Bidding Process

1. E-Tenders (Online Bids) are invited in two-tier system (Technical Bid and Financial Bid) from Individual/Firm/Company for Providing various Services/Licenses for 26th Mango Mela, 2017 to be held from 8th July to 9th July, 2017 at Yadavindra Gardens, Pinjore strictly on terms and conditions mentioned in Tender Document for the following activities: S. Tenders are to be submitted in Physically Form also containing the Tender Fee, EMD and Technical Bid only and are to be put up in Envelope to be superscribed as “Tender for (Name of Activity) – 26th Mango Mela, 2017” and to be addressed to the Divisional Manager, Pinjore Gardens and be submitted at Yadavindra Gardens, Pinjore or Head Office, SCO 17-19, Sector 17-B, . 3. Initially the technical bids will be opened electronically and the financial Bid will be opened electronically only of Technically Qualified Bidders. 4. The bidders are required to deposit the Tender Fee (Non- refundable), EMD (Refundable) in the shape of demand draft/cash receipt in favour of Haryana Tourism Corporation, Pinjore as mentioned in Schedule of Tender Fee and EMD (Page No. 3). FD/Cheques will not be accepted. 5. Tenders received without Tender Fee and Earnest money will be rejected out rightly. Earnest money deposited by the unsuccessful tenderers will be refunded. In the case of successful tenderer, earnest money will be converted in the form of Security Deposit and it will be forfeited in case the successful tenderer refuses to accept the award of contract or fails to complete the required formalities and fails to deliver the work

assigned within the specified and permitted time. The security will be refunded only after the Mela is over provided there is no contravention in running of the contract and no violation of the terms and conditions of the contract. 6. The bidders who are desirous of participating in e-tender shall upload the Technical and Financial bids in the formats prescribed in the tender document. 9. Financial Bid be Opened ONLINE only at Head Office, SCO 17- 19, Sector 17-B, Chandigarh of the Bidders submitted ONLINE and found technically qualified as per the Technical Qualification Criteria mentioned in Tender Document. 10. Tender shall be uploaded as per guidelines indicated in e- procurement portal i.e. http://etenders.hry.nic.in. The prospective bidders are expected to examine all instructions, General and specific Terms conditions given in the Tender document. Failure to furnish all information /documents as asked for in the bid document or submission of a bid not substantially responsive to the bid document in every respect will be at bidders risk and may result in rejection of its bid. 11. The bids are required to be uploaded as per the guidelines indicated for e-procurement as given on website http://etenders.hry.nic.in. The validity of the bid will be for a period of 90 days from the date of opening of bids or for a otherwise specified time. 12. The prospective bidders are required to quote for all the items given in the Financial Bid and the tender will be awarded to the overall lowest bidder. 13. General Terms and Conditions 1. Each activity/job has to be provided and made operational strictly as per specifications and schedule. 2. No subletting will be permitted. 3. The tenderer must give rates as per the proforma of Financial Bid including the applicable Taxes, EPF, ESI etc. separately. 4. The rates can be negotiated with the Lowest Bidder (L-1) for Item No. 1 to 4 and Highest Bidder (H-1) for Item no. 5 to 7 if necessary . 5. If Tenderer/service provider fails to supply the ordered quantity or fails to make the services fully operational as per the requirements, specifications and time schedule all the equipments lying at site will be confiscated and alternate arrangement will be made at the risk and cost of the Tenderer. Further, the EMD alongwith security deposit, if any, will also be forfeited. The said firm will also be blacklisted. 6. Every Service Provider will supply a list before start of the mela, of its team members/employees showing their names, addresses and photographs for the purpose of issue of photo identity cards as well as for Police Verification. No substitution of the employees will be allowed except in emergent cases and that too with the prior approval of management in writing. Further, a list of its employees as well as the substituted/changed employees to be deputed for the Mela duty, showing their names, addresses and photographs has to be supplied for the purpose of Police Verification. 7. The Agency/Service provider will solely be responsible for maintaining the proper record of employees/persons provided for various activities for the Mela and for payment of all emoluments/wages as per the statutory requirement/labour laws. The HTC will not be responsible for payment of the wages and compensation etc., if any, to the manpower deployed by the Service provider. 8. The rates will remain valid till the Mela is over. 9. The Agency/Service provider will pay all taxes and levies in force at present or that may be levied by the appropriate authorities at any time during the license period and the Licensor will not bear any liability on this account. 10. That any dispute arising out of these terms and conditions will be referred to the sole arbitration of the Managing Director, Haryana Tourism who may himself act as Arbitrator or appoint any serving or retired officer or any other person to act as Arbitrator on his/her behalf. Arbitrator will be governed by the provisions of the Arbitration & Conciliation Act-1996, as amended from time to time. The appointment of any person as Arbitrator will not be invalidated merely on the ground of his being associated with Licensor as one of its Officers in any capacity whatsoever. However, all disputes will be subjected to the jurisdiction of the local courts or the courts situated at . 11. Incomplete, conditional tender and the tenders without Tender Fee and EMD in specified mode are liable to be rejected out rightly. 12. 15-20 % extra work on total bill will be compensated / borne by the firm without any charges. 13. The H.T.C. reserves the right to increase or decrease the S.O.W. and quantities may vary from time to time as per the instructions given by the authorities. 14. Each activity/job has to be provided and made operational as per specifications and schedule. 15. Smoking, consumption of liquor, and chewing of tobacco etc. by the staff of the service providers are totally banned. 16. That the Service Provider/Agency will engage trained staff for the conduct of business and will bear their salaries/wages etc and will ensure due compliance of the applicable Labour Laws and other applicable laws. The said staff has to be courteous and well mannered with the customers/ visitors. The Service Provider/Agency will be fully responsible for the conduct and behavior of his employees and loss of reputation or property if caused by the nuisance created by the licensee or his employees in relation to the running of business and dealing with customers the same will be indemnified by the licensee to the licensor. Child labour will not be permitted.

