It is the opinion of this LSP that, if the DEP's review of the Tier I Permit Extension Application should extend beyond the date of the existing permit's expiration, W.R. Grace should continue to move forward with MCP filings during the review period. The potential submittals to be commented on and finalized during this period are part of the overall strategy for achieving MCP compliance and closure for the Property. This strategy has been developed from response actions completed under the initial Tier I Permit. Their conduct will not adversely affect disposal site conditions, increase the level of risk posed by the disposal site, or jeopardize future site investigations or response actions. As a result, these response actions should continue during the DEP's application review period, if necessary.

REASON FOR EXTENSION

The W.R. Grace & Co. disposal site (the "Site" herein) is located at 62 Whittemore Avenue, Cambridge Massachusetts. The Site consists of an irregularly shaped, approximately 25-acre area of land partially bounded by Whittemore Avenue to the north, residences, Harvey Street and Russell Field to the east, Rindge Avenue to the south, and the Alewife Brook Parkway to the west. The Site includes the buildings and property occupied by W.R. Grace & Co.-Conn. and the One Alewife Center property. The Massachusetts Department of Environmental Protection (DEP) Release Tracking Number (RTN) for the Site, assigned in 1987, is 3-0277. The Site is classified as a Tier IC Site, with a permit effective date of 18 March 2002.

An extension to the Tier I Permit is sought in order to finalize the asbestos-specific Phase II Comprehensive Site Assessment (CSA), revise the Method 3 risk characterization for the Site to include asbestos and other site contaminants, record an Activity and Use limitation (AUL), and finalize a Response Action Outcome (RAO) Statement for the Site. These work items are necessary to achieve closure of MCP compliance activities for Site. A brief description of the current status is as follows:

* A Phase II Comprehensive Site Assessment (Phase II) for asbestos has been completed at the site, in accordance with the Scope of Work dated 27 April 1999. Based on the results of the sampling program a Phase II Comprehensive Site Assessment for Asbestos Report, including Method 3 Risk Assessment, was prepared for the property. A Public Comment Draft of this document, dated 24 November 2003, was placed into the five public repositories for the Site on 26 November 2003. Notification of the availability of the document and the duration of the comment period (26 November to 15 December 2003) was mailed to the interested parties (Public Involvement mailing list) on 24 November 2003. At the close of the comment period, one individual request an additional 7 days to review the documents and have the opportunity to provide additional comments. This has resulted in a delay in the schedule to respond to comments and finalize the Phase II report.

* Completion of a Supplemental Method 3 Risk Characterization for both OHM and Asbestos at the Site is underway and expected to be completed by the end of December 2003. The results of this risk characterization will be used to prepare a Response Action Outcome (RAO) Statement for Site. This document will also be circulated for public review and comment.

H Preparation of an Activity and Use Limitation.

A condition of No Significant Risk exists at the Site under current conditions, for both asbestos and OHM. We anticipate foreseeable future risk can be mitigated through an AUL. Once recorded, this AUL will be used in support of a Class A-3 RAO for the Site. It is our goal to complete these final MCP submittals for the Site by March 2004. However, it is possible that additional time may be required given the complexity of the AUL and the public involvement process. For these reasons, W.R. Grace is applying for this permit extension.

Identification as a Disposal Site

In the mid-1980s W.R. Grace planned to develop portions of the property and voluntarily conducted an assessment to evaluate the environmental conditions at the property. The assessment report was completed in 1985 and submitted to the Massachusetts Department Environmental Quality and Engineering (DEP), which is now the Massachusetts DEP.

The DEP reviewed the assessment and other available information and concluded further information was necessary in order to address DEP concerns regarding contaminants at the site. At that time, the City of Cambridge and W.R. Grace requested the DEP be actively involved in the redevelopment studies for the property.

Six building sites had been proposed for development at the W.R. Grace property. Two subsurface exploration programs, conducted in November 1986 and October 1987, provided environmental information on soil and groundwater in the area of the proposed building sites. The data compiled from these two reports was used to perform an extensive risk assessment to evaluate transport pathways and receptors under the use of the property at the time, and under the proposed developed conditions.

