Hackney Carriage and private hire vehicle drivers licence application pack

Please find enclosed the application forms and guidance on which you may make the application for a driver’s licence for a hackney carriage (HC) and a private hire vehicle (PHV). Please read the notes accompanying the application form before you complete any of the forms. The application pack includes the following documents, if any are missing please contact me on the above telephone number. a. Application for Hackney Carriage / Private Hire Drivers Licence. b. Confirming your identity and Confirming your Right to work- details of the ID documents you will need to bring to your appointment when you make your application. The ID is necessary so that an Enhanced Disclosure and Barring Service (DBS) certificate may be obtained, and your entitlement to work in the UK can be verified. You will need to bring at least three pieces of evidence from the documents listed on ‘Confirming your Identity’, one from Group 1 and any two from Group 1, 2a or 2b. c. The DBS Update Service – the DBS is now completed online, and you must now subscribe to the DBS update service within 30days of your DBS certificate being issued d. Medical Report - applicants must be assessed as medically fit to drive to the same standard applied by the DVLA to the grant of public service and heavy goods vehicle licences (known as a ‘Group 2’ level of medical fitness). The medical report must be completed by their own G.P. at the applicant’s expense. Any uncertainties relating to the assessment carried out by the applicants’ GP will be referred to the Council’s medical advisor, and at his discretion the applicant may be required to undergo further tests. The decision of the Council’s medical adviser will be final. The completed medical report must be received within 4 months of the Doctor signing the report. e. Hackney Carriage and Private Hire Licensing Policy – all applicants must sign a declaration that they have read the Council’s policies on the licensing of Hackney Carriage and/or Private Hire drivers. f. Policy regarding the relevance of convictions and other related information - The criteria to be considered by the licensing authority when determining whether a person is a fit and proper person to hold a hackney carriage / private hire driver licence g. Taxi Driver Assessment - New PH/HC driver licence applicants must pass a Private Hire/Hackney Carriage Test Assessment. A pass certificate will need to be produced with the other documents requested when you make your application. h. Knowledge Test for new Applicants Guidance - New PH/HC driver licence applicant to pass a ‘Knowledge’ test of the area of . This will consist of a test in three parts. A fee of £30 will be charged for this test with a retake fee of £15 if failed.

What to do if you decide to apply for a licence

You will not be seen without an appointment and incomplete applications or documentation will be entirely rejected.

Taxi and private hire vehicle drivers are exempt from the Rehabilitation of Offenders Act 1974. This means that convictions and cautions that would usually be considered spent can be taken into account by councils when making licensing decisions.

The only exceptions to this requirement are ‘filtered’ convictions and cautions that are considered ‘protected’. The Council is the Data Controller of the information you provide and we have a statutory duty to collect and process the information to be compliant with the Local Government (Miscellaneous Provisions) Act 1976 and Town and Police Clauses Act 1847. This is part of our public task obligations as a Local Authority to ensure whether a person is ‘fit and proper’ to hold a Hackney Carriage or Private Hire Driver licence. This also includes processing information on medical checks, DBS check and DVLA checks. We may share your information and make any other necessary enquiries regarding your application with other departments and statutory organisations in relation to the application. Your personal information will be processed in line with Data Protection Legislation and we will not disclose information about you to anyone outside the Council unless the law permits or requires us to.

The Authority is under a duty to protect the public funds it administers and to assist other agencies in the prevention and detection of crime. We may use the information provided in this form for this purpose and share this information with other bodies responsible for auditing or administering public funds.

Under Section 51(3) Local Government (Miscellaneous Provisions) Act 1976, the local authority is required to maintain a register of private hire driver licences, including the following details which are available for inspection by members of the public: The name the of the person to whom it is granted; the date on which and the period for which it is granted; if the licence has a serial number, that number. As Mole Valley District Council issues dual Hackney Carriage and Private Hire Licences, the above applies to both.

The personal information you provide will be held for the duration of your licence from the date of receipt, after which it will be securely destroyed 5 years after the expiry, surrender or revocation of your final licence, in line with our retention policy (except in the event of an appeal or judicial inquiry, in which case it will be retained for as long as is required to determine these matters).

Please note: If a document in the List of Valid Identity Documents is: • denoted with * - it should be less than three months old • denoted with ** - it should be issued within the past 12 months • not denoted – it can be more than 12 months old CONFIRMING YOUR RIGHT TO WORK The licensing authority have a legal duty not to issue a private hire or hackney carriage drivers licence to people disqualified by their immigration status from holding such licences in order to prevent illegal working in the private hire and hackney carriage trade.

Your right to work in the United Kingdom will be checked as part of the application, this could include checking you immigration status with the Home Office. You must therefore provide a document or document combination that is stipulated as being suitable for this check. You must bring the original documents such as passport or biometric residence permit which will be scanned, checked for validity and a copy retained, the original will be returned to you. If there are restrictions on the length of time you may work in the UK, the licence once granted will not be issued for any longer than this period. In such circumstances, the check will be repeated each time you apply to renew or extend your licence.

If, during the period of your licence you are disqualified from holding a licence because you have not complied with the UK’s immigration laws, your licence will lapse and you must return it to the licensing authority, failure to do so is a criminal offence. You must subscribe to the DBS update service within 30 days of your DBS certificate being issued

Once your valid application form and fee have been received you will be e-mailed an invite to initiate the Disclosure and Barring Service (DBS) check online.

 You will be required to specify the three types of ID you will be using to prove your ID.  Please e-mail copies of your documentation to [email protected] . They will need to be sufficiently clear and legible that all identifying details can be read.  Once we have verified your identification documents, we will e-mail an invite to complete the DBS process online.

You are now required as a condition of your licence to subscribe to the DBS Update Service.

