The Minister for Finance and Coir introduced the Kerala Appropriation (No.4) BiU, 2017 in respect of the Second Batch of Supplementary Demands for Grants for the year ZO|T-2018 on 24-B_2O17. The Bill was raken up for consideration and passed on the same day. The house devoted I Hour and 3 mitutes for the business.

Private Membcre' Business : According to the calendar of sittings for the Seventh Sessron of the Fourteenth Kerala Legislative Assembly, two days were allotted for transacting Priyate Members' yiz. Motions for leave to intoduce all the four Bills came up before the House. Out of these, three bills were set apart for continuing the discussion and drscussron on one bill was concluded and withdrawn with the consent of the House. The continuation of discussion on Motions for leave to introduce were not taken uD due to the lack of time.

During the Seventh session, 18d August 2017 being the day scheduled for transacting Private Members' Resolution, the Resolution, which was left for continuing the discussion, moved by Sri K. S. Sabarinadhan, MLA on l9-r20l7 dissolved by the House after the discussion. The house then considered the Resolution given notice of by Sri Murali Perunelly, MLA and after the discussion the Resolution was withdrawn with the permission of the House. THE KERALA GOODS AND SERVICES TAX BILL. 2017

The Stat€ Government levies tax on sales in the form of value added tax, entry of goods in the State in the form of entry tax, luxury tax and entertainment tax, etc. Similarly, the Central Ciovernment levies tax on, manufacture of certain goods in the form of Central Excise duty, provision of certain services in the form of service tax, inter-State sale of goods in the form of Central Sales Tax. Accordingly, there is multiplicity of taxes which are being levied on the same supply chain.

2. The present tax system on goods and services is facing certain difficulties as unoer;

(i) there is cascading ol taxes as taxes levied by the Central Gov€rrment are not ayailable as set off against the taxes being levied by the State Governments;

(ii) certain taxes levied by the State Government are not allowed as set off for payment of other taxes;

(iii) the variety of Value Added Tax Laws in the country with disparate tax rates and dissimilar tax practices divides the country into separate economic spheres; and

(iv) the creation of tarifl' and non-tariff barriers such as octroi, entry tax, check posts, etc., hinder the free flow of trade throughout the country. B€sides that, the large number of taxes create high compliance cost for the taxpay€rs in the form of number of retums, payments, etc.

3. In view of the aforesaid difficulties, all the above mentioned taxes are proposed to be subsumed in a single tax called the goods and services tax which will be levied on supply of goods or services or both at each stage of supply chain starting from manufacture or import and till the last retail level. So, any tax that is presently being levied by the Central Government or the State Governments on the supply of goods or services is going to be converged in goods and services tax which is proposed to be a dual levy where the Central Covernment will levy and collect tax in the form of central goods and services tax and the State Government will levy and collect tax in the form of state goods and services tax on intra-State supply of goods or seNices or both 64

.4. In view of the above, Central Goods and Services Tax Act, 2017 (Central t.2 2017) is already 1",. 9f passed and it has become necessary to have a State Legislation.

5. The proposed - . legislation will confer power upon the State Government for levying goods and services tax on the supply. of goods or services or both which ,-*".t gJu* within a State. The proposed legislation will simplify and harmonise the indirect tax regime in the country. It is expected to reduce cost of production and inflation in the economy, thereby making the Indian trade and industiy more competitive, domestically as well as internationally, Due to the seamless ransfer of input tax credit from one stage to another in the chain of value addition, there is an in-built mechanism in the design of goorls and services tax that would incentivise tax compliance by taxpayers. The proposed goods and services tax will broaden the tax base, and result in better tax compliance due to a robust information technology inf.rastructure.

6. The said legislation inter alia, provides for the following, namely:_ (a) to levy tax on all intra-State supplies of goods or services or both except supply of alcoholic liquor for human consumption at a rate to be notified, not exceeding twenty percent as recommended by the Goods and Services Tax Council (the Council); (b) to broadbase the input tax credit by making it available rn respect of taxes paid on any supply of goods or services or both used or intended to be used in the course or furtherance of business; (c) to impose obligation on electonic commerce operators io collect tax source, at at such rate not exceeding one per cent of net value of taxable supplies, out of payments to suppliers supplying goods or services through their ponals; (d) to provide for self-assessment of the taxes payable by tbe registered; (e) to provide for conduct of audit of registered persons in order to verify compliance with the provisions of the Act; (l) _ to provide for recovery of arrears oftax using iarious modes including detaining and sale of goods, movable and immovable property of defaultin! laxable person; (g) provide to for powers of inspection, search, seizure and arrest to the officers; b)

