Himes III ABSTRACT Bargaining for Security: The Rise of the Pension and Social Insurance Program of the United Steelworkers of America, 1941-1960 Henry E. Himes III This dissertation charts the United Steelworkers of America’s (USWA) quest to win long term welfare security for its members from 1941 to 1960. The study focuses on external and internal events and issues that led the union to seek pensions and social insurance at the bargaining table in 1949, and ultimately, to enhance their private security at the bargaining table throughout the 1950s. Although labor’s ability to influence the passage of national health care was greatly curtailed by a rise in conservative politics during World War II and the immediate postwar era, issues beyond politics also played a role in the USWA’s decision to bargain for security in 1949. Chief among these issues was a postwar retiree crisis that began in 1946. In that year, steel companies such as Inland Steel and US Steel began to force retiree steelworkers who reach the age of 65 with little to no long-term economic security. The postwar retiree crisis thus ignited a swell of rank and file demands on union leaders to bargain for better forms of private insurance and to use the union’s bargaining power to end the arbitral and paternalistic nature of welfare capitalism. Consequently in 1949, after a significant strike, the USWA won a pension and social insurance program, which the union worked to expand and enhance throughout the 1950s. Although the union had used its bargaining power to secure one of the finest pensions and social insurance programs in American industry, private insurance programs were plagued by ever rising costs that ate into the wage gains of steelworkers. By 1960, after a two-year internal study of its pension and social insurance program, the USWA concluded that the indemnity (fee-for- service) insurance model was deficient and incapable of delivering the comprehensive and prepaid security the union demanded. Beyond the direct issue of welfare security, this study also sheds light on the internal union dynamics of the USWA in such a critical and influential era in American history. Moreover, the dissertation brings to light a more detailed portrayal and accounting of USWA President, Philip Murray, as he guided the union through World War II and the immediate postwar era. Dedicated to my father Henry E. Himes Jr. and my step-father James W. Masluk. I miss you both. iii Acknowledgments This dissertation originated a long time ago back in Youngstown, Ohio. I had recently left the army where I had served as an artillery officer and now faced the daunting life question of "what will I do next?" At first, I was uncertain where my path would lead. I had spent some time visiting friends in Columbus, Ohio, and my experience there, particularly the many deep conversations I had with the people I had met there, enlightened me, and made me think more intensely about the perplexing questions of life and how society operated. My sojourn to Columbus thus made me more intellectually curious and sparked my desire to go to graduate school. From Columbus, I moved back home to Youngstown, Ohio, where I was accepted into the master's program of history at Youngstown State University (YSU). At YSU, I had the great fortune to obtain a graduate assistantship at the Youngstown Historical Center of Industry and Labor (YHCIL) where I worked as a museum docent and archival assistant. Coming from a working-class family—my parents were auto workers, my grandfather was a steelworker, and my great uncle and great grandfather were skilled union bricklayers—working at YHCIL was a dream come true. My time at YHCIL opened my eyes to labor history, and more specifically, to the work of Staughton and Alice Lynd. At YHCIL, I was quickly exposed to the work the Lynds had done to try and prevent the wholesale shut down of Youngstown's steel mills in the late 1970s and early 1980s. Their work during the shutdown era was fascinating and intriguing, particularly their effort to help build a coalition of people to purchase and run the Youngstown Sheet and Tube steel mill as a community and employee-owned enterprise. However, it was another issue that the Lynds were involved with that ultimately led me to my eventual dissertation topic. iv In 1986 the LTV Steel Corporation filed for chapter 11 bankruptcy and immediately canceled retiree health insurance. Moreover, a few months after the initial bankruptcy announcement, the Pension Benefit Guarantee Corporation (PBGC) took over LTV’s underfunded pension plan, which led to a reduction in retiree pension payments and other hardships for steel retirees. Consequently, steel retirees, with the legal counsel of Staughton and Alice Lynd, founded Solidarity USA to fight to retain their pensions and benefits. I wrote my master's thesis on this organization. My experiences in the YSU master's program made me want to go to the next level and pursue a Ph.D., in US history. Thus, I subsequently applied to and was accepted into the history program at West Virginia University (WVU). Although I loved my master's thesis topic, I wanted to know more about how the system of private pensions and benefits originated in the steel industry. With that goal in mind, I was able to narrow down my focus and create the dissertation topic presented here. It was a long, arduous, and tedious process but in the end, I am happy with the final product and I look forward to eventually expanding this dissertation into a publishable monograph. Nothing in life is done alone. Rather, we are all the beneficiaries of social connections that support, love, encourage, and critique what we do in life. Whether that be our friends, family, community, peers, or advisors, we are hardly autonomous individuals, but instead, we owe our individual accomplishments to a myriad of people that have helped us on our journey. First of all, a dissertation cannot be written without sources. The bulk of the sources used in this dissertation, in particular, the USWA International Executive Board (IEB) minutes, came from the Penn State Special Collections library, which is the repository for the USWA. I want to thank the great staff at Penn State, they are all so knowledgeable, professional, and courteous and made my trips there a wonderful experience. Huber ABSTRACT Systems of political checks and balances, so prominently featured in the U.S. Constitution, are also commonly installed in statutory and regulatory regimes. Although such systems diffuse political authority and may facilitate participation and accountability, they come with a price. If exercised, political checks—even those that appear trivial—can obstruct statutory processes and saddle a policy system with an unintended default policy outcome. Policies that are neither debated nor chosen, but that emerge as unbidden defaults, exhibit the very democratic deficits that checks and balances are intended to remedy. This is precisely the situation of nuclear waste policy in the United States. The Nuclear Waste Policy Act of 1982 established a process for siting and constructing repositories for nuclear waste. When Nevada’s Yucca Mountain emerged as a likely repository site, that state’s officials and allies exercised the numerous political and legal checks afforded by the Act and appear, at least for the time being, to have defeated the selection. But Nevada’s victory may well be the nation’s loss. In the absence of a national waste repository, nuclear power plant operators have no choice but to store spent nuclear fuel on site, where it presents a number of risks not contemplated by the 1982 legislation. This outcome was not chosen or anticipated by legislators, plant operators, state and local siting authorities, or host communities. This Article argues that lawmakers must take more realistic stock of their own institutional behaviors. Although certain corrosive incentives are intractably embedded in our constitutional system, lawmakers can and should write statutes with full awareness of the risks of relying on statutory checks and balances.