The DBS Update Service allows:

 applicants to keep their DBS certificates up to date  employers to check a DBS certificate without the need for a new application.

By subscribing to the service you will not need to complete another DBS application each time you renew your licence, and you will be able to take your existing certificate to a new employer without needing to reapply.

You need to register for the Update Service at www.gov.uk/dbs-update-service

It costs £13 per year and you can pay by debit or credit card. So long as you remain subscribed to the service you will never have to pay for a new DBS application (which currently costs £57)

As soon you have completed your DBS application you can immediately apply to join the Update Service and track the progress of their application online. To do this you will need the disclosure application reference number or reference receipt to the applicant

You can also join the update service using their DBS certificate number once it has been issued. However, you only have 30 calendar days to do so from the date the certificate was issued – with day one being the date of issue.

If you do not subscribe to the DBS update service, or if your subscription lapses, we will suspend your hackney carriage / private hire driver licence 6 months after the date of the last DBS check.

Your licence will only be reinstated following receipt of a new DBS certificate. You will need to pay for a new DBS application (currently £57) and the suspension will not be lifted until the new certificate is received.

Medical examination report for a Group 2 (Hackney carriage and private hire) licence Please note, we apply the DVLA group 2 standard, the same as bus, coach or lorry drivers to Hackney carriage and private hire drivers. Please refer to the 'Check if a health condition affects your driving' guidance on the gov.uk website for the required standards for driving before you have this medical examination report completed. This medical examination form must be completed by a doctor at your own GP with access to your full medical record. The vision assessment must be completed by an optician, an optometrist or a doctor at your GP.

1 Requirements for Drivers with Diabetes treated with Insulin

All the following criteria must be met to licence the person with insulin treated diabetes for one year (with annual review as indicated below): • full awareness of hypoglycaemia • no episode of severe hypoglycaemia in the preceding 12 months • practices blood glucose monitoring with the regularity defined below • must use a glucose meter with sufficient memory to store three months of readings as detailed below • demonstrates an understanding of the risks of hypoglycaemia • no qualifying complications of diabetes that would mean licence being refused or revoked, such as visual field defect

Monitoring Glucose Readings

• regular blood glucose testing – at least twice daily including on days when not driving • no more than two hours before the start of the first journey • every two hours after driving has started • a maximum of two hours should pass between the pre-driving glucose test and the first glucose check performed after driving has started • use one or more glucose meter(s) with memory function to ensure three months of readings that will be available for assessment • requires the applicant’s usual doctor who provides diabetes care to undertake an annual examination including review of the previous three months’ glucose meter readings

• arrange for examination to be taken every 12 months by an independent Consultant Specialist in diabetes if the examination by their usual doctor is satisfactory

• at the examination, the Consultant requires sight of blood glucose self-monitoring records from the previous three months stored on the memory of the glucose meter

• the licensing application process cannot start until an applicant’s condition has been stable for at least one month

• appliants will be asked to sign an undertaking to comply with the directions of the healthcare professional treating their diabetes and to report any signicant change in their concerns to the licensing authorities

• You must always carry your glucose meter and blood glucose strips with you. You must check your blood glucose before driving and every two hours whilst you are driving.

• In each case if your blood glucose is 5.0mmol/l or less, take a snack. If it is less than 4.0mm0l/1 or you feel hypoglycaemic do not drive.

• If hypoglycaemia develops while driving stop the vehicle safely as soon as possible.

• You must switch off the engine, remove the keys from the ignition and move from the driver’s seat.

• You must not start driving again until 45 minutes after blood glucose has returned to normal. It takes up to 45 minutes for the brain to recover fully.

• Always keep an emergency supply of fast-acting carbohydrate such as glucose tablets or sweets within easy reach in the vehicle.

• You should carry personal identification to show that you have diabetes in case of injury in a road traffic accident.

• Particular care should be taken during changes of insulin regimens, changes of lifestyle, exercise, travel and pregnancy.

• You must take regular meals, snacks and rest periods on long journeys. Always avoid alcohol.

3 1. INTRODUCTION a. The Council has resolved to carry out Private Hire Vehicle Licensing under the adoptive powers contained in the Local Government (Miscellaneous Provisions) Act 1976 alongside their statutory responsibility for the licensing of hackney carriages. b. Priority and Principles Hackney carriages (HC) and private hire vehicles (PHV) supply a service to the public. The Council plays a role between the providers of the service and its customers. The Council’s over-riding priority in playing its role is to safeguard the public interest, this will be achieved by the application of the following principles to its administration, regulation and enforcement activities. 1. Public Safety Users of HC and PHV services put their trust in the drivers and the vehicles involved. The Council will build on the statutory requirements by providing administrative requirements, and setting licensing conditions that will aim to ensure good standards of safety to the public so that public trust is well founded.

2. Value for Money a. The Council will take steps to ensure so far as reasonably practicable the users of the HC and PHV service receive value for money and the Council provides value for money in its licensing services. b. The Council will regulate the hackney carriage tariff by the use of a transparent and coherent system. The system will take account of costs related to hackney carriage business. The Council will consider representations by hackney carriage proprietors or their representatives regarding the tariff. c. Members of the public travelling by hackney carriage will be protected from the dishonest application of the tariff by the enforcement of appropriate conditions and the formal investigation of complaints. d. The Council will seek to balance the income it receives from fees for the service with the cost of the service over time. 3. Quality of the Service to the Public The quality of the service provided to the public will depend on both the vehicles and the drivers. The Council will apply appropriate conditions to vehicle and drivers’ licences to ensure a good quality service is provided. Such conditions may include matters relating to the condition of vehicles, age of vehicles, and suitability of vehicle types for public use. Conditions may also be set regarding the appearance and conduct of the driver. 4. Meeting Travel Needs 1. The Council will use its controls over vehicle licences to ensure as far as is reasonably practicable that all sections of the community can be carried by the service without discrimination or disadvantage. 2. The Council will exercise its controls over the provision of HC vehicle licences to ensure as far as possible that there is no significant unmet demand for the service by the public. The unmet demand will be assessed as and when necessary. The Council is committed to the Disability Discrimination Act 1995 and will introduce the recommendations made by Government when they become statute. 5 Efficiency of the Licensing Service The Council will seek to ensure its administration, regulation and enforcement activities are carried out as efficiently and effectively as practicable. 6. Liaison with Licence holders The Council will inform licence holders about the service it provides and liaise with them in respect of proposed changes in the service. It will give due consideration to any views put forward about the service by the licence holders or their trade representatives.