(h) to establish the Goods and Services Tax Appellate Tribunal by the Appellate Central Cov€mment for hearing appeals against the orders passed by the Authority or the Revisional Authority;

(i) to make provision for penalties for contravention of the Provisions of the proposed Legislation; order to ensure that (j) to Provide for an antlprofiteering clause in servlces or business passes on the benefit of reduced tax incidence on goods or both to the consumers; and

(k) to provide for elaborate transitional provisions for smooth transition of existing taxpayers to goods and services tax regime' session and 7. THE KERALA MOTOR VEHICLES TAXATION (AMENDMENT) BILL,LOI'I

The existing sub-secrion (7) of sectiori 447 of the Kerala Municipality Act, 1994, provides that no person shall, without previous permission of the Municipality in writing and otherwise than in accordance with the conditions specified permission, in the establish an Abkari shop within a Municipal area. Sub-section (8) of the said Act provides that while granting permission to establish an Abkari shop near an educational institution or place oli worship, the distance prescribed limit in the Abkari Act for the time being in force or the rules framed thereunder shall be complied with and the Municipality shall not grant permission. to establish an Abkari Shop within the said distance limit. Sub-section (9) provides that Municipality shall be competent, in the interest of public peace or morality or on the grounds of convenience or nuisance, to order the shiftins of an Abkari Shop from the place where it is situated to another or its closing as iray be directed in this behalf. The afore mentioned provisions were included in the said Act as per the Kerala Municipaliry (Amendment) Act, 2014 (8 of 21lq. The Government have found that ir is essential to amend section 44i of the Kerala Municipality Act, 1994 in order to implement uniform Abkari policy in the State and put to an end to the discrimination between various applicants, the existing licencees and the fresh applicants. Accordingly the Government have decided to amend'the said Act. As the Legislative Assembly of the State of Kerala was not in session and the said proposal had to be given effect immediately, the Kerala Mlunicipalitv (Amendment) Ordinance, 2017 (10 of 2017y was promulgated by the Governor oi Kerala on the l', nJune of 2017 and the same was published in the Kerala Gazatte Exuaordinaxy No. ll36 dated l",June, 2017.

THE KERALA PANCHAYAT RAJ (AMENDMENT) BILL, 2OI7

A Bill to replace the said Ordinance by an Act of the Legislature could not be introduced in, and passed by the Legislative Assembly of the State of Kerala during its session which convened on the 8th day of June, 2017.

THE KERALA CO.OPERATIVE SOCIETIES (AMENDMENT) BILL, 2OI7

A three tier short term agricultural credit system is functioning in the Co-operative Sector of Kerala. It consists of Primary Agricultural Credit Societies, District Co-operative Banks and State Co-operative Bank. The District Co-operative Bank was designed to provide financial assistance to himary Agricultural Credit Co-operative Societies functioning under the provisions of the Kerala Co-operative Societies Act, 1969 and the rules made there under. But, during different intervals, Non-Agricultural Credit Sopieties were also given voting membership in the District Bank. Due to this, the representation of Primary Agricultural Credit Societies in the Board of District Co-operative Banks are drastically reduced. Under this circumstance, Government hbd appointed a committee to study, how the changes in representative charact€r in District Co-operative Banks will affect the strength of present three tier credit institutional system and the committee had submitted a detailed report with its recommendalion s.

2. Representation of Primary Agricultural Credit Societies in District Co-operative Bank is 31 70 only. Out of the 11759 societies affiliated with District Co-operative Banks, number of himary Agricultural Credit Co-operative Socielies is only 1670. Thus, it is only l4.2Vo. The paid up capital of 14 District Co-operative Banks is { 835.44 crore. Out of this ? 751.26 crorc is contributed by himary Agricultural Credit Societies, which is 84.18% of the total capital. Total Deposit in Distdct Co-operative Banks is I 52455.98 crore- The contribution of himary Agricultural Co-operative Society is I 26066 crore, which constitute 49.69Vo in total deposit. But, non-Agricultural Credit Societies have a deposit of < 1629.45 crore only. Balance is personal deposit. Hence, the committee suggested that the voting right in District Co-operative Banks should be limited to 69

Primary Agricultural Credit Societies and.Urban Co-operative Banks. Therefore, to ensure that only Primary Agricultural Credit Societies and Urban Co-operative Banks have the voting power in District Co-operative Banks, Sections 2 and 18 of the Kerala Co-operative Societies Act, 1969 have to be amended.

