D’AVRAY Fellow of the British Academy Abstract: Papal law is known from the late 4th century (Siricius). There was demand for decretals and they were collected in private collections from the 5th century on. Charlemagne’s Admonitio generalis made papal legislation even better known and the Pseudo-Isidorian collections brought genuine decretals also to the wide audience that these partly forged collections reached. The papal reforms from the 11th century on gave rise to a new burst of papal decretals, and collections of them, culminating in the Liber Extra of 1234. The Council of Trent opened a new phase. The ‘Congregation of the Council’, set up to apply Trent’s non-dogmatic decrees, became a new source of papal law. Finally, in 1917, nearly a millennium and a half of papal law was codified by Cardinal Gasparri within two covers. Papal law was to a great extent ‘demand- driven’, which requires explanation. The theory proposed here is that Catholic Christianity was composed of a multitude of subsystems, not planned centrally and each with an evolving life of its own. Subsystems frequently interfered with the life of other subsystems, creating new entanglements. This constantly renewed complexity had the function (though not the purpose) of creating and recreating demand for papal law to sort out the entanglements between subsystems. For various reasons other religious systems have not generated the same demand: because the state plays a ‘papal’ role, or because the units are small, discrete and simple, or thanks to a clear simple blueprint, or because of conservatism combined with a tolerance of some inconsistency. -

The Politics of Death: An Examination of Aristocratic Male Funerals During the Late Republic of Rome Winner, Humanities, Best Overall Undergraduate Paper Author: Leah MacIntyre The Roman Republic during the first century BC was marked by multiple periods of instability and political chaos, as well numerous civil wars, which together brought about a major shift in the traditional sources for political support in the Roman world. The military, traditionally "the defender of state and architect of empire," was no longer the exclusive institution of the landed Roman citizen, but now incorporated poorer classes who were inspired by the opportunities a military career offered in regards to personal gain and wealth.[1] Significant military reforms, beginning with the consulship of Gaius Marius, created the context for unprecedented concentrations of military power within select individuals, hereto unheard of, as well as militarily elected and enforced political offices within Rome.[2] The system of individual competition, inherent in Roman politics and public life, had always begrudgingly accepted the importance of gaining and maintaining the support of the people, who were defined as "the arbiters of success or failure [as] they alone could validate structural change."[3] However, due to the structural upheaval which marked the late Republic, the role of this mass became increasingly more important and central in the political theatre of Rome. Within the chaos of this period, it is no surprise that public events were co-opted as political tools, particularly the funerals of elite Roman citizens. Funerals became intensely public and political events which, at times, resulted in the outbreak of lethal violence and rioting due to the calculated actions of politicians and their supporters. -

The Catholic Church in the Czech Republic Dear Readers, The publication on the Ro- man Catholic Church which you are holding in your hands may strike you as history that belongs in a museum. How- ever, if you leaf through it and look around our beauti- ful country, you may discover that it belongs to the present as well. Many changes have taken place. The history of the Church in this country is also the history of this nation. And the history of the nation, of the country’s inhabitants, always has been and still is the history of the Church. The Church’s mission is to serve mankind, and we want to fulfil Jesus’s call: “I did not come to be served but to serve.” The beautiful and unique pastoral constitution of Vatican Coun- cil II, the document “Joy and Hope” begins with the words: “The joys and the hopes, the grief and the anxieties of the men of this age, especially those who are poor or in any way afflicted, these are the joys and hopes, the grief and anxieties of the followers of Christ.” This is the task that hundreds of thousands of men and women in this country strive to carry out. According to expert statistical estimates, approximately three million Roman Catholics live in our country along with almost twenty thousand of our Eastern broth- ers and sisters in the Greek Catholic Church, with whom we are in full communion. There are an additional million Christians who belong to a variety of other Churches. Ecumenical cooperation, which was strengthened by decades of persecution and bullying of the Church, is flourishing remarkably in this country. -

The Holy See I GENERAL NORMS Notion of Roman Curia Art. 1 — The Roman Curia is the complex of dicasteries and institutes which help the Roman Pontiff in the exercise of his supreme pastoral office for the good and service of the whole Church and of the particular Churches. It thus strengthens the unity of the faith and the communion of the people of God and promotes the mission proper to the Church in the world. Structure of the Dicasteries Art. 2 — § 1. By the word "dicasteries" are understood the Secretariat of State, Congregations, Tribunals, Councils and Offices, namely the Apostolic Camera, the Administration of the Patrimony of the Apostolic See, and the Prefecture for the Economic Affairs of the Holy See. § 2. The dicasteries are juridically equal among themselves. § 3. Among the institutes of the Roman Curia are the Prefecture of the Papal Household and the Office for the Liturgical Celebrations of the Supreme Pontiff. Art. 3 — § 1. Unless they have a different structure in virtue of their specific nature or some special law, the dicasteries are composed of the cardinal prefect or the presiding archbishop, a body of cardinals and of some bishops, assisted by a secretary, consultors, senior administrators, and a suitable number of officials. § 2. According to the specific nature of certain dicasteries, clerics and other faithful can be added to the body of cardinals and bishops. § 3. Strictly speaking, the members of a congregation are the cardinals and the bishops. 2 Art. 4. — The prefect or president acts as moderator of the dicastery, directs it and acts in its name. -

