1.1 DETERMINATION MADE BY THE AUGMENTED ELECTORAL COMMISSION FOR QUEENSLAND

Pursuant to section 73 of the Commonwealth Electoral Act 1918 (the Act), the augmented Electoral Commission for Queensland hereby determines that the boundaries and names of the Electoral Divisions into which the State of Queensland is to be distributed are as shown on the maps certified by the members of the augmented Electoral Commission for Queensland and lodged in File Number 03/1620 at the Principal Office of the Australian Electoral Commission in Canberra. These maps are numbered in the following sequence:

1.2 PROCESS FOLLOWED BY THE AUGMENTED ELECTORAL COMMISSION FOR QUEENSLAND IN MAKING ITS DETERMINATION

1. The determination of the augmented Electoral Commission for Queensland (the Commission) is that the boundaries of the electoral divisions in Queensland and the names of those divisions, including the new division of Bonner, shall be as proposed by the Redistribution Committee for Queensland in their report published on 22 August 2003, except for the changes described later in this report. 2. Notice of the Redistribution Committee’s proposal was published in the Commonwealth Gazette on 22 August 2003. Outline maps of the proposed redistribution by the Redistribution Committee for Queensland and a notice inviting Public Objections and Comments on Public Objections against the proposal were published in “The Courier Mail” and the “The Sunday Mail” newspapers on 23 August 2003 and 24 August 2003 respectively. In addition, the section 68 report was made available for public inspection at all offices of the AEC in Queensland. Furthermore, the section 68 report, outline maps and Public Suggestions and Comments on Public Suggestions were posted to the AEC website, www.aec.gov.au on 22 August 2003.

3. By the deadline of 6.00 p.m. on Friday 19 September 2003, Public Objections against the Redistribution Committee’s proposal were received from:

8. The augmented Electoral Commission during its deliberations considered all Public Objections, Comments on Public Objections and supporting documentation tabled at the inquiry.

9. In accordance with section 72(10)(b) of the Act, the augmented Electoral Commission issued a public announcement on 10 November 2003 that it had concluded its deliberations on the new boundaries and names of the 28 Divisions for Queensland.

10. This report of the augmented Electoral Commission’s determination is published in accordance with sections 73 and 74 of the Act.

1.3 REASONS FOR THE DETERMINATION MADE BY THE AUGMENTED ELECTORAL COMMISSION FOR QUEENSLAND

Consideration of Public Objections to the Redistribution Committee proposal

Community of Interests, Means of Communication and Travel, Physical Features and Existing Boundaries

11. The criteria set out in Section 66(3)(b) of the Act – community of interests, means of communication and travel, physical features and area, and boundaries of existing Divisions – are subordinate to the two objectives of enrolments in proposed Divisions being within a range of 3.5% above or below the average divisional enrolment at the projection time and current enrolments being within 10% above or below the quota. However, notwithstanding these overriding constraints, the Commission sought to ensure that the other criteria were given maximum possible consideration. Within the constraints imposed by the numerical criteria and the other considerations, the Commission adopted the view that it is highly desirable that electoral boundaries be readily recognisable. Accordingly, the Commission was guided by Local Government boundaries, locality boundaries, main roads, railways, waterways and other linear features, wherever possible.

12. The Commission received a number of objections and submissions arguing that Local Government Area Boundaries (LGA) are not mentioned in the Act and therefore should not form part of considerations when defining divisions. While agreeing that these are not mentioned within the Act, the Commission accepted their use as building blocks and indicators of community of interests as per s66 (3)(b) of the Act especially in rural areas. In metropolitan areas, LGAs were seen as less defining but their use was considered appropriate, taking other considerations into account.

13. One objection related to redrawing the boundaries across the State to “… produce an electoral redistribution that is as free from electoral bias as possible consistent with the criteria of section 66.” The Commission re-iterated that under Section 66 (3)(b) of the Act there are no provisions for including the consideration of political outcomes in the redistribution process. The Commission is of the firm view no political outcome was contemplated in the Redistribution Committee’s Proposal.

