jail but in 1867 the military turned him over to civilian courts which released him on bail n A few other Confederate officials spent short times in jail n Only Major Henry Wirz, commander of had to be readmitted n 1862: Lincoln appointed provisional governors for those parts of the South that had been occupied by federal troops n December 8, 1863: Lincoln issued 10% Plan n With exception of high Confederate officials and a few other special groups, all Southerners could reinstate themselves by taking a simple loyalty oath n When, in any state, a number equal to 10% of those voting in 1860 election had taken this oath, they could set up state government n Government had to be republican in form, must recognize freedom of slaves, must provide for black education Pearson Education, July 1864: Wade­Davis Bill n Provided for constitutional conventions only after a majority of the voters in a southern state had taken loyalty oath n Confederate officials and anyone who had “voluntarily borne arms against the United States” were barred from voting in the election or serving in the convention n Besides prohibiting slavery, new state constitutions would have to repudiate Political strength came from poor whites and yeomen farmers of eastern Tennessee n Enjoyed attacking “aristocrats” n Free homesteads, public education and absolute social equality were his goals n Despite early Republican willingness to work with him, he soon alienated them n Had respect for states’ rights n Had contempt for blacks Pearson Education, Inc., publishing as Longman © 2008 PRESIDENTIAL RECONSTRUCTION Johnson’s Reconstruction vision n Assumed that with war over, most Southerners would take loyalty oath n More classes of Confederates, including those with property in excess of $20,000 were excluded from the general pardon n By the time Congress convened in December 1865, all the southern states had organized governments, ratified the Thirteenth amendment abolishing slavery and elected senators and representatives Pearson Education, Inc., publishing as Longman © 2008 REPUBLICAN RADICALS n Ultra radicals in Congress (led by Sumner) demanded immediate and absolute civil and political equality for blacks n Should be given the vote, a plot of land, and access to decent education n Radicals (led by Thaddeus Stevens in House and Ben Wade in Senate) agreed with ultras’ objectives but were willing to forgo actual social equality n Moderate Republicans wanted to protect former slaves from exploitation and guarantee their basic rights but were not Republicans because threatened to return power to Democrats n Southern voters provoked Congress by their choice of congressmen n Black codes, aimed at keeping blacks in “as near a state of bondage as REPUBLICAN RADICALS Black Codes n Most permitted blacks to sue and testify in court, at least against others of their own race n Could own certain types of property and other rights were guaranteed n Could not bear arms n Could not be employed in an occupation other than farming or domestic service n Could not leave their jobs without forfeiting back pay n Mississippi code required them to sign RECONSTRUCTION n Congress formed joint committee on Reconstruction headed by Senator William Fessenden n Held public hearing that produced much evidence of mistreatment of blacks n Strengthened Radicals n Congress passed bill extending and strengthening the Freedman’s Bureau which had been established in March 1865 to care for refugees n Johnson vetoed it arguing it was an unconstitutional extension of military authority in peacetime Pearson Education, Inc., publishing as Longman © 2008 CONGRESS REJECTS JOHNSONIAN RECONSTRUCTION n Congress responded by passing a Civil Rights Act n Declared specifically that blacks were citizens n Denied states the power to restrict their rights to testify in court, to make contracts for their labor, and to hold property n April 9, 1866: Congress overrode presidential veto of Civil Rights Act and obtained upper hand in Reconstruction Pearson Education, Inc., publishing as Longman © 2008 CONGRESS REJECTS JOHNSONIAN RECONSTRUCTION n Johnson expected southern yeomen to share his prejudices against elite, voting suggested they did not n Johnson himself pardoned many of these “aristocrats” after they applied personally n Believed Congress could not legislate for South without Southern representatives but did not understand effect of southern intransigence on northern public opinion Pearson Education, Inc., publishing as Longman © 2008 CONGRESS REJECTS JOHNSONIAN RECONSTRUCTION n Yet Radicals faced problems: n Few Northerners believed in black equality n Between 1866 and 1868, Wisconsin, Minnesota, Connecticut, Nebraska, New Jersey, Ohio, Michigan and Pennsylvania rejected bills granting blacks the vote n Radicals were demanding not merely equal rights for freedmen but extra rights; not merely the vote but special protection for it, which flew in the face of conventional American belief in equality before the law and individual self­reliance Pearson Education, Inc., publishing as Longman © 2008 THE FOURTEENTH AMENDMENT n June 1866: 14 th Amendment submitted to states n Never before had newly freed slaves been granted substantial political rights n When British Caribbean sugar islands had AMENDMENT n Supplied broad definition of citizenship n Struck at discriminatory legislation like Black Codes n Attempted to force Southern states to let blacks vote by threatening to reduce their Congressional representation n Former federal officials who had served under the Confederacy were barred from state or federal office unless specifically pardoned by two­thirds vote of Congress n elections n Did “swing around the circle” to rally the public n Failed dismally n Northern women objected to “man” in amendment but most Northerners were determined to see African Americans have RECONSTRUCTION ACTS March 2, 1867: First Reconstruction Act n Divided former Confederacy (except Tennessee) into five military districts, each controlled by a major general n Gave these officers almost dictatorial power to protect the civil rights of all persons, maintain order, and supervise the administration of justice n To rejoin union, states had to adopt new state constitutions guaranteeing blacks the right to vote and disenfranchising broad classes of ex­Confederates n If new constitutions satisfactory and if new governments ratified 14t h amendment, would be admitted to Second Reconstruction Act required military authorities to register voters and supervise the election of delegates to constitutional conventions n Third Act further clarified procedures n Whites prevented ratification by refusing to vote thus failing to provide the required majority of registered voters n March 1868: Congress allowed constitutions to be approved by majority of voters n June 1868: Arkansas was readmitted

