• Hartman v. Goldman, an adverse possession case of first impression before New York’s Appellate Division;

Mr. Bailey has successfully defended a number of leading title companies and lenders in the nation and prevailed in numer- ous trials and settlements involving commercial and residential building owners, tenants, real estate developers, real estate brokerages, insurance companies and cooperative and condominium boards. Barry Bassis is the Disaster Response Supervising Attorney at Legal Services NYC. In this position, he supervises attorneys in the offices in the five of New York City about insurance issues arising from Superstorm Sandy. He also provides a resource for other organizations helping struggling New Yorkers with their insurance issues arising from the storm. Sarah B. D’Alessandro is a Staff Attorney for the Foreclosure Prevention Project at the Legal Aid Society of Northeastern New York, Inc. Sarah’s clients are homeowners facing foreclosure and she provides counseling, advice and representation in foreclosure litigation throughout the . Sarah is a member of the HomeSave Coalition of the Capital Region, a collaborative community organization bringing legal services providers, housing counseling agencies and other advocacy groups together to further their devotion to foreclosure prevention. Sarah has a demonstrated commitment to public service and meeting the needs of the underserved. While attending Fordham University School of Law, Sarah worked at the Tax and Consumer Litigation Clinic and volunteered at the Manhattan Civil Legal Advice and Referral Office. Sarah received a B.S. from the R.H. Smith School of Business at the University of Maryland in College Park and a J.D. from the Fordham University School of Law. Steven D. Farer is President of Farer and Schwartz, PC. Biography

Mr. Greenstein is a real estate partner who specializes in cooperative and condominium law. He has developed a special expertise through his representation of cooperative and condominium boards throughout the metropolitan New York City area. Mr. Greenstein served as a member of the New York State Bar Association's liaison committee with the Department of Law (Attorney General's Office) on co- op and condo conversions and as a member of the New York State Bar Association, was one of the draftsmen of the widely used 1989 form contract of sale for cooperative apartments. Mr. Greenstein has successfully mediated disputes involving real estate, cooperatives and condominium law. Formerly, as an Assistant Attorney General of the State of New York, Mr. Herzbach served in the Real Estate Finance Bureau, the office responsible for the regulation of condominiums and cooperatives in the State of New York. One of the highlights of Mr. Herzbach's career in private practice is his preparation of the first condominium offering plan in the State of New York to be accepted by the Attorney General under that office's certification procedures. Chairman of the Homeowners Association Subcommittee of the New York State Bar Association's Real Property Law Section Committee on Condominiums and Cooperatives, Mr. Herzbach also serves on the Bar Association's Liaison Committee with the Attorney General of the State of New York and was appointed to the New York State Attorney General's Task Force to revise the Condominium Act of the State of New York. He is also a member of both the Law Committee of the Associated Builders of New York and Past President of the Board of Directors of the Long Island Chapter of CORENET, Corporate Real Estate Network. He was recently appointed to the board of director of the Long Island Real Estate Group (LIREG). Mr. Herzbach also sits on the Board of Directors of Friends of Nassau Seniors and the Nassau County Chapter of the American Cancer Society where he was recently honored at their annual golf outing as "Man of the Year". Mr. Herzbach earned his Juris Doctorate at Hofstra University Law School where he is now an Adjunct Professor of Law teaching a course in condominium and cooperative law. Bio

Kirsten E. Keefe is a Senior Attorney with the Consumer Finance and Housing Unit of Empire Justice Center and Director of its Anchor Partner program for the NYS Office of the Attorney General’s Homeownership Protection Program (HOPP), funded through the National Mortgage Settlement. In addition to managing statewide grants to non- profit organizations providing direct assistance to homeowners, Kirsten works on policy issues regarding mortgage lending, foreclosures and financial consumer issues. Kirsten has focused on subprime lending and foreclosure since 1998, having started in direct services at Community Legal Services, Inc. in Philadelphia, PA. In 2009, Kirsten was appointed to and served a three-year term on the Board of Governors of the Federal Reserve System’s Consumer Advisory Council. She is Co-Chair the Board of Directors for the National Association of Consumer Advocates, a steering committee member of New Yorkers for Responsible Lending (NYRL), and part of the HomeSave Coalition of the Capital Region. She also serves on lending committees of the Community Loan Fund of the Capital Region. Kirsten has taught consumer law at Temple University Beasley School of Law, and has lectured at Albany Law School and other local universities. Kirsten received a B.A. from the College of the Holy Cross and a J.D. from Beasley School of Law at Temple University. Prior to law school, Kirsten served as a U.S. Peace Corps volunteer in Thailand.

Mitchell Azar Korbey, Esq.| Herrick, Feinstein LLP

Mitch Korbey is a partner of the firm, and the chair of Herrick's Land Use and Environmental Group. He is an accomplished urban planner and land use attorney with more than 20 years of experience in private practice and government service.

