Department of Child Development, Department of Women Development & Social Welfare Government of 1 2 Operational Guidelines for West Bengal on Rescue, Safe Return & Repatriation of Women & Child Victims of Trafficking & Cross Border Movement from Bangladesh

The National Task Force on Human Trafficking is made up of many agencies committed to a collaborative effort to identify and rescue victims, prosecute offenders, restore victims of human trafficking, in both sexual and labour exploitation. Representation includes, but is not limited to: Home Ministries, Women and Child Development Ministries, Labour & Employment Ministries, Ministry of External Affairs, State Crime Investigation Department (CID), Central Bureau of investigation (CBI) and Non- governmental Organizations (NGOs). The State Task Force will be serviced by the Women and Child Development Department of the State Government. The West Bengal Task Force headed by the Secretary, Women and Child Development will have representatives from the CID, Directorate of Social Welfare, Home Department, Ministry of External Affairs, Police, (BSF), Child Welfare Committee (CWC), NGOs and UNICEF has been functional since 2008. The Director, Social Welfare is the Member secretary of the Task Force and the Secretariat is based in the office of Directorate of Social Welfare. Based on the National Standard Operating Procedure (SOP) for Repatriation of Trafficked Child Victims between Bangladesh and developed by Ministry of Home Affairs (MHA), the role of the West Bengal Task Force and guidelines for rescue, return and repatriation has been drafted. The overall objective of the West Bengal Task Force against Human Trafficking is to counter trafficking in human beings through preventive and protective activities. The Task Force shall carry out the following activities: (i) Shall coordinate activities of Govt. Departments and Agencies regarding implementation of Policies involving the inter-state trafficking in persons to engage in efforts to facilitate cooperation among States/UTs involved as an origin, transit, or destination. Such effort shall aim to strengthen local capacity to prevent trafficking, generate awareness among community and all other stakeholders regarding risks of trafficking, cross-border mobility and necessary steps to be taken to prevent the same, prosecute traffickers and assist trafficking victims, and shall include initiatives to enhance cooperative efforts between destination and origin states/UTs. (ii) Monitor the progress of the repatriation of rescued women and children to the State/UT/Country of origin. It shall also monitor the progress of prosecution of traffickers.

3 (iii) Measure and evaluate progress of the AHTUs in the areas of trafficking prevention, protection, and assistance to victims of trafficking, and prosecution and enforcement against traffickers. (iv) Update procedures to collect and organize data, including significant research and resource information on human trafficking. Any data collection procedures established under this subsection shall respect the confidentiality of victims of trafficking. A proper MIS to be developed showing real time data on status of rescued children until the date of repatriation. (v) Engage in consultation and advocacy with Governmental and Non-Governmental organizations, among other entities, to advance the goal of Human Trafficking prevention. (vi) Formulate a policy for rehabilitation of rescued and repatriated children (from Bangladesh to India) and ensure necessary convergence between different government departments, PRIs and NGOs for the same. (vii) Facilitate/Initiate through competent/appropriate redressal authority, thorough investigation in case of any report of misconduct or violation of human rights and child rights by any of the agencies responsible for rescue and repatriation. (viii) Review existing safety protocols for children during rescue and repatriation and provide necessary suggestions for improvement. The procedure to be followed is as follows: 1. A child/woman victim/potential victim of cross border trafficking is rescued by the Police, Border Security Force (BSF), CHILD LINE, Non-Government Organization (NGO) and immediately after a foreign national is apprehended on charges of human trafficking, a detailed interrogation/investigation should be carried out to ascertain whether the person concerned is a victim or a trafficker.(vide Ministry of Home Affair’s Advisory dated 1.5.2012 No.14051/14/2011-FVI) 2. The child is produced before the Child Welfare Committee (CWC) within 24 hours and sent to any Children’s Home run by government or NGO. If the foreign identity of the child is revealed [child victim/potential victim of trafficking/a Child in need of care and protection (CNCP) as defined in the Juvenile Justice (Care and Protection of Children) Act, 2000] the child will be placed before the Child Welfare Committee (CWC) and sent to the government /NGO run children. After investigation If a child of Bangladeshi origin is apprehended with fake currency or with arms or in any such activities, they need to be considered as Juvenile in Conflict with Law (JCL) and should be produced before the Juvenile Justice Board (JJB). Any other child except the aforesaid