3. Corruption, illegal appcrintment, misappropriation of funds and illegal promotion are being reported from various institutions functioning in the Co-operative Sector. But, the Govemment could not safeguard the interest of the Co-operative sector in the matter due to legal restrictions. In order to safeguard the interest of the co-operative sector, an amendment in the Kerala Co-operative Societies Act, 1969 is necessary. Therefore, the Govemment have decided to amend section 32 of the said Act.

4. Certain provisions under the Kerala Co-operative Societies Act, 1969 hinder the free and fair elections to the committees of the co-operative societies. Hence, the provisions for cancelling the membership of a person if he fails to utilise service of the society for two consecutive years and not attending three Annual General Body Meeting of the society have to be amended. Therefore, Sections 16A & l9A of the Kerala Co-operative Societies Act, 1969 are to be omitted.

5. In order to promote fanspa.rency and to avoid devetoping vested interests ' in Co-operative governance, the term of office of the hesident and Vice President should also be fixed. Therefore, Section 28 and Section 28 AB have to be amended.

6. The States of Gujarat, Maharashtra and Tamil Nadu have already eslablished their Maritime Boards. The Mantlme State Council has strongly ?evelolment recommended rhe formation of Maridme Board in the State.

5. As an initial step, the Kerala Maritime Society, and the Kerala State Maritime Development Corporation are proposed ro be merged into the Board. As the l€gislative Assembly of fte State of Kerala was not in session and the above proposal had to be given effect to immediately, the Kerala Public Service Commission (Additional Functions as respects the services under the Kerala Administrative Tribunal) Ordinance, 2017 (16 ot 20U) was promulgated by the Governor of Kerala on the l5th day of July, 2017 and the same was published in the Kerala Gazette Extraordinary No.1476 dated 15th July, 2017

3. The Bill seeks to replace Ordinance No. 16 of 2017 by an Act of the State Legislature. THE KI,RALA MARINE FISHING REGULATION (AMENDMENT) BIIL, 20t7

Realisine the imDortance of conservation of the marine fish resources of the State and safeguarding the interest of the marine fishermen, the has enacted the Kerala Marine Fishing Regulation Act, 1980 (10 of l98l) providing for the regulation of fishing by fishing vessels in the sea along the coast line of the State. At present there is no provision in the Act for the r€gisftation of boat building yards, regishation of net manufacturing and selling units and constitution of Fisheries Management Councils.

2. In order to bring all fishing vessel constructions under the purview of the Kerala Marine Fishing Regulation Act, 1980, appropriate amendment has to be made in the Act. Restrictions for the use of fishing gear and the dimension of fishing gear has to be incorporated in the Act since very small and juvenile fishes are regularly caught causing serious threats to the fish stocks. The regulation of fishing gear shall be done by bringing all f,ishing net manufacturing dealers under a system of regulation and licensing. Hence, there should be provision for the registration of manufacturing units with Department of Fisheries. 74

3 For the effective management and surveilance of marine fisheries a new provision has to bs inserted in the Act so as to constitute a three tier Fisheries Management Councils Village, at District and Sute levels, conferrina certain powers and duties to them.

4. The said Act provides to impose penalties for violation of provisions under the AcL But, the quantum and extend of penalties needs to be modified considering devaluation of the currency and depending upon the type of vessels and gravity of violations committed. At present there is no provision in the Act to recover the penalty imposed under the Act. Hence, the Govemment have decided that any amount of penarty imposed under this Act shall be recoyered as if it were an arrear of public revenue due on land and a provision in this respect has to be inserted in the Act.

5. The Bill is intended to achieve the above objects.

The Bill is introduced pursuance in of clause (l) of futicle ZO4 of the Constitution of India read with Article 205 thereof, to authorise payment and appropriation of certain further sums from and out of the Consolidate; Fund of rhe State of Kerala required to meet the supplementary expenditure charged on the Consolidated Fund of the State of Kerala and the grants made by the t egislatiye Asssembly for the expenditure of the Govemment of Kerala ibr the Financial Year 2017 -ZOIB. 75
