l 1 J ] ] ] ] 3 RAP forE 75 Beograd-Nis-Border with FYRoM Koridori Srbije doo [ Section Vladicin Han- Donji Neradovac [ Executive Summary This document is the Annex to RAP for the Section Vladicin Han-Donji Neradovac, ( E-75) in lenght of26.3 km, which is one ofthree sections to be financed by the World Banlc r Because of the widening proposed in this section results the expropriation of 224 of hectares ofland and impacts 1388 families. The purpose of this RAP was to set out an action plan for [ expropriation and payment of compensation and assist the PAPs in their efforts to resettle and rehabilitate and improve their standards of living or at least be restored to the pre­ displacement levels. This RAP is based on the provisions imposed in the Resettlement Policy Frame Work (RPF) adopted for this project, which is in line with the Involuntary Resettlement Operational policy of the World Bank.

The RAP was provided with the World Banks No Objection and has been publicly disclosed on April26,2012.

In line with the Loan Agreement and after the respective procedures were fmalized three Contracts for Construction works were signed.

In line with the provisions of the Resettlement Policy Framework any additional impact .] should be considered and dealt with in line with the basic provisions of the Framework and the Resettlement Action Plan properly authorized and disclosed. The implementing entity expresses its reassurance that the additional expropriation will be followed by the same 1 principles as determined in the respective RAP for this section.

During the implementation period and execution of works on the three above mentioned l respective Construction works contracts a discrepancy was identified between the Main design and Bill of quanties and the actual needs for construction works. Usually the main design envisages the expropriation of necessary land to alow exploitation of materials from J the Borrow pit areas. Such borrow pits were not part of the Main design of expropriation and therefore not part of the process conducted for land acquisition in respect of the main alignment and structures. By request of the Employer CoS an amendement of the technical documents was initiated resulting in expropriation of additional land. ] This Annex deals with the additional land expropriation for purposes of acquiring borrow pits to the Contractor that requires the expropriation of 10,71 hectares ofland (107 112 square meters), within the Cadastral Municipalities ofPrevalac, , Suvi Dol and 2. The number of project affected persons (PAPs) and cases within each ofthe Cadastral 1 Municipalities is in Prevalac 34 parcels, 21 with one owner, 13 with co-owners, Korbevac 38

4 I L RAP forE 75 Beograd-Nis-Border with FYRoM Koridori Srbije doo Section Vladicin Han - Donji Neradovac [ parcels 18 with one owner, 20 with co-owners (5 are in state property), Suvi DollS parcels, 9 with one owner and 6 with co-owners, and cadastar Municipality ofVranje 2 with an impact of25 parcels, 13 with one owner and 12 with co-owners (1 in state property). Total number of expropriated parcels are 117 (5 in state property), with 61 sole owners and 56 co-owners. (Note that one PAP might be owner of one or 2 parcels, as two or more owners might be co­ t owners of one, two and more parcels). Area in state propery covers 24.540 m2, or 22.3% of expropriated land. Average size of expropriated parcels is around 700 m2 (without parcels in [ state property). In accordance to the datat from the Center of social welfare no one of the affected people is [ eligible to use any kind of support through the programs and allowances of the Center for social work.

The RAP documents the information-gathering and analytical process to ensure that the proposed developments leave no individual (project affected person or PAP) worse of than they were in the pre-project state. The process involves the assessment of all physical or economic impacts, displacement, or temporary or permanent loss of assets or facilities that may be experienced by the communities along the road.

The Expropriation process has commenced during November 2013 and is expected to be finished until May 2014. j Up to day, all compensation offers have been accepted by the owners. There are neither 1 pending grievances nor court procedures. The Contractor has to receive possession of site to the additional land by April 2014 and works on these parcels cannot commence prior to compensation has been paid or grievances J registered.

Nature of Impacts

The following impacts were identified in this additional land acquisition: J a) Permanently acquired land consisting of cultivated and non/cultivated land within the line of acquisition. The cultivated land includes paddy field, dry field, vegetable field, I non-cultivated land and forestry field. 1 Legal Framework for Land acquisition and compensation payment