Part 1 – Church Becomes Powerful Institution Evidence of Rome’s power grab • In 2nd century we see bishops over regions; people looked to them for guidance. • Around 195AD there was dispute over which day to celebrate Passover (14th Nissan vs. Sunday) • Polycarp said 14th Nissan, but now Victor (Bishop of Rome) liked Sunday. • A council was convened to decide, and they decided on Sunday. • But bishops of Asia continued the Passover on 14th Nissan. • Eusebius wrote what happened next: “Thereupon Victor, who presided over the church at Rome, immediately attempted to cut off from the common unity the parishes of all Asia, with the churches that agreed with them, as heterodox [heretics]; and he wrote letters and declared all the brethren there wholly excommunicate.” (Eus., Hist. eccl. 5.24.9) Everyone started looking to Rome to settle disputes • Rome was always ending up on the winning side in their handling of controversial topics. 1 • So through a combination of the fact that Rome was the most important city in the ancient world and its bishop was always right doctrinally then everyone started looking to Rome. • So Rome took that power and developed it into the Roman Catholic Church by the 600s. Church granted power to rule • Constantine gave the pope power to rule over Italy, Jerusalem, Constantinople and Alexandria. -

Statistical Analysis Marriage Nullity Cases in the United States of America from 2016-2018 Introduction Over three years have passed since the reform of the process for the declaration of the nullity of marriage legislated by the Motu proprio Mitis Iudex Dominus Iesus and Mitis et misericors Iesus has gone into effect. Due to the novelty of the Processus brevior coram Episcopo, there is much interest in the way it is being used. Several have already produced statistical studies. There are the two studies for the Ibero- American tribunals.1 In addition, the Canon Law Society of Great Britain and Ireland published in its 2019 Newsletter a statistical analysis for Tribunal activity in 2017.2 There is also the periodical Proceedings of the Canon Law Society of America, which began in 2017 to published the statistics for the briefer process.3 Scope and Method The present study seeks to analyze the statistics regarding the first instance activity of ecclesiastical Tribunals in the United States of America from 2016 through 2018. While some of above-mentioned studies relied heavily on reports of the Central Office of Statistics of the Church, the raw data for this study was gathered exclusively from the Annual Reports on the State and Activity of the Tribunal submitted to the Supreme Tribunal of the Apostolic Signatura. 4 Certainly this choice placed some limitations on the data intake; however, the report provides a unique data set including the number of appeals lodged by the defender of the bond. But very few rely on long term past perspectives, which could result in a precious opportunity to suggest innovative configurations related to specific institutional environments. On the other hand, historiography is a subject of growing interest in IS. Nonetheless, if many studies have already been carried out on the history of the technology or computer industries, very few have dealt with organizational IS history. This is regrettable, as it would give researchers a unique opportunity to understand long term IS dynamics and to grasp historical IS archetypes. Here, the author outlines a history of the IS of one of the oldest organizations in the world: the Roman Curia (the headquarters of the Catholic Church located within the Vatican). -

Chiegboka and Kanayo Louis Nwadialor DOI: http://dx.doi.org/10.4314/ujah.v14i1.11 Abstract The Apostolic tribunals especially the tribune of the Roman Rota is charged with the unity of jurisprudence and the responsibility to oversee the proper administration of justice since the doctrine of judicial precedents do not exist within the canonical jurisprudence of the local Churches. As such the local Churches must look to the jurisprudence and praxis of the Roman Curia in supplying for an express prescription of law. In line with the above therefore, this paper has discussed the basic issues of the Roman Rota as it is endowed with the status of judicial precedents considered necessary to serve as a guide and orientation for the interpretation of law in the local Church tribunals. Introduction John Paul 11(1988) provided for the judicial competences of some tribunals of the dicasteries of the Roman Curia (e.g. Congregation for Doctrine of Faith on graviora delicta-art 53; Congregation for Divine Worship and Discipline of Sacraments, non-consummation-art 67 and nullity of ordination-art 68 etc.) differently from the de facto Apostolic Tribunals (i.e. The Apostolic Penitentiary-artt. 117-120; The Supreme Tribunal of the Apostolic Signatura-artt. 121-125 and The Tribunal of the Roman Rota-artt. 126-130). Robinson 1 The crusades were a Christian enterprise. They were proclaimed in the name of God for the service of the church. Religion was the thread which bound crusaders together and united them in a single holy cause. When crusaders set out for a holy war they took a vow not to their feudal lord or king, but to God. The Fourth Crusade was no different. Proclaimed by Pope Innocent III in 1201, it was intended to recover Christian control of the Levant after the failure of past endeavors. Crusading vows were exchanged for indulgences absolving all sins on behalf of the church. Christianity tied crusaders to the cause. That thread gradually came unwound as Innocent’s crusade progressed, however. Pope Innocent III preached the Fourth Crusade as another attempt to secure Christian control of the Holy Land after the failures of previous crusades.
