General commercial terms and conditions Top of Europe Pass, 2021 range

General conditions 1. By purchasing a Top of Europe Pass for 3-8 days or as a season pass, the customer accepts the following terms and conditions of use and takes note of the following description of services. 2. The complete range of Top of Europe Passes is personal and non-transferable. The personal details of season passes in particular will be stored in the sales system.

Scope of validity 3. Top of Europe Passes are valid from 17 April to 28 November, 2021. 4. The Top of Europe Passes entitle their holders to enjoy unlimited travel on the following routes: • Ost (East) – / • Lauterbrunnen – – Grindelwald • Glacier – • Kleine Scheidegg – Jungfraujoch • Lauterbrunnen – Grütschalp – Mürren • Grindelwald – First • Grindelwald Terminal – Männlichen • Grindelwald Terminal – – Männlichen • Wilderswil – Schynige Platte • Interlaken – Harder Kulm 5. The pass is not valid on local bus services, nor on the mountain routes of Grindelwald Bus. The passes do not fall within the scope of validity of Grindelwald Bus. 6. The Top of Europe Pass is not valid for travel to and from a school, nor a place of work.

Discounts 7. Holders of the following personal season tickets will receive a discount: • GA Travelcard • Half-Fare Travelcard • and Top4 Season Sports Pass for the past 20/21 winter season • Swiss Half-Fare Card • Swiss Travel Pass 8. The above-named passes must be valid and presented each time the Top of Europe Passes are used. 9. Children aged 6–15.99 require the Top of Europe Pass at a net price of CHF 30.– per child. Family reductions such as the Junior Card, Child Travelcard or Swiss Family Card are not valid in combination with the Top of Europe Pass.

Travel class upgrade 10. Holders of Top of Europe Passes are entitled to receive a travel class upgrade at a reduced price on the Interlaken Ost – Lauterbrunnen / Grindelwald route.

Replacement passes 11. In the event of loss or wilful damage to Top of Europe Season Pass, a replacement pass will be issued on presentation of an official ID card and the payment of a CHF 30.– fee. 12. If a Top of Europe Pass holder changes their name or place of residence, a replacement pass will be issued free of charge.

Forgotten pass 13. If a holder has forgotten their Top of Europe Pass, they must purchase a valid ticket for the route to be travelled in accordance with the tariff. The sales staff will mark the ticket with an appropriate notice. The refund, less an administration fee of CHF 5, must be made within 10 days on presentation of the Top of Europe Pass and an official ID card at a Jungfrau Railways sales outlet.

Exchanges / Refunds 14. A Top of Europe Pass already purchased at the full price cannot be subsequently exchanged for a Top of Europe Pass at a discounted price, even if the pass holder subsequently purchases one of the personal season tickets listed under Point 7. 15. If the Top of Europe Season Pass holder has compelling reasons that are beyond their control, an appropriate refund may be made if the holder is no longer able to use the Top of Europe Season Pass. This does not apply to 3-8 day Top of Europe passes. The pass holder must leave the Top of Europe Season Pass at a sales outlet. The Jungfrau Railways Product Management Team will then decide on any reimbursement. Please note the operating times which are given at jungfrau.ch/fahrplan. Changes to the operating hours and timetables, or closures and partial closures of transport facilities do not entitle holders to an extension, exchange or return, or a refund or partial refund of the passes. Operating hours are subject to change without notice.

Ticket inspection / Misuse / Forgery 16. The Top of Europe Season Pass must be presented to the ticket inspector at every ticket inspection together with an official photo ID card. Holders of a discounted Top of Europe Season Pass must also present a valid season ticket in accordance with Point 7 (GA Travelcard, Half-Fare Travelcard and Jungfrau or Top4 Season Sports Pass for the 20/21 winter season will also be accepted as an official photo ID in this case). 17. Anyone who is unable to present a valid Top of Europe Pass at the time of a ticket inspection will be treated as a passenger without a valid ticket in accordance with Tariff 600 GTNB of the Swiss Federal Railways and Tariff 610 of the Jungfrau Railways. 18. Any actions by a visitor that are intended to enrich the visitor or another person unlawfully, and/or damage the transport companies‘ property or other rights are considered to be misuse. 19. A forgery occurs when a Top of Europe Pass or a receipt has been created, modified, duplicated, added to or otherwise manipulated without authorisation, or contains erasures. 20. All misused and/or forged Top of Europe Passes will be confiscated. In addition, the 600 GTNB and 610 Tariffs shall apply. A surcharge of CHF 100.– will be levied for misuse and CHF 200.– for forgery. 21. The transport company reserves the right to charge an administration fee of CHF 50 per incidence of misuse or forgery. 22. An initiated attempt of misuse will also carry the same consequences. 23. We reserve the right to prosecute under civil and criminal law.

Applicable law and place of jurisdiction 24. Swiss law exclusively is applicable to the contractual relationships between the Jungfrau Railways and its customers, including any disputes relating to the conclusion and the validity of the contract.
