CHECKS, BALANCES, AND NUCLEAR WASTE Bruce R. Huber ABSTRACT Systems of political checks and balances, so prominently featured in the U.S. Constitution, are also commonly installed in statutory and regulatory regimes. Although such systems diffuse political authority and may facilitate participation and accountability, they come with a price. If exercised, political checks—even those that appear trivial—can obstruct statutory processes and saddle a policy system with an unintended default policy outcome. Policies that are neither debated nor chosen, but that emerge as unbidden defaults, exhibit the very democratic deficits that checks and balances are intended to remedy. This is precisely the situation of nuclear waste policy in the United States. The Nuclear Waste Policy Act of 1982 established a process for siting and constructing repositories for nuclear waste. When Nevada’s Yucca Mountain emerged as a likely repository site, that state’s officials and allies exercised the numerous political and legal checks afforded by the Act and appear, at least for the time being, to have defeated the selection. But Nevada’s victory may well be the nation’s loss. In the absence of a national waste repository, nuclear power plant operators have no choice but to store spent nuclear fuel on site, where it presents a number of risks not contemplated by the 1982 legislation. This outcome was not chosen or anticipated by legislators, plant operators, state and local siting authorities, or host communities. This Article argues that lawmakers must take more realistic stock of their own institutional behaviors. Although certain corrosive incentives are intractably embedded in our constitutional system, lawmakers can and should write statutes with full awareness of the risks of relying on statutory checks and balances. -

The present is known while the future is inherently risky. This is problematic when studying time prefer- ences since uncontrolled risk can generate apparently present-biased behavior. We systematically manipulate risk in an intertemporal choice experiment. Discounted expected utility performs well with risk, but when certainty is added common ratio predictions fail sharply. The data cannot be explained by prospect theory, hyperbolic discounting, or preferences for resolution of uncertainty, but seem consistent with a direct preference for certainty. The data suggest strongly a difference between risk and time preferences. JEL C91 D81 D91 ( ) Understanding individual decision-making under risk and over time are two foun- dations of economic analysis.1 In both areas there has been research to suggest that standard models of expected utility EU and exponential discounting are flawed ( ) or incomplete. Regarding time, experimental research has uncovered evidence of a present bias, or hyperbolic discounting Frederick, Loewenstein, and O’Donoghue ( 2002 . Regarding risk, there are number of well-documented departures from EU, ) such as the Allais 1953 common consequence and common ratio paradoxes. ( ) An organizing principle behind expected utility violations is that they seem to arise as so-called “boundary effects” where certainty and uncertainty are combined. Camerer 1992 , Harless and Camerer 1994 , and Starmer 2000 indicate that vio- ( ) ( ) ( ) lations of expected utility are notably less prevalent when all choices are uncertain. This observation is especially interesting when considering decisions about risk-tak- ing over time. -

Many have to juggle multiple jobs with unpredictable hours—single-parent and two-income families alike—and whether wealthy or poor, the question of childcare is ever present. Only adding to this stress is the growing evidence of the importance of the years between conception and kindergarten for a child’s devel- opment. No wonder parents, and particularly mothers given their traditional role as the primary caregiver and increasingly as breadwinner, are so concerned about how to balance work and raise their young children. -
Promises and Limitations of Nudging in Education
EdWorkingPaper No. 20-296 Promises and limitations of nudging in education Philip Oreopoulos University of Toronto This article takes stock of where the field of behavioral science applied to education policy seems to be at, which avenues seem promising and which ones seem like dead ends. I present a curated set of studies rather than an exhaustive literature review, categorizing interventions by whether they nudge (keep options intact) or “shove” (restrict choice), and whether they apply a high or low touch (whether they use face-to-face interaction or not). Many recent attempts to test large-scale low touch nudges find precisely estimated null effects, suggesting we should not expect letters, text messages, and online exercises to serve as panaceas for addressing education policy’s key challenges. Programs that impose more choice-limiting structure to a youth’s routine, like mandated tutoring, or programs that nudge parents, appear more promising.
