and sustainability of the business climate; and 4. Promote development of the area adjacent to the highway in a coordinated manner.

9.2 Relationship to Underlying Base Zoning Districts

1. Development requirements of the HBO shall be applied in addition to any existing development requirements within underlying base zoning districts (UBZDs). 2. Where development requirements of the HBO conflict with the requirements in UBZDs which are not Planned Unit Developments (PUDs) the requirements of the HBO shall take precedence. 3. Where development requirements of the HBO conflict with the requirements in any Planned Unit Development (PUD), the requirements of the PUD shall take precedence. 4. If this Article does not mention or modify the requirements found in other Articles of this Resolution, the existing requirements of the UBZD shall be considered to be applicable unless specifically contradicted in this Article. 5. The Community Development and Risk Department may review conflicting requirements between the HBO and underlying zoning districts to determine which district’s requirements shall apply, in keeping with the purpose statement of this Article. a. If the decision rendered by the Community Development and Risk Department is challenged, an appeal may be made to the Beavercreek Township Board of Zoning Appeals, as described in Article 22 of this Resolution.

9.3 Overlay District Development Standards

1. Schedules of Permitted, Conditional and Prohibited Uses a. The permitted uses for lots within the HBO shall follow the permitted and conditional uses of the underlying zoning district. See Table 2 of this Resolution for a matrix of permitted and conditional uses. 2. Allowable Lot Sizes and Coverage Limitations a. Allowable lot sizes in the HBO shall be established in the underlying base zoning districts (see relevant Articles of this Resolution).

07/09/2020 102 of 115 b. Structures shall not exceed 60% coverage of the land proposed for development. c. Total coverage of structures plus other impervious surfaces shall not exceed 85% of the land proposed for development. i. Pervious surfaces, such as porous concrete, permeable asphalt, or interlocking permeable paving stones, shall not count towards the 85% maximum of allowable surface coverage. ii. Pervious surfaces shall be engineered to retain at least the first inch of precipitation, and meet any requirements for pervious surfaces outlined by Greene County & Conservation and the Greene County Engineer. iii. Pervious surfaces shall be maintained and repaired as to reliably retain at least the first inch of precipitation, and to meet any standards outlined by Greene County Soil & Water Conservation and the Greene County Engineer. 1. At the request of the Community Development and Risk Department, occupants of parcels containing pervious surfaces as described above shall present written documentation that those surfaces conform to any maintenance standards imposed by the Greene County Engineer and Greene County Soil & Water Conservation. 2. If pervious surfaces fall out of good repair and cannot meet the standards required in this Article, such surfaces shall be repaired or replaced in such a manner as to conform totally to this Zoning Resolution. 3. Yards and Setbacks a. Yard and Setback requirements shall adhere to those of the underlying base zoning district (see relevant Article of this Resolution), except that voluntary side yard setbacks shall be a minimum of ten (10) feet for properties located within the HBO. 4. Parking space requirements a. Parking space requirements shall adhere to those of the underlying base zoning district (see relevant Article of this Resolution). 5. Landscaping and screening requirements a. Landscaping and screening requirements shall adhere to those of the underlying base zoning district (see relevant Article of the Resolution). 6. All lots within the HBO will be subject to any Design Standards which are subsequently adopted by Beavercreek Township.

9.4 Accessory Uses

Accessory Uses in the HBD-O shall adhere to those of the underlying base zoning district (see relevant article of the Resolution).

9.5 Signs

07/09/2020 103 of 115 Signage requirements shall be as outlined in a lot’s UBZD (see Article 20 of this Resolution) with the following exceptions: 1. The allowable height of ground signs shall be fifteen (15) feet from the established grade of the US-35 road pavement to the top of the sign structure. a. Ground signs taller than six (6) feet above the grade of the US-35 road pavement shall be pylon signs. 2. Wall signs shall be allowable to the height of the primary structure on the lot in which the sign is displayed. Wall signs shall not extend above the roof of the primary structure to which the sign is attached.

