KG, Göttingen ♾ Printed on acid-free paper Printed in Germany www.degruyter.com Foreword The motivation for writing this book began with my, one might say, naïve belief that critical thinking could have avoided the rise of the Third Reich and the Shoah in World War II. The main culprits were put on trial in Nuremberg, and then came the Eichmann trial in Jerusalem and the Auschwitz trials in Germany. Later on, the compliancy of Heidegger, Gadamer, and others with the Nazi regime was exposed by prominent scholars.1 Thus, the personal and public reputations of Heidegger, Jünger, Schmitt, Gadamer and others were destroyed and then partly rehabilitated. Their teaching, which was essential in consolidating and promulgating the Nazi world-view and in creating and designing the atmosphere of support for the Nazi movement, has, however, mostly remained untouched and continues to be uncritically studied and referred to. As Alain Finkielkraut writes: As Jankélévitch has rightly noted, the extermination of the Jews “was doctrinally founded, philosophically explained, methodically prepared by the most pedantic doctri- narians ever to have existed.” The Nazis were not, in effect, brutes, but theorists. -

Benedict Department of History Graduate Program Professor Kevin Boyle ABSTRACT This work explores how German immigrants influenced the reshaping of American citizenship following the Civil War and emancipation. It takes a new approach to old questions: How did African American men achieve citizenship rights under the Fourteenth and Fifteenth Amendments? Why were those rights only inconsistently protected for over a century? German Americans had a distinctive effect on the outcome of Reconstruction because they contributed a significant number of votes to the ruling Republican Party, they remained sensitive to European events, and most of all, they were acutely conscious of their own status as new American citizens. Drawing on the rich yet largely untapped supply of German-language periodicals and correspondence in Missouri, Ohio, and Washington, D.C., I recover the debate over citizenship within the German-American public sphere and evaluate its national ramifications. Partisan, religious, and class differences colored how immigrants approached African American rights. Yet for all the divisions among German Americans, their collective response to the Revolutions of 1848 and the Franco-Prussian War and German unification in 1870 and 1871 left its mark on the opportunities and disappointments of Reconstruction. -

(JTI) and JT International Holding BV (JTH), on their own behalf and for and on behalf of all subsidiaries of JTH existing at the date of this Agreement (together Japan Tobacco Companies) and The European Community (the EC) represented by the European Commission (the Commission) and the Member States of the European Union participating in this Agreement (the Participating Member States). 1. RECITALS WHEREAS (A) illicit traffic in Cigarettes is a growing problem for the EC, for Member States and for legitimate trade in tobacco products. It takes the form of trade in both counterfeit Cigarettes and genuine products, which are smuggled into the EC without payment of any applicable EC or Member State tax or duty, or unlawfully introduced from low-tax jurisdictions into higher-tax jurisdictions; (B) illicit traffic in Cigarettes is against the public interest in tax collection, transparent markets, and the protection of lawful competition. As such, illicit traffic in Cigarettes is against the interests of the EC, the Member States, as well as Japan Tobacco Companies and their stakeholders, including employees, customers, business partners and shareholders; (C) the problem of illicit traffic in Cigarettes calls for binding cooperative efforts between the tobacco industry, the Member States and the EC aimed at eliminating the flow of contraband and counterfeit and consequent loss of revenues; (D) Japan Tobacco Companies recognise that creating a system to provide the EC and Member States with the effective and timely ability to track and trace sales of Japan Tobacco Cigarettes is an important component of their commitment to fight the trade in Illegal Product. -

Abu Ali Al-Madani Trading LLC Foreword On behalf of the Organizing and Scientific Committees, I am glad to present the Proceedings of the Third Conference of the International Society of Camelid Research and Development (3rd ISOCARD), which is being held in Muscat, Sultanate of Oman from the 29th of January to the 1st of February 2012. The Conference has attracted 200 participants from 39 countries. Over one hundred oral presentations will be given, and participants will have the opportunity to see approximately 85 poster presentations. We are sure that the selected topics will provide a wealth of information and many opportunities for discussions. The invited speakers’ papers will be published in a special issue of the Journal of Camelid Science. The theme for the 3rd ISOCARD Conference is “Challenges Facing Camelids in a Changing World”. It includes various sessions, namely: physiology, biochemistry and pharmacology, medicine, health and infectious diseases, immunology, reproduction, anatomy and surgery, pastoral systems, genetics and biotechnology, meat and products, milk and nutrition. The latest research findings by scientists from a broad range of camel research bodies around the world, including research, government agencies and industry are included in the proceedings. They reflect important advances pertaining to camelid health and production. We trust the proceedings will promote international communication in camelid science. -

CONSOLIDATED TABLE OF CASES ARRANGED ALPHABETICALLY VOLUMES 1—125 Notes : This table of cases lists as comprehensively as possible, in alphabetical order, all cases reproduced or reported in the Annual Digest /International Law Reports, entering cases under all common variants of their title. It should be noted that many cases appearing in the AD/ILR do not have a title as such in their original version (e.g. in jurisdictions where the practice is to use case numbers rather than titles). There are other circumstances (e.g. ICJ cases) where to include the full formal title (including the introductory ‘Case concerning’) would be misleading in an alphabetical table. Such cases are listed under the key element[s] (e.g. ‘Aerial Incident of 27 July 1955’ rather than ‘Case concerning ...’). The full formal titles are used, where they exist, in the table of cases by jurisdiction. ILR practice, in the presentation of cases and in the treatment of cases referred to and in the matter of cross-references, has varied considerably over the years. So far as practicable, the current table brings earlier tables into conformity with current practice. Page references in earlier tables have accordingly been deleted where they contained no more than a cross- reference or a direction to another part of the volume where treatment of the case could be found. Where, in the Annual Digest in particular, a long extract from a case has been included, this has been treated as a full report rather than a note – ‘long’, of course, being a variable concept. Current ILR practice is, wherever appropriate, to use English in case titles (e.g. -
