Varricchio, J., November 5, 2014. This case was transferred to Lehigh County on April 1, 2013. Plaintiff, Margaret Denzel (Plaintiff ) alleges that on February 12, 2010, she sustained injuries 10 Lehigh 7-17 op Denzel vs. Federal Cleaning Contractors et al. 641 at The Promenade Shops at Saucon Valley, a shopping center. Denzel claims that she slipped on the sidewalk in front of The Children’s Place store due to “certain elevations and accumulations of hills and ridges of ice and/or snow.” Compl. ¶¶15-16. Plaintiff sued the owners and management entities of the shopping center, Prudential Investment Management, Inc. (Pru- dential), Poag & McEwen Lifestyles Centers, LLC (Poag), and The Promenade Shops at Saucon Valley (Promenade). Plaintiff also sued Federal Cleaning Contractors, Inc. (Federal) and J. Foster & Sons (Foster), the two contractors who performed side- walk snow removal at the shopping center. Federal Mot. for Summ. J. 2. The Promenade is an outdoor shopping mall, approximately 475,000 square feet. The Promenade Shops consist of several large buildings with various stores, each with their own exterior entrance. The stores are bordered with wide sidewalks along two-lane drive- ways. Prior to Plaintiff ’s fall, a snowstorm brought 17 inches of snow to Allentown starting at 7 p.m. on February 9, 2010 until 7 p.m. on February 10, 2010. Due to the magnitude of the storm, Fed- eral performed snow removal and salting activities for three days, from February 10, 2010 through February 12, 2010. At the time of Plaintiff ’s fall, Federal still had four employees on duty. Foster had laborers working the same time period, including six at the time of Plaintiff ’s fall. Plaintiff is a school librarian in the North Penn School District, which was closed February 11 and 12 due to snow-day cancella- tions. Due to the snow day, Plaintiff did not have to work and was packing for a vacation to Arizona. She drove to the Promenade to buy sneakers for her trip the following day. She went to the Sneaker King and purchased a pair of shoes. The sidewalks were “absolutely clear on her path into Sneaker King.” Plaintiff alleges the “whole front looked perfect” and dry. Denzel Dep. 39:22-40:6, March 6, 2014 (Dep.). After her purchase, Plaintiff was headed to Ann Taylor Loft to see if there were any big sales. She had no specific need, but just wanted to browse. Dep. 168. She was carrying a purse and her 11 Lehigh 7-17 op 642 Denzel vs. Federal Cleaning Contractors et al. newly purchased sneakers in a plastic bag. Dep. 30, 43:19. Imme- diately prior to her fall, Plaintiff saw a clean-up crew and that the area she was headed towards had snow and was “not cleaned up.” Dep. 44:5-13. After turning the corner, Plaintiff slipped and fell in front of the Children’s Place store. She saw the snow and the ice ahead of her and fell while attempting to negotiate around it safely. The Children’s Place was a party to this suit; however, a stipulated dismissal was filed on June 3, 2014. Plaintiff fell on the sidewalk, and while she was supine and waiting for the ambulance, took photos of the area. She believed she slipped on black ice, and said if she could have seen it, she would “not walk on a chunk of ice.” Dep. 47:13-17. Plaintiff stated “As I got to the corner, I saw that there was snow—I knew I was going to have to be careful because it was snow and ice there at the end there.” Dep. 171. After Plaintiff ’s fall, Allied Barton Security filed an incident report at 11:11 a.m. on Friday, February 12, 2010. Federal Mot. for Summ. J. 3. On the incident report “voluntary statement made by complainant,” reads “I should have stayed home. This place is a mess.” Dep. 89:13-16. At her deposition, Plaintiff was asked if she saw the patches of snow and ice before her fall, and replied “I guess I could see that is was in front—it was off in front of me.” Dep. 53:5-6. Plaintiff did state she knew she would have to be careful, but decided to proceed. Defendants, Federal, Prudential, Poag and Promenade filed a Motion for Summary Judgment on July 8, 2014 and Defendant, J. Foster and Sons, Inc. filed a Motion for Summary Judgment on July 9, 2014. Plaintiff responded on August 5, 2014 and argument was held August 18, 2014. Summary Judgment Summary judgment should be granted if there are no genu- ine issues of material fact and the moving party is entitled to judg- ment as a matter of law. The moving party bears the initial burden of establishing the absence of a genuine issue of material fact. Boyer v. Walker, 714 A.2d 458 (Pa. Super. 