4 category whose foreign identity is revealed should be placed before CWC. If the child cannot be produced within 24 hours for any valid reason, the child will immediately be placed in the nearest children home run by the Government or NGO / with a fit person / fit institution prior to production of the child before CWC/JJB. 3. If, after investigation, the foreign identity of the child is ascertained and found to be a victim of trafficking, he/she should not be prosecuted under the Foreigners Act (vide MHA’s Advisory dated 1.5.2012 No.14051/14/2011-FVI) and the child be transferred from JJB to CWC and subsequently be placed in Children’s Home within [1 week] 4. Interview of the child is conducted in the Home by the counselor/ probation officer/ social worker or any member of CWC, in the presence of an Interpreter, to gather other information relevant to family tracing and case planning. In this regard setting-up a child –friendly corner for interviewing children can be done. 5. The Home Superintendent (Govt./NGO) with the help of social workers/ probation officers/ District Child Protection Society will upload the date in Form – J (child in distress) for a child and in Form R (Form for Recovered Persons) for a recovered adult on to the portal and database 6. Data regarding the case history in Form 20 and Individual Care Plan in Form 21 will also be uploaded on to the web portal victim database 7. A request will be sent to the respective State Task Force Secretariat for the address verification of the trafficked person in country of origin with copies to the relevant authorities (i.e. District Superintendent of Police (SP DIB), District-Magistrate, Director (Social Welfare/Women & Child Development), West Bengal Task Force Secretariat, Home F&NRI, and with all the documentation relating to the case confidentially. The operational guideline includes a structure of the West Bengal Task Force with names and contact numbers of important stakeholders like, H & FNRI, BSF, CID, NGOs as annexure. [Point No: 5+6+7= 1 week]. 8. The State Task Force Secretariat/Cell will send a request for identity/address verification with necessary documents to Branch Secretariat of Ministry of External Affairs (MEA) at Kolkata through Home F&NRI with intimation to the National Task Force at the MHA. [1 week] 9. The Branch Secretariat of MEA at Kolkata will send the requisition to the Deputy High Commission of Bangladesh in Kolkata with intimation to the BSM Division of MEA. [2 weeks] 10. The State Task Force Secretariat as well as the National Task Force will regularly review the progress regarding the identity/address verification. The National Task

5 Force Secretariat in the Ministry of Home Affairs, will monitor progress with the Bangladesh Government Task Force on Anti-Human Trafficking and take up outstanding cases with the Bangladesh High Commission in New Delhi. The State Task Force will also coordinate with Bangladesh Task Force with intimation to National Task Force. Status of each case would also be available on the Anti- Human Trafficking portal of MHA. 11. Bangladesh Deputy High Commission (BDHC) will expedite family tracing through its institutional arrangements and inform back within 45-60 days [8-9weeks] Or The Bangladesh High Commission will/may also issue the temporary travel documents. 12 The entire set of travel documentation is then sent to the State Home Department with intimation to the State Task Force. The State Home Department (F&NRI) will give a no-objection certificate (NoC) to the return of the trafficked person and intimate the Superintendent of Police (District Intelligence Bureau) [S.P (DIB)]. The Shelter Home in-charge will issue the Release Order on intimation by the S.P (DIB) of the district and shall send a copy of this release Order to West Bengal Task Force Secretariat. [1 week] 13. The NGO/GO Shelter Home in-charge will keep the trafficked victim ready with all relevant documents required during departure (like case files includes individual care plan, education & vocational skills imparted to the victim during her stay in NGO/GO Shelter Home, counselling reports, medical reports, case history and handing over other belongings includes money, mobile, jewellery etc to the victim). 14. The West Bengal Task Force Secretariat will take up with counterpart Task Force or NGO as nominated by the Task Force in Bangladesh for the safe reception of the trafficked victim and inform the SP (DIB ) about the arrangement for the safe return process based on which the SP(DIB) will initiate the return of the victim. 15. The Director of Intelligence Bureau (DIB) in consultation with BSF, West Bengal Task Force Secretariat and selected NGO will arrange for transportation of the child along with the case file to Border for repatriation by land to be handed over by the BSF to the Border Guards of Bangladesh (BGB) in the presence of BSF & NGOs of both side within [4weeks] with intimation to the State Task Force and the National Task Force. Incidental expenditure for the transportation can be met out of the AHTU funds. NGOs receiving funds under the Ujjawala scheme of the Ministry of Women and Child Development also provides for expenditure of the victim and escort which can also be tapped.

