CLAUSE 15 COUNCIL TO WRITE TO PREMIER, STATE AND FEDERAL MEMBERS AND NEIGHBOURING SHIRES REGARDING CONCERNS IN RELATION TO PROPOSAL TO DIVERT WATER FROM BURDEKIN RIVER TO MURRAY-DARLING SYSTEM - ISSUE TO BE RAISED AT NQLGA CONFERENCE (A-DCCS)

Motion

Moved Cr. Gist, seconded Cr. Loizou that the Burdekin Shire Council write to the Premier of Queensland, with copies to the State Member for Burdekin and the Federal Member for Dawson, expressing its concern as to the effect the proposal to divert water from the Burdekin and its catchment to the Murray-Darling system will have on the current and future residential, rural, industrial and commercial community in the Shire, and requesting, prior to a final decision, an independent and public report be prepared, addressing the economic, environmental and hydrological impact of the project on the community of the Shire.

Cr. McCathie foreshadowed the following motion:

"that correspondence be forwarded to the neighbouring shires:

1. enclosing a copy of the motion regarding Council's action in writing to the Premier of Queensland and State and Federal Members expressing concern in relation to the proposal to divert water from the Burdekin and its catchment to the Murray-Darling system; and

2. advising that Council will also be listing this issue as an agenda item at the North Queensland Local Government Association Conference."

CLAUSE 16 DISCUSSION ON IMPLICATIONS OF NEW WATER SAVINGS TARGETS SET BY STATE GOVERNMENT TO APPLY TO NEW BUILDINGS AFTER 1ST JULY, 2007 DEFERRED UNTIL NEXT MEETING (A-DEO) / (I-ADMIN) , (I-PLANDEV)

It was agreed that the discussion on the implications of new water savings targets set by State Government to apply to new building applications lodged after 1st July, 2007 be deferred until the next Ordinary Meeting of Council on 13th March, 2007 to enable further research to be undertaken.

There being no further business the meeting closed at 10.20 a.m.

3.01 General Maintenance • Christmas trees erected and decorated in Ayr and Home Hill; • Christmas banners put up at Ayr CBD crossing; • Solar lights installed at Skate Park, Anzac Park, Ayr • New shade sails installed and at Clare and Millaroo Pool; • New irrigation system completed at Brolga Park, Giru; • New basketball tower was erected at Watsons Green, Home Hill; and • 12 Coconets installed (10 at Coutts park, Ayr and 2 at Ayr Library) as part of Shires Palm safe program.

3.02 Community Assistance • Nativity scene erected at Don West Toyota; • 20 bins and clean up crew provided for Home Hill Harvest Festival; and • 10 bins and clean up crew provided for Ayr CBD Christmas parade.

3.03 Vandalism The following acts of vandalism occurred in the period:- • Old freezer dumped at Mount Inkerman lookout; • Break in at Council Nursery (chain fences cut and empty pots stolen); • 8 popup sprinklers broken at Chambers, Wickham Street, Ayr; • Break in at Tourist Information Centre, Plantation Park, Ayr (hose stolen and door latch broken from toilet storage area); • Toilet door broken at Alva Causeway toilets; • Garden bed in Ayr CBD was trampled on and plants pulled out; • Palms in pots located in Ayr CBD broken; • Illegal dumping on Old Home Hill Road and old river crossing (46 tyres, old fluming and general rubbish taken away)

3.01 General Maintenance • Christmas lights erected on Christmas tree in Brolga Park, Giru; • Pump replaced on the following water features:- o Ayr CBD marble feature; o Ayr CBD Centennial fountain; and o Burdekin Theatre Living Lagoon

3.02 Community Assistance • 6 sulo bins supplied, lights checked and toilets serviced for Carols in the Park held in Watsons Green, Home Hill

3.03 Vandalism The following acts of vandalism occurred in the period:- • Comfort Stop Home Hill:- o Fittings stolen from toilet door; o Lights around BBQ area broken; and o Pathway light bollards broken • Branch snapped off new fig tree in Queen Street, Ayr in front of Parker Street Video; • Vehicle driven through round-a-bout located at Queen and Soper Street; • Star pulled of Christmas tree in Home Hill CBD; • Rotten seafood scraps being dumped into bins in Ayr CBD after they have been serviced; and • Illegal dumping of rubbish outside of the Ayr Transfer Station

