I. Introduction

This report presents the results of the IR monitoring activity including the due diligence assessment of compliance of the contractor for Social Safeguards on completed pipe laying project and WTP improvements in the 7 provinces and municipalities of the Urban and Water Supply project. A field mission team (composed of Ms. Nysai Yeoun from Project Coordinator and Accountant of PIAC, Mr. May Simorn, National Environmental Specialist of PIAC and Ms. Monette Kojima- PKII Project Coordinator,) were deployed to conduct field visit and PIU meetings from last January 31- February 11, 2020, in the project towns, namely: Svay Rieng, Kampong Cham, Kampong Thom, Stoung, Stung Treng, Pursat, and Kampot.

Monitoring/Due Diligence Activities The social safeguard monitoring ensures that the affected pavements,driveways, and others are restored to their original condition after construction activities.

Grievance Redress Mechanisms (GRM)

The GRM is also looked at whether it is established to address the issues and complaints of affected persons at a stated time during and after construction activities. Among the 7 towns, the GRM has been instituted and disclosed to the communities before construction actitivities to discuss the steps and procedures how they can lodge and resolve their complaints and issues during and after construction. The affected persons can lodge their complaints to the PIU, which is actively monitoring the construction activities. Then the PIU directly relay the complaints to the Contractor representative on site for their appropriate action.

Consultation and Participation

Project consultation and participation is also assessed to ensure that that the communities are informed about the project’s commencement and discuss about the safety concerns during construction. This includes the participation of women in these activities to know their concerns and issues and how this can be addressed.

II. Project Background

The Government of Cambodia availed a loan from the Asian Development Bank (ADB) to fund the Urban Water Supply Project (UWSP). This was approved on 11 December 2014 and became effective on 16 June 2015. The project was estimated to cost $37.4 million. ADB provided a loan of $34.0 million from ADB’s concessional ordinary capital resources and the remaining $3.4 million was to be financed by the government. The executing agency is the Ministry of Industrial Handicraft (MIH) and the implementing agency is the Project Management Unit (PMU) under the General Department of Potable Water Supply. The loan closing date is scheduled for 30 June 2020.

The project’s impact will be expanded access to sustainable and safe water supply services for the urban population in Cambodia. This will contribute to the government’s 2025 target of 100% coverage for urban areas. Its outcome will be improved water supply infrastructure and service provision in nine towns. The project consists of four main outputs, namely:

• Output 1: Improvement of water supply systems in seven towns. • Output 2: New water supply system for Stung Treng • Output 3: Expansion of water supply coverage in • Output 4: Project implementation support.

III. Sub-projects’ Status

Based on the needs of the communities, the PIU/PWWs in each province/towns approved loan and status include the following:

Svay Rieng

Rehabilitation of WTP filters 1 & 2, and supply of chlorination facilities and Chlorine house under VO#1 works. i. Completed construction of chlorine house at PS#3 and installation work of chlorine tanks, motors, and piping at existing WTP; ii. For final inspection of the work completed.

Kampong Cham

The supply of pump and controls have been delivered, inspected and accepted by PIU. The Contractor replaced and installed the pumps and currently on the operation and the testing is 92% complete.

Kampong Thom

Kampong Thom WTP - Sheet piles are installed to protect the existing structures due to limited clearance and setback: i. Completed the pump replacement and installation at the existing Pump Station. ii. The construction of 450 m3 clear water tank is completed including waterproofing inside the tank. Sheet piling using the sink down method was allowed and approved for small tanks as per method statement on a small tank 450m3 capacity. iii. Ongoing rebar and formworks installation completed the wall (2nd lift) including the mat foundation for the 1050 m3 ground tank.

Stoung

Construction of underground tank, water treatment plant, floating intake and new intake structure under VO#1. i. At Reservoir: Completed the concreting works up to the top slab of the ground tank, and rebar installation and formworks for the WTP are continuous; ii. At WTP, sedimentation/filter tank walls are completed and curing and necessary filter accessories are on preparation; iii. At River Intake Well: excavation work continuous; iv. Pump Station & Chemical Room: completed an underground pump station structure and continues finishing work for the chemical building;

Pursat

The Contractor has initially installed the pumps and motors, including the controls. The Contractor also rectified the standard wire cable casing from a pump, this includes pump documents.

