Thiagarajan was present for today's (7-8-2009) enquiry. On behalf of the Public Authority, the Public Information Officer, Tambaram Municipality, Chennai was not present.

2. Under Section 6(1) of the Right to Information Act, 2005, the petitioner sent an application dated 18-9-2008 addressed to the Public Information Officer requesting him to give information on two items viz. (1) the year in which the construction of the house of one Thiru Vijayarangam was made and (2) copy of Building Plan approved by the Tambaram Municipality. As there was no communication from the Public Information Officer within the stipulated time of 30 days, under Section 7(1), the petitioner filed the first appeal under Section 19(1) to the appellate authority on 24-10-2008. The petitioner again under Section 19(3) sent the Second Appeal to the Commission on 25-11-2008. On the basis of the second appeal to the Commission, both the petitioner and the Public Information Officer, were summoned to appear before the Commission for today's hearing.

3, During the enquiry, the petitioner has stated that he has not received any reply from the Public Information Officer. The Public Information Officer, Tambaram Municipality, Tambaram, Chennai, is directed to give the complete and correct information according to the available records to the petitioner on or before 21-8-2009, get the acknowledgement from the petitioner and report the same to the Commission, before 28-8-2009

4. The Public Information Officer, Tambaram Municipality, Chennai, is directed to give explanation (1) for not having supplied the required information to the petitioner within the stipulated time of thirty days under Section 7(1) of the RTI Act, 2005, and (2) for not having appeared before the Commission's enquiry today (7-8-2009), through the Commissioner of Municipal Administration, Chennai, within one month from the date of receipt of this order, to the Commission.