1998); Pa. R.C.P. 1035.2. 12 Lehigh 7-17 op Denzel vs. Federal Cleaning Contractors et al. 643 In determining whether to grant summary judgment, the “trial court is required to take all facts of record, and all reasonable inferences therefrom, in a light most favorable to the non-moving party.” Thompson v. Ginkel, 95 A.3d 900, 906 (Pa. Super. 2014). Once the moving party has met its burden, the non-moving party must go beyond the pleadings and identify specific facts through admissible evidence that show a genuine issue for trial. Conclu- sory or speculative testimony in affidavits and moving papers is insufficient to raise genuine issues of fact and defeat summary judgment. Weible v. Allied Signal, Inc., 963 A.2d 521 (Pa. Super. 2008). Without evidence of facts that would allow a plaintiff to make out a prima facie case, the cause of action must be dismissed. Fazio v. Fegley Oil Company, Inc., 714 A.2d 510, 512 (Pa. Commw. 1998). In the instant case, the Complaint alleges that Defendants failed to maintain safe walkways for their business invitees. Plain- tiff ’s Complaint sets forth a cause of action against the Defendants for negligence. To maintain a cause of action for negligence a plaintiff must show the existence of a legal duty or obligation; a breach of that duty by the defendant; a causal connection between the breach and injury and actual loss or damage. Orner v. Mallick, 515 Pa. 132, 135, 527 A.2d 521, 523 (1987). Hills and Ridges Doctrine Plaintiff alleged in her Complaint that she slipped and fell due to “certain elevations and accumulations of hills and ridges of ice and/or snow.” In Pennsylvania, the “hills and ridges doctrine” protects a possessor of land from liability for generally slippery conditions resulting from recent ice or snow precipitation where the possessor has not permitted the ice or snow to unreasonably accumulate. Morin v. Traveler’s Rest Motel, Inc., 704 A.2d 1085, 1087 (Pa. Super. 1997). A “prerequisite to the application of the ‘hills and ridges’ doctrine is a finding of generally slippery condi- tions as opposed to isolated icy patches.” Id. at 1088 (internal cita- tion omitted). Here, there are concentrations of snow and ice on portions of the sidewalk. Plaintiff claimed “I saw the snow and ice in small, like, patches scattered around.” Dep. 171:23-24. The sidewalk that 13 Lehigh 7-17 op 644 Denzel vs. Federal Cleaning Contractors et al. she traversed to get to Sneaker King was clear and dry, in contrast to Morin, where the entire parking lot was coated by black ice due to freezing rain. Accordingly, the hills and ridges doctrine does not apply in this case. Plaintiff Knowingly and Voluntarily Assumed the Risk All Defendants claim they owed no duty to Plaintiff because Plaintiff assumed the risk of injury from a known and avoidable injury. As such, they claim that there are no genuine issues of material facts as to this negligence claim and that summary judg- ment should be granted. The doctrine of assumption of the risk relieves a defendant of its duty to protect a plaintiff where plaintiff has voluntarily and deliberately proceeded to face a known and obvious risk and is considered to have assumed liability for her own injuries. The question of duty is an issue of law for the court to decide. Sharpe v. St. Luke’s Hospital, 573 Pa. 90, 96, 821 A.2d 1215, 1219 (2003). To grant summary judgment on the basis of assumption of the risk, it must be concluded, as a matter of law, that the party consciously appreciated the risk attendant to a certain endeavor, “assumed the risk of injury by engaging in the endeavor despite the appreciation of the risk involved, and that injury sustained was, in fact, the same risk of injury that was appreciated and assumed.” Bullman v. Giuntoli, 761 A.2d 566, 573 (Pa. Super. 