PuRSUANT to the Social Security Act 1964, the Minister of Health hereby gives the following direction.

THE DRUG TARIFF 1. Title and commencement-( 1) This direction may be cited as the Drug Tariff 1967. (2) This direction shall come into force on the 1st day of August 1967, and shall apply to all pharmaceutical requirements supplied on or after that date to persons entitled to claim pharmaceutical benefits under the Social Security Act 1964, and to the supply on or after that date of pharmaceutical requirements to such persons as aforesaid.

2. Interpretation-( 1) In this direction, unless the context other­ wise requires,- "Commission" means the Trade Practices and Prices Commission constituted under the Trade Practices Act 1958 or the Price Tribunal constituted under the Control of Prices Act 1947 or any person to whom the powers of either are delegated: 1967/143 Drug Tariff 1967 823

"Director-General" meaDS the Director-General of Health within the meaning of section 5 of the Health Act 1956: "Hospital Board" means a Hospital Board constituted under the Hospitals Act 1957: "Licensed hospital" means a licensed hospital within the meaning of Part V of the Hospitals Act 1957: "Narcotic" means any substance, preparation, or mixture for the time being named or described in the First Schedule to the Narcotics Act 1965: "Outpatient" means any person being treated at any hospital under the control of a Hospital Board otherwise than as an inmate: "Payment" means payment by the Department in accordance with the terms of this Tariff: "Prescription Pricing Schedules" means the official schedules and amendments for prescription pricing issued by the Depart­ ment from time to time for the purpose of determining the prices to be paid to contractors in respect of pharmaceutical requirements supplied by them: "Prescription Pricing Supplement" means an amendment to the Prescription Pricing Schedules: "Proprietary preparation" means any pharmaceutical require­ ment that is prescribed in any prescription by reference to any trade mark or trade name or by reference to the name of its manufacturer: "The regulations" means the Social Security (Pharmaceutical Benefits) Regulations 1965*: "Retail price" means the price specified in the column headed "Prescription Retail Selling Price" in the First Schedule to the ,Prescription Pricing Schedules or as calculated under clause 9 or clause 10 of this Tariff, as the case may be: "Tariff" means the Drug Tariff 1967. (2) Except as provided in this clause, expressions defined in section 88 of the Social Security Act 1964 and in regulation 2 of the regulations have the meanings so defined. (3) The Prescription Pricing Supplement shall be read together with and deemed part of the Prescription Pricing Schedules.

PART I-GENERAL RULES AFFECTING THE TARIFF 3. Scope of Tariff-All medicines, drugs, and materials specified in the Schedule to this Tariff, and all preparations of anyone of them having an inert base, shall, subject to the restrictions (if any) as to their availability specified in that Schedule, be deemed to be included in this Tariff and to be pharmaceutical requirements for its purposes: Provided that the following classes of material shall be excluded from this Tariff and shall not be deemed to be pharmaceutical require­ ments: (a) A substance or any combination of substances specified in Part II of the Schedule to this Tariff where ordered for any purpose other than for the treatment of a patient's medical condition: *S.R. 1963/41 824 Drug Tariff 1967 1967/143

(b) Aerosols and similar articles packed under pressure other than a preparation (if any) that is specified in Part II of the Schedule to this Tariff: (c) Electrode jellies: (d) Insect repeIlants and similar preparations: (e) Long acting preparations for oral use other than those (if any) that are specified in Part II of the Schedu'le to this Tariff: ( f) Lozenges and similar products: (g) Plasters, machine spread: (h) Pregnancy tests: ( i) Preparations prescribed as foods: (j) Preparations prescribed for contraceptive purposes: (k) Proprietary medicines or proprietary articles ( other than a product that is a pharmaceutical requirement elsewhere specified in this Tariff or a product

