Summary of the 6th session

SKOPJE, 03/27/2012 – on its today’s session the Broadcasting Council has given a deadline to all the broadcasters that until the 30th September 2012 the latest they should adjust their working according to the article 11 from the broadcasting activity law. If the broadcasters do not act according to the article 11 until the envisaged deadline, they will have their license for performing broadcasting activity revoked, in accordance with the article 64 from the broadcasting activity law.

The Broadcasting Council has allowed all national satellite televisions to pay the compensation regarding the license for performing broadcasting activity on a determined number of installments and within specifically determined deadlines, by which act the broadcasting Council’s agreements will be accorded to those satellite televisions who have required such manner of payment.

Summary from the first sequel of the 5th session

SKOPJE, 03/21/2012 – on the first sequel of the fifth session, the members of the Broadcasting Council have reviewed the Information on the satellite televisions’ working, after which it was unanimously decided to have BM TV license revoked, based on article 63, paragraph 1 line 1, because of non commencing their activity within the envisaged deadline. Jungle TV, Perspektiva TV (Sky Net Plus), 24 Vesti TV, AB Kanal TV and Pink 15- TV have a deadline of 15 days to remove the obstacle because of which they do not broadcast their program through a satellite and to settle their obligations towards the Broadcasting Council, otherwise the Council will revoke their licenses for performing broadcasting activity.

After the analysis of the reports on the conducted monitoring, the Broadcasting Council sentenced the following indications and measures: Jungle TV: 4 written warnings with a demand for publishing;

Nasha TV: 2 indications; AB Kanal TV: 2 indications; Alfa TV: 4 indications; Sitel 3 TV: written warning with a demand for publishing and an indication; Pink 15- TV: 3 written warnings with a demand for publishing and one indication; 24 Vesti TV: no violations; Perspektiva TV: 2 indications; Sonce TV: 2 indications.

After the conducted monitoring of A2 TV it was concluded that a letter should be sent to the broadcaster and to the trustee of the bankrupt’s estate to point out to the fact that A2 TV does not fulfill the conditions from the license and that the television should give additional information on their factual condition and on their further plans.

Regarding the program ‘’on the way to…’’ (,,Na patot kon…’’), broadcasted on -M TV, it has been concluded that the program deviates from the program principles in the part where the host of the program does not intervene and does not limit him/herself, nor he/she warns his/hers interlocutor when the second one is pronouncing insults. With this Alsat-M TV acts opposite the program principle from article 68, paragraph 2, line 2 on ‘’the protection of the privacy and the dignity of the individual’’. Considering the Report of the analysis of Journal 1 at Sitel TV from 10th March 2012, the Council concluded that article 68 from the broadcasting activity law has been violated and it decided to take appropriate measure on the next sequel of the session, according to this article from the law.

Summary of the 5th session

SKOPJE, 03/20/2012 – The Broadcasting Council on its today’s session has passed down a resolution by which the seize of validity of the license for performing broadcasting activity of A1 TV is determined, because of the factual and legal basis for application of the article 62, paragraph 1, line 4 from the broadcasting activity law.

The Report on the realization of the obligations for protection and nourishment of the cultural identity on radio and television programs in 2011 was also adopted, which arises as an obligation from the National Program for adopting the Acquis Communautaire for 2011. Through a discussion it was concluded that the broadcasters in the previous year did not sufficiently satisfy the quota for originally created program, therefore it was decided to send additional indication to all the broadcasters to pay more attention to this aspect in the future.

Because of the fact that MEDI TV from Bitola and DJ Slave TV from Struga have been unavailable for a longer period of time, the Broadcasting Council decided to undertake activities in the direction of determining the factual condition of these two broadcasters. Related to the concluded change in the ownership structure of Gurra TV from Kichevo, without a previously required approval from the Broadcasting Council, the regulator decided to sentence written warning to this broadcaster. The Broadcasting Council concluded the removed illicit media concentration at the broadcasting entity Sky Radio Plus from Berovo.

The Broadcasting Council decided to notify the producers that have begun the realization of their public interests projects that until the 1st December 2012 the latest they should complete the projects, and if in the envisaged deadline they do not submit a final project, the Broadcasting Council will ask them to return the paid means.

The Council reviewed the Information on the short term and the medium term measures for development of the media on Romani language in the Republic of Macedonia, by a proposal of conclusion on the further acting of the Broadcasting Council, having in mind the recommendations and the activities contained in the Strategy for Roma population in the Republic of Macedonia, in the part related to the electronic media on Romani language. In those frames, despite the other, the legal and the technical possibilities for dispersion of the signal of the current regional televisions on Romani language in Skopje, in the interior parts of the Republic of Macedonia, especially in those part where there is bigger concentration of Roma population.

