12 Sundial and Toposcope on The Esplanade At the August meeting it was resolved to defer this item to enable full discussion when quotes for manufacture and installation of a replacement sundial and toposcope on The Esplanade had been received by the District Council. Alan Darrant had indicated that the Sid Vale Association would be willing to cover 50% of the costs. The most competitive estimate for manufacture (from a local company) is £1,320 +VAT which includes reinforcements and fixings in marine grade stainless steel. The removal of existing and installation of new is estimated to be in the region of £2,000 as it is difficult to assess how deep the foundations and reinforcements are. Members are asked to consider whether they wish to cover 50% of these costs. 13 Fortescue Telephone Box Members are asked to consider the attached request from the Fortescue 24 Residents Committee. 14 Manor Road Car Park Andrew Ennis, Service Lead for Environmental Health and Car Parks has received a petition supporting a proposal by local residents asking the District Council to consider measures to resolve the problem of vehicle related antisocial behaviour linked to Sidmouth’s Manor Road car park. The problems comprise both the obvious risk of accidents and injury arising from dangerous driving, unsightly litter and of course noise disturbance from revving engines and squealing tyres during the evening and late into the night. EDDC is being asked to consider the option of either closing this car park beyond a specified hour (perhaps 9pm, reopening at say 7am) via a new lockable barrier or to devise an exit only arrangement after that hour via, for example, a Dragon’s teeth barrier across the exit and a lockable barrier at the entrance. Other alternatives being considered include the use of CCTV and/or the introduction of ANPR (automatic number plate recognition) technology in the car park. It has also been suggested that such measures might effectively deter illegal encampment by the travelling community thereby avoiding recent problems. Prior to developing any of these ideas further (and prior to consulting more widely) Mr Ennis is keen to understand the position of both the Town Council and the Chamber of Commerce as to whether such steps, if properly managed, could be in the best interests of the town or whether any adverse consequences could outweigh the benefits to residents in the vicinity. 15 Local Government Pensions Scheme Members are asked to note and approve the employer adopted discretionary 25 – 32 powers options as set out in the attached Local Government Pension Scheme document in order to maintain uniformity with the Devon wide local government pension scheme.

 The Chairman reported that he had given permission for Sidmouth Majorettes to use Salcombe Regis Recreation Field for a practice session on Wednesday 1 July. Further dates had been requested and Members were asked to consider. RESOLVED: that permission be granted to Sidmouth Majorettes to use Salcombe Regis Recreation Field for practice sessions on 22 July, 12 August, 2 and 9 September; this would be ratified at the next available Trustee meeting.  The Chairman read a letter received from Health and Local Food for Families who thanked the Council for their grant which had been used towards the Sidmouth Make and Munch Sessions giving support to some of the families in receipt of Food Bank parcels in the Sidmouth area. 43 Exclusion of the Public RESOLVED: that the classification given to the documents to be submitted to the Council, be confirmed, and that the reports relating to exempt information, be dealt with under Part B. 44 Public Open Question Time  Mr Thurlow, SVA Conservation and Planning Committee, supported the implementation of a Neighbourhood Plan for Sidmouth and offered the SVA’s involvement and financial assistance.  Councillor Rayson asked whether the installation of a water butt at Sidmouth Cemetery was just an interim measure and whether the water pipe would be repaired. Councillor Hughes replied that the cost of replacing the lead pipes was prohibitive and he had suggested that addition water butts should be installed to make use of the run- off water from the chapel downpipes.  Councillor Rayson asked for an update with regard to the Sidford to Sidbury cycle path. Councillor Hughes replied that this project now faced some delays as the cost of Phase I had been recalculated at £1.3m and Phase II at £0.5m which together made the project unaffordable. Councillor Hughes had now suggested that the project be split into 3 Phases with the first, from The Byes to ’s Close, being implemented during 2016. 45 Police Report In the absence of Sgt Andy Squires, the Town Clerk presented the police report for June 2015 which showed a total of 30 incidents representing a 3.2% decrease in comparison to 2014. 46 Committee/Working Group Reports 46.1 Planning Committee Reports Councillor Dyson, Chairman of the Planning Committee presented the reports of the Planning Committee meetings held on Wednesdays 3 and 17 June 2015. RESOLVED: That the Planning Committee reports be noted and agreed. 46.2 Tourism & Economy Committee Reports Councillor Pollentine, Chairman of the Tourism & Economy Committee presented the reports of the Tourism & Economy Committee meeting held on Monday 15 June 2015. Councillor Pollentine asked Members to consider the implementation of an experimental facebook page for the Red Arrows visit which would include a crowd funding opportunity, probably using Just Giving. RESOLVED: that 1) the Tourism & Economy Committee report be noted and agreed. 2) experimental pilot facebook page would be set up for the Red Arrows visit.