Kampot

Construction of new intake well structure and new pump Control. i. Completed the intake tank well and top slab and final backfill works;

Stung Treng

The Design-Build contractor KIM MEX JV submitted a request for advance payment including the bank guarantees (Security and Performance) to the MIH-PMU in which payment is officially received on 24th Feb 2020. The contractor has submitted de-sign works for review and approval, was mobilized on 1st Feb 2020, and temporary and construction of perimeter fence is implemented. The current Progress is now at 1.50%.

The field Mission lasted for 11 days which covered 7 provinces/towns with sub-projects. The table below specified the conducted mission:

The improvement of the water supply systems in the backwashing towns is needed to augment the capacity and water quality to provide additional household connections and clean water supply in their service areas.

The objective of the PIAC monitoring and due diligence is to update the status of the implementation of the sub-projects and assess the compliance of the contractor to social safeguards and gender requirements under the contract agreement with the MIH.

There are no PIU monitoring conducted by the PIAC for the year 2019.

1.0 SVAY RIENG

1.1 Summary of Discussions, Observations, Findings, Issues, and Comments

The team was informed that construction activities including the (i) production improvement and (ii) pipe replacement have been completed. The WTP improvement includes (i) production improvement (chlorination chamber installation and improvement, (ii) iron and manganese removal plant improvement, (iii) water level adjustment chamber installation, (iv)laboratory equipment provision/installation. Meanwhile, the pipe replacements which were supposed to improve adequate water supply to household connections were done, except for one leakage on replacement pipe that is to be fixed by the contractor. Below (Table 1.1) specifies the status of the project improvements undertaken by the contractor.

1.2 Completed Civil Works

Based on the report of the PIU (Figures 1.2 to 1.7), the water improvement activities involved the completion of the following: a. Production Improvement

b. Replacement Pipes

Pipe Laying is already 100% complete, but there is one point where a leak has been observed that was supposed to be fixed by the contractor. PIU has informed the contractor about this issue since April 2019, but it has not been fixed yet.

1.3 Proposed Pipeline Extensions and others

The proposed pipeline extension includes the following:

a. Distribution pipelines: - Main pipeline HDPE 225mm: 2,100m. - Secondary pipeline HDPE 160mm: 8,400m. - Secondary pipeline HDPE 110mm: 26,300m. - Tertiary pipeline HDPE 63mm: 12,900m.

b. Water meter together with interconnection component: 1,651 sets

c. Concrete Water Treatment Plant with a capacity of 416m3 per hour, refer to Figure 1.7a The proposed extension lines cover 19 villages in 6 Sangkat of SvayRieng Municipality, Svay Rieng province with a total length of 49,700m (Table 1.2 and Figure 1.7 a). With this proposed expansion line, it is expected that around 1,651 households will be benefited, all of which need clean water. The proposed expansion lines are within SvayRieng Provincial Waterworks service coverage areas and can provide adequate water pressure (Figure 1) to supply clean water to consumers through the installed tertiary pipelines.

1.4. IR Compliance with Contract Agreement (Completed Civil Works)

a. Information Disclosure

For the completed civil works, the PIU indicated several steps were taken in disclosing the project information to villagers before the construction activities. This included the following:

Step 1: PIU officially informed the provincial administration about the project implementation and asked for their coordination with local authorities through issuing an official permission letter.

Step 2: PIU informed the municipal administration by providing the permission letter issued by the provincial administration.

Step 3: PIU informed Sangkat administration by providing the permission letter issued by the provincial administration.

Step 4: Sangkat administration instructed village chiefs to inform villagers living along the project alignments about the project activities and schedules 3 weeks before the construction started.

Also, the PIU was engaged in a public forum organized by the municipal administration every month and took care of disseminating ongoing project construction activities. However, according to the PIU, they were not able to document or have any record of these consultations. There were no reports and attendance lists but pictures were taken. The PIU, further, noted that in every public forum the participants were mostly women. The PIU also noted that elder women usually attended the consultations because they were left behind to take care of household affairs, while the younger people migrated or are working outside of the home.