9.6 Permitting, approval and enforcement

1. The process for obtaining any permits for lots within the HBO shall follow the processes outlined in Section 19.03 of this Resolution for the underlying base zoning district of the lot, EXCEPT in the case of non-residential new building construction. 2. New non-residential construction permits issued for lots within the HBO shall be subject to a Specific Site Plan Review process as outlined in Section 9.7 and 9.8 of this Article. a. Specific Site Plan applications shall not be considered officially filed until the applicant has submitted all applicable filing fees and submitted to the Zoning Department all information as may be required by this Zoning Resolution. Completeness of an application and submission of all necessary information is the responsibility of the applicant. Only after an application is determined by the Zoning Enforcement Officer and Planning Director to be complete and officially filed will application review procedures begin. Applications for specific site plan approval that do not adhere to the requirements of Section 9.7 of this Article may be considered to be incomplete, not officially filed, and not subject to Township review procedures. b. The buildings, circulation, open space, landscaping and other elements of the proposed non-residential construction project shall be arranged, planned and designed on the site to produce: i. Favorable relationships with the existing natural topography, bodies of water or water courses, existing desirable , exposure to significant views and exposure to and ; ii. Safety, convenience and ease of pedestrian and vehicular movement on, about and throughout the site and between the site and the community; iii. An overall positive visual quality throughout, into and from the project site.

9.7 Specific Site Plan Application

The applicant shall officially file an application for a specific site plan with the Community Development and Risk Department. The applicant shall make payment to the Beavercreek Township in an amount equal to the established filing fee applicable to the specific site plan application. The application shall contain an application original and copies of all application materials in a quantity specified by the Zoning Administrator. The application shall contain, but not be limited to, the following information:

1. Name, address and telephone number of the applicant. If the applicant is not the sole owner of the subject property, the application shall contain the name, address and telephone number of all owners of the property; 2. Each application shall be signed by the applicant, attesting to the truth and exactness of all information supplied on and with the application. If the applicant is not the owner of the property proposed for the specific site plan, the applicant shall submit a current notarized, written statement from the property owner(s) appointing the applicant as the owner's agent. The statement shall further acknowledge the owner's consent to be bound by the application, by any agreement made by the agent, and by all decisions made by the Township on this matter; 3. The legal description of the property incorporated in the proposed specific site plan; 4. A detailed site plan at a scale no smaller than one inch equals one hundred feet (1" = 100'), showing at minimum, the location, outline and use of all structures, all proposed public and private rights-of-way, vehicular streets and parking areas, pedestrian walkways and paths, and any bikeways. The applicant shall furnish an 8 1/2" x 11" transparency of this information suitable for projection by use of an overhead transparency projector onto a viewing screen; 5. All proposed vehicular parking areas shall be shown by total number of spaces, setbacks from structures and lot lines, dimensions of each parking space, location and dimensions of handicapped parking spaces, access aisles, points of ingress and egress, and landscaped areas. Fire lanes and location of "Fire Lane - No Parking" signs shall be shown; 6. The dimensions, height, gross floor area, entrances and setbacks of all structures; 7. The principal type of use, gross leasable floor area and entrances for all proposed business, office, industrial and nonresidential structures; 8. A map with contour intervals of two (2) feet which shows the proposed final topography of the development site; 9. Engineering studies and plans showing, to the extent determined appropriate by the Township, street improvements, nature and extent of earth work required for site preparation and development, location and size of water, sanitary sewer and storm drainage control systems, and waste disposal facilities; 10. Location of fire hydrants and any fire connections to buildings; 11. Any proposed street widening improvements and turn lane improvements adjacent to the project area; 12. Landscaping plans including the location and size of all landscaped areas, the location of all natural screening devices, type (species) and location of proposed vegetation, location and type of exterior materials of man-made screening devices, and initial (planting) and permanent (mature) height of all screening and buffering; 13. Lighting plans showing location and type of all proposed external lighting of parking, building and landscaped areas, streets and accessways; 14. Any additional information that may be required by the Zoning Administrator within fifteen (15) days of the date of submission.

