    ACMRO 6th National Conference 6-7 August 2019 Missionary Clergy and Religious in Australia: Challenges and Opportunities CONTEMPORARY MIGRATION: THE OPPORTUNITIES BEYOND THE CHALLENGES Fr. Fabio Baggio Migrants & Refugees Section - DPIHD With the Apostolic Letter Humanam progressionem on August 17, 2016, Pope Francis (2017a) established the Dicastery for Promoting Integral Human Development. It merged the Pontifical Councils ‘for Justice and Peace,’ ‘Cor Unum,’ ‘for the Pastoral Care of Migrants and Itinerant People’ and ‘for Health Care Workers.’ This new organization brings together the tools for promoting integral human development. However, the serious human emergency of increasingly frequent and consistent migrations caused by conflicts and natural catastrophes, has made it necessary to pay greater, specific and urgent attention to migration questions. For this reason, a special Migrants and Refugees Section has been set up within the Dicastery, which is led for the time being by the Pontiff himself. The magnitude, complexity and urgency of the issues related to migrants, refugees and asylum seekers in the world, along with the significance and importance of the vocation of the Church to accompany them, are the real ‘first premise’ of the Migrants and Refugees Section, as well as of the guidance and supervision of the Holy Father. The Section is called upon to give convincing testimony and to undertake effective action for the good of migrants and refugees. The Migrants and Refugees Section makes a fundamental aspect of the mission of the Church concretely clear: accompanying the people of God in all their joys and hopes, sorrows and anxieties, especially of the poor and all those who suffer (Second Vatican Council, 1965).

D’AVRAY Fellow of the British Academy Abstract: Papal law is known from the late 4th century (Siricius). There was demand for decretals and they were collected in private collections from the 5th century on. Charlemagne’s Admonitio generalis made papal legislation even better known and the Pseudo-Isidorian collections brought genuine decretals also to the wide audience that these partly forged collections reached. The papal reforms from the 11th century on gave rise to a new burst of papal decretals, and collections of them, culminating in the Liber Extra of 1234. The Council of Trent opened a new phase. The ‘Congregation of the Council’, set up to apply Trent’s non-dogmatic decrees, became a new source of papal law. Finally, in 1917, nearly a millennium and a half of papal law was codified by Cardinal Gasparri within two covers. Papal law was to a great extent ‘demand- driven’, which requires explanation. The theory proposed here is that Catholic Christianity was composed of a multitude of subsystems, not planned centrally and each with an evolving life of its own. Subsystems frequently interfered with the life of other subsystems, creating new entanglements. This constantly renewed complexity had the function (though not the purpose) of creating and recreating demand for papal law to sort out the entanglements between subsystems. For various reasons other religious systems have not generated the same demand: because the state plays a ‘papal’ role, or because the units are small, discrete and simple, or thanks to a clear simple blueprint, or because of conservatism combined with a tolerance of some inconsistency.

    New Members Appointed Pope Francis appoints PAV Ordinary and Honorary Members The Holy See has announced that on May 16, 2017, His Holiness Pope Francis appointed 45 Ordinary Members and 5 Honorary Members of the Pontifical Academy for Life. Archbishop Vincenzo Paglia, President of the Academy, commented on the appointments, saying that "with these appointments Pope Francis has formed a College of academics of the highest professional standing that will offer to the Catholic Church and to the whole world a deep and wise vision in the service of human life, especially life that is weakest and most defenseless. The Academicians named by the Holy Father come from 27 countries around the world and are outstanding in diverse fields of human knowledge. Among them are a number of non-Catholics, either belonging to other religions and non-believers, a sign that the protection and promotion of human life knows no divisions and can be assured only through common endeavor.” With respect to the appointment of Honorary Members, Archbishop Paglia noted that, "They represent the history of the Academy and a passion for human life for which we must all be grateful; it is thanks to the earlier work of so many illustrious men and women that today, with the appointment of new Academicians, our institution continues its service to life with renewed energy." - 1 - The Governing Council of the Academy, which will be appointed by the Holy See pursuant to the Statutes and the Regulations of the Academy, will appoint Corresponding Members and Young Researchers (a new membership category created in the Statutes promulgated by Pope Francis in 2016), and thus fill out the membership of the Academy.