The PIU also claimed the contractor coordinated with the relevant entities such as cable company, etc. while it worked with the local authorities and villagers. During construction, the PIU monitored the technical aspects/ status of the construction activities and coordinated with local villagers, particularly, if there are any issues and concerns about the project and on-going construction activities.

b. Physical Impacts

For the waterworks improvement, there was no affected private and public properties caused by the physical development activities because all the facilities and civil works were undertaken inside the premises of the PWW. However, minimal damage on the sidewalk, road pavement caused by pipe replacement is experienced. The contractor has restored the minimal damage caused by the construction activities. Based on the contract, the contractor is responsible for the repair or the restoration of the damaged facilities to their original condition. The PIU also pointed out that if the repair work was not properly done by the contractor, the villagers can file a complaint to the PIU and PIU forwards the complaint/s to the contractor. If the damage is minimal, the contractor asks the PIU to repair it on their behalf and paid the cost of repair work.

There were five (5) complaints lodged by the villagers during the civil works which were relatively minimal have been resolved already by the PIU. The PIU emphasized they were trying as much as possible to avoid any possible damage on both private and public properties.

c. Proposed Pipeline Extensions

The PIU informed that the proposed pipeline extensions are mostly located outside the central areas of the municipality and of the province; therefore, minimal damage on public and private properties is expected, but which can be restored. The length is about 49,700m which will supply an estimated number of 1,650 households.

1.5 Social Safeguard and Gender Requirement Compliance

The PIU received the project contract and implementation schedule at a later time after the project activities have started. Moreover, the contract was in the English language. The PIU claimed it did not understand the Contract well because it is written in English. Hence, it faced difficulty in monitoring the contractor’s performance because of the delayed access to the contract and language difficulty. The PIU monitored the status of the construction and technical aspects of the project. The contractor provided the daily progress reports and specifications to the PIU. Particularly,

- The PIU encouraged the contractor to recruit more women to work in the project. To this end, the contractor recruited some women to work on unskilled/light works. These women mostly came with family, husband, and children.

- No child labor was employed by the contractor.

- The contractor paid equally men and women doing the same task (workers, both sexes, were paid based on the result they produce). It is important to note that there could not estimate the number of workers (women and men) hired by the contractor, their wages, and their profile.

- The contractor rented a flat/unit with a proper room, toilet, and clean water for their workers.

- The PIU attended training on “Project Construction Supervision and Management” conducted in Siem Reap in May 2019.

- The PIU informally and verbally reminded the contractor to pay attention to the safety and health of workers; however, they did not have any record on this.

- The PIU did not have the information on whether or not the contractor provided an orientation or information on HIV/ AIDS and other health issues to their workers.

1.6 Walk-through of completed civil works and proposed pipeline extensions a. Completed Civil Works

No Contractor representative was around during the field visit. Hence, the PIA Mission team relied on the answers of the PIU.

The pipe-laying activities were completed, according to the PIU. However, there is a place where leaking has not been fixed yet. The PIU also noted there might have been a miscalculation of the length of the pipe causing pipe-laying work short of the proposed line network.

When asked whether the restored pavement and backfilling in the unpaved sites were acceptable to standards, the PIU answered in the affirmative. No serious issues were raised by the affected people during the pipe laying activities. b. Proposed Pipeline Extension

The proposed extension lines are located within the residential, commercial, institutional, and the PWWs’ service coverage areas. Some institutions include school, university, and pagoda. There are no historical sites along the project routes.

The proposed expansion lines will directly connect to the existing pipelines, which will be laid parallel with existing culverts and electrical poles (location to be determined by the Provincial Department of Public Works and Transport (DPWT), of SvayRieng Municipality, Svay Rieng province.

No adverse impact is expected with the construction of the ROW of the extension pipelines. Only minimal damage to pavements and other concrete roads will be experienced. Damages will be restored by the contractor. There will also be no impact on houses during pipelaying activities and only minimal damage to driveways as there is a wide space between the roadside and property lines. (Figure 1.8)

It is noted that people living along the proposed expansion lines settle their shelters along the access roads and their current water source of domestic consumption is boreholes, with rainwater harvested during the rainy season.

According to the PIU, the people expressed their eagerness and their need for clean water supply for domestic purposes.