4 2. APPLICATION FOR A JOINT HACKNEY CARRIAGE AND PRIVATE HIRE DRIVERS LICENCE

1. Age/Driving Experience. An applicant must have held a full UK/EU Driving Licence for at least 12 months prior to application.

2. Knowledge Test. All applicants for the Grant of a Driver’s Licence will be required to undergo a Knowledge Test to show an understanding of the area, Licensing Conditions and the Highway Code for the UK. The test will be conducted orally and will last for approximately 45 minutes. An exception to this will be for drivers who will be working on home to school run services for Local Authority Contracts only.

3. Driving Standards Agency Taxi/Private Hire Assessment All new applicants will be required to pass the Driving Standards Agency Taxi/Private Hire Assessment prior to the granting of a Driver’s Licence. The pass certificate will be required to be examined by the Council Officers.

4. Right to Remain and Work in the United Kingdom Applicants for the Grant of a Licence will be required to produce documentary evidence of a right to remain and work in the UK. Applicants on student visas will need to produce evidence that they will be employed by an operator with the necessary HM Customs and Revenue documentation providing evidence that they are not self employed.

5. Disclosure and Barring Service (DBS) and address history An applicant must be “fit and proper person” to hold a Licence. i. Applicants for the Grant and Renewal of a Licence are subject to an enhanced DBS check and must provide an address history for the past 5 years. ii. If an applicant is not able to provide a 5 year traceable history in the United Kingdom, or has spent six continuous months or more overseas (since the age of 16) the C ouncil will expect to see evidence of a criminal record check from the country / countries visited covering the period. iii. Because of the potential lifetime relevance for some of the most serious offences, the Council will need to ensure that sufficient background checks are conducted for those applicants who have lived overseas. For EU nationals a disclosure that is similar to the UK DBS will be required, for those countries for which checks are not available, the C ouncil will require a certificate of good conduct authenticated by the relevant embassy. iv. All applicants must subscribe to the DBS update service within 30 calendar days of the ‘date of issue’ which is printed on the certificate. On subscribing to the update service drivers must provide the original certificate and an authorisation mandate for the licensing authority to carry out an online check when necessary or in a timescale as dictated by any future legislation or statutory guidance. On grant of licence all licensees are required to maintain their certificates through the DBS update service throughout the currency of their licence.

6. Suitability of Applicant The policy regarding the relevance of convictions and other related information attached at Appendix 1 to this policy sets out the criteria to be taken into account by the Council when determining whether or not an applicant or an existing licence holder is a fit and proper person to be granted, have renewed or continue to hold a Hackney Carriage and/or Private Hire Driver Licence.

7. Mandatory Child Sexual Exploitation and Safeguarding Training Mole Valley District Council wants to take appropriate steps to protect the most vulnerable in our society by introducing mandatory Child Sexual Exploitation (CSE) and safeguarding training for taxi and private

5 hire drivers. All new drivers are required to pass the CSE training in advance of first being licensed and all existing drivers to pass within one year of the training being made available.

8. Evidence of Employment Before a licence will be granted to a new Private Hire Driver, evidence must be provided by the prospective employer confirming that an offer of employment has been confirmed for the individual. This should be in the form of a letterhead etc. and should be dated by the Operator and submitted with the application.

9. Medical Applicants will be required to provide a satisfactory medical examination. Mole Valley District Council requires that drivers of Hackney Carriage or Private Hire vehicles achieve a higher standard of medical fitness than other car drivers. The standard required by the Council is the same standard applied by the DVLA to the grant of public service and heavy goods vehicle licences and is known as a ‘Group 2’ level of medical fitness certificate which should be completed by their own G.P. If there is any evidence that the applicant has diabetes then they could be subject to a further examination by the Authorities own doctor, the fee charged for this examination will be at the applicants cost. A medical will be valid up to 44 years of age (unless the G.P. recommends a more regular medical) then at the ages of 45, 50, 55, 60 then every year after age 60.

10. Appearance Drivers are required to be smart and presentable at all times whilst working under the terms of the licence issued by the Authority. Footwear appropriate for driving must be worn at all times.

11. Licence Conditions The licence holder will be required to understand and accept all the terms and conditions attached to the licence. 12. National Registration of Refusals and Revocations The licensing authority provides information to the National Register of Taxi Licence Refusals and Revocations (NR3), a mechanism for licensing authorities to share details of individuals who have had a hackney carriage or Private Hire Vehicle (PHV) licence revoked, or an application for one refused. This is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the licensing authority – that is, assessing whether an individual is a fit and proper person to hold a hackney carriage or PHV licence

Therefore:

 Where a hackney carriage/ PHV licence is revoked, or an application for one refused, the authority will automatically record this decision on NR3.  All applications for a new licence or licence renewal will automatically be checked on NR3. If a search of NR3 indicates a match with an applicant, the authority will seek further information about the entry on the register from the authority which recorded it. Any information received as a result of an NR3 search will only be used in respect of the specific license application and will not be retained beyond the determination of that application.

