PROCEEDINGS OF 208th MEETING OF THE ERC-NCTE HELD ON 17th – 18th March, 2016

The 208th Meeting of the Eastern Regional Committee (ERC), National Council for Teacher Education (NCTE) was convened on 17th – 18th March, 2016 at Conference Hall, ERC, NCTE, 15, Neelakantha Nagar, Nayapalli, Bhubaneswar. The Chairperson, Members and Convener as listed below were present at the time of the 208th ERC Meeting.

At the outset, the Regional Director welcomed all the members of Committee and apprised them about the provisions of the NCTE Act, Rules, Regulations and Guidelines issued from time to time. With the permission of Chairperson, Shri Mukesh Kumar (Convener) presented the Agenda before the Committee for its due consideration and appropriate decision.

The committee unanimously decided that the institution may reply in response to the decision of the committee uploaded on the ERC website without waiting formal letters from the office of ERC. The replies so received will also be considered by the committee. 2. The Endowment Fund / Reserve Fund (5 Lakhs + 7 Lakhs) is 12 Lakhs per programme. (See ERC website: www.ercncte.org for detail). 3. The institution need to submit list of 10 schools for internship and school based activities duly approved by District Education Officer. 4. Institutions must give the affidavit for consent / willingness for number of units either one or two if it was not submitted earlier. 5. The institution shall comply with the additional facilities required (additional built-up area, additional staff, additional funds etc) for the SECOND UNIT as prescribed in NCTE (Recognition Norms and Procedure) Regulations 2014 before 31.10.2015. 6. As per provisions u/s 17(4) of the NCTE Act, 1993, if an institution offers any course or training in Teacher Education without obtaining recognition or permission under this Act, the qualification in teacher education obtained pursuant to such course or training or after undertaking a course or training in such institution, shall not be treated as a valid qualification for purposes of employment under the Central Government, any State Government or University, or in any school, college or other educational body aided by the Central Government or any State Government. 7. The Committee suggested to prepare Data Bank for the teachers. 8. The institution needs to install Fire Safety equipment and submit the Fire Safety Certificate if not submitted earlier.

1. Show cause notice was issued on 22.02.2016 on the following grounds. (i) The institution submitted two land documents which are in the name of individual. (ii) Buiding plan is not approved by any Govt Engineer.

2. In response to Show Cause Notice, the institution submitted its reply dated 22.02.2016 on the basis of uploaded minutes in ERC website which is not satisfactory. The institution is still difficient on the following grounds: (i) The land documents are registered in the name of individual which is not permissible as per NCTE Reguation 2014.

In view the above, the committee decided as under: The committee is of the opinion that application bearing code No. ERCAPP2316 of the institution regarding recognition for D.El.Ed is refused under section 14(3)(b) of NCTE Act 1993.

1. Show cause notice was issued on 09.02.2016 on the following grounds. (i) The land documents (Registered land deed) is in the name of S.K. Golam Ehiya i.e. in the name of individual which is not acceptable as per NCTE Regulation 2014.

2. In response to Show Cause Notice, the institution submitted its reply dated 11.02.2016 on the basis of uploaded minutes in ERC website which is not satisfactory.

In view the above, the committee decided as under: The committee is of the opinion that application bearing code No. ERCAPP3237 of the institution regarding recognition for B.Ed is refused under section 14(3)(b) of NCTE Act 1993. Indian Institute of Education, Plot No.2038, 2034, St. No.Naul Road, Vill/ P.O.-Naul, 17. 208.8.12 Tehsil/ Taluka-Shyampur, Town/ City- Howrah, Dist - Howrah, West Bengal - 711312. (D.El.Ed.) (PRIVATE) (West Bengal Board of Primary Education) (ERCAPP3235) After considering and examining the application along with the documents submitted by the institution, the agenda note, the NCTE Act, the NCTE Regulations 2014 including Norms and Standards, guidelines received from the NCTE Hqrs from time to time and reply from institution received in response to the show cause notice, the Committee discussed the matter in detail and observed as under:

1. Show cause notice was issued on 10.02.2016 on the following grounds. (i) The land documents (Registered land deed) is in the name of S.K. Golam Ehiya i.e. in the name of individual which is not acceptable as per NCTE Regulation 2014.

2. In response to Show Cause Notice, the institution submitted its reply dated 11.02.2016 on the basis of uploaded minutes in ERC website which is not satisfactory.

In view the above, the committee decided as under: The committee is of the opinion that application bearing code No. ERCAPP3235 of the institution regarding recognition for D.El.Ed is refused under section 14(3)(b) of NCTE Act 1993.