1.7 PIU Assessment of the completed work/Contractor’s compliance of the Agreement a. Pipe laying / Production improvement works

1. The Contractor was slow, their responsibility toward workers’ health and safety was low, and their response to any request for correction made by PIU was also slow.

2. According to the PIU, the newly improved WTP has not improved the quality of water. The quality of water is still the same as before construction. The contractor did their job but the current design and equipment did not improve the quality of water. b. Laboratory

With the current WTP, the laboratory could not be operated because chlorination could not be added as standard stated.

PIU pointed out that some of the installed pipelines could not be operated because (i) there was one point where a leak has been observed which has not been fixed by the contractor yet, despite the request for repair since April 2019, and (2) pipe laying works did not reach the proposed destination/location. d. Proposed pipeline extension

The PIU stressed that they will further enforce the contractor’s performance on technical and social aspects, particularly on gender issue (e.g. hiring of women workers in the unskilled work, payment of equal wages, etc.)

According to the PIU, the project currently improved water supply in SvayRieng municipality in terms of the expanded network. It hopes further improvement when an observed leak is fixed by the contractor. However, the water quality has not improved.

The PIU noted that they are satisfied with the network expansion improvement, but was partially satisfied with the water quality improvement.

2. Kampong Cham PIU

The status of the kampong Cham sub-projects is described below: a. Completed Civil Works

1. Production Improvement

Install 2 intake pumps and pump turbines: completed 100%; waiting for testing.

2. Replacement of Pipe

Pipe replacement: completed 100%. b. Proposed Pipeline Extensions

The proposed extension lines cover 10 villages in 4 communes/ Sangkat of 2 districts/ Municipality of with a total length of 30,000m (Table 2.1). Kampong Cham Provincial Waterworks also requested for 800 water meters. With this proposed expansion line, it is expected that around 2,168 households will be benefited from this expansion, all of which need clean water. The proposed expansion lines are within Kampong Cham Provincial Water-works service coverage areas and have adequate water (Figure 2.1 and Figure 2.2 )for distribution to final consumers through the tertiary pipelines.

2.1 Project Information Disclosure

a. Completed Civil Works

One week before the construction started, Kampong Cham PIU informed the village chiefs about the project activities and asked them to convey project information on the commencement of construction activities to target villagers. Most of the household members who received the project information were women because they stayed at home to take care of the housework.

In addition, the PIU participated in a public forum organized by municipal and district administration once a month and informed participants about the project activities; however, PIU did not have any record on this (no report and no attendance list). PIU noted in every public forum there were more women than men attending and participating.

PIU also added that local authorities in target areas were always informed about the project activities because they were annually integrated into Commune/Sangkat Development Plan (CDP) and Commune/Sangkat Investment Plan (CIP).

A PIU officer further discussed with the PIA team they did public dissemination to the village residents about their services. Figure 2.3

The Contractor coordinated with relevant entities such as the cable company, etc. and the PIU worked with local authorities and villagers. Further, the PIU focused mainly on the technical aspects implemented by the contractor and worked with local villagers on any concerns and issues on the project activities and the GRM process, particularly, who to contact and how the issues will be reported to the PIU.

b. Proposed Pipeline Extensions

The PIU noted that the information disclosure method implemented during previous civil works was time effective and expected to also do it in the proposed pipeline extensions.

2.2 Involuntary Resettlement

a. Completed Civil Works

There were no affected private and public properties caused by the intake pumps and their turbine installation activities because the works were undertaken on the premises of PWW. However, there was minimal damage on the sidewalk, concrete pavement and roadside caused by pipe replacement, but were repaired and restored into their original condition.

During project disclosure and through the GRM, the PIU pointed out to the village residents can lodge verbally their complaints and issues to the contractor and the PIU if they have concerns during construction, and if repair and restoration works were not properly undertaken by the contractor.

No complaints were made by villagers during civil works because they fully support the project activities.

Further, PIU emphasized that they were trying as much as possible to avoid any possible damageto both private and public properties.

b. Proposed Pipeline Extensions

The PIU informed that the proposed pipeline extensions are mostly located outside the central areas; therefore, no adverse impact will be experienced and minimal damage on public and private properties is expected. Temporary damage to properties will be restored to their original condition by the contractor after pipe laying.