The information recorded on NR3 itself will be limited to:

Information will be retained on NR3 for a period of 25 years. 6

This is a mandatory part of applying for and being granted a hackney carriage / PHV driver licence. The authority has a published policy on the approach it will take to requests by other authorities for further information about entries on NR3, and about the use it will make of any further information provided to it. Information will be processed in accordance with the Data Protection Act (DPA) and General Data Protection Regulation (GDPR). Any searches, provision or receipt of information of or under NR3 are necessary to the authority’s statutory licensing functions of ensuring that all drivers are fit and proper to hold the applicable licence. It is not intended that any NR3 data will be transferred out of the United Kingdom.

7 3. APPLICATION/RENEWAL FOR HACKNEY CARRIAGE/PRIVATE HIRE VEHICLE LICENCES a. Age/Standard of Vehicles

i. New Vehicles All vehicles which are being presented for first licensing by the Authority must be no older than 6 years old from the date of application. An exception may be made if the vehicle is considered by an Authorised Officer to be in exceptional condition. Vehicles over 3 years old at application will be required to undergo a MOT test, then every 12 months after up to 5 years old then an MOT test will be required no less than every 6 months. ii. Existing Licensed Vehicles Vehicles over 3 years old at renewal will be required to undergo a MOT test, then every 12 months after up to 5 years old then an MOT test will be required no less than every 6 months. Vehicles over 9 years old, unless in exceptional condition, will be considered too old and will have to be replaced. b. Insurance Certificate An Insurance Certificate or Cover Note covering the Driver for Private Hire Use must be provided on application or renewal. If only a Cover Note is provided, the full Certificate of Insurance must be provided to the Council within one calendar month, the insurance must be continuous and copies will need to be sent to Licensing. c. Licence conditions The licence holder will be required to confirm that they accept and understand all the terms and conditions attached.

8 4. APPLICATION FOR A PRIVATE HIRE OPERATORS LICENCE a. Suitability of Applicant The policy regarding the relevance of convictions and other related information attached at Appendix 1 to this policy sets out the criteria to be taken into account by the Council when determining whether or not an applicant or an existing licence holder is a fit and proper person to be granted, have renewed or continue to hold a Hackney Carriage and/or Private Hire Driver Licence. b. Location of Premises. An application for the Grant of a new Operator Licence will only be considered if the base is located within the Mole Valley District. c. Planning Permission. In the case of new applications, and business relocation, evidence of Planning Permission or confirmation from the Planning Department that Consent is not required must be produced before a licence will be granted. d. Licence Conditions. The licence holder will be required to confirm they accept and understand all the terms and conditions attached.

9 5. ENFORCEMENT. Compliance with the statutory requirements and conditions attached to licences will be maintained by enforcement actions in accordance with the Environmental Health Department’s documented policy on enforcement and the Council’s scheme of delegation. Enforcement action can include prosecution, simple caution, refusal, suspension or revocation of licences.

1. Introduction

1.1 This policy sets out the criteria to be taken into account by the Council when determining whether or not an applicant or an existing licence holder is a fit and proper person to be granted, have renewed or continue to hold a Hackney Carriage and/or Private Hire Driver Licence. In addition to criminal convictions the Council will also take into account other factors such as demeanour, attitude, general character, non-criminal behaviour and police or other relevant records or information from a reliable source.

1.2 Whilst this policy primarily applies to the determination of driver licences, where a conviction (as defined below) is considered relevant to the fitness and propriety/suitability of an individual to hold or be granted a Private Hire Operator Licence or vehicle licence, then this policy must be referred to in the determination of that licence/application.

1.3 The Council is mindful that each case must be considered on its merits and where exceptional circumstances demand, the Council may depart from this policy.

1.4 This policy provides guidance to any person with an interest in taxi and private hire licensing. In particular, but not exclusively:

 Applicants for a driver’s, vehicle or private hire operator licence  Existing licensees whose licences are being reviewed or renewed  Licensing officers  Members of the licensing committee/sub-committee  Magistrates and Judges hearing appeals against local authority decisions

1.5 For renewal applications and current licence holders the policy will not be applied retrospectively. However the policy will be applied if any additional convictions are incurred or brought to the attention of the Council that would call into question a person’s suitability to hold a licence.

1.6 It is the responsibility of Mole Valley District Council (referred to as the Council) to issue Hackney Carriage and Private Hire licences under the Local Government (Miscellaneous Provisions) Act 1976, the Town Police Clauses Act 1847 and the Hackney Carriage Byelaws. In exercising this duty the Council must consider the need to ensure the safety of the public its primary consideration. Licences cannot be issued unless the person is considered to be ‘fit and proper’.

1.7 In seeking to safeguard the safety of the public. The council will be concerned to ensure:

 That a person/applicant is fit and proper in accordance with Sections 51, 55 and 59 of the Local Government (Miscellaneous Provisions) Act 1976 (Part II)

1.8 There is no judicially approved test of fitness and propriety and, accordingly, a number of local tests have developed. These tend to be based on a test similar to the following:

‘Would you (as a member of the licensing committee or other person charged with the ability to a grant a hackney carriage driver’s licence) allow your son or daughter, spouse or partner, mother or father, grandson or granddaughter or any other person for whom you care, to get in to a vehicle with this person alone?’

If the answer to this question (or a similar test) is an unqualified ‘Yes’ then the test is probably satisfied. If there are any doubts in the minds of those who make the decision, then further consideration should be given as to whether this person is a fit and proper person to hold a hackney carriage driver’s licence.