Specific Terms and conditions:

The work will be completed one day earlier before the festival for inspection of authorities.

SPECIFIC TERMS & CONDITIONS: 1. The flower decoration shall be done according to approved designs. 2. The samples of all the flowers, floating candles, bouquets, balloons, etc to be got approved from the Architecture cell before the execution by the firm. 3. The rates quoted shall inclusive of the labour and transportation. 4. The flower decoration shall be done according to approved design. 5. Good quality of flowers will be used and the firm shall get the samples approved of all types of flowers to be used for this job. 6. Colour of the cloth frill, tissue cloth etc. to be used in Gazibo and decoration to be got approved from the Architect, HTC at site. 7. Gazibos, Buffet canopy, tissue cloth decoration and Urli chowki decoration shall be quoted for one time installation as well as rent on per day basis, if retained for some days. 8. Good quality of flowers should be used and the firm shall get the samples approved of all types of flowers to be used for this job. 9. The timings for making the individual areas of garden ready with flower decoration will be informed/should be enquired by the Florist from the Architecture cell from time to time. 10. The supplier shall be responsible for supplying the materials / decorations / preparing the gates as per the

Raw Data (Soft Copy) of all Digital Photography will be in tiff format in high resolution with all required digital enhancement like JPEG in hard Disk and Photographs on DVD whenever required ( for VVIP / VIP and guests) will have to be provided )

Specific Terms & conditions

1. The agency has to install its own requisite Computer System and laptop , UPS, printer and accessories (as required) alongwith requisite Software in the Media Centre for Editing alongwith Editors. 2. The duly uniformed teams for Still Photography and Videography will have to report to DDO, HTC, Pinjore daily at 8.00 AM and be available in the Mela till the end of all activities and events of particular day.

3. The soft copy of selected photographs are to be given in the media Centre for purpose of issue of Press releases for the day. 4. The Still and Videography will be the property of Haryana Tourism same is to be handed over back. 5. The service provider has to be taken for proper coverage of all activities / events of the Mela . 6. In case more / extra teams for Still Photography and Videography are required on any particular day or work, approval in writing be obtained for the same otherwise any claim for extra payment will not be entertained. 7. The record of the coverage of the Mela is required to be preserved by the service provider at least for 3 years. 8. The Service provider will keep a Cordial Relation with Activity Incharge and take day to day briefing. 9. The original and unedited still / video shoots are the property with of the HTC and are supposed to be handed over to the mela Authority immediately after the mela is over. 10. Final Still copies / duly edited & Vice Over DVD etc are required to be given within 21 days of the last day of the Mela . 11. The staff deputed for the Photography and for Videography will be in uniform wearing Photo I/ cards etc for quick identification. 12. Two sets of the selected still photographs ( Soft copy in the form of DVD / Hard Disk ) and two sets of the DVD / Hard Disk of the entire Videography are to be given free of cost after the mela is over. 13. The Lodging / Boarding arrangement will be made by Service provider himself.
