Minutes of Parish Council Meeting held on Tuesday, 24 July 2012 at 7.30pm in the Parish Hall.

24. Declarations of Interest. Councillor Mrs Fryer declared a Prejudicial Interest in Minute No. 30.1. Planning Application 54310.

25. Approval of the Minutes of the Meetings held on 22 May 2012; 19 June 2012 & 4 July 2012. Approved and signed as a correct record.

26. Matters Arising. 26.1 Parish Council letter of support to the Community Council of in connection with funding for upgrade of heating system. Councillor Walls advised the letter had been drafted. Councillor Mrs Smyth expressed concern that previous grants would have to be paid back. Mr S Baber, Chairman of the Parish Hall Management Committee advised that in negotiations with the Community Council of Devon this had not been mentioned. Councillor Wall recapped on the historic details. County Councillor Edgell advised that the significant factor is that it is a Listed Building and work should continue to keep it in order.

26.2 Parish Council Invoice to Parish Hall in respect of commemorative Diamond Jubilee Medals. It was noted that this has been submitted by the Clerk.

26.3 Spare Notice Board. Councillor Risdon advised that there was nothing to Sept report at present. Agenda

26.4 DCC Highway Issues. It was noted that these had been reported and a reminder that the Neighbourhood Highways Officer contact Councillor Mrs Fryer. Councillor Mrs Fryer advised he had still not been in touch. She further advised that a neighbour has been in touch with DCC Highways regarding the recent flooding and photographic evidence is to be sent. 2 East Worlington Parish Council Meeting 24.07.12

Councillor Risdon advised he had requested, under the Freedom of Information Act, details of accidents at Gidley Cross since 2006.

26.5 Empty Property at Three Hammers. This property is privately owned and continues to be unoccupied.

26.6 Appraisal of Sites by Rural Housing Enabler. No details had been Clerk to provided. remind

26.7 Directional Sign in Witheridge. An Invoice to be prepared and sent to Mrs C Clerk Hurst-Bannister. The item to be raised again at the Budget Meeting.

26.8 Informal Meeting with Parishes regarding Centre - 7/6/12 at The Amory Centre, South Molton. It had not been possible for Councillor Wall to attend and was not known if Councillor Mrs Mills had attended.

County Councillor Edgell was not at the Meeting but had since been told by those who had attended that it was worth while. It was surprising that no Minutes were taken. The Mayor of South Molton is proposing to have the meetings every 3 months. The main discussion focused on the livestock market and supermarket. Council Executive Committee had proposed a new site to be made available for the livestock market at Pathfields beyond Mole Valley Farmers and the town is keen that the main part of the land is scheduled for development. The Clerk advised that Councillors from Warkleigh and Satterleigh Parish Council attended the Meeting and notes had been written up and provided to Clerk Councillors which she would circulate to East Worlington Councillors.

27. Reports. 27.1 Mr T Pullen, Chulmleigh Community College Academy Trust. When sending his apologies, Mr Pullen had provided a written Report which was circulated to Councillors, covering the first year of the Chulmleigh Academy Trust focusing on what has been delivered as a result of the partnership and the priorities for next year, following a clear trajectory of improvement in the Schools.

27.2 County Councillor R Edgell commented on the Meeting held in the Civic Centre on 5 July regarding the Parish Grant, which he attended. Approximately 70 Chairmen, Clerks and Councillors were there but no definite proposal was made. There is to be another Meeting in September and the impression given was that there will be a safety net for small Parishes although it was not known what had got in mind. He stressed that this Council should be represented at the next Meeting on September 19 at 7pm. The Clerk advised that on this occasion, she would not be able to represent the Parish Council due to another Meeting. Councillors Risdon and Mrs Smyth would check their diaries to see if they could PR/JS attend.

The Clerk advised that at the end of the last Meeting, North Devon Council officers suggested the formation of a Sub Committee comprising Councillors or Clerks from large, medium and small Parishes to work out the finer details of a scheme.

27.3 District Councillor Mrs S Croft. Apologies sent.

27.4 Police. Not present.

27.5 Emergency Plan/Snow Warden Scheme. This to be an item on the Sept September Agenda. Agenda

27.6 Parish Hall. The Chairman, Mr S Baber advised that there were ongoing Applications for grants, a Business Plan is in place and fund raising taking place, including a sponsored marathon he is undertaking within the Parish the following weekend.

27.7 Worlympics Update. Councillor Mrs Fryer advised that there had been a productive Meeting to plan this event. A Poster and Gold, Silver and Bronze Certificates had been prepared and were approved by Councillors. There would be a cost of £20.00 for the ink. Further arrangements were discussed. Mr and Mrs M Wall to open the event. Torchbearers had been organised. The Olympic Rings logo had been checked and verified as in order. A final Meeting would take place 2 weeks before the event.