1.9 The Council will undertake whatever checks it considers necessary to ensure that licences are not issued to unsuitable people. In assessing the suitability of an applicant or licence holder, the council will take into consideration the following factors:

 Criminality  Number of endorsed DVLA driving licence penalty points  The conduct of the applicant in making the application (e.g. whether they have acted with integrity during the application process).  The previous licensing history of existing / former licence holders.

In addition, the Council will also consider further information from sources such as, but not limited to, the Police (including abduction notices), Children and Adult Safeguarding Boards, Multi Agency Safeguarding Hub, Social Services other licensing authorities, other departments within the Council, and statutory agencies.

1.10 In this policy, the word “applicant” refers to either new applicants, existing licence holders who are seeking renewal and existing licence holders who are being considered by the Council by virtue of offending activity having recently come to light.

1.11 In this policy, the word “conviction” is to be defined as including convictions, cautions, warnings, reprimands and other relevant information.

1.12 The Council reserves the right to overturn or annul a decision that has previously been made, or refuse a renewal of a licence, where clear errors are discovered.

1.13 As licensed drivers often carry unaccompanied and vulnerable passengers, the council will take a strong line in relation to applicants or existing licence holders with convictions for sexual offences. A licensed PHV or taxi driver is expected to be trustworthy. In the course

of their working duties drivers will deal with cash transactions and valuable property may be left in their vehicles. Drivers may well deal with customers who are vulnerable or intoxicated and potentially easily confused. Taking drugs and driving poses an obvious risk to public safety, whilst applicants who have convictions for the supply of drugs should also be treated with considerable concern, The nature and quantity of the drugs, whether for personal use or supply are issues which will be considered carefully. As licensees are professional vocational drivers, a serious view is taken of convictions for driving, or being in charge of a vehicle while under the influence of drink or drugs. More than one conviction for these offences raises significant doubts as to the applicant's fitness to drive the public.

2 General Policy

2.1 Whilst the Council may consider that an applicant with a conviction for a serious offence may not need to be automatically barred from obtaining a licence, it is however to be normally expected that the applicant would be required to:

a. Remain free of conviction for an appropriate period as detailed below; and

b. Show adequate evidence that they are a fit and proper person to hold a licence (the onus will be on the applicant to produce such evidence). Simply remaining free of conviction may not generally be regarded as adequate evidence that an applicant is a fit and proper person to hold a licence.

2.2 The standards and criteria set out in paragraphs 4 to 18 below are those that would normally be applied to applications and licences. The Council may depart from these criteria, however it will only do so in exceptional circumstances. The otherwise good character and driving record of the applicant or licence holder will not ordinarily be considered as exceptional circumstances.

3 Powers

3.1 Section 61 of the Local Government Miscellaneous Provisions Act 1976 allow the council to suspend, revoke or refuse to renew a licence if the application/licence holder has been convicted of an offence involving dishonesty, indecency, violence, of failure to comply with the provisions of the Town Police Clauses Act 1847 or of failure to comply with the provisions of Part II of the Local Government (Miscellaneous Provisions) Act 1976, or if he/she has since the grant of the licence been convicted of an immigration offence or required to pay an immigration penalty, or for any other reasonable cause.

3.2 The Rehabilitation of Offenders Act 1974 (Exceptions) Order 1975, allows the council to take into account all convictions recorded against an applicant or the holder of a Private Hire or Hackney Carriage driver’s licence, whether spent or not. Therefore the council will have regard to all relevant convictions, particularly where there is a long history of offending or a recent pattern of repeat offending. Applicants need to be aware that, in accordance with this Act, all convictions, cautions, warnings and reprimands must be

declared.

4 Consideration of disclosed criminal history

4.1 Under the provisions of Sections 51, 55 and 59, Local Government (Miscellaneous Provisions) Act 1976, the council is required to ensure that an applicant for the grant or renewal of a Hackney Carriage and/or a Private Hire Operator or Vehicle driver’s licence is a “fit and proper” person to hold such a licence. However, if an applicant has any convictions, warnings, cautions or charges awaiting trial, the council will look at:

. How relevant the offence(s) are to the licence being applied for . How serious the offence(s) were . When the offence(s) were committed . The date of the conviction, warning, caution etc. . Circumstances of the individual concerned . Any sentence imposed by the court . The applicant’s age at the time of offence / incident leading to the conviction, warning, caution etc. . Whether they form part of a pattern of offending . The applicant’s attitude . Any other character check considered reasonable (e.g. personal references if requested by the Council) . Any other factors that might be relevant, for example:  The previous conduct of an existing or former licence holder,  Whether the applicant has intentionally misled the council or lied as part of the application process,  Information provided by other agencies/council departments.

Where an applicant has been convicted of a criminal offence, the licensing authority cannot review the merits of the conviction [Nottingham City Council v. Mohammed Farooq (1998)].

4.2 In this policy ‘from date sentence has ended’ is taken to be the date which is reached once the whole of the period as sentenced by the court has elapsed and not necessarily the length of time served by the applicant. For example, if a sentence is five years imprisonment then the date that the sentence ends will be five years from the date of sentencing – regardless of the amount of time actually served by the applicant. If the sentence is amended by a court at a later date then this new sentence becomes relevant for the purposes of this policy. The term ‘since completion of sentence’ is to be construed in a similar way.

4.3 Existing holders of driver’s licences are required to notify the council in writing within five working days of receiving a driving licence endorsement, fixed penalty notice, warning, reprimand, police caution, criminal conviction or other criminal proceedings (including their acquittal as part of a criminal case). In addition, licence holders must inform the council within 3 working days of their arrest for any matter (whether subsequently charged or not).

To fail to do so, will raise serious questions for the Council as to the honesty of the licence holder and will be taken into account as part of any subsequent renewal applications.