2000). Respect- ing conditions on the land, which are known or discoverable by the possessor, the possessor is subject to liability only if he (a) knows or by the exercise of reasonable care would discover the condition, and should realize that it involves an unreasonable risk of harm to such invitee and (b) should expect that they will not discover or realize the danger or will fail to protect themselves against it and (c) fails to exercise reasonable care to protect them against the danger. Restatement (Second) of Torts §343. However, a “possessor of land is not liable to [its] invitees for physical harm caused to them by any activity or condition on the land whose danger is known or obvious to them ... .” Carrender v. Fitterer, 503 Pa. 178, 185, 469 A.2d 120, 123 (1983) (citation omit- 14 Lehigh 7-17 op Denzel vs. Federal Cleaning Contractors et al. 645 ted). A danger is deemed to be “obvious” when both the conditions and the risk are apparent to and “would be recognized by a reason- able person, in the position of the visitor, exercising normal percep- tion, intelligence, and judgment.” Id. (citation omitted). “For a danger to be ‘known,’ it must not only be known to exist, but ... also be recognized that it is dangerous and the prob- ability and gravity of the threatened harm must be appreciated.” Id. at 185, 469 A.2d at 123-24 (citation omitted). Furthermore, the court may decide the question of whether a danger was known or obvious where reasonable minds could not differ as to the conclu- sion. Id. at 186, 469 A.2d at 124. When a plaintiff voluntarily proceeds to encounter a known or obvious danger, she is deemed to have agreed to accept the risk and to undertake to look out for herself. Id. at 188, 469 A.2d at 125. In keeping with these principles, it is established that the of Pennsylvania does not render a defendant a guar- antor of the safety of its business invitees but, instead, charges a proprietor with a duty of reasonable care to make its property safe in circumstances where it cannot reasonably expect an invitee to discover, realize, or protect itself against a danger. See id. at 185, 469 A.2d at 123; Szumski v. Lehman Homes, Inc., 267 Pa. Supe- rior Ct. 478, 485, 406 A.2d 1142, 1145 (1979). [T]he question of assumption of the risk typically re- mains for the jury. Only where the evidence reveals a sce- nario so clear as to void all questions of material fact concern- ing the plaintiff ’s own conduct can the court enter summary judgment; in effect the court determines that the plaintiff relieved the defendant of the duty to guard him from a risk of harm regardless of the source from which the duty derived. Montagazzi v. Crisci, 994 A.2d 626, 636 (Pa. Super. 2010) (citation omitted). There have been two cases where our Supreme Court af- firmed a trial court’s finding that “as a matter of law, the plaintiff voluntarily proceeded in the face of a known risk and absolved the defendant from his duty to protect against the injuries sustained. Howell v. Clyde, 533 Pa. 151, 620 A.2d 1107 (1993) (four justices concurring in this portion of holding); Carrender v. Fitterer, 503 15 Lehigh 7-17 op 646 Denzel vs. Federal Cleaning Contractors et al. Pa. 178, 469 A.2d 120 (1983).” Struble v. Valley Forge Military Academy, 445 Pa. Superior Ct. 224, 229, 665 A.2d 4, 6 (1995) (citation omitted).1 Carrender discusses that land possessors can expect those on their property would avoid obvious and known dangers. The guests are expected to use alternative paths to avoid known and obvious dangers, this “is particularly true where a reasonable alternative way is open to the visitor, known or obvious to him and safe.” In Carrender, a patient parked in the clinic’s parking lot on the only space with a sheet of ice. Nevertheless, the plaintiff, who wore a prosthetic leg, decided not to park her vehicle elsewhere, but to exit her car and walk on the ice, attempting to traverse the ice by holding on to another vehicle to steady herself. Expectedly, the plaintiff slipped and fell on the ice and the Supreme Court held the clinic owners had no duty to the plaintiff because she assumed the risk as a matter of law, particularly in light of the clear conve- nient spaces available in the parking lot. In the case at bar, Plaintiff avers by opening the mall to the public, any reasonable business invitee had the right to assume that the conditions would have been safe and that the Defendant would have acted in accordance with the highest duty of care owed to the business invitees. The first step to determine if Plaintiff as- sumed the risk is to determine whether the risk is known and obvious. To analyze the risk requires whether a reasonable man could appreciate and recognize the risk. The record reveals Plain- tiff is a college graduate of normal perception and intelligence. Dep. 11:19-11:24. Additionally, Plaintiff was aware of the patches of snow and ice in her path. This is evidenced by the following excerpt of the deposition: Q. And when you saw these conditions, you knew they were dangerous?