47 Reports from Members with Special Responsibilities 47.1 Finance Report Councillor Dyson presented the May 2015 Finance Report. RESOLVED: that the May 2015 Finance Report be noted and agreed. 48 Neighbourhood Plan for Sidmouth Councillor Cole presented her discussion paper for Members consideration. RESOLVED: that a Neighbourhood Plan Feasibility Task and Finish Forum be set up to consider and make recommendations to Council on a possible Neighbourhood Plan for Sidmouth to consider matters including the plan scope and boundaries, resources required, costs and funding sources. TaFF membership would be Councillors Barlow, Cole, Dent, Earthey, Kilsbie and Wright and would report back to a future meeting of the Town Council. 49 Jurassic Coast Councillor Pollentine gave a comprehensive report and update with regard to various Jurassic Coast meetings he had attended on behalf of the Town Council. RESOLVED: that Councillor Pollentine’s report be noted. Standing Orders were suspended prior to the following item to enable Alan Darrant of the Sid Vale Association to speak on this issue. 50 Sundial and Toposcope on The Esplanade District Council’s Streetscene reported that the Sid Vale Association had contacted them regarding the sundial and toposcope on The Esplanade. The plinth of the sundial had been patched up but was getting beyond repair and there was currently a large chunk missing from the column which would be patched again as a temporary measure to see it through the summer. The plinth of the toposcope was also cracked and likely to be heading the same way. The SVA had supplied an article from their newsletter dated July 1983, detailing a ceremony to ‘hand over’ the sundial & toposcope to EDDC and Sidmouth Town Council. It noted that EDDC ‘has kindly undertaken to look after them’ (i.e. maintain - not replace.) The SVA was keen to renew the features, and had indicated that it may make a contribution towards costs. The Town Council was asked whether it would be able to assist with finance for the project RESOLVED: that this be deferred until the August meeting when all the quotes for manufacture and installation had been received. 51 Town Centre Flagpole Brackets At the meeting of the Tourism and Economy Committee held on Monday 15 June it was suggested that although the town was looking spectacular with bunting and flags flying, there were a number of locations around the town where there were no brackets to display flags. The Chamber of Commerce had suggested that the Town Council considered purchasing additional brackets which the Chamber could arrange the fitting and maintenance of. Councillor Barlow asked Members to consider purchasing up to 50 brackets at a cost of £25 per bracket. RESOLVED: that Sidmouth Town Council purchase brackets at a total cost of up to £1,250 for distribution by the Chamber of Commerce for business premises in Sidmouth. Individual businesses would be responsible for insurance and future maintenance.

The resolution to grant the Freedom has to be approved by ‘not less than two thirds of the Members of the Council who vote on it’.

Sidmouth Town Council - Local Government Pension Scheme A guide to benefits and employer adopted discretionary powers

1. When will the policy commence? This policy will be effective from 1 September 2015.

2. Why has the council introduced this policy? 2.1 This policy aims to set out in summary details of the Local Government Pension Scheme (LGPS) and the ‘discretionary powers’ that have been adopted by Sidmouth Town Council (STC). These are discretions under the following:

 The Local Government Pension Scheme Regulations 2013 (prefix R)  The Local Government Pension Scheme (Transitional Provisions and Savings) Regulations 2014 (prefix TP)  The Local Government Pension Scheme (Administration) Regulations 2008 (prefix A)  The Local Government Pension Scheme (Benefits, Membership and Contributions) Regulations 2007 (as amended) (prefix B)  The Local Government Pension Scheme (Transitional Provisions) Regulations 2008 (prefix T)  The Local Government Pension Scheme Regulations 1997 (as amended) (prefix L)

2.2 This policy takes into account the scheme changes effective 1 April 2014 (New LGPS). Further information about the LGPS, the scheme rules and benefits are available at www.Peninsulapension.org.uk.

2.3 The LGPS is open to all employees of the council between age 16 and 75 years. It is known as a “CARE” scheme (career average revalued earnings) and is administered by Peninsula Pensions (part of ) which is known as the ‘administering authority’.

2.4 The LGPS provides both contractual and discretionary benefits relating to:

 age retirement (in relation to the LGPS)  early retirement  redundancy, efficiency and ill health retirements  death in service of 3 x pensionable pay  widow’s/widower’s benefits  partner’s (same sex and cohabiting) benefits  children’s benefits  the purchase of additional pension.

2.5 The LGPS is an evolving scheme which is subject to change via statutory instruments and new Acts placed before Parliament. Information on changes to the scheme are posted on the council’s intranet and on the Peninsula Pensions website for all employees to access. For our policy relating to pension and redundancy, please see our Redundancy and Policy Procedure. 2.6 The pension scheme requires the Council to decide how it would like to deal with the discretionary benefits which form part of the LGPS scheme. These are referred to as ‘discretionary rules’ in this guide.

