SUMMARY The CHATEAU Bazaar is an indoor-outdoor and music festival occurring every Thursday + Friday staring in August running through October 2020, dependent on COVID regulations outlined by State of Minnesota and of Rochester, Minnesota.

CHATEAU Bazaar aims to carry on CHATEAU’s mission in arts+culture and celebrating community. We will welcome artists and visitors from all lifestyles. CHATEAU is a safe place where creativity, individuality and free expression are welcome.

APPLICATION PROCESS

• 2020 Application Open: July 15, 2020 • First Vendor selections will be made on the July 27, 2020 • Vendor selections will be made every Monday thereafter, 10 days in advance of the next Bazaar • August 3 selection for August 14-15 bazaar • August 10 selection for August 21-22 bazaar, and so on

1. To Apply: a. All vendor applications are completed online through Manage My Market i. Applicants must be 18 years of age or older ii. Applicants must list all products intended to sell on the application iii. Applicants many apply to as many dates as they would like to sell iv. c. A one-time application fee of $10 will be paid in order to file an application for one or more dates

3. Participation Fee a. 10’ x 10’ space - $200 per week (Thursday + Friday); or b. 25% of gross sales (CHATEAU will do all point of sales for COVID purposes and ease in operations)

4. Application Fee a. Upon applying to Manage My Market, vendors will be required to pay an upfront fee of $10. This fee will only be waived for CHATEAU members. Click here to become a member. b. An invoice will be sent to you through email once the CHATEAU has received your application. Paying this fee is the final step to complete your application, and your application will be consid- ered incomplete until the CHATEAU receives this application fee. c. NOTE: Paying the application fee does not guarantee entrance into the market.

5. Application Review Process: a. Applications will be reviewed by the CHATEAU and selected based on the following criteria: i. Original and unique products ii. Craftsmanship (at least 80% handmade) iii. Ties to the local Rochester, Southeast Minnesota, and Minnesota arts community iv. Artist’s biography a) Headshot or photo of artist

b) 4-6 high resolution color images of works for marketing purposes which do not re- quire image credit c) 100 or less words describing your products or the work in terms of unique concept, creative process, technique and/or materials used d) Statements longer than 100 words are subject to editing b. Failure to meet all guidelines above may result in forfeiting review of your application

VENDOR SELECTIONS & AWARDS 1. Booth Placement: a. CHATEAU staff will use the following considerations to assign booth locations and you may not have the same space from week to week. CHATEAU must follow all City-State-CHATEAU COVID regulations. CHA- TEAU at its sole discretion will place vendors and booth with this is mind: i. The overall quality and diversification of the artists and offerings ii. Total number of event dates requested by the vendor applicant iii. Proximity to competing or similar vendors iv. Electrical needs (electricity is not guaranteed) v. Overall flow of the event vi. Vendors are provided a 10’ x 10’ space and must stay within the assigned allotted area. We may be able to accommodate a smaller booth for those who prefer, but at our discretion.

2. Booth Representation: a. Only one business owner or artist may be present in booth indoors in CHATEAU due to COVID re- strictions and two (2) outside in alley. Booth attendants may change out throughout both days but there must be a representative at the booth at all times. b. Booth representative must wear a mask at all times. If a mask is not worn, art, artisan or booth repre- sentative will not be allowed to present and booth fee will be forfeited c. Due to COVID, there will be no sharing booth with multiple artists

3. Products Sold a. All items sold at the market must be approved by the CHATEAU. Vendors may not add products later in the season unless the CHATEAU approves them first i. If a vendor is found to be selling products that did not originate with their application and did not receive permission by CHATEAU staff, the vendor may be suspended for the remain- der of the bazaar-market season

4. ST19 Form a. Event organizers are required to collect this form from all vendors. Access a ST19 form is available at the end of this application or by clicking here ST19 form. Forms MUST be submitted with application prior to their market date. i. Disclaimer: Submitting the ST19 form does not guarantee acceptance into the market. Please do not send payments prior to receiving the CHATEAU Bazaar welcome packet from the CHA- TEAU. (Only payment exception to this is the $10 application fee that must be paid to be con- sidered for market.)

5. Sales & Use Tax a. Tax: This is each vendor’s responsibility. The Sales Tax must be included in the cost of the sale price. {Example: Earrings retailing for $35.00 include 7.5% for sales tax to be paid by artist. CHATEAU will not be responsible for sales & use tax on vendor sales.) b. Sales and check-out processing: CHATEAU will process all sales. Booth representative will provide cus- tomer a bill of sales. Once customer pays CHATEAU Ambassador, they will receive a stamp on receipt and can pick up product from artist or booth representative. No product will leave CHATEAU without being paid for with a stamped receipt. c. All credit card sales are charged 3.5% credit card processing fee by the CHATEAU.