4. Rules for standard-( 1) No claim by a contractor for payment in respect of the supply of pharmaceutical requirements by him shall be aHowed unless the requirements so supplied comply- (a) With the appropriate standards prescribed by regulations for the time being in force under the Food and Drugs Act 1947; or (b) In the absence of any such standards, with the appropriate standards for the time being prescribed by the British Pharma­ copoeia; or ( c) In the absence of any of the standards prescribed by paragraph (a) or paragraph (b) of this subclause, then with the appro­ priate standards for the time being prescribed by the British Pharmaceutical Codex. (2) In the absence of any of the foregoing standards prescribed by subclause (1) of this clause, the grade or quality of the product supplied shall not be lower than that ordinarily used for medicinal purposes. (3) Where a medical practitioner indicates in a prescription the pharmaceutical requirement to be supplied by reference to a trade mark, trade name, or by reference to the name of its manufacturer, a contractor shall supply the pharmaceutical requirement specified in the prescription in the form so indicated and not in any other form unless the prescribing practitioner has sanctioned a change.

5. Prices for pharmaceutical requirements-( 1) Subject to the pro­ visions of clause 22 of this Tariff, payment shall be made in respect of claims for pharmaceutical requirements in accordance with the prices specified in the First Schedule to the Prescription Pricing Schedules and in accordance with the rules for pricing contained in Part II of this Tariff. 1967/143 Drug Tariff 1967 825

(2) Subject to the provisions of clause 22 of this Tariff, where. the price of any pharmaceutical requirement is not specified as provlded in subclause (1) of this clause, payment shall be made in accordance with the rules contained in Part II of this Tariff. (3) A Prescription Pricing Supplement shall come into force on the 1st day of April, August, or December, or such other date as may be recommended by the appropriate committee, and payment in respect of any claims for pharmaceutical requirements. whatever their date, received by a Medical Officer of Health on or after the 16th day following the effective date of the Supplement shall be calculated in accordance with the prices specified in that Supplement. (4) Subject to sub clauses (5) and (6) of this clause, if any pharmaceutical requirements are supplied to a patient as pharmaceu­ tical benefits, they shall be so supplied free of charge to the patient, except that, if the requirements are to be delivered to the patient elsewhere than at the pharmacy or other place of business of the contractor, a reasonable charge in accordance with subclause (2) of regulation 14 of the regulations may be made for the delivery. (5) Notwithstanding anything in subclause (4) of this clause, a con­ tractor may charge a customer with- (a) The price of any pharmaceutical requirements that are supplied by him in excess of the maximum quantities specified in this Tariff; or (b) The excess of the price of any proprietary preparation (being a preparation that is specifically ordered by a medical practitioner and supplied by the contractor) above the amount payable as calculated in accordance with the Prescription Pricing Schedules and the rules for pricing contained in this Tariff. (6) Notwithstanding anything in sub clause (4) of this clause, a con­ tractor may charge a customer Sc in respect of any prescription dispensed at any time not within the ordinary hours of shop trading in the locality where the contractor carries on business.

PART II-RuLES FOR PRICING 6. Application of rules for pricing-(1) Subject to the discount (or discounts where applicable) provided for in clause 22 of this Tariff, or, in the case of a pharmaceutical requirement supplied by a medical practitioner, the discount of 10 percent provided for in subsection (1) of section 95 of the Social Security Act 1964, the prices of pharmaceutical requirements supplied pursuant to the regulations shall be determined in accordance with the rules for pricing contained in this Part of this Tariff. (2) Where the computation is within plus or minus one half of one percent of the correct net amount payable to a contractor in respect of the claim concerned, then notwithstanding that computation, payment to a contractor shall be made and accepted by him in full satisfaction of his claim against the Department for payment. (3) In the event of a dispute between a contractor and a Medical Officer of Health concerning payment to a contractor, the contractor may apply in writing to the Medical Officer of Health dealing with his claims who shall, on receipt of the application, refer it to the appropriate 826 Drug Tariff 1967 1967/143 committee for consideration and recommendation. The committee shall then consider the application and on coming to a decision shall notify the Medical Officer who shall then notify it in writing to the contractor.