9.8 Standards and Criteria for Specific Site Plan Approval

A specific site plan shall only be approved when the following standards and criteria are satisfied: 1. The specific site plan complies with the purpose and intent of this Zoning Resolution; 2. The proposed development carries out the purpose and intent of the Land Use Plan; 3. The proposed development promotes the health, safety and general welfare of the present and future inhabitants of the Township; 4. The proposed development has no significant detrimental impact that outweighs the development's benefits to the community; 5. The proposed streets and driveways on the site of the proposed project will be adequate to serve the residents, occupants or users of the proposed project, and the specific site plan, along with any necessary off-site vehicular circulation improvements, provides adequate vehicular ingress and egress and will be accessible from current or planned public thoroughfares adequate to carry traffic which will be imposed upon them by the proposed project; 6. The proposed project minimizes conflicts between vehicular, pedestrian and bicycle circulation patterns and movement; 7. The benefits of the proposed project mitigate any burden on public services and facilities, including fire and police protection; 8. The Specific Site Plan Application has been reviewed by agencies with a demonstrable interest in the design and execution of the proposed project, including, but not limited to: a. Beavercreek Township Fire Prevention Department b. Beavercreek Township Road Department c. Greene County Soil and Water Conservancy District d. Greene County Sanitary Engineering e. Greene County Engineer f. Any other agency which the Zoning Administrator designates as a potential stakeholder in the outcome of the proposed project.

9.9 Development Adjacent to the Creekside Trail Bike Path

Any parcel within the HBO and which adjoins or abuts the Creekside Trail Bike Path shall also be subject to the following development requirements: 1. When new development within the HBO requires a Specific Site Plan as outlined in Sections 9.6, 9.7, and 9.8 of this Article, that Site Plan shall include a buffered space between any non-residential structures and the Creekside Trail Bike Path. The Zoning Administrator will determine the area required for buffering, in keeping with the purpose statement of this Article. a. Paved surfaces specifically designed to function as ingress/egress points for travelers along the Creekside Trail Bike Path shall be the only acceptable surfaces which may be constructed within the buffer. i. Such surfaces shall be maintained in good repair and condition, and the responsibility of such maintenance shall be that of the owner or occupant of the parcel on which such surfaces are located.

07/09/2020 106 of 115 b. No structures of any kind shall be erected within the buffer area. 2. In addition to any other landscaping and screening requirements found within a parcel’s UBZD, parcels in the HBO which contain non-residential structures must provide screening when they abut or adjoin the Creekside Trail Bike Path. Such screening shall be included in the Specific Site Plan submitted in accordance with Sections 9.7 and 9.8 of this Article. 3. Screening shall be provided for one or more of the following purposes a. As a visual barrier to partially or completely obstruct the view of structures or activities in order to minimize or prevent nuisances; b. As an acoustic screen to aid in absorbing or deflecting noise; and c. For the containment of ambient debris and litter; 4. Screening may be one of the following, or a combination of two or more: a. A solid masonry wall; b. A solidly constructed decorative fence; c. A louvred fence; d. Dense evergreen plantings, and/or e. Landscaped mounding with ground cover

9.10 Other Applicable Regulations

1. It is recommended that all utilities be located underground in all new developments to the extent technically practicable. 2. In addition to the specific requirements of the overlay district established above, development within the district shall be subject to all other applicable requirements for development as established in this resolution.

9.11 Non-Conforming Uses, Land, Buildings, and Structures

Nonconforming uses, land, buildings, and structures located in the HBO shall be processed per Section 18.27 (Nonconformities) of the Beavercreek Township Zoning Resolution.

9.12 Appeals and Variances in Overlay Districts

The following provisions shall apply to appeals and variances in the overlay district outlined in this Article above:

1. At the discretion of the Community Development and Risk Department, administrative approval may apply to any permitted use or change of use that would not significantly affect the nature or appearance of the premises involved. Such actions shall be excluded from the requirements of this Article. 2. All uses not identified as permitted uses are prohibited or require a conditional use permit. Conditional use permits may be granted by the Board of Zoning Appeals, as described in Article 22 of this Resolution. 3. Fences, walls, signs, and similar types of improvements, or additions or alterations that will not significantly affect the appearance or function of existing uses will require administrative approval only. Such approval may be obtained by applying for a permit