Rural and Provincial Queensland (including the proposed Divisions of Capricornia, Dawson, Groom, Herbert, Hinkler, Kennedy, Leichhardt, Maranoa and Wide Bay)

Objections to the proposed divisions of Dawson, Herbert, Kennedy and Leichhardt

14. The Commission received one objection, which suggested that the Shire of Nebo and that part of the currently in Capricornia should be included in Dawson.

However, as Dawson met the statistical requirements, the Commission held the view that no change was necessary and affirmed the Redistribution Committee’s Proposal.

15. The Commission received several objections to the transfer of electors to Kennedy and was cognisant of the reasons for the objections. The Commission was mindful of the fact that no objection advanced any alternative to meet the statistical requirements of the Act. The was required to lose a significant number of electors to remain within quota. As Herbert is contiguous with only Kennedy and Dawson, and Dawson was to remain unchanged, it followed that a number of electors be transferred from Herbert to Kennedy. 2 783 electors from City of Thuringowa were already contained in Kennedy and the Commission believed that rather than have a number of City of electors transferred to Kennedy and thus having two LGAs split, a further 7 190 City of Thuringowa electors be transferred to Kennedy.

16. As no objections were received pertaining to the proposed Leichhardt, the Commission affirmed the Redistribution Committee's Proposal for that division.

Objections to the proposed divisions of Capricornia, Groom and Maranoa

17. The Commission received several objections to the proposed Capricornia. One objection suggested that the Shire of Emerald should be transferred from Maranoa into Capricornia. The statistical requirements for Maranoa were such that it was required to increase the number of electors because of the low level of projected growth in rural areas. Having regard to the community of interests, in addition to the statistical requirements, the Commission adopted the Redistribution Committee’s Proposal.

18. Another objection sought to retain the Shire of Jericho in Capricornia but for the same reasons stated above for Maranoa, the Commission did not support this objection.

19. Two objections were received suggesting splitting the Shire of Duaringa. In following the principle of aligning divisional and LGA boundaries wherever possible, the Commission rejected these objections and determined that this particular area remain, as LGAs indicate a community of interests, in the Division of Capricornia.

20. An expression of concern was received regarding the size of Maranoa. At the commencement of the redistribution, Maranoa covered approximately 37.5% of Queensland geographically. However, it was substantially below quota, especially for enrolment projections. Therefore it was necessary to increase the number of electors to not only to fulfil quota at the commencement date but also to meet quota in 2007. The Commission recognised that the division is essentially one of low growth, and that a large sparsely populated area needed to be added to ensure that the quota was met. The Commission, while noting that the division now covers 45% of Queensland geographically, believed the result best reflects the requirements of the Act.

21. One objection suggested that the Shire of Clifton be added to Maranoa and to balance it by adding part of Crows Nest to Groom. The Commission recognised the strong community of interests that exists between Clifton and Toowoomba and as there was no need to change existing boundaries of Groom, the Redistribution Committee's Proposal was supported.

22. Since the publication of the Redistribution Committee's Proposal, minor amendments to the external LGA boundaries of Cambooya (Groom) and Gatton (Blair) have been

identified and the divisions are changed accordingly. It should be noted that no electors were affected by this change.

Objections to the proposed divisions of Hinkler and Wide Bay

23. The Commission received several objections to the transfer of electors from Hinkler to Wide Bay and was addressed at the Inquiry on this matter. The objection supporting the proposal was expansive in detailing the communities of interests that exist between the Shires of Eidsvold, Gayndah, Mundubbera and the rest of the Burnett region centred on Bundaberg. The Commission believed that while the dissenting arguments possessed merit, on balance it would accept the Redistribution Committee's Proposal for these divisions because the links appear stronger with Bundaberg (Hinkler) than Maryborough (Wide Bay). In addition, by accepting the above arguments, the Commission supported the retention of the Shire of Biggenden in Wide Bay.

24. The objection suggesting the placement of Cooloola into Fairfax rather than Wide Bay was considered by the Commission. The Commission formed the view that such a change would not be able to be accommodated without major compensating movement of electors in surrounding areas and therefore supported the Redistribution Committee’s Proposal.