Prior to joining Herrick, Mitch served for six years as commissioner of the New York City Board of Standards and Appeals under Mayor Rudolph Giuliani, and as director of the New York City Department of City Planning's Brooklyn office, where he guided Brooklyn's first mixed use zoning districts through the public review process and spearheaded plans for the rezoning and revitalization of a number of neighborhoods, including Williamsburg and Greenpoint. Prior to running the Brooklyn office, Mitch was deputy director of the Staten Island office and served in the City Planning Department's Housing and Economic Development Division.

Mitch leverages his experience in local government to provide real estate owners and developers with strategic legal counsel on land use and zoning issues. He advises clients in connection with site acquisitions and assemblages, site development options, zoning lot mergers and the transfer of development rights. He assists clients before the Board of Standards and Appeals and the Department of City Planning in connection with applications for zoning variances, special permits and discretionary approvals. He also assists clients with applications to the New York City Landmarks Preservation Commission and resolves zoning and code-related issues at the Department of Buildings.

Mitch is an Adjunct Professor in Hunter College Graduate School's Urban Affairs and Planning Department where he teaches Land Use Law and leads a seminar entitled "Lawyers and Planners in the Development Process." His insights on real estate development and the intricacies of local zoning laws have appeared in major real estate and business publications, including Crain's, The New York Times and The Real Deal.

He is also a co-author of Herrick's land use and environmental blog, ZONE, which keeps readers up-to- date on the latest issues in land use and environmental law.

Joel H. Sachs represents private entities and governmental agencies in a wide variety of environmental, real estate, land development and zoning matters. A significant portion of his practice is devoted to representing municipal boards, and private clients before municipal boards and agencies throughout the State of New York in land use, zoning and environmental disputes. He serves as Construction Arbitrator for the American Arbitration Association. Widely recognized as a leader in Environmental Law, Mr. Sachs has received a number of awards, which are listed below. Mr. Sachs has enjoyed the rare privilege of serving as Chair of two Sections of the New York State Bar Association, the Environmental Law Section and the Real Estate Law Section.

CATHERINE A. SHERIDAN

Catherine A. Sheridan is a partner in the law firm of SCALISE & HAMILTON, LLP, in Scarsdale, New York, and practices out of the firm’s Long Island office, located in Carle Place, New York. Her practice areas include representing attorneys in professional disciplinary matters before local grievance committees and state appellate courts; providing advice to attorneys on ethical issues; and drafting and arguing appeals, as well as related motions, before state appellate courts. She is a member of the New York State Bar Association, the Nassau County Bar Association, and the Nassau County Women’s Bar Association. Ms. Sheridan received her B.S. and J.D. from St. John’s University and was admitted to practice in January 1994. Since 1996 Ms. Sheridan has also been admitted to practice before the United States District Courts for the Southern and Eastern Districts of New York.

From 1993 to 1997 Ms. Sheridan was employed as a Court Attorney with the Appellate Division, Second Department, where she researched and wrote memoranda of law, as well as drafted and recommended decisions and orders of the court. During her tenure with the Appellate Division, Ms. Sheridan was promoted to the position of Senior Court Attorney and served as a Law Secretary to the Hon. Leo F. McGinity. In 1997, Ms. Sheridan joined the law firm of Rivkin, Radler & Kremer in Uniondale, New York, where she worked as an associate in the appellate practice and business litigation departments.

In February 1999, Ms. Sheridan left private practice and rejoined the Appellate Division, Second Department, as an assistant counsel to the Tenth District Grievance Committee, where she handled the investigation and prosecution of attorney disciplinary matters. In 2001, she was promoted to Deputy Chief Counsel, and in April 2005, she joined the Appellate Division, Second Department’s Office of Special Counsel for Grievance Matters, where she served in the position of Deputy Chief Counsel while continuing to work in the area of attorney ethics and discipline. Ms. Sheridan remained with the Appellate Division until January 2009 when she started her own practice. In November 2012, she became Of Counsel to Scalise & Hamilton, and in July 2013 Ms. Sheridan joined the firm as a partner.

Ms. Sheridan has lectured at CLE programs on the topic of ethics and professional responsibility for the State and local bar associations, the Appellate Division, Second Department, and St. John’s University School of Law.

Nicholas M. Ward-Willis Principal Member Professional Experience Nicholas Ward-Willis represents businesses, developers, individuals, property managers and public bodies in a variety of land use, real estate and environmental issues, ranging from commercial and real estate transactions to state and federal environmental litigation. Mr. Ward- Willis has extensive experience in negotiating orders on consent with state and federal agencies in a variety of matters, including hazardous waste sites and oil spill sites. In the course of representation of his clients, Mr. Ward-Willis interacts with consultants on oil spills, mold and hazardous waste remediations. He represents private clients before various land use boards and assists the firm's public and private sector clients in complying with the State Environmental Quality Review Act, the New York City Watershed Regulations and other environmental laws. In addition to processing land use applications on behalf of clients, Mr. Ward-Willis has prosecuted and argued Article 78 cases before trial and appellate courts. Benjamin Weinstock is a partner at Ruskin Moscou Faltischek, where he is co-chair of the firm’s Real Estate Department.
