1 Procedures for Addressing Road and Water Crossing Hazards 2 on SFL-Responsible Roads 3 4 5 Introduction 6 7 The condition of forest access roads and trails within Abitibi River Forest is constantly 8 changing due to spring runoff, storm events, beaver dam failure, and blockages caused 9 by beaver or drifting debris. Unmaintained roads and water crossings will eventually fail 10 because of the gradual deterioration of construction materials. Human activity may also 11 alter the condition of roads and water crossings in a negative manner such as 12 mechanical damage and unauthorized ad-hoc repairs to restore access. Significant 13 deterioration or complete failure may result in conditions that represent a public safety 14 hazard or cause harmful effects on fish, fish habitat or water quality. The SFL holder 15 has developed this procedure for dealing with identified road and water crossing 16 hazards on the Abitibi River Forest that is the responsibility of the SFL. 17 18 The party responsible for the road has an obligation to make reasonable efforts to 19 monitor the status of the infrastructure and provide adequate warning of safety 20 hazards. Additionally, appropriate follow-up is required to enhance warnings and 21 reduce or eliminate the hazard. Under some circumstances, there is a legislative 22 requirement to report specific conditions that could harm water quality, fish or fish 23 habitat. 24 25 In those cases were there is an identified problem water crossing that is the SFL’s 26 responsibility, it will be corrected to current prescribed standards as soon as practical 27 on a priority basis. Problems that pose the greatest risk to public safety, fish passage, 28 or fish migration will be given a higher priority for remedial action, while lesser priority 29 problems will be attended to as time and resources permit. 30 31 It must be understood that roads and water crossings may not be restored in a timely 32 manner if damaged or destroyed by unplanned events (e.g. Major storm). There is no 33 obligation on the Crown or Forest Industry to undertake this repair work on behalf of 34 other users who may not have the resources to replace failed infrastructure and that 35 access to their business or property could be disrupted at any time. 36 37 The following procedure provides guidance to staff with respect to: 38 39 identification of hazards 40 establishment of initial safety warnings 41 reporting the condition 42 determining responsibility 43 follow-up actions to enhance warnings and reduce or eliminate hazards 44 record keeping 45 follow-up monitoring 46 legislative reporting requirements 47 providing assistance to stranded individuals 48 initiating emergency repairs 49 ARFMI incident notification requirements 50

1 Identification of Hazards 2 3 Forest Industry or MNR staff may encounter hazardous road or water crossing 4 conditions while traveling on forest access roads to undertake fieldwork, specific 5 surveys or while on patrols. 6 7 If a hazardous condition is encountered, staff have a duty to undertake the following: 8 conduct a preliminary assessment 9 establish an initial warning by hanging wide band flagging tape on either 10 side of the hazard at a suitable location to permit a safe stopping distance 11 if appropriate, utilize other materials (e.g. placement of brush) that will 12 signal the need to reduce speed and stop; Materials should not create an 13 additional hazard (e.g. felling a tree across the road) 14 determine accurate location (GPS reading if possible) 15 photograph the site and established warnings if a camera is available 16 17 In order to meet these obligations, staff travelling on forest access roads should ensure 18 their vehicle has a supply flagging tape (e.g. yellow CAUTION) and copies of Water 19 Crossing Safety Hazard Identification Form. It is recommended that field crews routinely 20 carry a digital camera. 21 22 23 Problems Identified by External Parties 24 25 Hazardous road or water crossing conditions may be reported to Abitibi River Forest 26 Management Inc. (ARFMI) or the Ministry of Natural Resources (MNR) by the public or 27 other resource users. Typically these reports can be expected in the spring or after 28 major weather events. If the road is the SFL’s responsibility, ARFMI will determine if 29 an inspection should be conducted and safety precautions implemented. If the road or 30 water crossing is identified as MNR’s responsibility, ARFMI will notify them of the 31 hazardous condition. 32 33 34 Reporting Procedure 35 36 Forest Industry staff must report hazardous conditions immediately upon returning to 37 the office. Field staff will complete a Water Crossing Safety Hazard Identification Form 38 and submit it to ARFMI. 39 40 Evaluation 41 42 The ARFMI will undertake the following: 43 assess the reported findings 44 determine responsibility for the road/ water crossing 45 initiate appropriate follow-up action 46 start documentation file 47 48 Determining Responsibility 49 50 The ARFMI will determine who is responsible for the road and/or water crossing based 51 on use management strategy documents. The Crown is responsible for infrastructure on