After reviewing the results of subsurface and hydrogeological evaluations for the Alewife 3 Center Master Plan Study conducted in 1984 and 1985, the DEP issued a Notice of Responsibility (NOR) on 9 February 1987 notifying Grace that the DEP had determined that a release of oil or hazardous materials had occurred at the Grace Cambridge facility, and assigned DEP Site Number 3-0277 to the W.R. Grace property.

Two field programs were completed 1998 to investigate for the presence of asbestos in soil at the Site. Based on the findings of these investigations, a second RTN (RTN 3-17014) was assigned to the Site in June 1998 as a result of the detection of asbestos in soil. H&A prepared a document that proposed linking RTN 3-17014 to the existing Tier IC Classification. On 13 July 1999, RTN 3-17014 was closed by the DEP and the compliance obligations under this RTN were rolled into existing compliance obligations under RTN 3-0277.

A-2 Regulatory Activities for Non-Asbestos Oil and Hazardous Materials (1987-2000)

The NOR issued by the DEP in 1987 required Grace to take actions to specifically define the nature and extent of any oil or hazardous materials that might exist on site and determine how they would be treated if they presented a hazard to the environment.

Haley & Aldrich prepared a report entitled "Environmental Data Report", dated 29 April 1988, on behalf of W.R. Grace to respond to the majority of these requirements. A long-term groundwater monitoring program was implemented in November 1987. For the first year, groundwater quality data was collected every three months. After the first year of monitoring, the sampling interval was reduced to two rounds of data collection per year, until 1994. Groundwater sampling events were conducted in 1994, 1998, 1999 and 2000, 2001, and 2003.

The risk assessment required by the NOR was completed by Meta Systems, Inc. (now named Cambridge Environmental, Inc.) in 1988, and concluded that contaminants of concern present at the site, naphthalene and petroleum hydrocarbons (evaluated as "oil and grease"), presented negligible long term or acute risks to the health of site workers, casual site users or neighbors. The report also concluded that all of the other contaminants detected at the Site posed negligible long-term risks, and that site contaminants had caused negligible effects to the environment.

In August 1989, Meta Systems issued an addendum to their 1988 report, which presented a reevaluation of the original 1988 risk evaluation based on the new MCP criteria in 1988. The reevaluation concluded that no Exposure Point Concentration exceeded applicable analogous public health standards, no Hazard Index exceeded the Total Site Non-Carcinogenic Effects Risk of Limit of 0.2, and that the Total Site Cancer Risk estimate is not greater than the Total Site Cancer Risk Limit of 1.0 x 10'. These results indicated that the Site continued to pose no significant threat to human health or the environment.

By January 1990 all elements identified in the NOR, except a Feasibility Study and the Remedial Action Plan, had been addressed and the results were presented to the DEP, the City of Cambridge, and the general public. A Phase III Feasibility Study had been completed and submitted to the DEP in 1988, however, the Department did not approve this report and it is no longer applicable. Therefore the Remedial Action Plan, which would be based on the Feasibility Study, has not yet been completed. A Hazardous Material Management Plan outlining procedures for soil management and dewatering during construction was prepared by Haley & Aldrich when Building 29 was renovated and One Alewife Center was constructed in 1988.

In a letter to W.R. Grace dated 2 March 1990, the DEP stated that environmental conditions at the Site had been sufficiently characterized, that procedures to estimate exposure and evaluate risks had been adequately documented, and that the DEP considered the Phase II Comprehensive Site Assessment including the risk characterization to be complete. However, in a memorandum prepared by DEP dated 31 July 2000, DEP indicated the 1988 risk characterization is not adequate for the Site, given the site assessment data currently available. DEP further indicated data generated since the completion of the 1988 risk assessment and Phase II CSA needs to be incorporated into risk calculations for the Site.

The redesign of the MCP in 1993 allowed for the transitioning of disposal sites listed in the "old" system to the "new" system within a timeframe set forth in the regulations. According to the 1993 Transition List of Confirmed Disposal Sites and Locations to Be Investigated, the

A-3 Grace site was listed as a Confirmed, Non-Priority Disposal Site without a Waiver. In compliance with the Transitions Provisions of the MCP, Haley & Aldrich submitted a Tier II Classification for the Grace property on 4 August 1995.