3.0 PARKS AND GARDENS

3.01 General Maintenance • New pump installed at water feature located on Corner of Queen and Edwards Street, Ayr; • Audit undertaken on Anzac Park irrigation system; • Removed Christmas decorations from Ayr and Home Hill Christmas trees; • Removed Christmas banners from Ayr CBD; • Removed Christmas tree frames from Ayr and Home Hill CBD; • Ayr and Home Hill Pool vacuum cleaners sent for repairs; • Repaired pump at Burdekin Cascades Caravan Park water feature; and • Installed flag pole on corner of Queen and Edwards Street, Ayr for Australia Day celebrations.

3.02 Community Assistance • Tree maintenance program completed at Beachmount Park; • Assisted in relocating the Tourist Information Centre from the Home Hill Court House to the Home Hill Railway Station; • Assisted in decorating the Home Hill Memorial Hall for Australia Day celebrations; • Supplied and transported chairs for the official opening of the new Tourist Information Centre in Home Hill; • Removed signage for the Community Events Notice Board located in Plantation Park, Ayr; and • Installed banner in Plantation Park, Ayr for Burdekin Singers

3.03 Vandalism The following acts of vandalism occurred in the period:- • A window grill torn out of window frame, entry door frame torn off, entry door lock destroyed and holes drilled in internal walls at Home Hill Band Hall Toilets; • Plants pulled out of garden bed in Seventh Street, Home Hill; • Grass area around Home Hill Diorama cut up by a vehicle; • Grass cut up by a vehicle in Plantation Park, Ayr; • Grass areas near Don West Toyota round-a-bout cut up by a vehicle; • Damage caused by a vehicle to garden beds located near Red Rooster, Queen Street, Ayr

After the recent success of @ Work & Play Queensland on Show in Sydney 2006, Townsville Enterprise Limited is once again coordinating a regional delegation to attend the @ Work & Play Queensland on Show Expo in Melbourne from 11-13 May. During a recent assembly all North Queensland Shire and City Council’s confirmed their active participation for this event

The aim of @ Work & Play is to entice skilled workers from Melbourne and the surrounding region to make the move north to Queensland. All Queensland regions will be represented and with the current skills shortage affecting the whole state, competition for skilled workers in all industries is expected to be very strong.

It is our intention to present high profile organisations and representatives for our region, whilst informing our target market of North Queensland’s potential. Background: The following comments are from the Manager of Planning & Development, Mr Shane Great:

The original Development Permit for reconfiguring this land was issued on 30th November 2005. This current application is triggered due to the Operational Works (i.e. roadworks, water, sewerage and stormwater management) required to service the proposed new lots.

Council’s engineering staff have assessed the design specifications lodged as part of this particular application and have recommended that the application be approved subject to the conditions included as part of the recommendation.

Executive Summary: Under the provisions of Part 25 of the Queensland Development Code, rainwater tanks will be mandatory for new dwellings in this shire which are approved for construction after 1 July 2007.

QDC 25 provides for Local Government to apply for modification of, or exemption from the Code.

The management group from the Environment and Operations Department have reviewed the Development Code, and considered reports from the Queensland Master Builders (North Queensland Region), The and an Investigation of the Feasibility of Domestic Rainwater Tanks by JWP Consulting Engineers for Citiwater Townsville.

Council is recommended to apply for exemption from Part 25 of the QDC, for the whole of the Shire area, on the grounds that viable water savings options are not found. The application for exemption is submitted by completing the standard application form, and sending to the Department of Local Government, Planning, Sport and Recreation. The Queensland Master Builders have provided written support for exemption.

It is understood that Townsville City and Thuringowa City have applied for exemption.

Officer’s Recommendation: Council resolve:- 1. Correspond with the Department of Local Government, Planning, Sport and Recreation, requesting exemption from Part 25 of the QDC, for the whole of the Shire area, and for all parts of the Code, on the grounds that viable water savings options are not found. 2. A copy of the correspondence be forwarded to the Local Member for Burdekin, Mrs Menkens.

