Texas1 declared that morality, absent third-party harm, is an insufficient basis for criminal legis- lation that restricts private, consensual sexual conduct.2 In a strongly worded dissent, Justice Scalia declared that this “called into question” state laws against obscenity (among others), as such laws are “based on moral choices.”3 Justice Scalia does not specifically reference Miller v. Califor- nia,4 the last case in which the Supreme Court directly addressed the issue of whether the government may suppress obscenity. However, if, as Justice Scalia suggests, obscenity laws have their primary basis in private morality, the governing case that permits such laws must countenance such a moral basis. Whilst experiences of the last year have been different across the Commonwealth, stirring examples of courage, commitment and selfless dedication to duty have been demonstrated in every Commonwealth nation and territory, notably by those working on the front line who have been delivering health care and other public services in their communities. We have also taken encouragement from remarkable advances in developing new vaccines and treatments. The testing times experienced by so many have led to a deeper appreciation of the mutual support and spiritual sustenance we enjoy by being connected to others. The need to maintain greater physical distance, or to live and work largely in isolation, has, for many people across the Commonwealth, been an unusual experience. In our everyday lives, we have had to become more accustomed to connecting and communicating via innovative technology – which has been new to some of us – with conversations and communal gatherings, including Commonwealth meetings, conducted online, enabling people to stay in touch with friends, family, colleagues, and counterparts who they have not been able to meet in person. Christie Hefner was no stranger to controversy. She had the physical appearance of the All- American professional: perfectly coiffeured shiny blond hair, tasteful yet elegant outfits, and understated jewelry that nevertheless communicated both style and confidence. Anybody meeting her for the first time could have been forgiven for mistaking her for a lawyer, consultant, or the general manager of an upscale country club. Hefner was nothing of the sort for she was both a self-proclaimed feminist and the CEO of the company with the most recognizable name in men's entertainment: Playboy Enterprises. Since taking over the company from her father Hugh Hefner, the quintessential playboy, she had had to work her way out of many difficult situations, both in Playboy’s U.S. home market and overseas. But for two months, after receiving an unnerving phone call in December 2006 that Erwin Arnada, the editor-in-chief of Playboy Indonesia, had been charged and indicted for promoting obscenity, Hefner had been agonizing over possible courses of action. Her most immediate concern was for Arnada’s safety. But she also knew that the incident raised important questions beyond Arnada. In managing the situation, Hefner had to make decisions that would inevitably affect the future global strategy of Playboy Enterprises. -

SEXING THE MUELLER REPORT Ruthann Robson* I. INTRODUCTION Sexual indiscretion, misconduct, and deceit percolate throughout the extensive 2019 Report On The Investigation Into Russian Interference In the 2016 Presidential Election—known as the Mueller Report.1 President Trump’s sexual behaviors are certainly not the focus of the Mueller Report, which resulted from the Acting Attorney General’s appointment of Robert S. Mueller, III as Special Counsel for the United States Department of Justice to investigate “any links and/or coordination between the Russian government and individuals associated with the campaign of President Donald Trump,” and “any matters that arose or may arise directly from the investigation.”2 Volume I of the Mueller Report addresses Russian interference with the 2016 election and any Trump campaign links in approximately 200 pages. Volume II of the Mueller Report, which is slightly longer at 241 pages, focuses on the question of whether the president obstructed justice in connection with the Russia-related investigations, including presidential actions related to the Special Counsel’s investigation itself. Hugh Hefner's After Dark: Speaking out in America
HUGH HEFNER'S AFTER DARK: SPEAKING OUT IN AMERICA (dir. Brigitte Berman, 2018 – 101 mins) Hugh Hefner splits opinion like a Wonderbra cleavage. His perennial two-finger–salute to censorship and lifelong crusade for sexual freedom won him money, power and respect – built on the foundations of launching a dirty magazine. What Hefner’s empire culturally represents often leaves me considering where I stand on feminism and structural power, as he veers in and out of my coming-of-age experiences, and Brigitte Berman’s documentary Hugh Hefner’s After Dark: Speaking Out in America brought me to another personal checkpoint, and on-the-fence regarding Hefner's legacy. I remember buying a vintage copy of Playboy magazine for a once-upon-a-time boyfriend. I was trying to be ‘the cool girl’ with a blasé approach to what I presumed was an innate male need to enjoy the female form. He would buy Nuts, and FHM and in the way I’ve always tried to raise the bar of my boyfriends' lifestyle choices, I believed Playboy would add a touch of class to the otherwise crass act of objectification. A vintage copy seemed to legitimise the gratuity. The sepia tones creating a force-field from critique; the ear-marked pages commanded a nostalgic, romanticised respect. The gratitude I received from aforementioned boyfriend, and – full disclosure – the ambiguous enjoyment I got from scrutinising these scantily-clad women, led me to buy a hardcover edition of Playboy At 50, complete with some of the publication’s most lauded editorial content, including interviews with an array of the most politically- influential people operating throughout the magazine’s 50-year run.