7. Prescription pricing-Payment for each prescription shall be cal­ culated by adding together the following: (a) The total retail price of the ingredients: (b) The average container charge specified in the Second Schedule to the Prescription Pricing Schedules: (c) Without limiting paragraph (b) of this clause, where, pursuant to any appropriate prescription, the pharmaceutical require­ ments are prescribed or supplied in a dropper bottle, metal tube, or other approved container, the amount from time to time specified in the Second Schedule to the Prescription Pricing Schedules: (d) The appropriate dispensing fee as set out in the Third Schedule to the Prescription Pricing Schedules.

8. Computation of retail price-(1) The retail price shall be deter­ mined on the basis of the price charged to contractors for the pharmaceutical requirement in such units as are customarily purchased by a contractor and at such prescription basic wholesale prices as are approved from time to time by the Commission. Where necessary, any such prices shall be converted to retail prices in the metric system. (2) The principal divisions of the metric system for the calculation of the retail price of any pharmaceutical requirement shall be 100 grams or 100 millilitres or a specified number, and 1 gram or 1 millilitre or a specified number, or a specified pack. (3) If a pharmaceutical requirement can be purchased in quantities other than in the quantities specified in sub clause (2) of this clause, the retail price shall be calculated in the appropriate ratio to those quantities. ( 4) Where a liquid is purchased by weight and is dispensed by volume, an appropriate adjustment, based on the specific gravity of the liquid, shall be made in computing the retail price. (5) All computations concerned with quantities of pharmaceutical requirements that are specified in the Schedule to this Tariff shall be made in the metric system: Provided that, in the case of a pharmaceutical requirement that is prescribed or ordered in terms other than those of the metric system, computations shall follow the Apothecaries to Metric Conversion Tables for the time being approved for this purpose by the Minister. (6) Where a prescription for an injection orders the supply of a dry pack of a pharmaceutical requirement together with one or more ampoules or vials of a sterile diluent, payment for the composite items shall be made as for one prescription, and, where applicable, the provisions of sub clause (1) of clause 11 of this Tariff shall be applied to the combined retail price. (7) Where, for special reasons concerned with the protection of the patient, a medical practitioner directs on the prescription that a pharmaceutical requirement is to be dispensed daily or at such other regu­ lar intervals as he considers necessary, payment shall be made by adding 1967/143 Drug Tariff 1967 827 together the total retail price of the quantity of the pharmaceutical requirement dispensed on each occasion, and the appropriate dispensing fee; but the Department may in its discretion refuse to pay the container allowance in respect of any second or subsequent dispensing. (8) Where the strength of a preparation is not indicated on a prescription the contractor shall endorse there on the strength supplied. Otherwise payment shall be based on the price of the lowest strength available.

9. Items not listed in the First Schedule to the Prescription Pricing Schedules-( 1 ) In the case of items not listed in the First Schedule to the Prescription Pricing Schedules, the retail price shall be com­ puted by adding together the following: (a) The price charged to the contractor (without sales tax) : (b) Fifty percent of the price specified in paragraph (a) of this subclause: (c) Any sales tax. (2) Where necessary the price so computed shall be converted to the nearest appropriate metric amount specified in clause 8 (2) of this Tariff.

10. Items dispensed by count-( 1) Where items dispensed by count are listed in the First Schedule to the Prescription Pricing Schedules, the retail price of the number dispensed shall be calculated as an exact numerical proportion of the retail price shown in that Schedule. (2) Where items dispensed by count are not listed in the First Schedule to the Prescription Pricing Schedules, the retail price shall be computed by adding together the following: (a) The price charged to the contractor (without sales tax) : (b) Fifty percent of the price specified in paragraph (a) of this subclause: ( c) Any sales tax. (3) Broken quantities shall be computed as an exact numerical proportion of the retail price.