Background: Council at its meeting held on 13 February, 2007 moved:- 1. Council correspond with the appropriate Government Department requesting exemption from the proposed legislation which will require all houses approved after 1 July 2007 to have a rainwater tank. 2. A copy of the correspondence be forwarded to the Local Member for Burdekin, Mrs Menkens.

Page 1 of 3 Council resolved that the motion lay on the table pending further investigations into the proposed legislation. Council at its meeting held on 27 February, 2007 agreed to defer discussion until the ordinary meeting of Council on 13 March, 2007, to enable further research to be undertaken.

Councillors will be aware that there are areas of Queensland with significant water supply problems, particularly in the south-east, and there is an urgent need to introduce water-saving measures. QDC 25 came into effect in SEQ on 1 January this year, and for other areas the commencement date is 1 July 2007.

Burdekin is located in Group 6, for which water savings targets are 59 kL (kilolitres) per year for new detached houses and 35 kL per year for other new Class 1 dwellings.

The Councils in Group 6 are: Atherton Shire, Burdekin Shire, Cherbourg Shire, Douglas Shire, Hope Vale Shire, Kilkivan Shire, Mackay City, Mirani Shire, Murgon Shire, Sarina Shire, Tiaro Shire, Whitsunday Shire, Woocoo Shire, Wujal Wujal Shire, Yarrabah Shire.

This grouping is rather strange. There is a wide range in average annual, frequency and distribution of rainfall between these locations, suggesting that little attention has been paid to the rainfall statistics.

There are other requirements in addition to the water savings. The following relate to new detached dwellings, and include:-

1. Dwellings must collect rain from a minimum 100m2 of roof, or half the roof area, whichever is less 2. Minimum tank size is 5,000 litres 3. Collection for external use, and for internal use, to toilet cisterns and washing machine cold water taps 4. Discard 15 litres ‘first flush’ of roof catchment 5. Screened rainheads, mosquito and vermin proofing, flap valves to the tank inlets 6. Automatic switching to allow top-up from reticulated supply, with backflow prevention 7. Connection of overflow to stormwater, with physical air-break or non-return valve.

The specification requires a number of devices and fixtures in addition to the tank itself. It is estimated that the additional cost per detached dwelling is around $5,000 – confirmed by Housing Industry Association.

In June 2003, Citiwater Townsville commissioned JWP Consulting Engineers to investigate the feasibility of domestic rainwater tanks.

The JWP Report is a 67 page study, covering water quality, climate and seasonal rainfall, intensity of rain events, water charges and financial implementation, and mosquito-born diseases.

The key findings are:

• The seasonal nature of rainfall in the dry tropics makes it difficult to design a rainwater tank system that will be of benefit to the property owner and the water authority • During the latter part of the dry season, rainwater tanks are likely to be empty, whereas peak demands on the reticulated system will still occur during these periods. (It should be noted in this context that reticulated water supply systems are also required to provide for fire fighting). • There is a risk that poor installation and maintenance could increase the incidence of mosquito-born diseases

Page 2 of 3 • Rainwater tanks will collect a proportion of run-off during ‘normal’ rain events, but have little impact when less frequent but massive rainstorms occur. Since the stormwater systems are necessarily designed for these rainstorms, there is no benefit for stormwater management.

The report concludes that there is no benefit gained by property owners, residents or the water service provided.

The management group from the Environment and Operations Department have also noted the following reasons for applying for exemption:

• Burdekin Shire has a low number of new dwelling applications (35 new dwellings) • Burdekin Shire is a rural shire and has increased risk of contamination • Burdekin Shire has reducing trends in water consumption • There is no immediate threat that that the Burdekin Shire water supply will run low • There are other more relevant local issues with regard to water usage reductions that need to be investigated.

Executive Summary: The future use of the Home Hill Showgrounds was identified by Council for investigation as a Process Improvement Project. Following a public call for Expressions of Interest, no submissions were received. Consequent to this, an expression was received from Bowmaker Family Trust. Part of the proposed activities suggested by the Bowmaker Family Trust include using part of the showgrounds as a motorhome stopover. To enable the motorhome stopover activity within the showgrounds, an appropriate Management Plan has to be prepared and submitted to the Department of Natural Resources and Water (DNRW) for approval.