2.3 Social Safeguard and Gender Requirement Compliance

The PIU received the project contract and implementation schedule after the project activities have already commenced. Moreover, the contract was in the English language. The PIU faced some difficulty in monitoring the contractor's performance because of the late arrival of the contract and the contract was not translated to Khmer. The PIU monitored the technical aspects. The contractor provided the final report and specification to the PIU.

The PIU encouraged the contractor to recruit more women to work in the project. The contractor recruited some women to work on unskilled/light works. For those living nearby, the women mostly came as a family (with husband and children). The children were not hired nor child labor was employed by the contractor.

The PIU also informed that the contractor paid equally the men and women doing the same task (workers, both sexes, were paid based on the result they produce, as well). The PIU informed the team that the contractor rented a flat/unit with a proper room, toilet, and clean water for their workers. It is important to note that the PIU could not estimate the number of workers (women and men) hired by the contractor, their wages, and their profile because they worked for only 1 or 2 days and then left, according to the PIU.

The PIU attended the training on “Project Construction Supervision and Management” conducted in Siem Reap in May 2019.

The PIU informally and verbally reminded the contractor to pay attention to the safety and health of workers; however, they did not have any record on this. Also, the PIU did not have information on whether or not the contractor provided an orientation or information on HIV/ AIDS and other health issues to their workers.

2.4 Walk-through of completed civil works and proposed pipeline extensions

A walk -through was conducted by the mission team with the PIU to see the condition of the completed works and actual location of the proposed pipeline extension.

a. Completed Civil Works

The Contractor representative was not around during the field visit. Hence, the PIA team was with the PIU representatives during the walk-through.

Pipe laying and intake pump installation activities were completed (intake pumps are waiting for testing).

Asked whether the restored pavement and backfilling in the unpaved sites were acceptable to standards, the PIU noted positively. No serious issues were raised by the affected people during the pipe laying activities.

b. Proposed Pipeline Extensions

The proposed expansion line is located within the residential areas and the Provincial Waterworks’ service coverage areas. It will directly connect to the existing pipelines, to be laid in parallel with existing culverts and electrical poles within the ROW to be determined by the Provincial Department of Public Works and Transport (DPWT), of two Districts / Municipality of Kampong Cham province (Figure 2.6).

It is noted that people living along the proposed expansion lines get their current water source for domestic consumption from existing boreholes and private mobile water suppliers, including harvested rainwater during the rainy season. The PIU expressed the people shared their need for clean water supply to reduce their exposure to water-borne diseases, and the convenience of directly connected to the pipe system.

2.5 Overall Comments of PIU/Communities

1. The PIU expressed the project has improved the water supply in Kampong Cham PWW.

2. The PIU suggested top management to provide all requested components to ensure the effectiveness of the project.

3. As to timing, the PIU indicated that delayed response to the PIU request would leave the PIU with no better choice but to install whatever is available within their capacity to fulfill the urgent needs of village residents. With the delay, once the requested items are delivered, the PIU needs to make a new request to transfer the requested items into a new location. That is time-consuming, according to the PIU.

4. As to the technical aspect, the PIU would like the consultant (PIA) to be more precise on product specification (in writing) to prevent the contractor from supplying a low-quality product.

5. The PIU also added that they are a technical entity so they do not have sufficient skill on the social aspects to monitor/enforce the contractor compliance. Therefore, having help from the PIA on this aspect will increase the effectiveness of the monitoring process.

6. The PIU illustrated that women are the ones who benefit the most from the project because they take care of the housework and enjoy the convenience of the piped system.

7. The PIU additionally suggested that the contractor (1) should repair/restore damaged properties as quickly as possible to avoid complaints, (2) should listen to the PIU on the construction process, (3) should have administrative officer helping to write report for the PIU on- site,(4) should have a decision-maker on site, and (5) should provide documents to the PIU in the as much as possible.

8. The PMU mentioned that the project helped improve the water supply.

9. The PIU is satisfied with the improvement and requested PIAC to visit the PIU’s more frequently.

10. The PIU was happy with the project because it hired a Cambodian contractor who was easy to communicate and work with.

11. Interview with households:

Interview with Mr. Ros Tai Sun and Mrs. Yen Sopheafrom BoengKokTiPirvillage, BoengKok Sangkat, Kampong Cham Municipality, Kampong Cham Province.