11. Discount-( 1) In pricing any uncompounded preparation supplied pursuant to a prescription, where the retail price, exclusive of dis­ pensing fee and container charge, is in excess of $2.50, the retail price shall be discounted by 10 percent, but in no case shall that discount reduce the retail price of an ingredient below $2.50. (2) This clause shall not apply to insulin, allergy treatment sets, diagnostic reagent tests, radiographic preparatory substances, bulk supply orders, or medical practitioners' supply orders.

12. Official requirements not in the First Schedule to the Prescription Pricing Schedules-Where any pharmaceutical requirement (being a requirement included in the British Pharmacopoeia, the British Pharmaceutical Codex, or the British National Formulary, but not one included in the First Schedule to the Prescription Pricing Schedules) is purchased as a ready made preparation, a contractor shall claim by stating in writing the cost price and source of supply. In any other case the prescription shall be priced in accordance with the rules for pricing contained in this Part of this Tariff. 828 Drug Tariff 1967 1967/143

13. Rounding calculations-Calculations for the price of each ingredient are to be rounded to the nearest cent, but exact half cents are to be so expressed. The final half cent is to be rounded upwards to the nearest cent.

14. Minimum charges-(l) The minimum charge for any ingredient in a mixture shall be 1c. (2) The minimum total charge for alI ingredients in a mixture shall be 5c: Provided that where the total retail price of all the ingredients, including any that are not specified in this Tariff, exceeds Se, pay­ ment shall be made for the total value of the requirements that are specified in this Tariff rounded upwards to the nearest cent. (3) For the purposes of this clause the term "mixture" means any prescribed preparation requiring the admixture of two or more in­ gredients, including a vehicle or excipient.

15. Water-(l) Where the term "aqua" is used in a preparation with­ out qualification, it shall be interpreted to mean wholesome drinking water. (2) Distilled water shall be charged for only where specified on the prescription or where its use is necessary in conformity with standard dispensing practice. (3) Water for injection may be charged for where the contractor certifies in the prescription that the water was supplied for the purpose. (4) Wholesome drinking water shall not be an ingredient bearing a charge on a prescription.

16. Bulk supply orders and medical practitioners' supply orders­ (1) Payment for bulk supply orders and medical practitioners' supply orders shalI be computed as follows: (a) Where the quantity of any pharmaceutical requirement that is supplied exceeds the basic wholesale unit for the time being specified in the First Schedule ,to the Prescription Pricing Schedules, payment shalI be based on the appropriate whole­ sale rate: Provided that a contractor may receive payment based on his statement of the cost price of the requirement to him and his source of supply so long as the amount payable therefor does not exceed that which would be payable had the said basic wholesale units (or parts thereof) been supplied: (b) No payment shalI be made for containers supplied with materials ordered on a bulk supply order for a hospital or other approved institution: (c) Where any pharmaceutical requirement ordered on a medical practitioner's supply order is supplied in a dropper bottle, metal tube, or any other approved container, the sum specified in the Second Schedule to the Prescription Pricing Schedules shall be paid for that dropper bottle, metal tube, or other approved container, as the case may be: (cl) No payment shall be made for a dispensing fee, except in the case of a pharmaceutical requirement compounded by the contractor. 1967/143 Drug Tariff 1967 829

(2) Before any discount provided for in this Tariff is deducted, there shall be deducted from the total price of any supply order, computed in accordance with subclause (1) of this clause, a special discount of 10 percent. The discount may be deducted only once.

17. Proprietary preparations-(1) If any prescription orders a pro­ prietary preparation that is identical in composition to a pharmaceutical requirement specified in this Tariff or is deemed by the Director-General to be identical to a requirement so specified, payment shall be made in accordance with the rules for pricing contained in this Part of this Tariff: Provided that, in the case of any requirement listed in the table of allowances specified in the Prescription Pricing Schedules, only partial payment may be made, and then only on the advice of the appropriate committee. (2) Any payment made or to be made to a contractor pursuant to subclause (1) of this clause shall be accepted by him in satisfaction of the price of any pharmaceutical requirement referred to in that sub­ clause to the extent of that payment.

