Fifth report of the Committee of Experts in respect of Spain Item to be considered by the GR-J at its meeting on 19 September 2019 In accordance with Article 16 paragraph 3 of the Charter, the Committee of Experts of the European Charter for Regional or Minority Languages submits its fifth report on the application of the Charter in Spain to the Committee of Ministers of the Council of Europe. The report contains proposals for recommendations to be addressed by the Committee of Ministers to Spain. The Spanish Government has been given the opportunity to comment on the content, in accordance with Article 16 paragraph 3 of the Charter. 1 This document has been classified restricted at the date of issue. In accordance with the Deputies’ decision (CM/Del/Dec(2001)765/10.4), it will be declassified after examination by the Committee of Ministers. Website: www.coe.int/cm CM(2019)125 2 The European Charter for Regional or Minority Languages provides for a control mechanism to evaluate how the Charter is applied in a State Party with a view to, where necessary, making recommendations for improving its legislation, policy and practices. The central element of this procedure is the Committee of Experts, set up under Article 17 of the Charter. Its principal purpose is to report to the Committee of Ministers on its evaluation of compliance by a Party with its undertakings, to examine the real situation of regional or minority languages in the State and, where appropriate, to encourage the Party to gradually reach a higher level of commitment. -

ELEN REPORT TO THE U.N. UNIVERSAL PERIODIC REVIEW, 35th SESSION 2020. LANGUAGE DISCRIMINATION AGAINST NON- CASTILIAN LANGUAGE SPEAKERS IN SPAIN ELEN is the European NGO that works for the promotion and protection of European lesser- used languages. It represents 45 languages with 164 member organisations in 23 European states. It has consultative status with the European Parliament, the Council of Europe, the UN and UNESCO. 1 ELEN STATEMENT TO THE U.N. UNIVERSAL PERIODIC REVIEW, 35th SESSION. LANGUAGE DISCRIMINATION AGAINST NON-CASTILIAN LANGUAGE SPEAKERS IN SPAIN Since ELEN’s 2015 Report to the UN UPR on language discrimination in Spain several public institutions in the Kingdom of Spain continue to openly discriminate against non-Castilian languages (Catalan, Galician, Basque which enjoy co-official status, and Aragonese and Asturian which do not). The organisations engaged in defending these languages and the media have regularly highlighted these cases of linguistic discrimination at the national and international level. While the incidents involve different degrees of severity all of them illustrate the low level of respect for speakers of non-Castilian languages as well as being clear violations of the human rights of those citizens. The inability to use co-official languages, and Asturian and Aragonese, is widespread among civil servants and authorities in spite of the official status of these languages (when they have such status) as well as being in violation of several international treaties and conventions signed and ratified by Spain. CATALAN ELEN member organisation Plataforma per la Llengua has reported1 99 cases of serious un- addressed language discrimination in the Catalan-speaking territories in the period between 2015 and 2019. -

National and state interests of Slovaks and Catalans: parallelism between Slovakia and Catalonia in the way to achieve national emancipation Martin Švikruha Dalibor Mikuš Matúš Meluš Assistant professors at the Department of Public Administration, University of Ss. Cyril and Methodius in Trnava (Slovakia) abstract The integration of European states within the European Union has been one of the basic attributes of political development in Europe since the end of World War II. Despite the ongoing process of this project, we notice a strengthening of separatist efforts within individual states. These trends have been most visible in recent years in Catalonia, which has already taken concrete political steps towards independence. In our contribution we look at the issue of Catalonia from a specific point of view, comparing it to the case of Slovakia. It has a similar historical experience with the accomplishment of emancipatory efforts in the last stage of the 20th century. Slovakia’s independence arose from the peaceful division of the original Czecho-Slovak state unit and represents a positive example for other states. There- fore, we decided to compare these two specific cases. In this context, the primary question arises from the extent to which the requirements of Catalonia are justified and whether it is possible to identify a certain parallelism with a set of internal and external factors char- acteristic of the creation of new states in the 1990s in Europe. Based on interviews with the direct political actors in this process in Slovakia, we have identified three key attributes that we consider to be important prerequisites in the process of fulfilling national interests in the form of a new state. -

Historiography and rediscovery of the thought of the 1700s and 1800s* Miquel Batllori abstract This text shows the similitudes and the differences between Ignasi Casanovas and Frederic Clascar, two of the most important representatives of the religious thought in Catalonia, in the first third of the 20th century. The article studies their philosophi- cal writings in the rich context of their global work, analysing their deficiencies and underlining the positive contribution to the Catalan culture. key words Ignasi Casanovas, Frederic Clascar, religious thought. El Conseller Soler ha explicado que en Alicante los presupuestos de la Generalitat contemplan 321,5 millones en los capítulos de inversiones reales (VI), de transferencias de capital (VII) y el Sector Público Instrumental, y además otros 25 millones en ayudas para reparar los daños ocasionados por la DANA en viviendas. Ello supone un total de 346,5 millones de euros, es decir el 39,3% de la inversión territorializada, lo que significa 2,3 puntos por encima del peso poblacional de las comarcas alicantinas respecto a la Comunitat Valenciana.
