Parcel ID 02-00513. The applicant desires to establish a new heavy equipment retail and service business on the property. The company that wishes to establish on the property if rezoned is Flint Equipment Company. • New information since the October 1, 2019, Mainland Planning Commission meeting: On November 13, 2019, the applicant submitted the following document which are attached to this staff report. 1. Payroll data for the existing facility and the additional employees that will be added after the new facility is open along with the current taxes for the existing facility. 2. 3d perspective drawing of the proposed facility. 3. Zoning Site plan used in the previous presentation 4. Existing Commercial zoning map 5. Zoning Exbibit for the immediately adjacent properties 6. DOT Traffic Counts 7. National Highway System information. 1 Noticing: A public hearing notice was published in The Brunswick News, mailed to property owners within 200 feet of the subject property, and posted in two places on the subject property on October 21, 2019. The matter was noticed for the November 7, 2019, meeting, and the applicant requested a deferral to November 21, 2019. The Board of Commissioners deferred the application and public hearing to November 21, 2019. FINDINGS: In conformance with Section 1103 of the Glynn County Zoning Ordinance, the following factors are to be considered in making a decision on a request for rezoning: (Staff’s comment is shown in bold). 1. Whether the zoning decision will permit a use that is suitable in view of the use and development of adjacent and nearby property. The property is split zoned as Local Commercial (LC) and Forest Agricultural (FA). The property immediately northwest, Gary Lee’s Meat Market, is zoned LC, and there are several LC zoned properties to the west of the subject property before the county line with Brantley County. The property to the north, across the railroad tracks, is residential. The property to the southeast is the BOPOW parcel (Case number ZM4117) which is a separate rezone request from Planned Development (PD) to Highway Commercial (HC). The commercial uses allowed under the PD on this parcel are primarily consistent with Neighborhood Restricted Commercial (NC) and Local Commercial (LC). No other Highway Commercial property exists in this area. 2. Whether the zoning decision will adversely affect the existing use or usability of adjacent or nearby property. The neighborhood makes a transition from the Exit 29 interchange heading west along Highway 82. The uses are residential, agricultural or forestry, with a few local commercial uses. The Highway and Freeway Commercial uses are concentrated around the Exit 29 interchange. 3. Whether the property to be affected by the zoning decision has a reasonable economic use as currently zoned. Yes, the property is zoned local commercial along a portion of the Highway 82 and Forest Agricultural. 4. Whether the zoning decision will result in a use, which will or could cause an excessive or burdensome use of existing streets, transportation facilities, utilities or schools. Additional uses allowed in HC may create more traffic than the existing site creates as it is currently zoned. If the property is rezoned to HC and redeveloped in the future, the County would analyze impacts to streets, traffic, and utilities during the site plan approval process. The zoning decision would not cause an excessive or burdensome use of schools. ZM4010 – Flint Equipment Company Rezone Nov. 21, 2019 BOC 2 5. Whether the zoning decision is in conformity with the policy and intent of the Comprehensive Land Use Plan. The future land use map in the 2018 comprehensive plan, “Envision Glynn,” indicates that this property is Low Density Residential (LDR). The map reflects an intent to retain the residential character of the area. The applicant requested an amendment to the future land use map from LDR to Commercial to bring the use into compliance with the Comprehensive Plan. This request is noticed for consideration on October 1, 2019, prior to the consideration of the rezone request. 2018 Comprehensive Plan – Future Land Use Map 6. Whether there are other existing or changing conditions affecting the use and development of the property, which give supporting grounds for approval or disapproval of the zoning decision. No changes to the area since the 2018 Comprehensive Plan was adopted by the County. More intensive commercial uses continue to develop around Exit 29 under existing zoning. 7. For a zoning decision involving the grant of a special use or conditional use permit, the Planning Commission shall include comments on those matters identified in Section 904.3 of the Zoning Ordinance. Not applicable. ZM4010 – Flint Equipment Company Rezone Nov. 21, 2019 BOC 3 8. Such other matters as the Planning Commission deems relevant. The Planning Commission did not determine other matters as relevant. PLANNING COMMISSION ACTION At its regular meeting of October 1, 2019, the Mainland Planning Commission voted 3-3 (with Commissioner Williams absent) during two votes taken during the meeting. The first motion was in favor of denial, and the second motion was in favor or approval subject to restrictions. Both votes failed to carry a majority vote. BOARD OF COMMISSIONERS POSSIBLE ACTIONS Pursuant to Section 1107 of the Glynn County Zoning Ordinance, the Board of Commissioners shall take one of the following formal actions: (i) Approve the proposed zoning decision; (ii) Approve the proposed zoning decision with modifications or conditions; (iii) Continue the hearing to a later date; (iv) Remand the application back to the planning commission; or, (v) Deny the proposed zoning decision. If the site is only available for lease, the lease term must be a minimum of 25 years. The property is owned by Steven Swartzrock (27.98 acres) and Rockland Enterprises LLC (47.36 acres). The Charles City Area Development Corporation (CCADC) has an option on the property that expires August 31, 2022 (First Amendment to Option Agreement dated April 4, 2019). Based on the Grant and Development Agreement dated September 16, 2019, Charles City will grant funds to the CCADC to purchase the property no later than March 1, 2020.

It is located in Sheridan and Roosevelt Counties. This refuge lies in the highly productive prairie pothole region and has relief typical of the glacial drift prairie with relatively gentle rolling plains with occasional shallow depressions. This is basically a prairie refuge located in the transition zone be­ tween the mixed grass and short grass prairie. Native brush species consisting primarily of chokecherry, buffalo berry and snowberry are common in coulees and sandhill areas. A few old shelterbelts still remain on the refuge and these trees appear to be out of place on the prairie, but are composed of a variety of introduced deciduous species. The climate is typical of the northern great plains, with warm summers and cold winters, and marked variations in seasonal pre­ cipitation. Precipitation averages 12 to 15 inches per year. Temperatures can exceed 1000F in the summer and drop to -450F in the winter. Spring is generally the windiest period with veloci­ ties of 20 miles per hour that are associated with passing weather systems. The refuge encompasses 31,457 acres, which includes 13,546 acres of open water and marsh, 14,354 acres of grasslands and 3,557 acres of cultivated lands, primarily former croplands.