Sunshine Coast (including the proposed Divisions of Fairfax, Fisher and Longman)

Objections to the proposed divisions of Fairfax, Fisher and Longman

25. Neither of the two objections against Fairfax, being the inclusion of the Shire of Cooloola (see paragraph 24) and the realignment of the boundary to retain all of in Fisher and place the localities of and Kuluin into Fairfax, met the statistical requirements of the Act without very significant changes to the proposed boundaries and the underlying nature of the divisions. Therefore the Commission determined that the Redistribution Committee's Proposal for Fairfax was acceptable with a minor adjustment to the divisional boundary in the Maroochydore area. That is, by following Cornmeal Creek, Southern Drive and the Sunshine Motorway rather than Maroochydore Road, an additional 1 458 Maroochydore electors are able to be retained in the same locality.

26. The Commission received several objections that included proposals pertaining to Fisher, including a further objection that did not satisfy the statistical requirements. Another suggested the swapping of the areas of Maleny and Landsborough between Fisher and Longman. The Commission believed that greater community of interests is achieved by keeping the railway corridors towns of Landsborough and Beerwah in the same division. Therefore the Commission supported the Redistribution Committee's Proposal with a minor adjustment to the boundaries of the divisions of Fisher and Longman. That is, to follow the Mooloolah Valley and Glenview locality boundaries (west of Glasshouse Mountains Rd) rather than roads, thus ensuring 220 electors were not split from the rest of Mooloolah Valley and Glenview.

Gold Coast (including the proposed Divisions of McPherson, Moncrieff and Fadden)

27. Apart from two minor objections, one referring to a personal desire for Victoria Point to remain in Fadden and the other for McPherson to be renamed Macrossan (see naming of divisions at paragraph 43 of this report), the three divisions wholly in the City of Gold Coast LGA elicited no other specific comments and the Commission accepted the Redistribution Committee's Proposal.

Greater Metropolitan Area (including the proposed Divisions of Bonner, Bowman, Brisbane, Griffith, Lilley, Moreton, Oxley, Petrie, Rankin and Ryan)

Objections to the proposed divisions of Bonner, Bowman, Griffith, Moreton and Rankin

28. The Commission received several objections to Rankin being east of the Pacific Highway. Even though a small portion of the City of Brisbane remains within Rankin, the philosophy of retaining the community of interests of an LGA is best served by linking those suburbs of the City of Logan east of the Highway with those in the west. Notwithstanding this, small portions of the City of Logan east of the highway are also included in the divisions of Bowman and Forde to meet statistical requirements. Accordingly, the Commission accepted the Redistribution Committee's Proposal for Rankin.

29. Several objections were received regarding Bowman. One wished to remain in the electorate of the current member and one other dealt with outcomes beyond the scope and control of the redistribution process. Other objections to Bowman are linked to the objections against Rankin being east of the Pacific Highway. One objection suggested that the part of Burbank (City of Brisbane) that was previously part of Fadden be added to Bowman. However, as the rest of Burbank that was previously in Griffith is proposed to be in the new seat of Bonner, the Commission believed the community of interests criteria is best met by having all of Burbank within the same division and accepted the proposal for Bowman.

30. One objection suggested the realignment of the proposed Bonner/Griffith boundary at Holland Park but that suggestion failed to meet the statistical requirements of the Act. Most other objections received regarding Bonner are reflected in the objections above pertaining to Bowman. However one objection also sought to have Lota and part of Manly West areas added to Bowman. As Bowman is comprised of all of the Shire of Redland and a small portion of the City of Logan, adding a section of the City of Brisbane would reduce the community of interests criterion compared with the Redistribution Committee's Proposal. The Commission therefore supported the boundary of the proposed Bonner. (The naming of Bonner is addressed at paragraph 42 of this report).

