ORDINANCE NO 2122 Series of 2019 Authored by Colin. ROY M. GONZALES AN ORDINANCE DECLARING THE OLD POBLACION IN THE CITY OF SANTA ROSA AS "THE CITY OF SANTA ROSA HERITAGE SQUARE' PRESCRIBING ITS USE AND CONSERVATION, AND FOR OTHER PURPOSES. WHEREAS, the City Government of Santa Rosa aims to protect, preserve, conserve and promote the nation's cultural heritage, its property and histories, and the ethnicity of local communities; WHEREAS, there are a number of historical structures and sites still existing within the old Poblacion of the City of Santa Rosa, Laguna City; WHEREAS, there is an inherent need to preserve and rebuild the remaining historical structures and sites within the old poblacion for the future generations of Rosenians; WHEREAS, in order to preserve the historical core of City of Santa Rosa and to honor the memory of the numerous personage of the City, the Sangguniang Panlungsod of City of Santa Rosa, Laguna hereby MAGILAS NA PAMAMAHALA, PARA SA MASIGLANG SANTA ROSA 5/F City Government Center, J.P. Rizal Blvd., City of Santa Rosa, Laguna — (049) 530-0015 local 5100 to 5104 2 declares the Old Polacion of the City of Santa Rosa, Laguna as the "City of Santa Rosa Heritage Square" and hereby declares the following; WHEREFORE, on motion of Councilor Roy M. Gonzales, duly seconded by All Councilors, the Sangguniang Panlungsod of City of Santa Rosa, Laguna resolves, as it is hereby resolved, to enact an Ordinance: CITY ORDINANCE NO. 2022, SERIES OF 2019 - AN ORDINANCE DECLARING THE OLD POBLACION IN THE CITY OF SANTA ROSA AS "THE CITY OF SANTA ROSA HERITAGE SQUARE, PRESCRIBING ITS USE AND CONSERVATION, AND FOR OTHER PURPOSES". BE IT ORDAINED by the Sanggunian Panlungsod of City of Santa Rosa, Laguna in regular session assembled that: " ARTICLE I TITLE SECTION 1. Title. This Ordinance shall be known as "The City of Santa Rosa Heritage Square Ordinance" ARTICLE II POLICIES AND PRINCIPLES SECTION 2. Declaration of Policy. The City Government of Santa Rosa aims to create a balanced atmosphere where the historic past coexists in harmony with modern society. It shall approach the problem of conservation in an integrated and holistic manner, cutting across all relevant disciplines and technologies. The City of Santa Rosa, understands that conscious effort to protect these structures will further enhance its potential as a City; and in enacting this Ordinance, understands that such a move will increase the City's tourism potential and it will preserve its historical and cultural heritage. ARTICLE III DEFINITION OF TERMS SECTION 3. Definition of Terms For the Purpose of this Ordinance, the following terms shall be defined as follows: (a) Building and Structures- should be taken as similar term and refer to vertical coinstriction either for human habitation or for residential or commercial puposes. (b) Conservation - shall refer to all the processes and measures of maintaining the cultural significance of a cultural property including, but not limited to, preservation, restoration, reconstruction, protection, adaptation or any combination thereof. (c) Cultural Heritage - shall refer to the totality of cultural property preserved and developed through time and passed on to posterity. (d) Heritage Houses-are houses of significant cultural, historical, social, architectural, and artistic value. Because of their significance, they are considered national treasures for the present and future generations. Heritage houses may be houses of ethnic/indigenous tradition, and of the Spanish colonial, American colonial, Post-war periods and/or mixed historical styles (e) History- shall refer to a written record of past events relating to Philippine history. (f) Old Poblacion - Poblacion or poblacion (literally "town" or "settlement" in Spanish; Tagalog pronunciation: [pobla on]) is the common term used for the central, downtown, old town or central business district of the City of Santa Rosa, which takes up the area of Barangay Kanluran and Barangay Kanluran. 