4.4 It is an offence for any person knowingly or recklessly to make a false declaration or to omit any material particular in giving information required by the application for a licence (s57 Local Government (Miscellaneous Provisions) Act 1976). Where an applicant has made a false statement or a false declaration on their application for the grant or renewal of a licence, the licence will normally be refused.

4.5 Any offences or behaviour not expressly covered by this Policy may still be taken into account.

5 Options when determining an application/licence

5.1 When determining an application or reviewing an existing licence in relation to convictions or other relevant information the Council have the following options:

 grant the licence or take no further action  grant the licence with additional conditions  refuse, revoke, or suspend the licence  issue a warning

5.2 If a licence holder’s conduct is such that, were they to be applying for a new licence their application would normally be refused, they should expect consideration to be given as to the suspension or revocation of their licence.

6. Offences involving violence

6.1 Licensed drivers have close regular contact with the public. A licence will not normally be granted if the applicant has a conviction for an offence that involved the loss of life such as:

 Murder  Manslaughter  Manslaughter or culpable homicide while driving  Terrorism offences  Any offences (including attempted or conspiracy to commit offences) that are similar to those above.

6.2 A licence will not normally be granted until at least 10 years have passed since the completion of any sentence and / or licence period following conviction for an offence shown below:

 Arson  Malicious wounding or grievous bodily harm which is racially aggravated

 Actual bodily harm  Assault occasioning actual bodily harm  Grievous bodily harm  Robbery  Possession of firearm  Riot  Assault Police  Violent disorder  Common assault  Resisting arrest  Any racially-aggravated offence against a person or property  Affray  Any offence that may be categorised as domestic violence  Harassment, alarm or distress, intentional harassment or fear of provocation of violence  Any offence (including attempted or conspiracy to commit offences) similar to those above.

6.3 A licence will not normally be granted until at least 5 years have passed since the completion of any sentence and / or licence period following conviction for an offence shown below:

 Obstruction  Criminal damage  Any offences (including attempted or conspiracy to commit offences) that are similar to those above.

6.4 A licence will not normally be granted if an applicant has more than one conviction for an offence of a violent nature.

7. Offences involving a weapon (not a firearm)

7.1 If an applicant has been convicted of possession of a weapon or any other weapon related offence, this will give serious concern as to whether the person is fit to carry the public. For firearms offences see 6.2.

7.2 Depending on the circumstances of the offence, an applicant should be free of conviction for 5 years (or at least 5 years must have passed since the completion of the sentence, whichever is longer), before a licence is granted.

7.3 2 or more convictions for a violent offence will normally result in an application being refused.

8. Sexual and indecency offences

8.1 All sexual and indecency offences will be considered as serious. Applicants with convictions for sexual or indecency offences that involve a third party will normally be refused. Such offences include:

 Rape  Assault by penetration  Offences involving children or vulnerable adults  Trafficking, sexual abuse against children and / or vulnerable adults and preparatory offences (as defined within the Sexual Offences Act 2003).  Making or distributing obscene material  Possession of indecent photographs depicting child pornography.  Sexual assault  Indecent assault  Exploitation of prostitution  Soliciting (kerb crawling)  Any sex or indecency offence that was committed in the course of employment as a taxi or PHV driver  Making obscene / indecent telephone calls  Indecent exposure  Any similar offences (including attempted or conspiracy to commit) or offences which replace the above

8.2 In addition to the above the council will not n o r m a l l y grant a licence to any applicant who is or has ever been on the Sex Offenders Register or similar register.

9. Dishonesty

9.1 A serious view is taken of any conviction involving dishonesty.

9.2 A minimum period of 5 years free of conviction or at least 5 years since the completion of sentence (whichever is longer) is required t o h a v e p a s s e d before a licence is granted. Offences involving dishonesty include:

 theft  burglary  fraud  benefit fraud  handling or receiving stolen goods  forgery  conspiracy to defraud  false representation

 obtaining money or property by deception  other deception  taking a vehicle without consent  fare overcharging  or any similar offences (including attempted or conspiracy to commit) o r offences which replace the above

9.3 A licence will not normally be granted if an applicant has more than one conviction for a dishonesty offence.

9.4 Applicants or existing licence holders that are found to have intentionally misled the council, or lied as part of the application process, will normally be rejected or refused. 10. Alcohol and Drugs

10.1 A serious view is taken of convictions for driving, or being in charge of a vehicle while under the influence of drink or drugs or where the driver has been found to be under the influence of psychoactive substances.

10.2 At least 5 years, after the restoration of the DVLA driving licence following a drink drive or driving when under the influence of drugs conviction should elapse before an application will be granted.

10.3 A licence will not normally be granted where the applicant has more than one conviction for offences related to the possession of drugs and has not been free of conviction for 10 years or at least 10 years have passed since the completion of any sentence and/or licence period, whichever is the greater. There will then be full consideration of the nature of the offence and the quantity /type of drugs involved.

10.4 A licence will not n o r m a l l y be granted where the applicant has a conviction for an offence related to the supply of drugs.

10.5 If there is evidence of persistent drugs or alcohol use, misuse or dependency a specialist medical examination (in accordance with DVLA Group 2 medical standards) and a satisfactory medical report may be required before the licence is granted. If the applicant was an addict (drug or alcohol) then they would be required to show evidence of 8 years free from drug taking after detoxification treatment.

10.6 A licence will not normally be granted for drunkenness offences not involving a motor vehicle for a period of one year after a single conviction and 2 years after 2 or more convictions within 2 years of each other.

11. Driving offences involving the loss of life

11.1 A very serious view is to be taken of any applicant who has been convicted of a driving offence that resulted in the loss of life.