The Broadcasting Council reviewed the correspondence of Alfa TV regarding the decision of the editorial not to broadcast the program ‘’Vo centar’’ (‘’In the Centre’’). The demands of Kanal 5 TV and Sitel TV for the assessment of the presence of music in their programs have also been reviewed and adopted, during which the Broadcasting Council will submit to the broadcasters information that it already disposes of. Summary of the 4 th session

SKOPJE, 27.02.2012 – On today’s session, BC noted that TV Sitel, TV AlsatM and Nasha TV have fulfilled the imposed sanction – written warning with an obligation for publishing. Only Jungle TV hasn’t fulfilled its obligation, and decision was made that if this broadcaster doesn’t fulfill this obligation – written warning with an obligation for publishing in a period of 7 days, a misdemeanor charge to be raised against it. Regarding the Report of the monitoring of the programming “Life- 20 Years Independence”, which was broadcast on TV Alfa, the BC took into account that TV Alfa had announced five times in all broadcast episodes of the serial that images from MRT had been used, except of once, so BC decided to point out to TV Alfa that in the episode broadcast at 3rd of January 2012 it didn’t provide information on the owner of the archival footage. BC also pointed out to this broadcaster that in the future it must regulate the rights for using audio-visual materials in its programs, which are property of other broadcasters or producers according to the Copyright Law, since the Article 77 from the Broadcasting Law commits them to create and broadcast programs with regulated copyrights. BC will also inform MRT, stating that in the future, for violations of their rights, they may initiate proceedings according the Copyright Law. The Information on the Request for approval to change the ownership structure of TV Shutel, was also adopted. The points from 4 to 16 of the Agenda, related to the Reports from the monitoring of the local TV stations, were postponed for the continuation of the session.

02/10/2012, SKOPJE – the Broadcasting Council held its second session on the 10th February, where the reports from the monitoring of the terrestrial televisions and radios of national level were discussed. The members of the Broadcasting Council pronounced the following measures:

Alsat –M TV: two written warnings, Kanal 5 TV: two written warnings, Sitel TV: one written warning with commitment for publishing and one written warning,

The Broadcasting Council decided to address Telma TV 3 notifications. After the processing of the reports from the monitoring of the radio stations on national level, the Broadcasting Council pronounced down the following measures:

Ros Metropolis Radio: 2 written warnings with a demand for publishing, one written warning and one notification. Antenna 5 Radio: 3 written warnings with a demand for publishing, one written notification. Kanal 77 Radio: notification and one written warning with a demand for publishing The Broadcasting Council also adopted the proposal report of the inventory commission on the conducted inventory list of the basic means, the small inventory, the material and the reserve parts in the storehouse, the demands and the obligations of the Broadcasting Council of the Republic of Macedonia for 2011. The Broadcasting Council decided to commence the preparation activities for the call of applications for issuing licenses for television program services through public communication networks’ operators. Also, the possibility for granting licenses for nonprofit broadcasting institutions for the religious communities was discussed. The Broadcasting Council adopted the analysis of the monitoring of the broadcasters’ ownership structure and of their obligations in terms of the transparency in the ownership structure in the period between 1st July and 31st December 2011 and the Analysis of the supervision of the obligations of the public communication networks: registered packages, pronounced fines, most frequent violations and the pronounced measures in the last quarter of the year, that arise as an obligations from the National Program for Adoption of the Acquit Communautaire 2011.

After the adoption of the Report of the analysis of the television program services of the Public Broadcasting Service MRT and the Report from the monitoring of the Public Broadcasting Service – Political pluralism in the television news, that also arise as an obligation from the National Program for Adoption of the Acquit Communautaire 2011, it was decided that it is useful to send these documents to the Macedonian Radio Television.

The Broadcasting Council adopted the draft statute for creation of a Network of regulatory bodies for media on South Eastern Europe – SEENRA (South Eastern European Network of Regulatory Bodies). As a main initiator of SEENRA, the Broadcasting Council invited all the regulatory bodies from the Southeastern European region to participate in this network.

The Council analyzed the Information related to the correspondence with the Cinemathque of Macedonia related to the submission of copies from the television programs of public interest financed by the broadcasting fee through the Broadcasting Council, and it decided to go through the possibilities for recopying of the projects in digital format.

After concluding that with the planned change illicit media concentration does not appear and the provisions from the Broadcasting Activity Law are not violated, the Broadcasting Council decided to approve the demand for a change in the ownership structure of the Broadcasting Entity Radio Ohrid LTD from Ohrid.

Summary from the 1st session

SKOPJE, 01/12/2012 – on its first session, the Broadcasting Council adopted the Minutes from the 19th session of the Broadcasting Council of the Republic of Macedonia, held on the 28th November 2011 that had two sequels, held on the 1st December 2011, i.e. on the 2nd December 2011.

The Council adopted the Final report from the conducted revision on the project CEE Digi TV, financed by the accession funds of the European Union the IPA Transnational in the process for public procurement in a procedure with a demand for collecting offers without publishing an announcement. The Draft for public procurements of the Broadcasting Council of the Republic of Macedonia for 2012 was adopted, together with the accompanying documents to the Plan: Proposal – Procedure for public procurement, Proposal – Form for public procurement and Deployment of public procurements according to sectors.

The Broadcasting Council decided to issue an approval for a change in the ownership structure of the Broadcasting Entity Zupa TV from the village Mal Papradnik – Center Zupa, given the fact that with the change illicit media concentration will not be created, i.e. there are no formal and legal obstacles.

The Information on the fulfillment of the obligation for publishing the data according to article 20 from the Broadcasting Activity Law was as well adopted and the Council decided that because of failure to fulfill the obligation for publishing the data on the working of the previous year, that arise from article 20 paragraphs 1 and 2 from the Broadcasting Activity Law, to pronounce the following measures: written warning to the Broadcasting Entity A2 TELEVISION LTD; temporary interdiction for advertising and teleshopping of one day to the Broadcasting Entity DJ Slave LTD Struga; temporary interdiction for advertising and teleshopping of three days to the Broadcasting Entity MEDI TV LTD from Bitola.

The Broadcasting Council adopted the Report related to the held working meeting with the representatives from DIGIT ALB from Albania. On the session, the Draft- Decision for the termination of the validity of the Rulebook on professional improvement, additional education and specialization of the members of the Broadcasting Council was not adopted.
