Consultation Report

1 Introduction

1.1 This document is the Consultation Report that the Council is required to prepare for submission of the LDP to the National Assembly under Section 22 c) of the Town and Country Planning (Local Development Plan) () Regulations 2005.

1.2 In accordance with the Regulations, the Consultation Report identifies: (a) bodies engaged or consulted at the pre-deposit, deposit and site allocation representation (alternative site) stage; (b) the main issues raised in these stages, and how they have been addressed in the Local Development Plan (LDP); (c) the total number or representations received during these stages (Preferred Strategy, Deposit & Alternative sites) (d) the steps taken to publicise plan preparation, and how this complies with the Involvement Scheme contained in the Delivery Agreement.

1.3 The Report makes reference to and follows the Initial Consultation Report (ICR) http://www2.torfaen.gov.uk/EnvironmentAndPlanning/Planning/ForwardPlanning/Publi cations/DepositLDPInitialConsultationReport.pdf (Document SD05) which was prepared under regulation 17 for the deposit stage. The ICR included Annexes showing the detailed responses of the Council to the relevant individual representations made in the public consultation on the Preferred Strategy, and indicated how these influenced the policies and proposals in the Deposit LDP.

1.4 The Consultation report builds on the ICR detailing the further stages in the plan preparation including the consultation and engagement on the deposit and alternative site stages (Regulation 18 and 21).

1.5 Key Consultation dates

Initial Delivery Agreement 14th October 2005 - 4th November 2005 Preferred Strategy: 28th January 2008 - 10th March 2008 Deposit Plan: 28th March 2011 - 31st May 2011 Alternative Sites: 29th June 2011 - 10th August 2011. Alternative Sites Addendum: 28th September 2011 - 9th November 2011.

Community Involvement Scheme

The following sections indicate the key stages in plan preparation from the Community Involvement Scheme and how these have been complied with in the preparation of the Local Development Plan.

Key Stages in Plan Preparation

1. Pre-Deposit Participation (Regulation 14) - LDP Key Stakeholder Engagement to generate strategic issues and alternatives

2. Pre-deposit public consultation (Regulation 15 & 16) - Public Consultation of Preferred Strategy & Options and associated SA(SEA)

4. Deposit of Proposals (Regulation 17) - Preparation and publication of Deposit Plan.

Deposit

On 15th February 2011 Council approved the Deposit Torfaen LDP and associated documents for public consultation (Link to Council Report in Appendix B). The Deposit LDP was subject to public consultation from 28th March 2011 to 31st May 2011. During which time, and in accordance with the „Community Involvement Scheme‟ contained in the LDP „Delivery Agreement‟, manned public exhibitions were held throughout the ; with free summary leaflets being handed out, as well as the documents being made available for purchase or inspection at Council Offices, Libraries and for free download on the Council‟s website. The Deposit LDP was also summarised in a centre page double spread of Torfaen Talks in April 2011 (See Appendix C); with a lead up article in the preceding February 2011 edition (Appendix C). Notices were also placed in the press (Appendix E) and statutory consultees and stakeholders were invited through individual letters to make written representations by the end of this consultation period (Appendix D). Site Notices (Appendix D) were also posted on all allocated sites during the Deposit period and stakeholder meetings were held with several Town and Community Councils.

The Deposit consultation included exhibitions throughout the County Borough during the public consultation period in order to convey the policies and proposals contained within the Deposit LDP to members of the public and other interested parties. Members of the Forward Planning team were available at the exhibitions in order to answer queries on the Deposit LDP and provide assistance where required. 5. Representations on deposit proposals of LDPs (Regulation 19 & 20)- Collate & provide feedback on representations

All representations received were acknowledged (letter included in Appendix D) and put on the website.

Based on the submissions additional site visits, meetings where required and further work has been carried out. Details of this and how all representations have been addressed is detailed in the report of consultation (Document SD06). This was presented to Council meeting on 21st February 2012 (Link in Appendix B).

6. Representations on a site allocation representation (Regulation 21) - Advertise 'Alternative Sites'

Alternative Sites

Following on from the consultation on the Deposit LDP, the 99 „Alternative Sites‟ proposed in the representations received were the subject of public consultation between 29th June to 10th August 2011 and a further consultation on an „Alternative Sites Addendum‟ was held between 28th September to 9th November 2011. Again, the „Alternative Sites Schedules‟ and the representations received on the Deposit LDP were made available for inspection at Council Offices, Libraries and for free download on the Council‟s website. Notices were also placed in the press and statutory consultees and stakeholders were invited to make written representations by the end of these consultation periods. Site Notices were also posted on all mapped Alternative Sites (Appendix D). Public meetings were held with interested parties on request.

As required by national guidance, the Countryside Council for Wales and Environment Agency were consulted on any Sustainability Appraisals received from representors during these consultations and that their comments on them have been summarised in the Report of Consultation.

The Alternative Sites arising from representations made on the Deposit LDP include: -

new sites put forward for consideration; proposed amendments to allocated site boundaries; and proposed amendments to the Urban Boundaries.

99 „Alternative Sites‟, put forward by representors during consultation on the Deposit LDP, were consulted upon between 29th June to 10th August 2011. A further consultation on an „Alternative Sites Addendum‟ was undertaken between 28th September to 9th November 2011. During these consultations, 192 representors made 435 individual representations on the Alternative Sites.

