PART 1 REDISTRIBUTION OF QUEENSLAND INTO TWENTY - EIGHT ELECTORAL DIVISIONS 25 November 2003 Commonwealth Electoral Act 1918 Sections 73 and 74 1.1 DETERMINATION MADE BY THE AUGMENTED ELECTORAL COMMISSION FOR QUEENSLAND Pursuant to section 73 of the Commonwealth Electoral Act 1918 (the Act), the augmented Electoral Commission for Queensland hereby determines that the boundaries and names of the Electoral Divisions into which the State of Queensland is to be distributed are as shown on the maps certified by the members of the augmented Electoral Commission for Queensland and lodged in File Number 03/1620 at the Principal Office of the Australian Electoral Commission in Canberra. The determination of the augmented Electoral Commission for Queensland (the Commission) is that the boundaries of the electoral divisions in Queensland and the names of those divisions, including the new division of Bonner, shall be as proposed by the Redistribution Committee for Queensland in their report published on 22 August 2003, except for the changes described later in this report. 2. Notice of the Redistribution Committee’s proposal was published in the Commonwealth Gazette on 22 August 2003. Outline maps of the proposed redistribution by the Redistribution Committee for Queensland and a notice inviting Public Objections and Comments on Public Objections against the proposal were published in “The Courier Mail” and the “The Sunday Mail” newspapers on 23 August 2003 and 24 August 2003 respectively. In addition, the section 68 report was made available for public inspection at all offices of the AEC in Queensland. Furthermore, the section 68 report, outline maps and Public Suggestions and Comments on Public Suggestions were posted to the AEC website, www.aec.gov.au on 22 August 2003. 3. In accordance with section 72(3) of the Act, the augmented Electoral Commission held a public inquiry into Public Objections on Thursday, 16 October 2003. The inquiry was advertised in “The Courier Mail” and the “The Sunday Mail” newspapers on 11 October 2003 and 12 October 2003 respectively. A transcript of the inquiry is included on the compact disc accompanying this report. Those appearing at the inquiry were: Paul Neville MP, Member for Hinkler Cameron Milner, Australian Labor Party (Qld Branch) Hon Arch Bevis MP, Member for Brisbane 8. The augmented Electoral Commission during its deliberations considered all Public Objections, Comments on Public Objections and supporting documentation tabled at the inquiry. 9. In accordance with section 72(10)(b) of the Act, the augmented Electoral Commission issued a public announcement on 10 November 2003 that it had concluded its deliberations on the new boundaries and names of the 28 Divisions for Queensland. 4 10. This report of the augmented Electoral Commission’s determination is published in accordance with sections 73 and 74 of the Act. 1.3 REASONS FOR THE DETERMINATION MADE BY THE AUGMENTED ELECTORAL COMMISSION FOR QUEENSLAND Consideration of Public Objections to the Redistribution Committee proposal Community of Interests, Means of Communication and Travel, Physical Features and Existing Boundaries 11. The criteria set out in Section 66(3)(b) of the Act – community of interests, means of communication and travel, physical features and area, and boundaries of existing Divisions – are subordinate to the two objectives of enrolments in proposed Divisions being within a range of 3.5% above or below the average divisional enrolment at the projection time and current enrolments being within 10% above or below the quota. However, notwithstanding these overriding constraints, the Commission sought to ensure that the other criteria were given maximum possible consideration. Within the constraints imposed by the numerical criteria and the other considerations, the Commission adopted the view that it is highly desirable that electoral boundaries be readily recognisable. Accordingly, the Commission was guided by Local Government boundaries, locality boundaries, main roads, railways, waterways and other linear features, wherever possible. 12. The Commission received a number of objections and submissions arguing that Local Government Area Boundaries (LGA) are not mentioned in the Act and therefore should not form part of considerations when defining divisions. While agreeing that these are not mentioned within the Act, the Commission accepted their use as building blocks and indicators of community of interests