27.8 Parish Grant Meeting on 04/07/12 attended by the Clerk. Previously covered.

28. Code of Conduct. Councillors had been circulated with the relevant literature comprising the Model Code from North Devon Council and the National Association of Local Councils. 28.1 To adopt a Code of Conduct. County Councillor Edgell advised that the cut off date for the old Standards regime was 1 July 2012. There had been insufficient time to produce a proper document and no guidance given and he felt this was unsatisfactory. The North Devon Council Model Code of Conduct has the backing of the Legal Department of North Devon Council.

Councillor Mrs Fryer proposed the National Association of Local Councils Model was adopted. Seconded by Councillor Risdon and unanimously agreed.

28.2 Members Register of Interests Forms. Members would ensure that these Cllrs were returned to the Clerk within 28 days.

29. Finance. 29.1 Balances. Treasurer's Account as at 9/7/12 £1,333.60. Business Instant Access Account as at 9/7/12 £1,000.00.

30. Planning. Clerk 30.1 54310 - Erection of one livestock building at Stone Farm, East Worlington. 4 East Worlington Parish Council Meeting 24.07.12

Councillor Mrs Fryer declared a prejudicial interest, being a neighbour of the applicant, left the room and did not take part in the discussion decision or voting thereon. It was resolved to recommend approval subject to the usual environmental constraints.

31. Planning Correspondence. 31.1 Parish Council Planning Application for Car Parking. Councillor Wall and Mr S Baber to follow this up with Mr A Gordon-Lee, who had offered his assistance TW/SB in this regard. A Meeting will be arranged with Councillors to progress this.

31.2 Dispensation in respect of the Car Park Planning Application. Councillors would not progress this.

31.3 The following North Devon Council Decision Notices were noted: APPROVALS FOR 53683 - Reserved Matters Application for erection of one new dwelling with covered parking (hybrid planning permission 48172) at former orchard & walled garden, East Worlington House, East Worlington.

54043 - Retrospective Application for erection of ground mounted solar photovoltaic panel array (2 rows 50kW) at Middle Burrow Farm, East Worlington.

31.4 53682 - Approval of details in respect of discharge of Condition 6 (phased programme), Condition 8 (details and drawings of design, materials and means of enclosure), Condition 9 (roof slate), Condition 10 (timber on elevations), Condition 11 (hard and soft landscaping), Condition 12 (arboricultural method statement), attached to Planning Permission 48172 at land adjoining Kinloch, East Worlington. Copy correspondence was noted to the Agent from North Devon Council confirming the details submitted are acceptable in respect of Phase 1 of the development.

31.5 North Devon Council Planning Application 53625 - Wind Turbine at Mounticombe Farm. Email from Debbie Holland and Adam Frankel with a request that this Council consider adding additional comments as a consultee. This Council responded on 5/4/12 as follows: "We support wind energy but there is concern regarding the size".

Mr A Frankel advised he had been in correspondence with North Devon Council Planning Officer Ms J Watkins who indicated that if the Application was to be approved by planners, the Application would be called in and heard by the Planning Committee in October. The Application was still open for comments, and the historic details were given. There was concern that other farmers would appeal, apply or re-apply and that there would be many more Applications.

Councillor Wall felt it would be helpful for the Parish Council to have a Policy in place when wind turbine Applications were received and suggested the following was included: 1. How close is the turbine to property? 2. Is it viable? 3. Concern as to whether the development is for the sake of it or part of the business as a high energy user and wishes to supplement energy.

A discussion by Councillors and County Councillor Edgell followed.

5 East Worlington Parish Council Meeting 24.07.12

It was left that Councillors would bring their suggestions to the Meeting regarding the Cllrs Car Park Planning Application Meeting.

Correspondence. 32. 32.1 DCC. Details of a Road Closure from 19 - 21 September from Boundys Cross to Horsehill Cross, East Worlington to enable May Gurney Limited to establish a new connection. The details were taken for the notice board and the Clerk would include SB the information in the Community News Section of the North Devon Journal nearer Clerk the time.

32.2 Lenthsman Visit. 2/8/12 - 6/8/12.

32.3 District Council. Letter regarding Planning Act 2008, Community Infrastructure Levy Regulations 2010 - Consultation on draft Charging Schedule. Comments to be received by 20/8/12. The draft Charging Schedule can be viewed on the website at: http://www.middevon.gov.uk/cil This communication had been received in hard copy form the day before the Meeting and it was not possible to study this in great detail. The Clerk had requested an email version which had been received on the day of the Meeting and this to be emailed to Councillors. It was hoped that Councillor Mrs Fryer would be SF able to respond on behalf of the Parish Council.

33. Notices & Publications Received. These were placed on the table & available to read.

34. Public Questions. None raised.

35. Matters raised by Councillors/Clerk. Worlympics Meeting. This had been covered previously during the Meeting.

36. Date of next Meeting: Tuesday, 25 September 2012 at 7.30pm in the Parish Hall.