18. Insulin preparations-(I) Payment in respect of the several forms of insulin allowed under this Tariff shall be made by adding together the cost price of insulin as approved from time toO time by the Commission, and 20 percent of the cost price of the lowest priced insulin. The amount so computed shall be the basis of payment for the higher priced brands, but in no case shall less than a 15 percent increase on the cost be allowed. (2) Except where the amount payable in respect of a particular form or brand of insulin is specified for the time being in the First Schedule to the Prescription Pricing Schedules, payment shall be computed in accordance with this rule. Where no brand of insulin is specified the least expensive brand available. shall be supplied.

19. Diagnostic reagent tests-Payment for the supply of pharma­ ceutical requirements used in respect of diagnostic reagent tests shall be computed by adding together the cost price as approved from time to time by the Commission, 20 percent of that price, and the appropriate dispensing fee.

20. Radiographic preparatory substances-Payment in respect of the several forms of radiographic pharmaceutical requirements allowed under this Tariff, including barium sulphate, shall be made by adding together the cost price as approved from time to time by the Commission and 20 percent of that price.

21. Rectified spirit-When is prescribed for use in pharma­ ceutical requirements that are used as external preparations, payment shall be made only for industrial methylated spirits, unless the medical practitioner has specified that rectified spirit is to be used. 830 Drug T arifJ 1967 1967/143

PART Ill-MISCELLANEOUS PROVISIONS 22. Claims on the Depar1ment-(l) Pursuant to regulation 14 of the regulations, a contractor may submit claims for payment in respect of pharmaceutical requirements supplied by him during half-monthly or monthly periods. (2) The amount due to the contractor on every claim, as computed in accordance with this Tariff, shall be reduced by a discount of 2! percent. (3) Where the claim relates to or includes any prescription or order which was last dispensed more than three months before the date on which the claim is first received by the Medical Officer of Health, the amount due to the contractor in respect of every such prescription or order so dispensed shall, unless the contractor satisfies the Medical Officer of Health that he has a reasonable excuse for his delay in sub­ mitting the claim, and subject to any general or special directions given by the Director-General, be reduced by a further discount of 10 percent: Provided that the amount due shall not be reduced by the said further discount in any case where a prescription is endorsed "extended supply" and is fulfilled in part only and is received by the Medical Officer of Health for payment within six months of the date of initial dispensing.

23. Allergy treatment sets-( 1) Payment in respect of an allergy treatment set allowed under this Tariff shall be the amount specified from time to time in the Prescription Pricing Schedules or the amount approved from time to time by the Director-General. (2) In the case of a person for the time being approved by the Director-General as the manufacturer of approved allergy treatment sets, the amount payable in respect of any allergy treatment set supplied by him shall be the amount approved from time to time by the Director-General. (3) In the case of a contractor, the amount payable in respect of any allergy treatment set supplied by him shall be computed by adding together the cost price of the set, 20 percent of the cost price, and the appropriate dispensing fee.

24. Intravenous fluids-Payment to a licensed hospital or to a medical practitioner in respect of the types of intravenous fluids allowed under the Schedule to this Tariff shall be the amount of the allowance specified from time to time in the Prescription Pricing Schedules or the sum approved from time to time by the Director-General.

25. Period and quantity of supply-( 1) Payment may be made pur­ suant to anyone prescription for a quantity of the pharmaceutical requirement so prescribed sufficient to provide treatment for a period not exceeding seven days in respect of the original supply and a further seven days in respect of the repeat: Provided that, on the contractor supplying a lesser or greater quantity than that prescribed and endorsing the prescription accordingly, pay­ ment shall be made- 1967/143 Drug Tariff 1967 831