31. Objections were received regarding the Yeronga and Annerley areas proposed to be moved from Moreton to Griffith. In this instance, the Commission accepted many of the arguments put forward by several objections and determined that all of the suburb of Yeronga should be retained within Moreton and most of Annerley be retained in Griffith. Consequently, the Commission realigned the boundary for Moreton and Griffith. The Commission noted the objection regarding the linking of the suburbs of Carina, Carina Heights and Carindale, but decided to retain the boundaries as proposed in this area due to the statistical requirements of the Act.

Objection to the proposed division of Lilley

32. The only objection to Lilley is linked to Petrie and suggested making Petrie an “…outer northern suburbs seat…” with Lilley becoming an “…inner northern suburbs seat…” involving “…an exchange of 12,700 electors between the two electorates”. The Commission believed that the movement of more than 25 000 electors was unnecessary and does not meet any of the criteria under the Act. As a result the Commission affirmed the Redistribution Committee's Proposal.

Objections to the proposed divisions of Brisbane, Oxley, Petrie and Ryan

33. The Commission received several objections to the proposed seat of Brisbane with consequential effects on Ryan and Petrie. The Commission recognised that the transfer of electors from Ryan to Brisbane in The Gap and from Brisbane to Ryan in Paddington and Milton increased unnecessarily the number of electors transferred and determined that these moves be reversed. The Commission also determined that the area of The Gap which was proposed to be transferred from Dickson to Brisbane be transferred from Dickson to Ryan instead.

34. Objections were received that Ferny Hills and Ferny Grove should be retained in the one division in line with community of interests even though the former is in the and the latter in the City of Brisbane. The Commission considered this objection and saw some merit in the argument but believed that on balance the Redistribution Committee's Proposal should be accepted in this area, Ferny Hills in Dickson and Ferny Grove in Brisbane.

35. One objection sought to add parts of Stafford and Stafford Heights to Brisbane from Petrie. The Commission partly recognised the merit in this objection but also recognised that if done in isolation, a section of Everton Park would appear as a peninsula of Petrie, surrounded on three sides by Brisbane. The Commission determined that this section of Everton Park and part of Stafford should be added to Brisbane and removed from Petrie.

36. The same objection sought to have Brisbane retain some of the previous south of the Brisbane River. The Commission rejected this, not only on the grounds that the Brisbane River forms a natural boundary, but also, that South Brisbane is inextricably linked with West End and any split would severely impact on the community of interests criterion. Apart from the above changes, the Commission accepted the Redistribution Committee's Proposal for Brisbane, Petrie and Ryan.

37. Objections were received regarding three areas of Oxley. One objection suggested that the suburb of Blackstone should be placed in Oxley to provide a more clearly defined boundary that better reflects community of interests. The Commission agreed, in part, and determined that the area of Blackstone north of the Cunningham Highway be placed in Oxley.

38. Other objections suggested the rejoining of the suburbs east of the Centenary Highway with those in the west, however, the statistical requirements of the Act could not be

met in this scenario. Another suggested change was to give Acacia Ridge to Moreton along with Sherwood and Chelmer. The Commission determined that the boundaries proposed by the Redistribution Committee in these areas were appropriate considering the numerous compensating movement of electors that would be required to meet this objection. The Commission accepted the boundary for Oxley with no further change.

Outer Metropolitan Area (including the proposed Divisions of Blair, Dickson and Forde)

Objections to the proposed divisions of Blair, Dickson and Forde

39. Several objections were received regarding the boundary of Blair. The boundary with Oxley regarding Blackstone is addressed earlier in this report (see paragraph 37). Other objections include the use of geographical features rather than the LGA Boundaries in the northern areas of Blair; aligning the Queensland State electoral boundaries of Ipswich and Bundamba with federal boundaries; and moving some of the into Forde. The Commission considered but ultimately rejected these objections, believing that the Redistribution Committee's Proposal was more cognisant of the provisions of the Act. The Commission noted Gatton Shire Council’s approval of the Shire being retained in Blair.

40. The Commission did not receive any objections to the proposed Dickson other than those pertaining to Brisbane. Those objections, if adopted, would have returned Ferny Grove to Dickson. The Commission adopted the Redistribution Committee's Proposal for Dickson.