THOMAS Interviewed by Andrew Russ on October 28, 1988 Russell Thomas resides in North Jackson, Ohio and was born on January 18, 1908 in East Palestine, Ohio. He attended high school in Coitsville, Ohio and eventually was employed for the United Steel Workers of America in the capacity of local union representative. Tn this capacity, he worked closely with the Youngstown's local steel workers' unions. It was from this position that he experienced the steel strike of 1952. Mr. Thomas, after relating his biography, went on to discuss the organization of the Youngstown contingent of the United Steel Workers of America. He went into depth into the union's genera- tion, it's struggle with management, and the rights it obtained for the average worker employed in the various steel mills of Youngstown. He recollected that the steel strike of 1952 was one that was different in the respect that President Truman had taken over the operation of the mills in order to prosecute the Korean War effort. He also discussed local labor politics as he had run for the posiUon of local union president. Although he was unsuccessful in this bid for office, his account of just how the local labor political game was played provided great insight into the labor movement's influence upon economic issues and public opinion. His interview was different in that it discussed not only particular issues that affected the average Youngstown worker employed in steel, but also broad political and economic ones that molded this period of American labor history.

A. ***** The Ohio State University 1961 Approved by Adviser Department of History PREFACE On Sunday, May 30, 1937, a crowd of strikers and sympathizers marched toward the South Chicago plant of the Republic Steel Corpora­ tion. The strikers came abreast a line of two hundred Chicago police, a scuffle ensued, and the police opened fire with tear gas and revolvers. Within minutes, ten people were dead or critically injured and scores wounded. This sanguinary incident, which came to be known as the "Memorial Day Massacre," grew out of a strike called by the Steel Workers Or&soizing Committee of the CIO against the so-called Little Steel companies. Two months previously the U. S. Steel Corporation, traditional "citadel of the open shop," had come to terms with SWOC, but several independent steel firms had refused to recognize the new union. Nego­ tiations, never really under way, had broken down, and SWOC had issued a strike call affecting about eighty thousand workers in the plants of Republic, Youngstown Sheet & Tube Company, and Inland Steel Company in six states. The Memorial Day clash, occurring only a few days after the * strike began, epitomized and undoubtedly intensified the atmosphere of mutual hostility which characterized the strike.