Institute for Teacher Education, Plot No- 428 & etc., Vill- Dhurabila, PO- Dhamkuria, 18. 208.8.13 Tehsil/Taluka/Town/City- Chandrakona Town, Dist - Midnapore, West Bengal - 721201 (B.Ed.-Addl. Intake) (PRIVATE) (Vidyasagar University) (ERCAPP2448) After considering and examining the application along with the documents submitted by the institution, the agenda note, the NCTE Act, the NCTE Regulations 2014 including Norms and Standards, guidelines received from the NCTE Hqrs from time to time and reply from institution received in response to the show cause notice, the Committee discussed the matter in detail and observed as under:

1. Show cause notice was issued on 23.02.2016 on the following grounds. (i) The Registrar of Vidyasagar University has submitted a written information vide letter dated 22.01.2016 that the University did not issue the NOC for 4 year B.A/B.Sc.B.Ed programme to Institute for Teacher Education (ERCAPP2460) and (ERCAPP2467) and lodged FIR against the institutions for providing forged NOC document to ERC, NCTE. (ii) Hence, the Committee decided to issue show cause notice to the institution for rejection/withdrawal of all applied teacher education programmes seeking grant of recognition/permission including all existing programmes recognised by NCTE.

2. In response to Show Cause Notice, the institution submitted its reply dated 27.02.2016 with a request to withdraw application bearing code No. ERCAPP2448 towards grant of recognition in B.Ed (Addl Intake).

In view the above, the committee decided as under: 1. The application bearing code No. ERCAPP2448 be closed.

2. The institution applied four applications simultaneously for additional intake/additional course in the existing institution namely “Institute for Teacher Education” run under the Gopsai Avinandan Santha. During the scrutiny of all the new applications, the ERC forwarded the NOC of B.A.B.Sc.B.Ed programme (ERCAPP2467) to the issuing authority i.e. Registrar of Vidyasagar University, West Bengal for verification of its authentication or genuineness. The Vidyasagar University vide letter dated 22.01.2016 reported that the NOC is forged and they have lodged a FIR against the management of the society. Consequently, upon receipt of SCN issued from ERC they have withdrawn all four applications. Such action on the part of the management of the society which is unbecoming of the authority those who are running existing Teacher Education programmes and logically it appears to the member of the ERC that the authenticity of the documents and infrastructure of the existing institution be verified upon physical inspection of the institution.

The NCTE Hqrs be requested to conduct the inspection of the existing institution namely Institute for Teacher Education (ERCAPP1361), Plot No- 428 & etc., Vill- Dhurabila, PO- Dhamkuria, Tehsil/Taluka/Town/City- Chandrakona Town, Dist - Midnapore, West Bengal - u/c 13 of the NCTE Act 1993.

Institute for Teacher Education, Plot No- 428 & etc., Vill- Dhurabila, PO- Dhamkuria, Tehsil/Taluka/Town/City- Chandrakona Town, Dist - Midnapore, West Bengal - 19. 208.8.14 721201 (4 yr B.A. B.Sc. B.Ed. Intergrated) (PRIVATE) (Vidyasagar University) (ERCAPP2467) After considering and examining the application along with the documents submitted by the institution, the agenda note, the NCTE Act, the NCTE Regulations 2014 including Norms and Standards, guidelines received from the NCTE Hqrs from time to time and reply from institution received in response to the show cause notice, the Committee discussed the matter in detail and observed as under:

2. In response to Show cause notice, the institution submitted a representation dated 16.06.2015 which was considered by ERC in its 191st Meeting held on 14-15 July 2015 and as decided by ERC, a letter to the institution was issued Vide No. 34152 dated 24.07.2015 on the following grounds :

(i) The institution is required to re-submit the faculty list recruiting following due procedure as per new Regulation 2014 and duly countersigned by the West Bengal Board of Primary Education.

3. But in 206th ERC Meeting held on 26-27 February 2016 inadvertently Formal Recognition u/c 7(16) of NCTE Regulation 2014 for applied D.El.Ed course with an intake of 50 (one unit) for the session 2016-17 was decided whereas reply of Show cause notice and re-submission of faculty list not yet been submitted by the institution till date. So, the decision of 206th ERC Meeting stands withdrawn.

In view the above, the committee decided as under: Last opportunity under section 14(3)(b) of the NCTE Act 1993 is given to the institution to submit its reply within 15 days, failing which the application will be rejected.