Petitions were received from 6 community groups as follows: - a 61 signature petition received from Rosemead Residents requesting the deletion of the Ty‟r-ywen Farm housing allocation (Policy H1/6); a 15 signature petition received from the Twmpath Residents Association requesting the deletion of the Animal Pound and Adjacent Land housing allocation (Policy H2/2); a 287 signature petition received from Fight the Plan requesting the deletion of the Animal Pound and Adjacent Land housing allocation (Policy H2/2); a 26 signature petition received from New Inn Residents against the inclusion of the Greenacres, Sluvad Road, New Inn Alternative Site (ASUB11) within the Urban Boundary and the Jerusalem Lane, New Inn Alternative Housing Site (ASN17 & ASUB09) within the Urban Boundary; a 87 signature petition received from New Inn Residents against the inclusion of the Greenacres, Sluvad Road, New Inn Alternative Site (ASUB11) within the Urban Boundary and the Jerusalem Lane, New Inn Alternative Housing Site (ASN17 & ASUB09) within the Urban Boundary; and a 122 signature petition received from Croesyceiliog Residents requesting the deletion of the Craig Y Felin regional employment site allocation (Policy EET4/1).

All representations received were acknowleged (letter included in Appendix D) and put on the website.

Based on the submissions additional site visits, meetings and further work has been carried out. This was presented to Council meeting on 21st February 2012 (Link in Appendix B) and final details of this and how all representations have been addressed is detailed in the report of consultation (Document SD06).

7. Submission of LDP to the National Assembly (Regulation 22) - Prepare Recommendations Report on all representations received

The final recommendations report was submitted to members for approval on 21st February 2012 (See details of Council Reports and links to these documents in Appendix B) . The final recommendations report has been updated following the council meeting to include all the errata detailed at the meeting and that was allowed through the delegated powers given to the Chief Planning and Public Protection Officer at that meeting. This final report is included as Document SD06.

Overview of Engagement

A consultation database has been established and the people and organisations on this database (current list is included in Appendix A) have been kept informed throughout the various stages of the Plan preparation process.

People and organisations on the LDP database were kept informed of the forthcoming stages of the LDP preparation according to when they became involved in the process.

The Council LDP Consultation Database contains a continually updated list of stakeholders, respondents and interested parties ranging from national umbrella organisations to local members of the public. People are removed from the database if they make a formal request to this effect. Throughout the process all consultees on the database have been kept informed of the Plan preparation process.

There are currently 765 consultees on the database.

Table 1 below shows a general overview of the number of people consulted with and the number of representations received at each stage of LDP preparation.

Post Deposit

The Initial Consultation report (Document SD05) details engagement and consultation up to deposit stage. Following from this the deposit plan was consulted on and the following details the subsequent plan preparation stages.

Consideration of Representations received to the Deposit LDP and Alternative Sites - In accordance with the Local Development Plan Regulations, the Council is required to consider and formulate responses to the representations received. This must take place prior to submission of the LDP for Examination.

A Report has been prepared (Document SD06) which outlines the Council‟s response to each of the representations received together with a recommendation on each one. For submission of the LDP The Schedules of Focused and Minor Changes which arise from the Report were also reported and subject to consultation.. The Consultation Report has been divided into the following sections: - . Main Issues Report: „major‟ Policy based Representations as ordered in the Deposit LDP; . Appendix A: Table of individual responses to all representations received (including responses to „minor‟ representations) in Representor order; . Appendix B: Representations on New Alternative Sites and Settlement Boundary Amendments; . Appendix C: Representations on the Sustainability Appraisal Report; and . Torfaen County Borough Council has prepared Local Development Plan (LDP) documents for the above plan. The Council approved the Deposit LDP for consultation at its Council meeting on 15 February 2011, and the statutory consultation period commenced on 28 March 2011 and will now end at 5pm on Tuesday 31 May 2011.

The Council has prepared its Alternative Sites Register and is now undertaking a six week consultation on the document between 29th June and 10th August 2011. The Alternative Sites Register sets out the site allocation representations that were received during the recent consultation on the Deposit LDP. These representations have suggested new sites, the alteration or omission of allocated sites and changes the settlement boundaries in the Deposit LDP. It is important to note that these alternative sites are not being proposed by the Council; they were submitted by individuals and organisations on the Deposit LDP.

The LDP will, upon adoption, replace the current de- velopment plan and form the basis for decisions on land use planning for the County Borough of Torfaen (excluding the area of the Brecon Beacons National Park). Representations (including those taking the form of objections) should specify the matters to which they relate. Objections should also specify the change sought, the grounds on which they are made and the test(s) of soundness to which they relate (see below). Representations on the Deposit LDP may be completed on-line at www.torfaen.gov. uk and using the on-line comments form. All representations made about the Plan will be available for the public to view. The deposit LDP will be considered by an independent Inspector who will assess whether it is ‘sound’. There are a number of tests of soundness and these can be found on the comments form for making representations or at www.torfaen.gov. uk Objections to the deposit LDP should make reference to these tests wherever possible. Any representation proposing a new or extended site for development or one that proposes to incorporate a site rejected by the Authority should be accompanied by an independent sustainability appraisal to consider the impact on sustainability the representation is likely to have.

Representations may also be accompanied by a request to be notified at a specified address of the next stage of the LDP and/or that the LDP has been submitted to the Welsh Assembly Government for independent examination and/or the adoption of the plan. The Local Planning Authority cannot change the plan at this stage but it can decide whether it is in favour of any changes proposed. Representations made in accordance with this notice (i.e. ’duly made’) will be considered by an independent Inspector appointed to examine the soundness of the plan. Only those making representations seeking to change the deposit LDP (i.e. objectors) whose representations were ‘duly made’ have the right to appear before and be heard by the Inspector at the Examination.