2 MAGILAS NA PAMAMAHALA, PARA SA MASIGLANG SANTA ROSA 5/F City Government Center J.P. Rizal Blvd., City of Santa Rosa, Laguna — (049) 530-0015 local 5100 to 5104 3 (g) Restoration - shall refer to the action taken or the technical intervention to correct deterioration and alterations. ARTICLE IV NATURE AND PURPOSES SECTION 4. The Nature and Purpose of Declaring the City of Santa Rosa Heritage Square. The City of Santa Rosa Heritage Square espouses the following objectives: (a) To promote the preservation and conservation of the historical and cultural heritage and resources of City of Santa Rosa, Laguna City for the appreciation of its history and culture. (b) To raise the awareness and level of appreciation of Filipinos in general and Rosenians in particular of the history of City of Santa Rosa, Laguna and its significance in the history of the Republic of the Philippines, and the various local personages who have contributed to the history of the City and the Republic of the Philippines (c) To develop tourism and business along the lines of conserving the socio-cultural heritage, preserving the envirolment and sustaining development; and (d) To contribute to the enhancement of the quality of life of all the inhabitants of City of Santa Rosa, Laguna. ARTICLE V BOUNDERIES DEFINING THE HERITAGE SQUARE SECTION 5. - The Boundaries Defining the City of Santa Rosa Heritage Square is the area covering what is known as the o/d poblacion of the City of Santa Rosa and shall now be known as the City of Santa Rosa, Heritage Square, more particularly defined as follows: a. Starting from the corner of F. Gomez Street and P.Gomez Street in Barangay Malusak, proceeding Westward along F. Gomez Street to turn South at P. Arambulo Street in Barangay Kanluran to the corner of G. B. Zavalla Street; From thence, it shall proceed eastward along G. B. Zavalla Street, crossing Rizal Boulevard again going back to P. Gomez in Barangay Malusak. Rizal Boulevard from the Santa Rosa Arch southwards to the section fronting the old Isabel Lijauco - Mariano Delfino and Emilio Lijauco-Jose Zavalla (now ALSCO) houses; this site encompasses Rizal Blvd., from the foot of Santa Rosa Bridge to the corner of G.B. Zavalla St.; and F. Gomez St., from the corner of Arionuevo St. to the corner of P. Gomez St.; b. All houses and structures fronting these abovementioned routes, including but not limited to the Santa Rosa Plaza, Santa Rosa de Lima Parish Church, City Museum, First Old Church in Poblacion, Zavalla Old House, two other old houses and the City of Santa Rosa Arch and Hacienda as well as the Offices-Government District which includes the Gusaling Batasan, and Tourism Dept., Old City Hall ARTICLE VI IMPLEMENTING OFFICE SECTION 6. City of Santa Rosa Heritage Council (CSRHC). This body is hereby created to be known as "City of Santa Rosa Heritage Council" to be organized within 30 days from approval of this ordinance and to be composed of the following person appointed by the City Mayor. The Council shall be composed of the following: (a) SP Chairman, Committee on Tourism, as chairman, unless the City Mayor designates another person from the body to act as chairman; MAGILAS NA PAMAMAHALA, PARA SA MASIGLANG SANTA ROSA 5/F City Government Center J.P. Rizal Blvd., City of Santa Rosa, Laguna — (049) 530-0015 local 5100 to 5104 4 (b) Representative from the Sangguniang Panlungsod as designated by the City Vice-Mayor, as Vice Chairman; (c) City Administrator, as member; (d) City Planning and Development Coordinator, as member; (e) City Treasurer, as member; (f) City Legal Officer, as member; (g) Head of the City Tourism Office, as member; (h) City Engineer, as member; (i) Office of the City Building Official, as member; (j) City Schools Division Superintendent, as member; (k) A representative from a Non Governmetal Organization engage in the promotion of the socio- cultural well-being of the people through the preservation and protection of its cultural heritage and advancement of its creative expressions in the City of Santa Rosa. SECTION 7. Power and Function. The City of Santa Rosa Heritage Council (CSRHC) is hereby designated as the governing body of the City of Santa Rosa, Heritage Square with the following powers and functions: (a) To initiate, plan, undertake, and supervise the restoration, upkeep and maintenance of public places or areas, streets, and other local government properties in the City of Santa Rosa Heritage Square; (b) To adopt, issue, promulgate and implement regulations
