RESUMEN La doctrina española es unánime en el sentido de situar en el siglo XVIII el origen de las primeras normas jurídicas protectoras del patrimonio cultural. Normas protectoras, sin embargo, las hubo antes en los territorios históricos vascos, en algunos sectores concretos. Y como consecuencia de su conflictiva inclusión en el ámbito de la monarquía constitucional, las promulgadas a partir de dicho período con vocación de aplicación general a todo el territorio estatal, tuvieron escasa efectividad real, derivando en una situación de incuria y abandono de nuestros bienes culturales. Pretendemos examinar en el presente artículo, las normas con las que los órganos forales quisieron tutelar algunos específicos bienes, analizar en qué medida se aplicaron las que se dictaron por los diferentes gobiernos de la monarquía, antes de la plena implantación del ordenamiento constitucional y dar cuenta de alguno de los primeros intentos de desarrollar una verdadera política de tutela del patrimonio cultural, el programa que para este objeto esbozó, a caballo del XVIII y el XIX la Real Sociedad Bascongada de Amigos del País. SOBRINO ARANZABE SUMMARY Spanish doctrine unanimously agrees to date the birth of the first legal regulations protecting cultural heritage in the 18th century. Nevertheless, protective laws existed in the Basque Historical Territories before that date, in some specific sectors. And, as a result of their controversial inclusion in the scope of constitutional monarchy, laws enacted from that period on and drawn for general application in all the territory of the state had scarce effectiveness, and led to a situation of carelessness and abandonment of our cultural heritage. In the present article we try to examine the laws that regional authorities used to guard some specific goods; to analize to what extent laws enacted by the different governments of the monarchy were actually applied befo- re the full implementation of the constitutional legal system; and to shed light on some of the first attempts to carry out a real protective policy for Basque cultural heritage, such as the programme that The Royal Basque Society of Friends of the Country outlined with this purpose between the 18th and the 19th century.