In 1995 W.R. Grace completed an additional evaluation for petroleum in soil at the Site. The supplemental evaluation consisted of a subsurface soil exploration field program and a screening and chemical testing program. The results of the supplemental evaluation were used to assess the approximate horizontal and vertical extent of contamination detected in soil in areas of historical fuel oil storage and in areas where previous analytical testing indicated oil and grease concentrations greater than 10,000 ppm. Analytical testing indicated total petroleum hydrocarbon (TPH) concentrations above Upper Concentration Limits (UCLs) in three soil samples of 165 samples tested.

The DEP issued a Notice of Audit on 26 January 1996 informing Grace the Tier II submittal was to undergo auditing by the DEP, and then based on the audit findings, issued a Notice of Audit Findings/Notice of Non-Compliance to Grace dated 20 September 1996. According to the Notice of Audit Findings, additional points were added to the Grace Numerical Ranking System (NRS) Potential Exposure Pathway score by the DEP because of the potential for emissions of naphthalene during remediation and redevelopment activities proposed for the Site.

The reevaluation of the site in response to the Notice of Non-Compliance resulted in the submission of a new tier classification in October 1996, recommending the site be reclassified as Tier IC under the MCP. The site was granted a Tier IC permit the following year, with an effective date of 13 February 1997. The Tier IC permit allowed for continuing oversight of the site by a Licensed Site Professional, however, certain activities on the site could require the approval of the DEP. The Tier IC permit is effective for 5 years and therefore expires on 13 February 2002.

In 1998, DEP established two new, more accurate, methods of determining the components of petroleum present in groundwater and soil. The new analytical methods, for extractable and volatile petroleum hydrocarbons (EPH and VPH), break down the aliphatic and aromatic fractions of petroleum. Reevaluation of soil in the areas at the Grace site where sample analysis in 1995 indicated TPH UCL exceedences or high TPH concentrations using the EPH and VPH methods determined that the concentrations of carbon ranges present do not exceed UCLs for these parameters. However, one area of the Site was found to warrant further consideration under Phase III of the MCP due to the presence of a single EPH sample (C11- C22 aromatic carbon range) above the associated UCL.

A Phase III Remedial Action Plan (RAP) to address the EPH UCL exceedence was completed in February 2000. The RAP presented an evaluation of five remedial alternatives to the concentrations of TPH in soil at the Site. Based on comments received during the public involvement document review process enhanced in-situ bioremediation was selected as the remedial action alternative for the area of petroleum at the Site. As discussed above, a RAM Plan to conduct the enhanced in-situ bioremediation was submitted to DEP on 18 July 2001 (BioRAM). Three RAM Status Reports (dated 16 November 2001, 22 May 2002 and 20 November 2002) were prepared during the implementation of the BioRAM. In December 2001 and March 2002, sampling results indicated that bioremediation had occurred successfully and that the remedial goal has been met. Concentrations of EPH in the soil had been reduced to below the applicable UCLs. A Bioremediation RAM Completion report was submitted to the DEP on 21 April 2003

A-4 PHASE II ACTIVITIES FOR ASBESTOS (1998-2003) - SUBSEQUENT TO ISSUANCE OF TIER I PERMIT

A Phase II Comprehensive Site Assessment for Asbestos was prepared based on the exploration and sampling programs described below. As described on Page 1 of this attachment, a Public Comment Draft of this document, dated 24 November 2003, was placed into the five public repositories for the Site on 26 November 2003.

The report will be finalized by the end of December 2003.

Evaluations for Asbestos in Soil

In response to concerns raised by community members about the potential presence of asbestos at the Site and potential exposures to such material in the event the Site was redeveloped, Grace voluntarily undertook a sampling plan to characterize soil at the Site for the presence of asbestos. The sampling plan developed by Grace was reviewed and agreed upon by the DEP, the COC, and the Alewife Study Group (ASG). Explorations began on 14 May 1998. Since May 1998, two additional sampling rounds at the Site took place in December 1998 and September 2003..

