I propose to look at the punk rock band The Clash not solely as a first wave English punk rock band but rather as a “news-giving” group as presented during their interview on the Tom Snyder show in 1981. I argue that the band’s use of communication metaphors and imagery in their songs and album art helped to communicate with their audience in a way that their contemporaries were unable to. Broken down into four chapters, I look at each of the major releases by the band in chronological order as they progressed from a London punk band to a globally known popular rock act. This place is magical, here we can all be together, No matter who we are, no matter where we come from, Here peace and goodwill fills the air, here we are closer to God, While the music brings us together in joy. Even the most abstractive dreams come true. When I read on the website of Muzyczna Owczarnia that the Animals & Friends would perform at Wietek Kołodziejski, I could not believe that. Theoretical and practical thoughts ran through my mind as quickly as lightning, and then I called Wietek to ask him for a ticket and to Grzegorz Kasprzyk to book accommodation at his Koliba (chalet). Muzyczna Owczarnia. The interest was so high that there were two concerts: on Sunday 10th and on Monday 11th. I arrived in Jaworki on Saturday to tune myself in this emotional atmosphere:) Sylwia, Wietk’s wife, had everything ready. The musicians came on Sunday at 3 p.m. with Łukasz Gorczyca and Sebastian Kowol. Their presence was meaningful so there is a short mention about them. Łukasz Gorczyca - basist, composer, author of numerous projects, known from cooperation with many famous domestic and foreign musicians. The grounds of opposition are in summary: a) The opponent performs under the names/trade marks THE ANIMALS (the Band) / ERIC BURDON and THE ANIMALS and has these names registered in the USA under numbers 76524982 and 76524983. He has spent his career as a lead singer and songwriter of these bands and was inducted into the Rock n’ Roll Hall of Fame in 1994. b) The applicant was a member of the Band but was never given any ownership rights in respect of the name of the Band. The applicant initially sought to register a series of five marks in respect of a very wide range of goods in Classes 9 and 41. There was never a realistic likelihood of the marks being used on such a range of goods and services and thus there was no bona fide intention of using the mark on the specification requested. The application therefore offends against Section 3(6) of the Trade Marks Act 1994.