6. Payments for Booth Fees and/or Product Sales Vendors have two options for paying booth fees: a. Standard Booth Fees will be collected one week after the application is chosen on the Monday before the Bazaar. b. Commission-Based Booth Fee: READ CAREFULLY. CHATEAU will process all product sales for Commission based model and provide your net sales (Gross Sales less CHATEAU Commission of 25%) on each Monday after Closing by check for all sales made. You will receive your payment via Check or Venmo.

Please do not make any payments until receiving an invoice from CHATEAU.

7. Late Fees a. If booth fee is not received on the Monday before the Bazaar at which the artist is appearing, the booth space is subject to forfeit and may be given to another artist.

8. Rebuttal Rule: a. If a vendor is not accepted into the market by the CHATEAU, there are no rebuttals allowed.

9. Wait List Additions: a. If a vendor from the waiting list agrees to fill a vendor space at the market, payment will be received over the phone upon acceptance of the dates in during load-in time on event site prior to setting up.

WEATHER & CANCELLATIONS

1. All outstanding invoices or payments received are non-refundable unless specifically stated otherwise by CHATEAU.

2. Weather: a. CHATEAU staff will work monitor outdoor booths with the National Weather Service to track severe weather throughout the summer. While this is a rain or shine market, factors that impact safety like hail, high winds, tornado warnings, and/or lightning can be cause for delay or cancellation of outdoor booths of the CHATEAU Bazaar. Prolonged heavy rain may also cause cancellations. CHATEAU will post the outdoor booth status morning of the day of bazaar on CHATEAU website. b. Day of emergency communications will be communicated via Textiful, the CHATEAU Bazaar text alert platform. i. Sign up for alerts by texting BAZAAR to 312-487-3550. c. CHATEAU Bazaar is an outdoor and indoor market, which means rain and other unpredictable factors remain a possibility. Vendors should be prepared for outdoor weather elements. The event is immediately over when evacuation orders have been issued by CHATEAU staff or the City of Rochester.

3. Cancellations & Refunds: a. CHATEAU Cancellations i. In the event of inclement weather, outdoor vendors will be given the option to relo- cate indoors in either the CHATEAU Salon or the Skyway Mezzanine. If both days are affected by inclement weather and accommodations indoors are not made, 50% of the booth fee will be repaid. Commission fees will not be affected by inclement weather and no refunds will be given if that payment structure is chosen. b. Vendor Cancellations i. If a vendor decides to cancel any market dates, the vendor must provide advanced notice so that staff can fill the booth space from the waiting list. i. No refunds will be given if the vendor cancels for any reason.

4. Termination: a. The CHATEAU reserves the right to terminate any vendor in violation of any policy or procedure, in- cluding ill-behavior toward CHATEAU staff and volunteers, event attendees, and/or other vendors, without warning. No refund will be issued. b. The CHATEAU serves alcohol on the premise. Vendor, if of legal age and holding a valid form of iden- tification, is allowed, at their own discretion, to consume alcohol. Any openly drunken or lewd be- havior will be grounds for termination.

OPERATIONS 1. Sale Hours: a. Vendors should load in according to the load in schedule and be present at their booth for the entirety of the bazaar. i. Thursdays 4 p.m. to 8:00 p.m. ii. Fridays 11 a.m. to 8:00 p.m. iii. If a vendor sells out of product, they must remain at the event through operation hours to present a full market and to maintain safe exit procedures. iv. Should a vendor start ‘shifting’ their allocated space or taking down booth earlier than hours above, the vendor will be asked to remain in their assigned (clearly marked out) spaces or forfeit deposit and miss the next CHATEAU Bazaar market date at no refund. With the exception of a documented medical or family emergency.

2. Canopies & Signage: a. If vendor is provided an outdoor space, vendor must provide a fire or flame rated canopy (an EZ Up 10’ x 10’ tent is highly recommended) and tables for their booth. i. The canopy must be weighted down with at least 30 lbs. per leg (120 lbs. Total). Weights must be actual tent weights and singularly attached to each tent leg. ii. Use of propane tanks, tables, or other equipment as weights is prohibited and CHATEAU reserves the right to enforce this regulation. If the vendor does not comply, vendor will be asked to halt sales until proper weights are secured.