A total of 882 soil and split soil samples were collected from the Site by Grace, the Alewife Study Group (ASG), and the City of Cambridge (COC). Of the 882 samples analyzed, 833 samples (COC-33; Grace-745; ASG-55) were analyzed or reportedly analyzed using the EPA Region 1 protocol combined with PLM (using EPA Method 600/R-93-116) and 49 samples were analyzed using TEM (EPA 600/R-93-116-Chatfield Semi-Quantitative).

Based on PLM analysis, 678 samples contained no visible asbestos material, 84 samples contained asbestos at "trace" levels (less than 1%), 71 samples were determined to contain asbestos at 1 % or greater. Therefore, 9% of the soil samples analyzed PLM contained 1 % or more asbestos and 81% of the samples contained no visual asbestos.

Of the 49 samples analyzed by TEM, 31 samples contained no asbestos material, 12 samples contained "trace" levels of asbestos, and 6 samples were determined to contain 1% or greater asbestos. Therefore, 64.6% of the samples analyzed using TEM contained no asbestos material and 12.5% of the soil samples contained 1% or more asbestos.

A MCP Imminent Hazard evaluation was conducted to evaluate the potential for exposure to asbestos detected in surficial soil samples at the site, which is described below. In additiona to the Phase 11 CSA described above, Haley & Aldrich prepared two reports describing the results of the December 1998 program; "Preliminary Data Report, Asbestos Sampling Program, W.R. Grace & Co.-Conn., Cambridge, Massachusetts," dated 21 January 1999, and "Report on Evaluation for Asbestos in Soil, W.R. Grace & Co.-Conn., Cambridge, Massachusetts," dated 22 April 1999.

Evaluations for Asbestos in Air, Sediment, and Groundwater

PHASE II ACTIVITIES FOR ASBESTOS (1998-2003) - SUBSEQUENT TO ISSUANCE OF TIER I PERMIT

A Phase Il Comprehensive Site Assessment for Asbestos was prepared based on the exploration and sampling programs described below. As described on Page 1 of this attachment, a Public Comment Draft of this document, dated 24 November 2003, was placed into the five public repositories for the Site on 26 November 2003.

The report will be finalized by the end of December 2003.

Evaluations for Asbestos in Soil

In response to concerns raised by community members about the potential presence of asbestos at the Site and potential exposures to such material in the event the Site was redeveloped, Grace voluntarily undertook a sampling plan to characterize soil at the Site for the presence of asbestos. The sampling plan developed by Grace was reviewed and agreed upon by the DEP, the COC, and the Alewife Study Group (ASG). Explorations began on 14 May 1998. Since May 1998, two additional sampling rounds at the Site took place in December 1998 and September 2003..

A total of 882 soil and split soil samples were collected from the Site by Grace, the Alewife Study Group (ASG), and the City of Cambridge (COC). Of the 882 samples analyzed, 833 samples (COC-33; Grace-745; ASG-55) were analyzed or reportedly analyzed using the EPA Region 1 protocol combined with PLM (using EPA Method 600/R-93-116) and 49 samples were analyzed using TEM (EPA 600/R-93-116-Chatfield Semi-Quantitative).

Evaluations for Asbestos in Air, Sediment, and Groundwater

I Five separate evaluations for the presence of asbestos in air have been conducted at the site by W.R. Grace since July 1998 (July 1998, two in December 1998, January 1999, and October 1999). Three of these evaluations were conducted during environmental subsurface exploration programs. A total of 60 air samples have been collected using high and low volume sample A-5 collection techniques. Of those samples, 38 air samples have been analyzed using Phase Contrast Microscopy (PCM) for the presence of fibers, and 22 samples have been analyzed using TEM for the presence of asbestos. TEM analysis results indicate no asbestos structures were detected. Based on the ambient air monitoring data, asbestos fibers identified in the soil are not being released into the air. A majority of the Site soils are covered with pavement and or vegetation, thus fibers are unlikely to become airborne under current conditions.