6 15. A summary of the long term plan developed by the assigned NGOs/ Govt. Shelter Home is also to be shared with the both countries to ensure continuity of care and services after trafficked person returns to their countries. 16. During the hand over process all documents related to victim’s case including the case file which includes individual care plan ,education & vocational skills imparted to the victim during her stay in NGO/GO Shelter Home, counselling reports, medical reports, case history should also be handed over to the respective counterparts and they should be briefed about the case. 17. Repatriation by air will not be taken up unless if there are exceptional circumstances. 18. In case of children, if required, they shall be accompanied with by an interpreter- cultural mediator until s/he is handed over to a suitable person from an NGO of country of origin. A list of interpreters with phone numbers should be available with at all Panchayats, BSF outposts, CWC and office of DMs. 19. Immigration authorities of two countries should handle according to Human Rights compliance. 20. After the safe handover, IG BSF/BGB will send the copies of the notes to the RRRI Task Force/National Task Force for filing and recording with a copy to the High Commissions within 14 days. (2 weeks) Total time taken for return and closing of file: 21 weeks for closing. Notes :- l All correspondence regarding repatriation of Bangladeshi children must be sent to the Additional DG (East), Border Security Force, 20/1 Gurusaday Dutta Road, Kolkata -700019 , with a copy marked to concerned inspector general for a quick decision in future. l After the Child in Conflict with Law (CCL) becomes legally free from JJB s/he attains the status of CNCP and the process of repatriation as given in the aforesaid SOP should be followed for her/his safe return to her/his country of origin. l West Bengal Task Force being a nodal body for Rescue-Recovery-Repatriation & Integration will facilitate the process of repatriating Bangladeshi victims of trafficking and cross border movement. Thus CWC /JJB cannot issue suo moto order for repatriation. The West Bengal Task Force has to be kept in the communication loop. l Instances where the parents of minor victims are in correctional homes may be treated as special cases. In these situations the children can be released with their parents by obtaining a valid travel permit and No Objection Certificate.

7 l The information regarding children of Bangladeshi victims who are born in India to be informed to Ministry of External Affairs and Home (F &NRI) Department, CWC along with West Bengal Task Force.

l In case of a death of Bangladeshi victim after confirmation of nationality verification, the body should be sent with due respect as per the standard immigration protocol and this matter will also be taken up with Ministry of Home Affairs, GOI. In case where the nationality of the victim has not been confirmed, the body will be cremated with due respect in the country

21 Annexure VII : MHA Advisory on Preventing and Combating Human Trafficking in India dealing with Foreign Nationals

Sub : Advisory on preventing and combating human trafficking in India dealing with foreign nationals.