Chiegboka and Kanayo Louis Nwadialor DOI: http://dx.doi.org/10.4314/ujah.v14i1.11 Abstract The Apostolic tribunals especially the tribune of the Roman Rota is charged with the unity of jurisprudence and the responsibility to oversee the proper administration of justice since the doctrine of judicial precedents do not exist within the canonical jurisprudence of the local Churches. As such the local Churches must look to the jurisprudence and praxis of the Roman Curia in supplying for an express prescription of law. In line with the above therefore, this paper has discussed the basic issues of the Roman Rota as it is endowed with the status of judicial precedents considered necessary to serve as a guide and orientation for the interpretation of law in the local Church tribunals. Introduction John Paul 11(1988) provided for the judicial competences of some tribunals of the dicasteries of the Roman Curia (e.g. Congregation for Doctrine of Faith on graviora delicta-art 53; Congregation for Divine Worship and Discipline of Sacraments, non-consummation-art 67 and nullity of ordination-art 68 etc.) differently from the de facto Apostolic Tribunals (i.e. The Apostolic Penitentiary-artt. 117-120; The Supreme Tribunal of the Apostolic Signatura-artt. 121-125 and The Tribunal of the Roman Rota-artt. 126-130). Noonan, Jr.* The two marriages of Charles, Duke of Lorraine, led to one of the most fascinating canonical trials of the seventeenth century. Professor Noonan uses this trial and its attendant circumstances as a springboard from which to examine the policies, procedures, and politics of post-RenaissanceRoman Catholic law. His Article under- lines the problems faced by a legal system that attempts to regulate the relationshipbetween man and woman. In broader perspective, it analyzes the reaction of a legal system forced to compromise between abstract social values and practical necessity. Professor Noonan's analytical framework can be profitably utilized as a tool to examine the manner in which our current social policies are implemented and administered. Anthropology rightly devotes great effort to deciphering the primi- tive attempts of men to make law in the primordial patterns, for from this effort will come material to illuminate our own behavior. But just as child psychology does not exhaust the study of man, so there is need to understand critically the functions of law in a more sophisticated phase. In its developed uses we are more likely to see analogues to our present problems, more likely to gain insights into the purposes, perver- sions, characteristics, and limits of the legal way of ordering human behavior in a mature society. Especially is this true of a system far enough removed from our own to be looked at from a distance but close enough in its assumption and its methods so that comprehension is not strained.

The conference, sponsored by the Dicastery for Laity, the Family and Life, the Diocese of Rome and the Pontifical John Paul II Theological Institute for the Sciences of Marriage and Family, kicked off celebrations of the “Amoris Laetitia Family Year,” which will conclude June 26, 2022, at the World Meeting of Families in Rome. Pope Francis told conference participants, most of whom were watching online, that his exhortation was meant to give a starting point for a “journey encouraging a new pastoral approach to the family reality.” “The frankness of the Gospel proclamation and the tenderness of accompaniment,” he said, must go hand in hand in the Church’s pastoral approach. The task of the Church, the pope said, is to help couples and families understand “the authentic meaning of their union and their love” as a “sign and image of Trinitarian love and the alliance between Christ and his church.” The Church’s message, he said, “is a demanding word that aims to free human relationships from the slaveries that often disfigure them and render them instable: the dictatorship of emotions; the exaltation of the provisional, which discourages lifelong commitments; the predominance of individualism; (and) fear of the future.” Marriage is a part of God’s plan for individuals, is the fruit of God’s grace and is a call “to be lived with totality, fidelity and gratuity,” the pope said.