They are happy with the clean water supplied by Kampong Cham PWW because the quality and the price are acceptable, in addition to the convenience they are now enjoying. Mr. Sun further noted his wife takes care of all of the housework and used to fetch water. The project construction activities caused a very minimal disturbance and damage to his family’s property, all of which were restored to their original condition.

12. Interview with Mr. Sreng Seng Yeourn, 55 years old, from Romul village, Ro'ang Commune, Kampong Siem District, Kampong Cham Province.

He is currently using water which is pumped from a well (30m depth) and the water needs to go through portable filtration equipment before it can be drunk. He is excited to hear that there will be a clean water supply for his village. He expects to connect to the water system for his family while the water from the well will be used to watering his crops. He also shared that people living in his village who do not have wells purchased water from the ones who have well with a price of 2,500 Riel (0.625 USD)/m3. Also, they also use harvested rainwater during the rainy season. Compared to the price structure of the water supplied by Kampong Cham PWW, the current water price is more expensive. Below is the Kampong Cham PWW water price per cubic meter:

a. 0 – 6m3: 900 Riel (0.225 USD)/m3. b. 6 – 12m3: 1,200 Riel (0.300 USD)/m3. c. >12m3: 1,500 Riel (0.375 USD)/m3.

3.0 Kampong Thom PIU

The improvement of the Kampong Tom Waterworks covers the construction of the clean water reservoir under Output 1. One structure was already completed and the second one is being constructed. The pipe-laying work was completed in May 2019. On this subproject, two additional components have been proposed, including the Concrete Slope Protection Works and the Expansion of Distribution Network.

The table below summarizes the status of the subproject activities in Kampong Thom.

3.1 On-going Construction Activities a. Construction of the Clean Water Reservoir

The PIU is satisfied with on-going sub-project activities. There is no significant impact on the community as it is located within the compound of the PWW. Hence, no project information and consultation was undertaken by the PIU under this sub-project. There was no complaint lodged by the village residents about the project. Pictures shown as Figure 3.3. b. Contractor’s compliance with the Contract Agreement for the construction of the Clean Water Reservoir

In terms of compliance with the contract agreement, particularly, the reporting system, the PIU claimed the Contractor does not disclose its current staff to the PIU. The contractor does not provide a daily or a weekly and monthly written report to the PIU.

In terms of the safety and health concerns of the workers, the contractor only provided limited space where the workers can rest and do cleaning and sanitation requirements. The Contractor just built a tent and hammocks for the workers to rest. Only one restroom is used by the workers, which is not compliant, in case women are working at the construction site. A separate restroom is required for the women workers.

The PIU monitors the progress of the construction activities and is happy with the implementation of the sub-project as they will soon provide adequate and clean water to its clients.

The PIU together with other PIUs in other provinces receiving a loan from the ADB attended an Orientation on Environmental, Social Safeguards and Gender Policies conducted by PIAC in Siem Reap in August 2018.

3.2 Proposed New Sub-Projects

Two sub-projects are being proposed by the Kampong Thom PWW which includes the (i) River Banks Protection project and the (ii) New Pipeline Extension a. River Banks Protection No significant impact is seen in terms of the potential loss of private and public assets and structures as the site is near the WTP and compound of the PWW. Except for minimal erosion during construction which can be minimized/mitigated through environmental mitigation measures, no other impact is seen outside the area. b. New Pipeline Extension

For additional household connections, the expansion network is being proposed by the PWW to PMU for approval. The proposed new expansion network does not pose a significant impact on the communities or potential loss of assets and structures as there is a wide ROW for the pipeline network. Temporary damage to facilities and pavements will be restored by the contractor after the pipelaying activities. Figure 3.3. c. Project Information Disclosure/Grievance Mechanism

The Kampong PIU declared no project information disclosure and consultations have been conducted yet as they are still waiting for the project approval from the PMU. They plan to inform the commune about the project and when the project construction will start. The grievance mechanism will also be discussed with the commune prior to the construction activities. Prior to construction, the PIU wants to talk to the site engineer of the contractor about project construction details and other contract agreements on social and gender requirements.