11.2 A licence will not normally be granted if an applicant has a conviction for:

 Causing death by dangerous driving  Causing death by careless driving whilst under the influence of drink or drugs  Causing death by careless driving  Causing death by driving: unlicensed, disqualified or uninsured drivers  Or any similar offences (including attempted or conspiracy to commit) offences which replace the above

12 Other traffic offences

12.1 Traffic offences such as driving without due care and attention, reckless driving, more serious speeding offences (usually dealt with by a court), or offences of a similar nature will give rise to serious doubts about the applicant’s suitability to be a driving professional. An applicant with any such convictions will be required to show a period of at least 1 year free of such convictions. For applicants with more than one offence this should normally be increased to 2 years.

12.2 At least three years should elapse (after the restoration of the DVLA driving licence), before a licence would be granted for a Hackney Carriage or Private Hire drivers licence.

12.3 Traffic offences such as obstruction, some speeding offences (usually dealt with by means of a fixed penalty), pedestrian crossing offences, traffic light offences waiting in a restricted area, or offences of a similar nature may not ordinarily merit refusal.

12.4 In cases where the courts have imposed a disqualification in respect of the DVLA driving licence, the periods stated above should normally commence from the date of the restoration of the licence.

12.5 In this policy, the term “disqualification” refers to the period served, in order to take account of the fact that a court may reduce the period of disqualification from driving. An applicant must provide evidence in advance to prove that the court agreed a reduction in the period of disqualification.

12.6 In “totting up” cases where disqualification is considered by the Court, even if the court does not disqualify (e.g. because of exceptional circumstances) a driver, the licensing authority is likely to refuse a hackney carriage or private hire driver’s licence because different criteria apply. An applicant will normally be expected to show a period of 12 months free from conviction from the date the court made its finding of exceptional circumstances justifying the non-disqualification.

13 Outstanding Charges or Summonses

13.1 If the individual is the subject of an outstanding charge or summons their application can

continue to be processed, but the application will need to be reviewed at the conclusion of proceedings.

13.2 If the outstanding charge or summons involves a serious offence and the individual’s conviction history indicates a possible pattern of unlawful behaviour or character trait, then in the interests of public safety the application may be put on hold until proceedings are concluded or the licence may be refused.

14 People banned from working with children and vulnerable adults

14.1 A serious view is to be taken of any applicant or licence holder who has been banned from working with children or vulnerable adults. A licence will not be normally be granted if an applicant has been found unfit to work with children or vulnerable adults.

15 Non-conviction information

15.1 The Council will take into account intelligence which has not led to a conviction. This may include but not be limited to information regarding acquittals, circumstances in which convictions were quashed due to misdirection to the jury, circumstances where the decision was taken not to prosecute, situations where the person has been arrested and bailed but not yet charged, civil penalties and complaints from the public. In considering the most appropriate action to take following the receipt of information), the credibility of both the witness / complainant and the licence holder will be taken into account.

15.2 If an applicant has been arrested or charged, but not convicted, for a serious offence which suggests he could be a danger to the public, consideration should be given to refusing the application or revoking an existing licence.

15.3 In assessing the action to take, public safety will be the paramount concern. Decisions will be taken on balance of probability.

15.4 A licence will not normally be granted until at least 1 year has elapsed since a Criminal Behaviour Order.

16 Licensing Offences

16.1 Offences under taxi and private hire and associated legislation such as plying for hire without a licence, overcharging and refusing to carry disabled persons will prevent a licence being granted or renewed until a period of 3 years has passed since conviction.

17 Insurance Offences

17.1 A serious view will be taken of convictions for driving, being in charge of a vehicle without insurance, or allowing person to drive whilst uninsured. A p r e v i o u s isolated incident will not necessarily stop a licence being granted provided an individual has been free of conviction for 3 years. However strict warning should be given as to

future behaviour. More than one conviction for these offences will prevent a licence being granted or renewed.

17.2 An operator found guilty of aiding and abetting the driving of passengers for hire and reward without insurance will have his Operator’s Licence r e v i e w e d w i t h a v i e w t o revocation and will not be permitted to hold a licence for a period of at least 3 years from the date of any revocation.

17.3 Where a specific offence is not mentioned, a suitable period of time will be determined by reference to offences described. The Council reserves the right to refuse a licence where there are aggravating circumstances, even where these guidelines would otherwise indicate that a licence might be granted.

18 Applicants with periods of residency outside the UK

18.1 Because of the potential lifetime relevance for some of the most serious offences mentioned in this policy, the Council will need to ensure that sufficient background checks are conducted for those applicants who have lived overseas. For EU nationals a disclosure that is similar to the UK DBS will be required, for those countries for which checks are not available, the council will require a certificate of good conduct authenticated by the relevant embassy.

18.2 If an applicant has spent six continuous months or more overseas (since the age of 16) the council will expect to see evidence of a criminal record check from the country / countries visited covering the period.

19 Summary

19.1 Whilst a criminal history in itself may not automatically result in refusal and a current conviction for a serious crime need not bar an applicant permanently from becoming licensed, in most cases, an applicant would be expected to have remained free from conviction for 3 to 10 years (detailed above), before an application is likely to be successful. If there is any doubt about the suitability of an individual to be licensed, the Council will be mindful of the need to protect the public and caution will be exercised.

19.2 While it is possible that an applicant may have a number of convictions that, individually, do not prevent a licence from being granted, the overall offending history will be considered when assessing an applicant’s suitability to be licensed. A series of offences over a period of time is more likely to give cause for concern than an isolated minor conviction. Some discretion may be afforded if an offence is isolated and there are mitigating circumstances, but the overriding consideration is the protection of the public.