Vendors who apply for any space must comply with the CHATEAU’s temporary membrane, structures, tents, and cano- pies policy.

3. Electricity: a. There is extremely limited electricity for vendor usage. Food vendors will be accommodated first for electrical needs. Those with the greatest power needs will be placed near power sources located close to the stages. If electricity is needed for your booth, specify the voltage request including why electric- ity is needed on the application. The CHATEAU will assign you a power source. If you utilize a source not assigned to you, you will be asked to remove your hook up. Note: electricity is not guaran- teed to most vendors. Contact the CHATEAU if you have any questions regarding power on site. i. You may not bring your own personal generator. Unless it is a “whisper” generator and you are outdoors.

4. Sound: a. You may not play sound from your vendor booth. CHATEAU Bazaar is a music and art festival, and CHATEAU programs the event area with both live and recorded music.

5. Load-In Procedure: a. The vendor welcome packet will detail specific load-in times based on your booth location. Here is a general overview of the process: i. Check-in with event staff and unloading procedures ii. Quickly unpack products from vehicle and park vehicle off-site iii. Return after parking to set up the tent and product displays iv. Any vendor unloading or parking in an unauthorized area will be asked to move. b. Disclaimer: The CHATEAU is not responsible for vendor parking, and any trucks and trailers must get in and out of vendor loading area as quickly as possible.

6. Load-Out Procedure: a. The vendor welcome packet will detail specific load-out times based on your booth location. Here is a general overview of the process: i. Pack up all product and take down tent before retrieving vehicle. ii. Retrieve vehicle from parking. iii. Follow directions from event staff to drive to designated booth space. iv. Quickly pack vehicle. v. Follow directions from event staff and slowly drive out of the event. b. Unloading. The parking lot nearest CHATEAU is a privately owned parking lot. CHATEAU or City will attempt to rent space for loading and unloading but cannot promise such parking will be available. There is street parking near CHATEAU. iii. Use the utmost caution when entering the market space with your vehicle.

7. Vendor/CHATEAU Relations: a. If any vendor is found to be mistreating CHATEAU staff, inclusive of all employees (direct staff or third party) or ignores their instruction, the vendor will receive one (1) written warning. If misconduct is re- peated, no second warming will be given, and the vendor will be removed from the market for the entirety of the season. CHATEAU reserves the right to directly terminate a vendor if the conduct is deemed severe enough for immediate removal from the market. b. No smoking is permitted by any vendors/employees on the event site. This is a health department rule and will be strictly enforced for all event vendors.

8. Vendor-Generated Trash: a. Vendors must remove any trash created by their space and haul away upon load- out. The trash con- tainers set in the market area are for attendees’ use and are not intended to handle vendor-generated trash. b. Vendors are NOT allowed to use on-site Sanitation cans rented by the CHATEAU. All vendors must

take away their own garbage and dispose of properly. c. If a vendor is found to be using event-specific garbage cans, CHATEAU reserves the right to write up the vendor.

PARKING 1. The CHATEAU is not responsible for vendor parking. A variety of parking options for both vehicles and trail- ers/oversized vehicles are available in downtown Rochester. Visit rochesterparking.com to review options and make appropriate accommodations.

ADDITIONAL INFORMATION 1. The CHATEAU or any associated businesses or sponsors are not responsible for any accidents or damage that take place as a result of vending at the event.

2. The CHATEAU is not responsible for any goods the vendor sells that in any way cause harm to the purchaser of your goods or services provided at the event.

3. In the event a vendor is either unable or unwilling to fulfill contracted participation in the event for any reason, the vendor must notify Robin Anderson immediately and CHATEAU reserves the right to fill that vendor space with another vendor from the wait list.

4. All authorized vendors participating in the event shall be individually responsible to the CHATEAU for any loss, personal injury, deaths, and/or any other damage that may occur as a result of the vendor’s negligence or that of its servants, agents, and employees, and all vendors hereby agree to indemnify and save the CHATEAU harmless from any loss, cost, damages, and other expenses, including attorneys’ fees, suffered or incurred by the CHA- TEAU by reasons of the vendors’ negligence or that of its servants, agents and employees; provided that the ven- dors shall not be responsible nor required to indemnify the CHATEAU for negligence of the City, its servants, agents or employees. No insurance is provided by the CHATEAU to participants in the street market.

5. A CHATEAU Bazaar vendor is responsible for complying with all federal, state, and local laws and ordinances at its own cost.
