Whereas by section 122 (2) of the Constitution of the Federation as modified by the Coiutitutlmt (Si^pension and M odification) Decree 1966 and the States (Creation and Transitional Provisions) Decree 1967 It IS provided that the Judges of the High Court of Lagos State shall consist of the Chief Justice of Lagps State and such number of other Judges (not being Iras than five) as may be prescribed by law; i

And WHEREAS by section 123 (1) of the Constitution of the Federation as modified by the Constitution (Smpension and M odification) Decree 1966 and the States (Creation and Transitional Provisions) Decree 1967 IS provided the Qhief Justice and other Judges of the High Court of Lagos State shall be appointed by the Supreme j^ilftary Council, acting after consultation with the Advisory Judicial Committee :

Now therefore, the Supr eme Military Council, acting after consultation with die Advisory Judicial Committee, do hereby appoint Abdul Raheem Bakarb as a Judge of the High Court of Laws State widi effect from 1st September 1969.

And whereas the Supreme M ilitary Council, after reviewing his case, is pleased to grant him a free pardon:

Now therefore, in exercise of the powers conferred by section 101 (1) of the Comtitution of the Federation^d all other powers enabling it in that behalf, the Supreme M ilitary Council do hereby grant the aforesaid Yaya Said a free pardon.

Whereas a Trade Dispute has arisen and now exists between the U.A.C. and Associated Companies African Workers’ Union and the Niger River Transport Limited, Burutu;

And whereas the endeavours to promote a settlement by negotiation have proved unsuccessful;

Now THEREFORE, THE COMMISSIONER FOR Laboui^ in exercisB of the powers conferred upon him by section 11 (2) of the Trade Disputes (Emergency Provisions) Decree No. 21 of 1968, hereby refer the matter in dispute to an Arbitration Tribunal and hereby appoint Mr S. A. Ajuyah, B.A., ll.b.. Solicitor and Advocate, of No. 2 Robert Road, W arri, to act as Sole Arbitrator to examine the claims of the U.A.C. and Associated Companies African Workers’ Union concerning the question relating to "The length of notice of retirement to employees retired on 31st December, 1968”, with the following as die terms of reference of the Tribunal:—

"To inquire into the trade dispute declared by the U.A.C. and Associated Companies African Workers’ Union against the Niger River Transport Limited, Burutu in accordance with section 4 of the Trade Disputes (Emergency Provisions) Decree 1968 as referred by the Federal Commissioner for Labour and to consider the circumstances under which the dispute has arisen and set out in as much detail as may be considered necessa^, the proper form and length of notice required to be givai by the employera to the employees in relation to the question of retirement of employees, to ascertain whether die purported notice of retirement given by the employers to the employees who were retired on‘31st December, 1968 is valid in law and in accordance witfi provisions of the Employees Hand Book of die Company, and to make such awards, having regard to the circumstances of the dispute and such other matters pertaining thereto or arising Aerefrom as the Arbitration Tribunal may deem necessary.”

And it is dfrected that the said Sole Arbitrator shall within 21 days of the date of his appointment or such longer period as the Commissioner may allow make his award, and fordiwith send a notification of the award to the Commissioner.