(a) If the quantity prescribed does not coincide with the volume of a standard container and the amount contained in the nearest next largest standard size container is supplied; or (b) If the quantity prescribed does not coincide with an original pack and the requirement is packed in a collapsible tube, dropper bottle, or other special container from which it is not prac­ ticable to dispense the exact quantity. (2) Notwithstanding anything in paragraph (a) of the proviso to subclause (1) of this clause, in any case where the liquid oral form of a pharmaceutical requirement and either the restriction "antibiotic restriction" or "penicillin restriction" applies, payment shaIl be made for- (a) The exact numerical proportion of the bulk pack if such a pack is available; or (b) The next smallest pack or the next smaIlest number of packs, as the case may be, if the quantity prescribed does not coin­ cide with a standard pack and a bulk pack is not available; or (c) The next largest pack if the quantity prescribed does not coincide with a standard pack and neither a bulk pack nor a smaIler pack is available: Provided that, in any case where the pharmaceutical requirement is ordered as an injection and the restriction "antibiotic restriction" applies, payment may only be made for a quantity sufficient for a period not exceeding 72 hours' treatment. (3) Notwithstanding anything in subclause (1) or subclause (2) of this clause, where a quantity is specified in the availability column of Part II of the Schedule to this Tariff, it refers to the maximum quantity of the pharmaceutical requirement for which payment may be made on each occasion that the requirement is dispensed, either on the original dispensing of the requirement or on the dispensing of any repeat. The restriction of availability to "one pack" or "one tube" shall not apply to a medical practitioner's supply order or to a bulk supply order. (4) Notwithstanding anything in subclause (1) or subclause (2) or subclause (3) of this clause, where, in the opinion of the prescribing medical practitioner, extended treatment is necessary for a period of not less than one month and no danger is involved in the use of a pharmaceu­ tical requirement without medical supervision, a supply of that pharma­ ceutical requirement not exceeding a quantity sufficient to provide that person with treatment for a specified period of one month in the case of a narcotic or from one to three months in any other case may be made on anyone prescription; and, if the medical practitioner has endorsed the prescription with the words "extended supply" and has specified on it the period for which that pharmaceutical requirement is to be supplied, payment shaIl be made in respect of a claim made accordingly: Provided that in any case where a patient is receiving an extended supply of any pharmaceutical requirement, that requirement shaIl be dispensed in monthly lots, unless- (a) The prescriber makes a special endorsement on the prescription stating the period for which each lot is to be dispensed; or (b) The contractor or the patient endorses the back of the prescrip­ tion with a statement of the special reasons why a quantity greater or less than a monthly lot is required to be dispensed: 832 Drug Tariff 1967 1967/143

Provided also that, in the case of a pharmaceutical requirement in respect of which the restriction "antibiotic restriction" or "penicillin restriction" applies, no more than one month's supply shall be dispensed at anyone time. ( 4) Any prescription that is not presented to a contractor for dis­ pensing within four days of its being written in the case of a narcotic, or within three months of its being written in any other case, shall cease to be a charge to the Department. (5) A repeat on a prescription that remains unfulfilled after one month from the date of first dispensing of any requirement named in the prescription shall cease to be a charge to the Department. The contractor concerned may submit a claim for the part fulfilment of the total quantity ordered in respect of the part that is due for payment. (6) A repeat on a prescription endorsed "extended supply" that remains unfulfilled after three months from the date of first dispensing of any requirement named in the prescription shall cease to be a charge to the Department. The contractor concerned may submit a claim for the part fulfilment of the total quantity ordered in respect of the part that is due for payment.