4.0 STOUNG

The improvement of the Stoung Water Works is one of the sub-projects which include the construction of the water treatment plant, pumping station, floating intake and new intake structure. The pipelaying work was completed in May 2019. The proposed additional component includes the expansion of the distribution network and the construction of a new office building to replace the old building. The proposed extension lines cover 27 villages in

53 ADB Loan No.3232 CAM - COL - Cambodia Urban Water Supply Project the five communes /Sangkat of . It is expected that 1,626 households will benefit from this proposed expansion line.

The field mission team met with the Stoung PIU on Feb. 4, 2020, in the morning and discussed the following status:

The PIU further noted the observance/ compliance of the Contract Agreement as follows:

4.1 On-going and Completed Projects a. Project Information Disclosure

As part of the provisions of the contract agreement, the contractor and the PIU informed the village about the commencement of the construction activities. This was undertaken with the Department of Rural Development. A Letter was sent to the commune district head regarding the schedule of construction activities, location and safety measures for the community. This message was disseminated to the village residents by the commune head. b. Workers Safety/Work Rest Area

The contractor rented a house for sleeping quarters and rest areas of the workers during day time. Separate restrooms for men and women workers are provided by the contractor. c. Worker’s hiring and compensation

There were 28 workers in the beginning. The hired female workers undertake unskilled work such as cooking and cleaning of the construction premises.

Photos of on-going projects are shown below as Figures 4.2 to 4.3.

The PIU noted an 8 working hour, from 7-11 am and 1-5 pm. Overtime is after 5.30 pm and the rate is 1.5% on top of one’s daily rate. (Table 4.2)

All TCO staff have IDs, but the workers do not have, according to the PIU. The contractor did not provide any training to the workers.

4.2 Stoung PIU’s Comments

1. There has been no major impact on the project site. The damaged pavements were restored to their original condition. There were no complaints from the residents about the project and during construction, except for the noise. If the residents could not wait for the restoration of damaged pavement, the contractor provides cement and sand to the residents to restore the damaged pavement, according to the PIU.

2. The PIU does not have a copy of the contract and work schedule of the contractor.

3. The PIU monitors the progress of the civil works by looking at the drawing plan. It does not have a record of the workers hired by the contractor.

4. The PIU expressed they want the project done before the Khmer New Year.

5.0 Stung Treng

The Stung Treng Water Works has the following sub-components: (i)Raw Water Intake, (ii)Transmission Main (from Intake to water treatment Plant),(iii) water treatment plant, and (iv) other facilities, (v) distribution Mains (treated water pipelines), and (vi) customer service connections. An estimated 5,000 household connections are expected to benefit from the system.

There are no on-going activities or any type of preparatory activity yet. The team was accompanied by the PIU for a walk-through to see the location of the proposed water system facilities.

5.1 Summary of Meeting Results, Walk-through, Issues and Concerns a. Public Consultations

Community consultations were undertaken in 2017, three years ago. As of now, there are no planned schedules yet and the PIU noted they will plan the activity as soon as the schedule of construction is firmed up. They do not want the people to expect too soon because the project has been delayed already. Figure 5.3 b. PIU Learning Visit

As part of their preparation, PIU visited Siem Reap’s SWRSA to learn how they could implement the project more effectively. c. PIUs involvement in the project

The PIU expressed its plan to get into more active monitoring at the construction site by assigning one staff to oversee the civil works activity.

Further, the PIU plans to use the land near the construction site as the temporary shelter of the contractor's workers and staff.

5.2 Walk-Through at the proposed Intake and WTP site

Both the location sites of the Intake and the WTP have been cleared and also cleared of the UXO. The sites are far from the communities and no significant impact is expected during the construction activities. The Intake site is 31mx 31m and the new

intake is 2kms away from the proposed WTP. Picture shown in Figure 5.4

6.2 Compliance to Social Safeguards and Gender Requirements based on Contract Agreement a. Project Information Disclosure

Before the construction activities, project information/ consultation was undertaken to discuss the schedule of construction activities, the location of the construction activities and potential impact on the residents' assets and properties. Residents are informed that impact is minimal and that no assets and properties are adversely damaged. Restoration of damaged properties into its original condition is also discussed with the covered communities including the GRM process, in addressing complaints and issues during construction.