Groundwater samples were collected from three wells and analyzed for asbestos content during five groundwater sampling events conducted from October 1999 through May 2000. Three groundwater monitoring wells were selected due to their proximity to the MBTA tunnel, specifically, in the vicinity of the groundwater leak into the tunnel. No fibers greater than 10 pm in length were detected in the eight groundwater samples analyzed at the Site. The EPA's drinking water standard of 7 MF/L is based on fibers greater than 10 pm in length. The EPA drinking water method (EPA-600/4-83-043 (100.1)) was used to evaluate the groundwater for the presence of asbestos. Thirteen (13) asbestos fibers less than 10 pm in length were identified. In one sample one fiber was identified at 6 pm in length, the remaining 12 fibers were all less than 5 pm in length. The widths of the 13 fibers varied from 0.05 to 0.25 pm.

Ten sediment samples were collected from locations on the north, east and west banks of Jerry's Pond, as shown on Figure 8. Sediment was collected using a trowel and placed into stainless steel bowls, The sediment contained elevated moisture levels and did not require additional wetting. The collected sediment was homogenized using the trowel, and a sample was collected from the bowl. No asbestos fibers were found in the 10 samples of sediment collected from the banks of Jerry's Pond. Samples were analyzed using the EPA Region 1 Protocol combined with PLM.

Four surface water samples were collected on 21 October 1999 using a stainless steel remote sampler and standard surface water sample collection techniques from locations along the northern bank of Jerry's Pond on 21 October 1999 A total of 8 asbestos fibers, less than 5 pm in length, were detected in the surface water of Jerry's Pond. Jerry's Pond has likely been impacted by the transport asbestos fibers contained in soils via water erosion, from accessible or exposed surficial soil containing asbestos. With the close proximity of Jerry's Pond to the nearby Route 16 and Route 2, the surface water in Jerry's Pond has also likely been impacted by fibers released during automobile braking, which settled onto roadways and were transported via runoff from the nearby roadways.

Additional Investigations

In January 1999, a characterization of previously-identified petroleum-in-soil hot spots using the recently promulgated DEP EPH/VPH method, was conducted at the site. During this 4-day boring program, Haley & Aldrich field representatives collected four air samples through personal air monitors worn while sampling was being conducted, Samples were analyzed by PCM overnight to determine if asbestos was present in the air above the OSHA PEL of 0.1 fiber/cc. One of the four sample analyzed by PCM (sample ID 4JAN99) indicated fibers present at a concentration of 0.170 fibers/cc. Following the protocol established for the December 1998 asbestos sampling program, the laboratory immediately analyzed the fibers in the sample by TEM, to determine if the fibers present were asbestos. The TEM analysis of this sample indicated no asbestos structures were detected in the sample.

A-6 U Asbestos Response Actions Implemented

RTN 3-17014 was assigned to the site in June 1998 as a result of the evaluation of on-site soils for the presence of asbestos. A NOR for this RTN was issued by the Department of Environmental Protection (DEP) on 19 April 1999. A Report dated 22 June 1999, as revised 13 July 1999, was submitted to the DEP to Link RTN 3-17014 to the current Tier I C classification. The NRS Scoresheet was reviewed in accordance with 310 CMR 40.1500, in order to link RTN 3-17014 to the Site Tier IC classification. The NRS Scoresheet indicates that the current site classification of Tier IC is not altered by the linking of RTN 3-17014 to the existing classification. As a result of linking RTN 3-17014, the scoresheet was increased 15 points from the existing Tier IC classification, for a total of 376 points. This was below the 450 points needed to qualify as a Tier IB site.

Additionally, Grace has also conducted two (2) Release Abatement Measures (RAMs) for the excavation of two utility trenches and installation of electrical utility conduits and associated transformers at the Site.

This section requires a statement identifying actions material to the disposal site taken by the DEP to enforce its requirements. This statement should also include a description of similar administrative actions taken by other state, federal, or local agencies.

Requirements imposed by the DEP for remedial actions and further assessment at the site and the performance of resulting response actions were outlined in the Notices of Responsibility dated 9 February 1987 (3-0277) and 19 April 1999 (3-17041).

The original Tier I Permit was issued on 13 February 1997. A Permit Extension was issued on 18 March 2002. Since issuance of the Tier I Permit Extension, no enforcement actions relating to oil and hazardous materials at the site have been imposed on the Applicant by the DEP. In addition, no enforcement actions have been imposed by other federal, state, or local agencies. During the term of the Tier I Permit, response actions at the site have focused on the completion of Comprehensive Assessment and Response Actions.