26. Bulk supply orders-(1) Notwithstanding anything in this Tariff, the licensee or manager of a licensed hospital or the matron or other person in charge of an institution approved by the Director-General may obtain, pursuant to a bulk supply order on a form to be supplied by the Department, such pharmaceutical requirements as he expects will be required for the treatment of persons who are under medical supervision in that hospital or approved institution: Provided that payment shall not be made for any requirement that is specifically restricted in the Schedule to this Tariff: Provided also that the licensee or manager or, as the case may be, the matron or other person may be called upon to justify the amount ordered. (2) Payment shall be made to the contractor on the presentation of the appropriate copy of a bulk supply order form supplied by the Department which- (a) Sets forth the pharmaceutical requirements which have been supplied; and (b) Has endorsed on it a receipt, signed and dated by the licensee or manager or, as the case may be, the matron or other person, indicating that the requirements have been received by him: Provided that a special form, also provided by the Department, shall be used in the case of an order for the bulk supply of a narcotic. (3) The quantities ordered on a bulk supply order are to be limited to those quantities that are sufficient to meet reasonable needs for a period not exceeding one month, after taking into account stock on hand at the time of preparing the requisition. ( 4) The Minister may at any time, by notice given in such manner as he thinks proper, declare that any hospital or other approved institu­ tion shall not be entitled to obtain supplies of pharmaceutical require­ ments under this clause; and on the making of any such declaration this clause shall cease to apply with respect to that hospital or other approved institution. 27. Medical practitioners' supply orders-( 1) Notwithstanding any­ thing in this Tariff, a medical practitioner may obtain, pursuant to a medical practitioner's supply order, such pharmaceutical requirements as he expects to be required for personal administration to patients under his care, if the quantities ordered are reasonable for up to one month's supply in the conditions obtaining in his practice; but no payment will be made for any pharmaceutical requirement that is specifically restricted in the Schedule to this Tariff. The medical practitioner may be called upon to justify the amounts ordered. (2) Payment shall be made to the contractor on the presentation of the medical practitioner's supply order if at the time of supply it- (a) Is signed personally by the medical practitioner: (b) Is dated in the medical practitioner's own handwriting: (c) Sets forth the pharmaceutical requirements that the medical practitioner requires at the time: (d) Has endorsed on it a receipt signed and dated by the medical practitioner, or his agent, in respect of the requirements supplied. Any order for a narcotic shall be written on a form to be supplied by the Department. (3) A medical practitioner may, except in exceptional circumstances, order only those pharmaceutical requirements that he requires to ad­ minister personally to a patient or requires for emergency use until a supply can be obtained by the patient pursuant to a prescription. (4) The Minister may at any time, on the recommendation of the Medical Services Advisory Committee appointed under section 121 of the Social Security Act 1964, by notice given in such manner as he thinks proper, declare that any medical practitioner whose name is specified in the notice shall not be entitled to obtain supplies of pharma­ ceutical requirements under this clause; and on the making of any such declaration this clause shall cease to apply with respect to that practi­ tioner. Any such notice may in like manner be revoked.