41. The only objections relating to Forde were dealt with by the Commission when considering the boundaries of Blair and Rankin. The Commission accepted the Redistribution Committee's Proposal for Forde.

Names of Proposed Divisions

42. The naming of the new division in honour of the late Senator Neville Thomas Bonner, AO generally received positive comment. The only exception was that one objection claimed that as Mr Bonner was an elder of the Jagera people, the name should be allocated to the division that closest covers the area purported to be “Jagera Land”. The objection claimed that the proposed Moreton meets this requirement. While the Commission understood the objection, the suggested naming of the new division was in honour of his service, as a Senator for Queensland, to the people of Queensland. The Commission rejected this objection and accepted the Redistribution Committee’s Proposal. Furthermore, acceptance of the objection would mean cessation of the use of Moreton as a division name and renaming of the proposed division of Bonner. 43. An objection was received proposing that the name Macrossan, suggested by several people at the suggestion phase of the redistribution, should not be discounted and perhaps be used to replace McPherson. The Commission determined that as there were only minor changes to McPherson, they were not sufficient to warrant a name change and the name McPherson would be retained. 44. The Redistribution Committee's Proposal resulted in 27 divisions that, for the most part, can be readily identified with the existing 27 divisions. The Commission determined to retain the existing names of those divisions and confirmed that the new division is to be named Bonner.

Displacement of electors

45. As a result of the augmented Electoral Commission’s determination, the number of electors transferred to a different Division is 392 821, which equates to approximately one in six electors of the State at 12 March 2003, being the quota date.

Significance of changes to the Redistribution Committee proposal

46. The augmented Electoral Commission determined that, in accordance with the provisions of the Act, the changes to the Redistribution Committee for Queensland’s proposal for the State were not significant. Consequently, in accordance with section 72(13) of the Act, the augmented Electoral Commission’s proposal is not open to further objection and the 2003 Redistribution of Queensland into 28 Electoral Divisions is now concluded.

1.5 GENERAL DESCRIPTION OF THE MANNER IN WHICH EACH PROPOSED DIVISION HAS BEEN CONSTITUTED

The tables in the following pages set out how each proposed Division is constituted and are arranged under Statistical Local Areas (SLAs). Each SLA comprises a number of CCDs that applied at the 2001 Census of Population and Housing.

The SLA is the most widely used unit in the presentation of Census data and collectively covers the whole of Queensland without gaps or overlaps. SLAs correspond, in the majority of cases, to Local Government Areas (LGAs). Where a particular LGA is substantially different from the general run of LGAs in terms of size and economic significance, the LGAs can be split into a number of SLAs. For reasons of availability of data, the SLAs used for this redistribution are those in place at the 2001 Census.

APPENDIX E GUIDELINES FOR THE NAMING OF COMMONWEALTH ELECTORAL DIVISIONS

Several Commonwealth Parliamentary committees have considered guidelines for naming Electoral Divisions. The guidelines below were affirmed by the Joint Standing Committee on Electoral Matters in 1995. The Redistribution Committee for Queensland and the augmented Electoral Commission for Queensland took these guidelines into account when considering the names of Electoral Divisions. It should be noted that neither the Committee nor the augmented Commission are in any way bound by them.

Naming after persons

In the main, Divisions should be named after deceased Australians who have rendered outstanding service to their country. When new Divisions are created the names of former Prime Ministers should be considered.

Federation Divisional names

Every effort should be made to retain the names of original Federation Divisions.

Geographical names

Locality or place names should generally be avoided, but in certain areas the use of geographical features may be appropriate.

Aboriginal names

Aboriginal names should be used where appropriate and as far as possible existing Aboriginal Divisional names should be retained.

Other criteria

• The names of Commonwealth Divisions should not duplicate existing State Districts. • Qualifying names may be used where appropriate (eg Melbourne Ports, Port Adelaide). • Names of Divisions should not be changed or transferred to new areas without very strong reasons. • When two or more Divisions are partially combined, as far as possible the name of the new Division should be that of the old Division which had the greatest number of electors within the new boundaries. However, where the socio-demographic nature of the Division in question has changed significantly, this should override the numerical formula.