Budget and cost [ Basic Cost of expropriation includes land compensation cost, compensation for standing crops, and other taxes. All the funds made available through PERS are estimated and designated through the Law of the Budget for 2014 and Business Plan ofPERS, by which the necessary amount of needed funds are transferred to the PERS. The Government made those funds operable by passing the Law through the Parliament. The law of the Budget has been passed through the Parliament and disclosed at the Official herald of Republic of Serbia .. The estimated budget is 80.000.000,00 RSD which covers the average compensation amount of 700 RSD/m2 (cca. 6,5 EUR/m2). ( The execution of the Budget, which shall be proof of compensations paid, shall be certified by PERS, The respective Municipality shall certify that the expropriation of land is finalized, I Socio-economic data

The census of people affected by the project has been done through the identification of owners whose property will fall under the impact of additional land acquisition. The key element to the social impact is that no structure is subject to expropriation. The next element, with the same relevance to the social impact, is that the area of expropriated land parcels is rather small and that almost half of them are in co-ownership legal status. As all of the PAPs l accepted the offered compensation rate at once, it is out of any doubt that they are satisfied with the compensation rate, Therefore, it may be concluded that most of the expropriated J parcels are to be considered as minor impact, either being less then 20% of the total land property of household/family and without expropriated the structures. It is important to point out that the expropriated households get a chance to purchase more new land for money I acquired by the expropriation process. Information on minor (expropriation less than 20% of total land property) or mayor impact J (expropriation of more than 20% of land property and/or structures used for permanent housing or bussiness) may be obtain only by the statement of a PAP. As has been explained in the RAP, municipal cadastre office registrates data on the property (land, structures) of a 1 single citizen who lives (has permanent residence) on the territory of the municipalty, but has no evidence on property in other municipalities. Also, cadaster office does not have a link with data on the property of the other members of the same household (husband, wife, I children, etc.). Therefore, information on the percent of the expropriated parcel in relation to the total land property may be obtained only by the statement of PAPs. As PAPs were not interested to participate in survey, one might only conclude that they were very satisfied with J the compensation rate. The level of satisfaction may be measured by the ratio of compensation rate for land (cca, 6,5 EUR per 1 m2) in the region where in the last several decades agriculture land has not been a subject of market transaction as nobody was interested ] for buying land for agricultural purposes. Only land that was in market transaction was agruculture land in the vicinity of the municipal centre, and those parcels were purchising as so-called pseudo-building land, with intention to convert it in building land and to build ] structures. These activities were aginst the law regulations, Structures were built without the building permit. Inspite the illegal status of these activities and practices, they were tolerated by the officials. To day, almost 30% of builidng structures in Serbia are illegaly built or ] reconstructed, on the land that is still in the category of agricultural, forest etc.

1 [ RAP forE 75 Beograd-Nis-Border with FYRoM Koridori Srbije doo Section Vladicin Han- Donji Neradovac l­ The data on residency status of owners/co-owners (place of permanent residency of the owners of land) reveals that the land in most cases is far from the place of permanent l residency of the owner, which suggest that expropriated land was neither agriculturally engaged nor has it served as main income resources to any of the affected households. Out of 114 owners/co-owners 30 of them live in the cadaster municipality where the expropriated land parcel is, and 84 live outside of the cadaster municipality.

[ According to the available data from the PE Putevi Srbije (team for the administrating the expropriation process) all owners accepted the compensation offer without a dispute, i.e. not a single has initiated a court procedure. As a conclusion to such level of acceptance of compensation and its actual endorsement by the PAPs they had no interest of participating in any additional survey. In line with respective provisions ofthe RPF public consultations were held with the PAPs in [ order to exchange information. Best practice in previous expropriation showed that free flow of information between project implementing entities and PAPs is essential to promoting effective public consultation and participation and to achieving the objectives of resettlement activities. Public consultation and gathering were conducted on November 6, 2013, November 22, 2013, December 6,2013, January 21, 2014 and January 24.2014. PAPs were informed about need for additional land acquisition and individually informed about the area to be expropriated and the compensation amount. The main concern of the PAPs at those public consultation was the compensation amount and the schedule of payment. The CoS team also informed the PAPs about salient features of the Law of expropriation in respect of payment.

Unviable parcels

As per provisions of The Resettlement Policy Framework, June 2009, unviable parcels are defined as a remaining parcel of land after expropriation is not economically viable, it will be acquired and compensated if the Project Affected Person so desires. Although PERS is the beneficiary of expropriation and designated as such in the Decision of Public Interest internal monitoring of the expropriation and payment of compensation shall be l facilitated through the Implementing entity CoS.

This RAP in compliance with RPF will be publicly disclosed at the official website of CoS, Municipality Vladicin Han as well as the web site of the World Banlc. The salient features of RAP will be translated in Serbian and disclosed.