Did you know they were dangerous? A. I knew I saw snow and ice. Q. Did you know they were dangerous? A. Snow and ice, yes. Yes. ... Q. Knowing that there was a dangerous condition ahead of you, was there any reason why you simply did not turn around and go back to your car? A. I saw patches where I could walk. It wasn’t all snow and ice. There were patches of ice and snow. Dep. 171:25-174:3. Q. Did anything prevent you from simply stepping over it? A. No. Q. Physically you were capable of doing that? A. Yes. Dep. 213:16-21. Plaintiff grew up in Buffalo, and is accustomed to snowy conditions. She is aware snow is slippery and that there is a risk you can slip and fall if you step on ice. Plaintiff stated “I’m familiar with ice.” Dep. 27:4. “I’m acquainted with black ice.” Dep. 59:9-10. She was on the lookout for black ice and walking carefully. Dep. 60:7-14. Common sense dictates that walking on snow or ice bears the risk of slipping, falling, and possibly injuring oneself. Despite Plaintiff ’s admitted knowledge that snow and ice were present and her concern that she might fall, she never asked for help nor did she utilize an alternative path to continue her shopping and safely navigate the shopping area. Instead, the Plaintiff proceeded to walk over the ice and snow in order to continue shopping. It was at that time she slipped and fell, sustaining injuries. Plaintiff alleges she thought what she was doing was safe. However, a reasonable person knows snow and ice are dangerous. 17 Lehigh 7-17 op 648 Denzel vs. Federal Cleaning Contractors et al. Attempting to walk among the patches on the sidewalk, not surpris- ingly, caused her fall. No reasonable minds could disagree that Plaintiff found a dangerous area, and while appreciating the risk, decided to proceed ahead. The photographs Plaintiff took as she laid on the sidewalk show the walkway in this area was substan- tially covered by snow, ice, and slush. Plaintiff may have believed she could hopscotch through the accumulation; however, a reason- able person would not believe it would have been a safe path to walk. Although Plaintiff claims that this does not amount to assump- tion of the risk, common sense dictates that walking on snow and ice bears the risk of slipping, falling, and possibly injuring oneself. Moreover, as our Superior Court had occasion to observe early last century that it “is well known that rain or snow, falling upon the sidewalks of a town or city ... will render them slippery and conse- quently more difficult to walk upon.” Wilson v. Reading Company, 95 Pa. Superior Ct. 570, 573 (1929). Under Pennsylvania law, “There are some dangers that are so obvious that they will be held to have been assumed as a matter of law despite assertions of ignorance to the contrary.” Howell v. Clyde, supra at 158 n.9, 620 A.2d at 1110 n.9. “Ice always is slip- pery, and a person walking on ice always runs the risk of slipping and falling.” Barrett v. Fredavid Builders, Inc., 454 Pa. Superior Ct. 162, 168, 685 A.2d 129, 131 (1996). Here, the Court may decide the question of whether the snow and ice on the sidewalk was known or obvious because reasonable minds could not differ as to the conclusion. Plaintiff ’s deposition testimony clearly indicates that she had actual knowledge of the location of the scattered snow and ice patches, its slippery propensities and the dangers she faced in voluntarily attempting to walk over it. When an invitee enters busi- ness premises and discovers dangerous conditions which are both obvious and avoidable, and [even so] proceeds voluntarily to en- counter them, the doctrine of assumption of the risk operates ... as a counterpart to the possessor’s lack of duty to protect the invi- tees from those risks. Carrender, supra at 187-88, 469 A.2d at 125. By voluntarily encountering the risk, an invitee is deemed to have 18 Lehigh 7-17 op Denzel vs. Federal Cleaning Contractors et al. 649 agreed to accept the risk and to undertake to look out for himself. Consequently, to say a plaintiff assumed the risk of injury of a known and avoidable danger is another way of expressing the de- fendant’s lack of duty to shield the plaintiff from such dangers. Id. at 188, 469 A.2d at 125 (citations omitted). In Havir v. Fountain Hill Development Associates (C.P. Lehigh May 2, 2012), a tenant walked through Fountain Hill De- velopment’s parking lot, which was covered in slush. The tenant fell and was injured. The tenant claimed she did not know ice was underneath the slush, but was aware it was a slippery substance and attempted to walk across it despite that knowledge. The tenant further argued that she did not voluntarily walk through the park- ing lot, as she was required to go to work and did not have any reasonable alternatives. The court held the plaintiff did not prove she was compelled to go to her car, or that she was precluded from safely returning to her apartment. On a motion for summary judg- ment, the case was dismissed because reasonable minds could not disagree that the plaintiff voluntarily proceeded in the face of an obvious and known danger. In the case at bar, Plaintiff was aware of the dangerous condi- tion and was under no compulsion to continue shopping. Plaintiff stated the sidewalk leading from her car to the Sneaker King was absolutely dry and clear. Plaintiff could have turned around and avoided the ice completely. Above all, the Plaintiff did not need to go to the shopping center at all that day, especially considering that the school she worked at was closed because of hazardous climate conditions. Even if she still decided to venture out of her home, she did purchase the item she came for and had no reason not to return to her car and not attempt to walk in an evidently perilous area. The Defendants in this case owed Plaintiff a duty to exercise reasonable care to protect her from conditions on the land which were known or discoverable to them. However, Plaintiff assumed the risk of her injury when she knowingly and voluntarily walked over the patches of snow and ice. As such, the Defendants’ duty to the Plaintiff is discharged. Without proof of duty, Plaintiff can- not establish negligence. He had been Co-Chair of the Stevens & Lee Bankruptcy Group for 17 of those years. “The Magna Carta – Still Relevant After All These Years?” Presented by: John P. Servis, Esq. Wednesday, November 18, 2015 June 15, 2015 marked the 800th anniversary of the sealing of the Magna Carta (Latin for “Great Charter”) by King John. Even the most reluctant students of history tend to remember that 1215 was an important year. Some even associate the year with the document. But what did it say, and should we even care about it in the 21st century?