Officer's Recommendation: That Council :

1. Approve the Management Plan for the Secondary Use of Trust Land at the Home Hill Showgrounds, including the use of part of the land for the purpose of conducting the operation of a motorhome park for the parking of self-contained motorhomes only, and submit the Management Plan to the Department of Natural Resources and Water (DNRW) for approval;

2. Agree in principle to enter into negotiations with the Department of Natural Resources and Water for trustee lease to Bowmaker Family Trust of the Home Hill Showgrounds Reserve R95 and R115, containing an area of 11.2 hectares on standard lease terms and conditions including but not limited to : (a) Term - 25 years (b) Annual Rental – 10 cents per annum if and when demanded. (c) Responsibility for all repairs and maintenance of buildings and grounds (d) Payment of annual rates and charges (e) The lessee is to use the land only for public purposes consistent with the reserve purpose being showgrounds and recreation apart from those uses identified in the Management Plan (includes motorhome stopover) (f) Lessee to provide appropriate records to prove that income is used for the development, maintenance and expenses of the land.

Background – Management Plan A draft Management Plan for Secondary Use of Trust Land for the Home Hill Showgrounds was submitted and adopted, for consultation purposes, by Council on 12 April 2005. Following adoption, community consultation was undertaken. This process was required by DNRW as a specific section was included in the Management Plan to accommodate the use of part of the area for parking of self-contained motorhomes.

Public meetings were held in respect of the Home Hill and Ayr Showgrounds on 12th and 26th May 2005 respectively. The community consultation revealed that caravan park operators were concerned about possible loss of revenue, even though motorhome bodies indicated that their members may not use the services of caravan parks.

The community consultation process followed by Council and its outcome need to be advised to DNRW, as well as Council’s decision on use of part of the land for the purposes of conducting the operation of a motorhome park for the parking of self-contained motorhomes only.

Background – Expressions of Interest Following assessment by Council on 7 March 2006 of the objectives and scope of the Future Use of the Home Hill Showgrounds project, stakeholders were identified and contacted. Stakeholder meetings were held on 7 April, 16 June and 5 September 2006.

At its meeting held on 12 September 2006 (Clause 14), Council resolved to call Expressions of Interest for lease of the Home Hill Showgrounds Reserves. To assist community groups and organisations who may have had an interest in submitting an Expression of Interest, a consultation meeting was held to explain all matters regarding the proposed trustee lease.

No expressions were received at the closing date, (9 October 2006).

Since that time an Expression of Interest has been received from Bowmaker Family Trust. Mr Leroy Bowmaker visited the Shire on 22 February to further discuss his proposal.

Mr Bowmaker interest’s in the land originates from his close association with the district, having grown up in Home Hill and attended many working bees and events at the Home Hill Showgrounds, and his desire that the reserves continue to be available for community use by present and future generations.

Mr Bowmaker advised that he has sourced community support and has a number of organisations prepared to engage in usage of the area for leisure activities.

Once repairs are completed, it is Mr Bowmaker’s desire to also use the area as a stopover for motorhomes, including disposal of grey water. Council will recall that the use of the Home Hill Showgrounds area as a stopover for motorhomes has been considered in the past, the Council will need to give consideration to including this use in the Draft Management Plan.

Link to Corporate/Operational Plan 6.4 recognise the provision of services, facilities and infrastructure across the Shire (including non-Council owned) to determine most efficient and effective delivery for the Shire, including Showgrounds facilities.

Legal Authority or Implications (statutory basis – eg Act, Local Law, legal risks) Land Act – the Reserve can be trustee leased subject to approval of Department of Natural Resources and Water.

Financial and Resource Implications It may be necessary for Council to demolish some buildings prior to lease of the area. This issue should be discussed and negotiated with any proposed lessee. A trustee lease, on standard terms, should transfer the responsibility for maintenance and upgrade of facilities and grounds from the Council to the lessee, unless otherwise agreed by Council