    THE EFFECTS OF RADICAL GROUPS ON THE LABOR MOVEMENT By HUGHi G. CLELAND* T HIS paper is, in a sense, a response to what was a most im- Tportant presidential address by Dr. Philip S. Klein at our meeting last year in Philadelphia. One of the striking points that Dr. Klein made at that time was that our journal, PENNSYLVANIA HISTORY, has devoted only one half of one per cent of its articles to Pennsylvania history since 1865. "Pennsylvania historians," said Dr. Klein, "know almost nothing about their state since the end of the Civil War, and do not seem to be doing very much about it."' Dr. Klein noted that we have also been somewhat unbalanced in our treatment of ethnic groups in the Commonwealth. The Scotch-Irish, the German church people and the Plain Sects, whose history has been treated quite extensively, today make up only about ten per cent of our population. The history of ethnic or cultural groups who have arrived more recently is still largely unwritten. One could not help but be struck by Dr. Klein's state- ment that there are now 200 Catholics in Pennsylvania for every Quaker and 200 people of Jewish faith for every Amishman. Dr. Klein believes that the study of the period since the Civil War and of the contributions of newer ethnic and religious groups is "the primary challenge of the next 25 years for the Pennsylvania Historical Association." This paper is an attempt to contribute in a very small way to filling the void. Primarily it is an attempt to indicate some of the areas where research would seem to be indicated for graduate students or more mature investigators in the next few years.

Baylor, College of the Holy Cross One of the most momentous shifts in twentieth-century party politics was the Democratic Party’s embrace of civil rights. Recent scholarship finds that this realignment began as early as the 1940s and traces it to pressure groups, especially organized labor. But such scholarship does not explain why labor, which was traditionally hostile to African Americans, began to work with them. Nor does it ascribe agency to the efforts of African American pressure groups. Focusing on the National Association for the Advancement of Colored People (NAACP) and the Congress of Industrial Organizations (CIO), this article attempts to fill these gaps in the literature. It explains why civil rights and labor leaders reassessed their traditional animosities and began to work as allies in the Democratic Party. It further shows how pressure from the new black-blue alliance forced the national Democratic Party to stop straddling civil rights issues and to become instead the vehicle for promoting civil rights. NAACP and CIO leaders consciously sought to remake the Democratic Party by marginalizing conservative Southerners, and eventually succeeded. The partisan transformation on civil rights is arguably became the party of states’ rights. The civil rights the most important twentieth-century case in Ameri- transformation arguably presaged the future partisan can politics in which parties changed positions on division on cultural issues as well.

For some time it has been evident that the c.I.O. was being led away from the fighting, drive-ahead spirit that won it great sup­ port in earlier days. The sweeping organizing drives and pace­ setting economic gains that made it so attractive to the workers in the past are now giving way to internal strife, inter-union raid­ ing, Red-baiting, witch-hunting, stagnation and decline. The c.I.O.'s leaders were once the targets of union-haters. They were Red-baited. Today the union-haters sing hosannas to most of these very leaders beCause they themselves picked up Red-baiting and witch-hunting as weapons against progressives in the unions. The recent C.1.O. convention in Portland brought the long de­ veloping situation to a head. Differences carne out into the open and were fought out between the dominant Right and progressive Left. For the first time a c.I.O. convention faced two sets of resolutions. What's behind this · division in the C.1.O.? Who is responsible for it? How can the c.I.O. be brought back to the forward-looking path it followed in its earlier days? For an adequate answer to those questions we should first retrace the c.I.O.'s development both to the time of its birth-days when it was united and progressive -and further back, to the historic conditions that led to its rise.