28. LIST OF PHARMACEUTICAL REQUIREMENTS FOR WHICH PAYMENT IS ALLOWED OR CONDITION ALLY ALLOWED

PART I-DEFINITIONS 1. (1) "Antibiotic restriction" means the supply of the pharmaceutical requirement in accordance with clause 25 of this Tariff for the treatment of an infection- (a) Where the infection is resistant to penicillin or sulphonamides; or (b) Where a broad spectrum antibiotic is regarded by authoritative medical opinion as the treatment of choice for the infection: Provided that, in the case of a prescription endorsed "extended supply", payment shall be made only where the requirement is used in the treatment of a chronic respiratory condition or other chronic condition in which a broad spectrum antibiotic is regarded as the treatment of choice by authoritative medical opinion. (2) Any proprietary topical application (other than a preparation that is specified in Part II of this Schedule) shall not be a charge to the Department. Where any quantity of any pharmaceutical requirement specified in this subclause, or its salts or derivatives, is present in any preparation compounded by a contractor, not being a preparation specified in Part II of this Schedule, it shall not be a charge to the Department. The requirements so specified are chloramphenicol, chlortetracycline, erythromycin, oxytetracycline, and tetracycline. 2. "Approved condition" means a pharmaceutical requirement supplied pursuant to a prescription endorsed with the words "Approved con­ dition" written in the practitioner's own handwriting or signed or initialled by the practitioner, and ordered for therapeutic purposes, but neither for contraceptive purposes nor as a pregnancy test. 3. "Dermatological specialist" means that payment may be made only when the pharmaceutical requirement concerned is ordered by a derma­ tological specialist; but, in the case of treatment recommended by the dermatological specialist, the prescription of a medical practitioner endorsed with the words "recommended by [name of specialist]" shall be accepted for payment. 4. "Hospital Board" means that payment may be made only when the pharmaceutical requirement concerned is supplied by a Hospital Board to an outpatient (being for the purposes of this Tariff any person who is not an inmate of a public hospital) on the prescription of a medical practitioner. S. "Hospital Board-specialist" means that the pharmaceutical require­ ment concerned may be supplied free of charge only by a Hospital Board to an outpatient on the prescription of a specialist. Where treat­ ment of any such outpatient with the requirement has been recom­ mended by a specialist and the requirement is prescribed by a medical practitioner, the prescription of the medical practitioner endorsed with the words "recommended by [name of specialist]" shall be accepted by a Hospital Board and the requirement shall be supplied as aforesaid. "In combination" means that the pharmaceutical requirement concerned is allowed at the Department's expense only when included in a prescription in combination with other pharmaceutical requirements that are specified in this Schedule as being available otherwise than "in combination", and then only to the extent specified. 7. "Intravenous fluids" means that payment may be made only­ (a) To a licensed hospital for the treatment of any patient in the hospital (being treatment that has been recommended by a medical practitioner), or if the requirement has been supplied by the hospital to a medical practitioner for the treatment of a patient in his own home; or (b) To a medical practitioner who has used the requirement for the treatment of a patient either when treating him at a licensed hospital or at his home. 8. "Maternity hospital" means that payment shall be made only when the pharmaceutical requirement concerned is supplied, pursuant to a bulk supply order, to a maternity hospital licensed under the Hospitals Act 1957. (See clause 26 of this Tariff.) 9. "Midwifery order" means that payment may be made only when the pharmaceutical requirement concerned is supplied in the specified· quantity to a patient as an authorised midwifery requirement pursuant to a midwifery order signed by the hospital licensee or manager of a· private hospital within the meaning df the Hospitals Act 1957, or by a midwife or maternity nurse registered under the Nurses and Midwives Act 1945, as the case may be. 10. "Ophthalmological specialist" means that payment may be made only when the pharmaceutical requirement concerned is ordered by an ophthalmological specialist (including the registrar of the appropriate department of a public hospital) for the treatment of any medical condition affecting the eye; but, in the case of treatment recommended by the specialist, the prescription of a medical practitioner endorsed with the words "recommended by [name of specialist]" shall be accepted for payment. 11. "Otolaryngological specialist" means that payment may be made only when the pharmaceutical requirement concerned is ordered by an otolaryngological specialist (including the registrar of the appropriate department of a public hospital) for the treatment of any medical condition affecting the ear, nose, or throat; but, in the case of treatment recommended by the specialist, the prescription of a medical practitioner endorsed with the words "recommended by [name of specialist]" shall be accepted for payment. 12. <'Penicillin restriction" means the supply of pencillin in accordance with clause 25 of this Tariff; but in the case of a prescription for penicillin which is endorsed "extended supply", payment may be made when the penicillin is used in the treatment of conditions in which it is regarded as the treatment of choice by authoritative medical opinion. 13. "Psychiatric specialist" means that payment may be made only when the pharmaceutical requirement concerned is supplied pursuant to a medical practitioner's supply order signed by a medical practitioner engaged in the practice of psychiatry. 14. If any question arises as to whether a medical practitioner is a specialist for the purposes of this Schedule, that question shall be referred to the Minister whose decision shall be final.

EXPLANATORY NOTE This note is not part rif the Drug Tariff, but is intended to indicate its general effect. This Drug Tariff sets out the drugs, medicines, and materials that may be supplied at the cost of the Department of Health by chemists and others who have contracted to supply them under the Social Security (Pharmaceutical Benefits) Regulations 1965. It also sets out the terms and conditions of supply, the procedure for the lodging and payment of claims by contractors, and the rules for fixing the prices payable to contractors. The Schedule to the new Tariff specifies the materials and classes of materials that are allowed or conditionally allowed at the cost of the Department of Health.