THE POLITICS OF RECONSTRUCTION by Armstead L. Robinson The first Reconstruction was one of the most critical and turbulent episodes in the American experience. Few periods in the nation's history have produced greater controversy or left a greater legacy of unresolved social issues to afflict future gener- ations. The postwar period-from General Robert E. Lee's surren- der at Appomattox in April 1865 through President Rutherford B. Hayes's inauguration in March 1877-was marked by bitter partisan politics.     ^Andrew Johnson and the Philadelphia Election of 1866 HE TRADITIONAL image of Andrew Johnson's campaign tour during the congressional elections of 1866—the "swing Taround the circle," as it was called—is one of an ill-tempered, illiterate, semi-insane, and thoroughly undignified President thrash- ing madly through the North, harassed on all sides by gangs of ruffians instigated by the Radicals. The conclusion is that Johnson failed politically because he was unable to present his ideas in a sufficiently decorous manner. But it is questionable, when all is said and done, that political success is the natural result of political dig- nity. Certainly, the utterances of Thad Stevens or, better yet, Ben Butler during this campaign were not notably dignified, and, in any case, Johnson had spoken often in the North during the war and had been well received. What this suggests is that perhaps the real clue to his failure, in Philadelphia in particular and in the North in general, lies in what he was saying rather than in any fault of delivery. The essential issue was that of the Negro. The status of the Negro (the basic issue of Reconstruction and therefore of the 1866 election) was not decided in isolation but rather within the apprehensive atmosphere of the i86o's. Thus the "swing around the circle" should be viewed in the context of the Negro question and the general anxiety of the northern voter. The stage for the congressional elections of 1866 had been set by the clash between President Johnson and Congress in the spring of that year.

For at least a century, the bully pulpit has amplified presidential power and authority, with significant consequences for the separation of powers and the constitutional order more broadly. Although the power of presidential rhetoric is a familiar feature of the contemporary legal and political landscape, far less understood are the constraints upon presidential rhetoric that exist within our system. Impeachment, of course, is one of the most important constitutional constraints on the president. And so, in the wake of the fourth major presidential impeachment effort in our history, it is worth pausing to examine the relationship between presidential rhetoric and Congress’s power of impeachment. Although presidential rhetoric was largely sidelined in the 2019–2020 impeachment of President Donald Trump, presidential speech actually played a significant role in every other major presidential impeachment effort in our history.

    THE PITTSBURGH SOLDIERS' AND SAILORS' CONVENTION, SEPTEMBER 25-26, 1866 Charles D. Cashdollar city of Pittsburgh, Pennsylvania, played an important role in the struggle over reconstruction following the Civil War. TheDuring the late summer of 1866, President Andrew Johnson, in an attempt to present his policies personally to the people, toured the Northern states. During this "swing around the circle," Johnson re- peatedly allowed himself to be drawn into impromptu exchanges with the extremist elements of his audience. When Johnson visited Pitts- burgh on September 13, 1866, on his Northern tour, the mayor of the city refused to see him and an ill-mannered, jeering crowd refused to allow him to speak. 1 This visit to Pittsburgh was, as was the rest of Johnson's tour, extremely damaging to his cause. Even more injurious to the President's efforts, however, was the Soldiers' and Sailors' Con-i*^ vention held in Pittsburgh on September 25 and 26, 1866. /This convention was national in scope. Delegates arrived from as far away as California and Nevada. 2 To James G. Blaine, it was the most influential of the four political conventions held that year and it "... did more to popularize the Fourteenth Amendment as a political issue than any instrumentality of the year." 3 As such, it was extremely important in focusing the power struggle between President Johnson and the Radical Republicans in Congress, r- The power struggle between Johnson and Congress began during the summer of 1865. Immediately upon his ascension to the Presidency, Johnson continued the reorganization of the Southern states which President Lincoln had begun.

    Executive Power and Republicanism: The Battle to Define Ulysses S. Grant’s Presidency 1868-1880 Annabelle Frances Grenville-Mathers Submitted for the fulfilment of the Degree of Doctor of Philosophy Department of History March 2015 1 2 Thesis Summary This thesis situates the presidency of Ulysses S. Grant (1869-1877) and the attempts to provide him with a third term in the republican political culture of Reconstruction. Exploring the period through the lens of the press, pamphlets, and archival material, it shows how republican ideas – especially hostility to partisan politics and fear of concentrated power – in the era had the capacity to both augment and detract from the president’s ability to secure the post-war settlement. Early interpretations of Grant’s presidency, written by scholars often hostile to Reconstruction, accused him of overzealous support for African-American civil rights. In contrast, revisionists blamed Reconstruction’s failure in part on Grant’s weak administration. However, when viewed through the prism of the republican political culture of the era, it is possible to see how Grant’s presidency could be simultaneously strong and weak. Republicanism enabled the portrayal of Grant as both a model republican and a tyrant- in-waiting. This thesis argues that the very qualities which made him a strong president – his antipartisanship, self-sacrifice, and honour – gave Grant the independence and support which many feared would be the undoing of the republic. Republicanism had the power to define the parameters of the possible during Reconstruction. With the federal government in tumult and the boundaries of presidential power undefined, Americans’ fears over the safety of their liberties helped shape what could be achieved during Reconstruction.