Important Information (please read carefully) This forms part of the Terms and Conditions for your Assessment

For the test to take place you must;

• Bring your photocard driver’s licence with you; this must be presented before the Assessment. • Your licence should be at your current address and in date. • If you have the older style paper licence, then you will need to bring an acceptable form of photo identification such as a passport. • Eyesight must conform to current legislation (20m / 68ft) so if you require glasses /contact lenses then bring these with you. • You must provide a vehicle for the Assessment. • The vehicle must be right hand drive, in a roadworthy condition and comply with current road legislation i.e. taxed, insured for the purpose of the Assessment, and fit for purpose i.e. for carrying passengers. • Interior of the car should be clean and free of all types of litter and clutter. The examiner will not be expected to conduct a test sat in a dirty seat and will be at liberty to terminate the test should the car interior be in a dirty or cluttered state • Be punctual, if you are later than 5 minutes the Assessment may be cancelled at the discretion of the Assessor and you will still be charged the full fee. • Appropriate footwear should be worn, for example, no flip flops, sandals or high heels.

The Assessment

Please allow 1 hour for the assessment. You will be asked 2 maintenance related questions (show me / tell me) and be expected to drive for approximately 45 minutes on a variety of road types and be asked to perform 2 reversing manoeuvres with the possibility of an emergency stop. You will be asked to drive independently of directions for a 10 minute period following road signs and directions to a particular destination. There will be a 10 to 15 minute debrief at which point you will be advised of the result.

A maximum of 9 minor driving faults are allowed. If you exceed 9 minor driving faults or commit any serious or dangerous faults, this will result in a failure.

Please note that if you take your Assessment in an automatic, you may not be licenced by your authority to drive a manual vehicle.

From time to time, a Senior Assessor may sit in during an Assessment for quality control purposes.

You may cancel or change the appointment date up to 5 working days prior to the test without incurring costs other than forfeiture of the credit card surcharge (if any) if you cancel. If you do not give the required notice, you will not receive any refund whatsoever and re-booking will attract the full fee.

GUIDANCE ON THE KNOWLEDGE TEST FOR NEW APPLICANTS

HACKNEY/PRIVATE HIRE DRIVERS: MAY 2018

All new applicants have to pass a Knowledge Test which covers local knowledge about the Mole Valley District area, licensing conditions and the Highway Code for the UK.

The test will be oral, in English, and will last for approximately 45 minutes.

When you are ready to take the test, please phone the Licensing Department to make an appointment on 01306 879234 at least 3 weeks before you intend to take the test.

The test will be in three parts. If you pass part of the test but fail another you will not need to retake that part again provided you pass with 12 months. If you fail any part of the test you will be allowed to return on two occasions within 12 months to retake that part. Part 1 of the test is split into 2 section (routes and locations) – to complete part 1 of the test you will need to pass both section a and b.

This supplement provides guidance and information on the layout of the proposed test.

Part 1a – Understanding the area (Routes)

• You will be asked to demonstrate knowledge of the local area by showing you are familiar with local routes

• You will need to answer 4 out of 5 questions correctly.

• You will be asked to describe the shortest route from any of the start locations listed below to any of the destinations listed below. Please make sure you are familiar with all of the key locations in the Mole Valley district.

Example Answer;- You MUST NOT use a hand-held mobile phone, or similar device, when driving, except to call 999 or 112 in a genuine emergency when it is unsafe or impractical to stop. It is far safer not to use a hands-free device while you are driving - find a safe place to stop first or use the voicemail facility and listen to messages later.

Study Tips

We advise that you obtain a good working knowledge of the local area. Spend time in the local area and studying maps; using the internet and/or the telephone directory to research the names of the roads on which local landmarks or bars, restaurants, schools etc. are situated; and re-familiarising yourself with the Highway Code.

CONDITIONS IMPOSED ON THE GRANT OF A HACKNEY CARRIAGE OR PRIVATE HIRE VEHICLE DRIVER’S LICENCE

1. The licence holder shall at all times when acting as driver of a hackney carriage or private hire vehicle:

a) conduct him/herself in a civil or orderly manner and comply with the reasonable requests of passengers in the vehicle;

b) take all reasonable precautions to ensure the safety of persons conveyed in or entering or alighting from the vehicle;

c) dress respectably and neatly;

d) (i) convey a reasonable quantity of luggage if so required by the person hiring the vehicle; (ii) give reasonable assistance in loading and unloading the luggage; and (iii) give reasonable assistance in removing luggage to or from the entrance of any place at which he may take up or set down a passenger.

e) not carry in the vehicle more than the number of passengers specified in the vehicle licence.

f) The driver will be required to pass the Driving Standards Agency Private Hire and Hackney Carriage Test Assessment if their driving is brought into question by complaints to Mole Valley District Council or motoring convictions and their licence will be suspended until such time as proof of passing the DSA Test Assessment is produced.

2. The licence holder shall at all times comply with the lawful instructions of an Authorised Officer of the Council concerning any matter relating to his/her occupation as a hackney carriage or private hire vehicle driver.

3. The licence holder shall notify the Council in writing as soon as possible and, in any event, within one month of any:

a) Change of address; b) Illness or injury affecting his/her fitness to drive in any way;

4. The licence holder shall notify the Council in writing within five working days of receiving a driving licence endorsement, fixed penalty notice, warning, reprimand, police caution, criminal conviction or other criminal proceedings (including their acquittal as part of a criminal case).

5. The driver shall wear his/her identity badge conspicuously at all times while working.

CONDITIONS RELATING TO PRIVATE HIRE VEHICLES ONLY a) The licence holder shall not display signs, call out, stand with the vehicle at a Hackney Carriage rank or do anything else whatsoever which is likely to give any person the impression that the vehicle is available for hire as if it were a Hackney Carriage. b) The licence holder shall not carry any person in the vehicle during a hiring without the express permission of the hirer. c) When the vehicle has been hired to be present at an appointed time and place the driver shall, unless delayed by some sufficient cause, punctually attend the vehicle at that time and place.