3. What is the council’s policy? Normal age retirement under the scheme is linked to your state retirement age (protection applies if you reach age 65 between 1 April 2012 and 31 March 2022). However, you can opt to retire from age 55 but this may result in a reduction in your pension benefits.

3.2 The level of reduction applied if you opt to take your pension benefits before your normal retirement date (NRD) is determined by actuarial tables. Further information regarding the level of reductions can be obtained from the Town Clerk.

3.3 Your benefits will be reduced if you:

 Retire between ages 55 and your NRD (or age 65 if protected) and you are age 60 after 1 April 2016  Retire between age 55 and your NRD and you joined the LGPS after 1 October 2006.  Retire between ages 55 and your NRD and you are aged 60 before 31 March 2016 and joined the LGPS before 1 October 2006, BUT have not achieved the sum of 85 (age and LGPS service).  Are aged 55 between 1 April 2016 and 31 March 2020 and have achieved the sum of 85 (age and LGPS service).

3.4 These reductions only apply if you choose to retire between age 55 and your NRD and do not leave the council for reasons of ill health retirement or redundancy.

3.5 Benefits can accrue up to age 75. Benefits may also be deferred between your NRD and age 75. This means your benefits will be enhanced by the pension fund in recognition of you not having taken them.

4. The following are the discretions adopted by STC Regulation R31 Policy Decision

4.1 The LGPS makes provision for the payment of benefits under an ill health retirement. The payment of these benefits are not age related but based upon the recommendation of the council’s occupational health advisor.

4.2 The main criteria used to recommend an ill health retirement is that you have become permanently incapable of discharging efficiently the duties of your current employment and you have reduced likelihood of obtaining gainful employment (in Local Government or otherwise) before your normal retirement date (NRD).

4.3 Ill health retirement benefits are based upon one of three tiers. The tier under which you retire will determine whether your benefits are enhanced and by how much. The occupational health advisor is responsible for determining the appropriate tier. The tiers are as follows:

Tier 1 No prospect of other gainful employment at any age before your normal retirement date. You will get a pension and normally a lump sum based on the membership you have built up so far, PLUS all the extra membership you would have built up if you had remained a member to your NRD. Tier 2 No prospect of other gainful employment now or any time in the next 3 years; but there IS good prospect before your NRD. You will get a pension and normally a lump sum based on the membership you have built up so far PLUS 25% extra membership you would have built up if you had remained a member to your NRD. Tier 3 Good prospect of other gainful employment straight away or any time in the next 3 years. You will get your lump sum (if applicable) to keep. But your pension will only be paid for a limited time, and will be reviewed after 18 months. The pension is paid for a maximum of 3 years but may be suspended earlier following the 18 month review or taking up gainful employment. Benefits are paid based upon accrued service only, there are NO enhancements. East Devon District Council is required to undertake a review at the end of 18 months to determine whether you are still incapable and if pension benefits should continue to be paid.

5. Flexible Retirement

The council will consider flexible retirement requests. If you are over age 55 you may request to take your pension benefits whilst still in employment where it is agreed that you can reduce your hours of work or in such circumstances as your grade is reduced.

This approach offers an opportunity for individuals to take a gradual or phased approach to retirement. This option is entirely at the council’s discretion with cost and service/customer needs as the primary considerations.

6. Making additional pension contributions (APCs)

You can make additional pension contributions (APCs) up to a maximum of £6,500 per annum (increased annually by CPI). There are two methods used for making additional pension contributions:

7. Your contributions

Your contributions are based upon a table of pensionable pay bandings which show the employer and employee contribution rates.

Your contribution rate is determined by all your pensionable pay, including overtime, additional hours, market supplements and honoraria. STC has adopted the following discretionary rules for these circumstances:

8. Periods of unpaid leave

If you take unpaid leave then this will reduce your pension benefit. You have the option to purchase the lost pension under an APC arrangement. If you make the option within 30 days of the last date of unpaid leave then the council will pay 2/3rds of the cost of the lost pension and you will pay 1/3rd.

If you fail to make a decision to the council in the 30 day period then the full cost of purchasing any lost pension must be paid for by yourself. The cost is determined by actuarial tables and the council will advise of the value of the lost pension benefit.

If you take unpaid leave under the Additional Unpaid Leave policy here then your pension benefits are not affected.

9. Leaving and joining the LGPS

All permanent and fixed term employees are automatically opted into the LGPS unless they choose to opt out. You are able to opt out of the LGPS and opt back in as many times as you wish, however this will of course affect your benefits as it will directly affect the amount of service accumulated in the scheme as well as your pensionable pay accrued. In addition, during any opt out period no death in service benefits would be paid.