The undersigned is directed to refer to this Ministry’s Office Memorandum No. 15011/6/2009ATC (Advisory) dated 09.09.2009 on the above mentioned subject (copy enclosed). It has come to the notice of this Ministry that foreign nationals are associated in some instances of human trafficking among women and children. 2. Further to the detailed procedure outlined in the above mentioned Office Memorandum, it has been decided with the approval of the competent authority that in cases of foreign nationals who are apprehended in connection with human trafficking, the State Governments/UT Administrations may follow the following procedure : (i) Immediately after a foreign national is apprehended on charges of human trafficking, a detailed interrogation/investigation should be carried out to ascertain whether the person concerned is a victim or a trafficker. (ii) The victims and the persons actually involved in human trafficking should be treated differently by the police authorities. This is in line with the SAARC Convention which advocates a victimcentric approach. (iii) Missions/Posts in India may be informed of the arrest/detention of the foreign national by the concerned state or other authorities through CPV division in the Ministry of External Affairs(MEA) or the concerned territorial Division in MEA. (iv) It is seen that in general, the foreign victims of human trafficking are found without valid passport or visa. If, after investigation, the woman or child is found to be a victim, she should not be prosecuted under the Foreigners

22 Act. If the investigation reveals that she did not come to India or did not indulge in crime out of her own free will, the State Government/UT Administration may not file a charge sheet against the victim. If the chargesheet has already been filed under the Foreigners Act and other relevant laws of the land, steps may be taken to withdraw the case from prosecution so far as the victim is concerned. Immediate action may be taken to furnish the details of such victims to the Ministry of External Affairs (Consular Division), Patiala House, New Delhi so as to ensure that the person concerned is repatriated to the country of her origin through diplomatic channels. (v) During the interim period, pending repatriation, the victim may be taken care of in an appropriate children’s home, or “Ujjawala” home or appropriate shelter home either of the State Government concerned or of any NGO aided by the Government of India/State Government. (vi) If the investigation reveals that the person is actually a trafficker, he/she may be chargesheeted under the Immoral Trafficking Prevention Act and the Foreigners Act and due process of law should be followed in such cases. (vii) In order to ensure better conviction rates of perpetrators of the crime of trafficking, prosecution should be based on documentary, forensic and material evidence. State Governments are advised to encourage the law enforcement agencies to investigate the cases in a manner that they are able to build fool proof cases against the traffickers, so that convictions can be guaranteed. Use of fast track courts and video conferencing to the extent possible also need to be ensured. Please refer to para 7 of the enclosed Advisory dated 9.9.2009. 3. All other instructions contained in this Ministry’s Advisory dated 09.09.2009 including reporting to the Anti Human Trafficking Nodal Cell in MHA will be applicable in the case of foreign nationals associated with human trafficking, whether they are women or children (children means both boys and girls upto 18 years of age). 4. You are requested to issue suitable directions to all concerned under intimation to this Ministry. 5. The receipt of this Office Memorandum may kindly be acknowledged. (G.V.V. No. : 4257-SWJJA–18/2007 Dated : Kolkata, 14th December, 2007 ORDER 1. A good number of Bangladeshi Children are apprehended every year in different parts of India including the State of West Bengal. Many of these children are, actually, victims of trafficking. Their repatriation to their native country takes unduly long time though their cases are disposed of by the Juvenile Justice Boards/ the Child Welfare Committees under the provisions of the Juvenile Justice (Care & protection of children) Act, 2000 amended by the Juvenile Justice (Care & protection of children) Amendment Act 2006. As a result of the inordinate delay in the process, the repatriation of the children (has been) effected. 2. With the objective of ensuring speedy repatriation of Bangladeshi Child Victims and reducing the period of unnecessary detention in homes under the aforementioned Act, the UNICEF, India has recently organized two bi-lateral meetings between the concerned authorities of India and Bangladesh. It was decided, inter-alia in the second bi-lateral meeting that both the Govts would set up Focal Points and Task Forces in this regard. 3. The Governor is, therefore, pleased to form a Task Force for the State of West Bengal, consisting of the following officials and functionaries: 1. The Pr.