In this seminar we will look at the background and context of the Magna Carta, its use by England over the centuries, and its veneration by Americans from colonial times to the present day. Is our nation’s legal system truly indebted to this 800 year old document, or is this just another case of excessive Anglophilia?

Attorney John Servis is Chairman of the BALC Continuing Legal Education Committee. He has practiced law in Pennsylvania since 1988. John has a B.A. in classical language from Cornell University, a J.D. from American University, an LLM (Taxation) from Villanova University, and an M.A. in history from Lehigh University. This lecture will examine the highlights of perhaps America’s most brilliant legal career by looking not only at Holmes’ major dissents and decisions but also looking to his life history as being a basis for many of his legal theories. Holmes, in addition to being a brilliant jurist, is a profoundly interesting human being as we will see.

Attorney Malcolm J. Gross is a founding partner of Gross McGinley, LLP, headquartered in Allentown, where he has long represented media interests, including representing them in their pursuit of access to government records. Malcolm J. Gross was born in Allentown, PA. He graduated from Muhlenberg College, cum laude in 1962, with a Bachelor’s Degree in History and Political Science. He earned his J.D. from Villanova University School of Law in Philadelphia in 1965 and was admitted to the Pennsylvania Bar that year. While at Villanova, he was an editor of the Law Review. Mr. Gross also is admitted to the United States District Court for the Eastern District and Middle Districts of Pennsylvania, the United States Court of Appeals for the Third Circuit and the Supreme Court of the United States.

Attorney Gross has written on a wide range of topics, and his articles have appeared in such national publications as Social Work, Case & Comment, and Communications and the Law. He also has published work in the Pennsylvania Bar Quarterly and the Pennsylvania Law Journal Reporter. Some of his articles cover press law including defamation, subpoenas, and freedom of information issues. He also writes about general-interest issues such as custody and domestic relations.

In 2004, 2006, and 2012, Attorney Gross was named a Pennsylvania Super Lawyer, reserved for the top 5 percent of Pennsylvania attorneys, and holds an AV Rating by Martindale- Hubbell Legal Directory.

“Immigration Law Pro Bono for the Non-Immigration Lawyer” Presented by: David Trevaskis, Esq. Thursday, December 3, 2015

This session will highlight developments in immigration law, especially the status of immigration reform that will provide opportunities for pro bono service for both the veteran immigration lawyer and the non-immigration attorney. Featured is Citizenship Day, an annual opportunity for pro bono service that any lawyer can support. DACA, Deferred Action for Childhood Arrivals, will be discussed to emphasize how work in such areas requires immigration expertise.

David Keller Trevaskis, Esq., is an attorney and former third grade teacher with a Master’s Degree in Education. He is the Pro Bono Coordinator for Legal Services for the Pennsylvania Bar Association (PBA), responsible for assisting local bar associations, legal services programs and other groups who offer pro bono legal services across the Commonwealth. Trevaskis coordinates the PBA’s pro bono placement efforts, using the PALawHelp.org and PAprobono.net technologies to expand the resources for the neediest among us. He runs the PBA’s Pro Bono Office and the wide range of that work is viewable at http://www.pabar.org/public/probono/probonohome.asp. Trevaskis is a frequent presenter across Pennsylvania on civil legal aid and pro bono issues and is recognized as a national expert in public education about the law. Obermayer Education Award, a 2000 President’s Award from the Pennsylvania Bar Association for the Project PEACE anti-violence program he developed and still coordinates, the Philadelphia Bar Association’s Young Lawyer Division’s 2002 F. Sean Peretta Service Award, and a 2004 Chester County Bar Association President’s Award. In 2006, Trevaskis was the second recipient of the Compass Award, which was first given to United States Supreme Court Justice Sandra Day O’Connor. During that same year, Trevaskis received the President’s Citation from the Indiana Bar Association and the LEAP-Kids Lifetime Achievement and Mentor Award. In 2007, Trevaskis received the President’s Award from the Delaware County Bar. Trevaskis was one of ten inaugural Gavel Award winners from Community College of Philadelphia in 2009.