1 Crown land unless a third party has accepted responsibility by a formal legal 2 mechanism (e.g. Land Use Permit, Memorandum of Agreement, Maintenance 3 Agreement, Forest Management Plan etc). 4 5 If it is determined that the SFL is responsible for the problem infrastructure, ARFMI 6 will initiate warning and remedial actions as described in the document. 7 8 If it is determined that a third party other than the SFL is responsible for the 9 problem infrastructure, the MNR will be notified in a timely manner by phone and a 10 follow-up e-mail or letter. 11 12 If the Crown is responsible for the infrastructure, the MNR will be notified in a 13 timely manner by phone and a follow-up e-mail or letter. 14 15 16 Supplemental Warning Enhancements 17 18 For roads that are the responsibility of the SFL, ARFMI in consultation with affected 19 Shareholder, will determine if additional warning techniques should be utilized until the 20 hazardous condition can be minimized or eliminated. Factors to consider include: 21 location, traffic volume, season of use, severity of the hazard, visibility of the problem, 22 stopping distance, and turn around options. 23 24 Supplemental warning methods may include placement of signs/barricades, 25 establishment of berms or other visible speed reducing materials such as brush (not 26 logs, as this could create a hazard). Consideration might also be given to placement 27 of a sign at the beginning of the road indicating the road is blocked and/or 28 impassable at a specified kilometre. It is important to consider seasonal use 29 patterns (e.g. hunting activity, snowmobile usage) as the visibility or risk of the 30 hazard may change depending on seasonal conditions 31 32 Photographs (date stamped) should be taken of all warning measures and the Water 33 Crossing Safety Hazard Identification Form should be updated accordingly. 34 35 A supply of standardized signs is stored at the Abitibi River Forest Management Inc 36 office in Englehart. 37 38 Remedial Action
39 For assigned road infrastructure ARFMI will determine what remedial action should be 40 undertaken to minimize or eliminate the hazard and/or restore access. Remedial work 41 should be consistent with land use plans, resource plans, and road use management 42 strategies. 43 44 a. Notice – The management contractor will circulate an email to the affected 45 Shareholders advising them of the hazard when first advised by the general public 46 or MNR. `Original Constructor` road list (i.e. refer to Appendices) will be used to 47 identify which Shareholder(s) representative is responsible for the road. 48 49 b. Marking of Hazard - The Shareholder will be first on the scene and will conduct 50 the necessary hazard abatement work (i.e. initial marking, establishment of berms

1 and/or posting). This will be more cost effective as they would normally have active 2 operations in closer proximity to the hazard. If not available then the management 3 contractor will carry out initial hazard abatement work on behalf of ARFMI on a 4 cost recovery basis. A Shareholder may elect to undertake the hazard abatement 5 work if there is no Shareholders designated as `original constructor`. At their 6 discretion, they may also charge back associated cost to ARFMI. In all cases, 7 expenditures over $5000 will subject to approval by the Board. 8 9 c. Communications - ARFMI in consultation with affected Shareholder(s) 10 representative responsible for the road will identify any controversies or 11 impediments to undertaking remedial work to the SFL General Manager. If no 12 response received within 5 working days of initial marking of hazard then removal 13 of structure will be the requirement. 14 15 d. Remedial Work – Shareholders and/or management contractor will once again 16 take advantage of the nearest active contractor in the area to complete required 17 road improvements in a timely and cost effective manner. 18 19 e. Cost Recovery – In some cases Shareholders may elect to undertake the necessary 20 repairs at their own expense for unassigned roads but this will remain at their sole 21 discretion. In all other cases the road list provided in attached appendices will be 22 used to identify Shareholder(s) responsible for associated cost of the road work. 23 24 Option 1 – Shareholder Road: Original constructor is responsible for cost of repairs, 25 replacement or decommissioning (i.e. directly or where ARFMI undertakes repairs 26 on behalf of the Shareholder). The affected Shareholder(s) may also elect to recoup 27 part or all of these costs as part of their business–to-business arrangements with 28 Third Party contractors who operate on their allocations. 29 30 Option 2 – Non Shareholder Road: Funding is not available where the road list 31 indicates there is no Shareholder(s) assigned responsibility for the road. Therefore, 32 total cost for remedial work will be charged back on a pro-rata basis to 33 Shareholders at the same percentage specified under the Percentage Share of 34 Harvest Rights table (i.e. refer to Schedule C under Shareholders agreement). 35 36 Option 3 - Replacement cost under Option 1 and 2 can be recovered where funding 37 has been secured under the provincial Road Construction and Maintenance 38 Agreement: 39 i. Shareholder(s) at their sole discretion may request emergency hazard 40 abatement project funding from existing allocations set aside for Short-Term 41 Maintenance under the program. 42 ii. A cost estimate for remedial work will be prepared by Shareholder(s) 43 responsible for the road. 44 iii. The request will be made to and approved by the Roads Working Group 45 consistent with the approved Flow Through Agreement procedures. 46 iv. Once approved, the total project cost will be recovered by equally reducing 47 (i.e. weighted average) each of the proponents existing Short-Term 48 maintenance allocation under the program. 49 v. Decommissioning costs are not eligible under this program. 50 51