The training of the workers on HIV/AIDS was not undertaken by the contractor, even information booklets were not provided, according to the PIU. c. Worker’s Hiring and Remuneration/Wages

Hired workers were from nearby communities. Women workers who were hired did unskilled work such as digging and cooking for the contractor's staff. The female worker is paid according to actual work undertaken. The PIU claimed they did not have information on how much the female and male workers were paid by the contractors. d. Child labor

No child labor is hired by the contractor. e. Capacity Enhancement

Some PIU key management officers attended the training orientation on ADB Policy on Environment, Social Safeguards and Gender conducted by the PIAC consultant in August 2018. f. Restoration of damaged pavements and pathways

Restoration of the damaged pavements is undertaken immediately after construction. The PIU shared an experience where a restored pavement has been ruined so they requested the contractor to repair the damage to the pavement.

7.0 Kampot

7.1 Sub-project Status

The sub-project in Kampot includes the New Water Chamber Well (78 m3). As to its status, the panel switch and the Chamber Intake is already finished (100%).

7.2 Proposed new sub-projects:

The PIU informed the team it has proposed the following for PMU and ADB approval:

1. Water treatment Plant (14,000 m 3/ day) 2. Raw Water Pumping station 15, 400 m3 /day 3. Raw Water Pipeline (5.5km) 4. Replacing raw water pump 3 units (2 with different capacity and one standby)

7.3 Compliance to Contract Agreement of Social Safeguard and Gender: Completed sub-project a. Project Information Disclosure

The PIU issued a letter to the concerned departments, commune, and village to inform the project’s schedule of construction activities. Particularly, the project information was also provided to the Department of Public Works and Transportation and sent a letter to the Department of Environment in the province because the contractor cut down a huge tree at the site. b. Hiring of Workers

The hired group of workers, sub-contractor came from the other province and no local workers were hired.

No other information was shared by the PIU as the contractor did not give them any progress report. c. Overall Comments

1. According to the PIU, the construction took almost one year when the contract should have been only for three to four months.

2. The PIU was not given a copy of the contract agreement, including the work schedule and work specification to actively monitor the contractor’s activity and progress. It did not know when the construction activities were ending.

3. The PIU, however, is satisfied with the new intake pump despite the completion delay as they now have adequate water.

9.0 Grievance Redress and Procedures

The GRM procedure is established in every PIU sub-project to ensure that affected persons ( in terms of lodging and timely resolution of their issues and concerns during and after construction activities). The steps include the filing of their concerns and issues to the PIU and the PIU checks and relays to the Contractor for the immediate action of the complaints and issues on hand.

10.0 Consultation and Participation

The consultation activities with communities and affected residents are undertaken a week before the commencement of the construction activities. These activities were undertaken by the PIUs to announce the upcoming activities and the safety measures to be undertaken during the construction. The GRM procedures is also discussed with the affected residents

90 ADB Loan No.3232 CAM - COL - Cambodia Urban Water Supply Project how they can bring out to proper authorities, to PIUs, their complaints and issues and steps that are to be undertaken.

Consultations have been undertaken with communities but no proper documentation was made by the PIUs( Attendance List segregated by sex, proceedings, and photo documentation). The participation was described qualitatively as “ more elderly women attended the consultation” but no numbers were available as to the number of women and men in the consultation activities.

11.0 Recommendation/Immediate Action

This section provides the overall recommendation of the PIUs based on their experience in implementing their Sub-projects: a. The PIU should be provided a copy of the contract between MIH and the contractor, construction schedule, and detailed design before the construction activities. b. The PIU should be given a translated version (Khmer version) of the contract between MIH and the contractor so that they know what, where, and how to monitor the contractor’s compliance with the contract agreement and provide feedback as necessary during construction. c. The PIU should be given an orientation on how to access assistance from health facilities on the information of HIV/AIDS and other related diseases and, d. The PMU should mobilize the National Resettlement/ Social Development and Gender Specialist to assist the PIU and the contractor in coordinating with local health officials to conduct the orientation on HIV/AIDS and other related diseases. e. The contractor should assign an administrative staff at the project site to document the contracted workers and the wages provided to women and men on the type of work undertaken.