1 Information Required – Emergency Repairs 2 3 Basic information is required with submissions for emergency assistance from MNR. 4 MNR will provide any required submission details at that time. 5 6 Emergency Repairs – Stranded Individuals and Equipment 7 8 Sometimes individuals and their vehicles become stranded beyond impassable 9 washouts, however, there is no legal obligation on the part of the SFL to provide this 10 assistance. If there is a need to consider undertaking prompt emergency repairs to 11 restore access and/or evacuate stranded individuals beyond impassable washouts, the 12 MNR will be advised. The timely restoration of access to enable the retrieval of vehicles 13 or equipment is not guaranteed and will be handled on a case-by-case basis. Cost 14 sharing and/or arrangements for funding will be required for the SFL to equitably 15 complete any required work. These emergency repairs will be undertaken in a manner 16 consistent with land use plans, resource plans, road use management strategies and 17 proper construction practices. 18 19 Signage at the start of major road networks, that specifies that a “Road is not 20 Maintained - Use at own Risk” will serve as a notice to users, that they should not 21 expect emergency repairs to be completed on their behalf should they or their 22 equipment become stranded because of unexpected washouts. 23 24 Monitoring 25 26 Periodic monitoring of hazard warnings on SFL assigned roads and crossings are 27 necessary to ensure that flagging tape, signs, barricades or berms are still present and 28 functional. Sometimes warning efforts are vandalized, removed or circumvented. 29 Alterations should be documented by photograph and records updated. Field staff 30 should restore warnings to the best of their ability before leaving the site. Findings 31 should be reported to the ARFMI, who will determine necessary follow-up action. In 32 many cases, ongoing monitoring can be accomplished during the course of regular field 33 activities. Under some circumstances, specific inspections might need to be scheduled 34 on a seasonal basis. The ARFMI and MNR will ensure there is an efficient and 35 coordinated approach to monitoring on roads where the MNR has agreed to share in the 36 task of monitoring on SFL responsible roads.
37 Record Keeping 38 39 Water Crossing Inventory Updating 40 41 ARFMI has established files that contain road/water crossing hazard records. These 42 internal records will be used to demonstrate due diligence in the event of any civil or 43 environmental legal action. This file will be updated as follow-up actions are completed. 44 Any delays in undertaking follow-up action will be recorded along with rationale. 45 46 Water Crossing Inventory Updating 47 48 The ARFMI will ensure that a Water Crossing Inventory is updated to reflect any 49 physical remedial work that was undertaken to correct the hazardous conditions. The

1 Water Crossing Safety Hazard Identification Form Terminology and Definitions
2 Safety Hazard Ranking 3 4 Document any safety concerns by completing a Water Crossing Safety Hazard 5 Identification Form. Identify, on the form, whether the safety concern is high, low, or 6 potential for each hazard condition that exists at the crossing. A separate Water 7 Crossing Safety Hazard Identification Form must be completed for each crossing where a 8 safety hazard has been identified. 9 10 High – defined as an existing safety hazard at the crossing that requires 11 immediate action. Such a hazard could result in an accident causing damage, 12 injury or even death to the unsuspecting user of the road. A condition described 13 as a high hazard is one that needs to be brought to the immediate attention of 14 the responsible agency (e.g. washout, road flooded, large hole in deck, broken 15 stringer, etc.) Field crews should be prepared to mark encountered hazards with 16 wide band flagging tape before they leave the site. 17 18 Low – defined as an existing safety hazard at the crossing that does not require 19 immediate action, however if not addressed will develop into a High Safety 20 Hazard. (lack of adequate signage, small hole in deck, significant erosion, etc.) 21 Field crews should be prepared to mark encountered hazards with wide band 22 flagging tape before they leave the site. 23 24 Potential – defined as a condition at a crossing that is not yet a safety hazard 25 but raises the flag that if not addressed may develop into a safety hazard. 26 Monitoring may be required. (minor erosion, evidence of crushed timbers, 27 beaver activity, etc.) 28 29 None - no public safety issue is known to exist.
30 Definitions
31 Bridges 32 Structures, including culverts, with a span or opening width greater than three 33 meters.
34 Culvert 35 A drainage structure - either a short bridge 3.0 meters or less in length or a 36 structure with enough fill over it so that little of its strength is needed to support the 37 traffic load. A conduit for conveying surface water through an embankment.

1 Piping 2 Subsurface erosion caused by the movement or percolation of water outside and 3 parallel to a culvert.
4 Scour 5 The erosion of soil when it occurs under water, as in the case of the streambed or 6 undermining of a bridge abutment or culvert (which may result in a perched 7 condition).
8 Stable Slope 9 A fill or cut slope that is trimmed flatter than its natural angle of repose. Gravity 10 does not cause individual soil particles to move down the slope if it is stable. A 11 person should be able to walk up a stable slope without causing slumping and 12 sliding of soil particles.
13 Subsidence 14 The settlement of land surface, in this case sections of a roadway or water crossing, 15 caused by the consolidation or removal of underlying soil.
