Scopeof Application 1.1 ln connectionwith the Invitationfor Pre-qualificationindicated in Sectionll, Pre-qualifibationData Sheet (PDS), the Employer,as defined in the PDS, issues this Pre-qualificationDocument (POD)to applicantsinterested in biddingfor theworks described in SectionV, Scopeof Works.The nameof Project,number of contractsand the name and identificationof each contract, correspondingto this pre-qualification, areprovided in the PDS. 2. Sourceof Funds 2.1 Thesource of fundsis describedin PDS. 3. Fraudand Corruption 3.1 The Employerrequires that Applicants,Bidders, Suppliers, Contractors,and Consultantsunder these contracts, observe the higheststandard of ethicsduring the procurement and execution of suchcontracts. ln pursuitof thispolicy, the Employer: (a) Defines,for the purposesof this provision,the terms set forthbelow as follows: (i) "corrupt practice" means the offering, giving, receiving,or soliciting,directly or indirectly,of anythingof valueto influencethe actionof a public officialin the procurementprocess or in contract execution; (ii) "fraudulentpractice" means a mis-representationor omissionof factsin orderto influencea procurement processor the executionof a contract; (iii) "collusivepractice" means a schemeor anangement betweentwo or more bidders,with or without the knowledgeof the Employer,designed to establishbid pricesat artificial,noncompetitive levels; and (iv) "coercivepractice" means harming or threateningto harm,directly or indirectly,persons or their property to influencetheir participationin the procurement processor affectthe execution of a contract; (b) will rejecta proposalfor awardif it determinesthat the Bidderrecommended for award has, directly or throughan agent,engaged in corrupt,fraudulent, collusive or coercive practicesin competingfor the Contract in question; (c) willsanction a firmor individual,including declaring them ineligible,either indefinitely or fora statedperiod of time,to be awardeda contractif it at anytime determines that they have,directly or throughan agent,engaged, in corrupt, fraudulent,collusive or coercivepractices in competingfor, or in executing,a contract;and (d) willhave the rightto requirethat a provisionbe includedin PRE-QUALIFICATION FOR ELECTRO-MECHANICAL WORKS OF LOWARI TIINNEL PROJECT 4 Bidding Documentsand requiringbidders, suppliers, contractorsand consultantsto permit the Employerto inspecttheir accounts and recordsand otherdocuments relatingto the bid submissionand contractperformance and to have them auditedby auditorsappointed by the Employer. 4. EligibleApplicants 4.1 An Applicantshall be a private,public or governmentowned legal entity,subject to ITA4.6, or any combinationof themin the form of association(s)including Joint Venture (JV) with the formal intent,as evidencedby a letter of intent;to enter into an agreementor underan existingagreement. In the caseof a JV, unlessotherwise specified in the PDS,(i) all partiesshall be jointlyand severally liable, and (ii) there shall be no limiton the numberof partners. 4.2 The eligibilitycriteria listed in this Clause4 shallapply to the Applicant,including the partiesconstituting the Applicant,i.e., its proposedpartners, subcontractors or suppliersfor any part of theContract including related services. 4.3 An Applicantand all partiesconstituting the applicantshall have to registerwith PakistanEngineering Council (PEC) in Categoryas mentionedin PDSfor participatingin the bidding (if qualified). 4.4 Applicantsand all partiesconstituting the Applicantshall not havea conflictof interest.Applicants shall be consideredto havea conflictof interest,if theyparticipated as a consultantin the preparationof the designor technicalspecifications of the Worksthat are the subject of thisprequalification. Where a firm, or a firmfrom the sameeconomic or financialgroup, in addition to consulting,also has the capabilityto manufactureor supply goodsor to constructworks, that firm,or a firm from the same economicor financialgroup, cannot normally be a supplierof goodsor works,if it providedconsulting services for the contract correspondingto this prequalification,unless it can be demonstratedthat thereis not a significantdegree of common ownership,influence or control. 4.5 An Applicantshall submitonly one applicationin the same Prequalificationprocess, either individually as an Applicantor as a partnerof a joint venture.No Applicantcan be a subcontractor whilesubmitting an applicationindividually or as a partnerof a joint venture in the same Prequalificationprocess. A Subcontractorin any application may participate in morethan one application,but only in thatcapacity. An Applicantwho submits,or participatesin, more than one applicationwill cause all the applicationsin which the Applicanthas participatedto be disqualified. 4.6 Applicantsshall not be under executionof a Bid-securing Declaration. 4.7 Applicantsand all partiesconstituting the Applicantshall provide such evidenceof their continuedeligibility satisfactory to the Employer,as the Employershall reasonablyrequest including legaland financialautonomy and compliancewith Commercial

4.8 ln case of JVs, one of the partnerswho is responsiblefor performinga key functionin contractmanagement or is executinga majorcomponent of the proposedcontract shall be nominatedas beingin chargeduring the pre-qualificationand biddingperiods and in the eventof a successfulbid, during contractexecution. The partnerin chargeshall be authorizedto incurliabilities and receiveinstructions for and on beharfof any and all partnersof the jointventure; this authorizationshall be evidencedby submittinga powerof attorneysigned by legally authorizedsignatories of allthe partners.
B. Contentsof the PrequalificationDocument
5. Sectionsof 5.1 Thedocument for the prequalification of Applicants (hereinafter - Prequalification "PrequalificationDocument") consists of parts 1 and 2 which Document compriseall the sections indicated below, and should be readin conjunctionwith any Addendum issued in accordancewith ITA 7. PART1 - PrequalificationProcedures o Sectionl. Instructionsto Applicants (lTA) o Sectionll. PrequalificationData Sheet (pDS) . Sectionlll. QualificationCriteria and Requirements o SectionlV. ApplicationForms
PART2 WorksRequirements o SectionV. Scopeof Works 5.2 The "lnvitationfor PrequalificationApplications" issued by the Employeris notpart of the prequalificationdocument. 5.3 The Employeraccepts no responsibilityfor the completenessof the prequalificationdocument and its addenda unless they were obtaineddirectly from the Employer. 5.4 The Applicantis expectedto examineall instructions,forms, and terms in the PrequalificationDocument and to furnishall informationor documentationrequired by the prequalification Document.
PRE.QUALIFICATIONFOR ELECTRO.MECHANICALWORKS OF LOWARI TUNNEL PROJECT 6 6. Glarificationof 6.1 A prospectiveApplicant requiring any clarificationof the Prequalification PrequalificationDocument shall contact the Employerin writing Document at the Employer'saddress indicated in the PDS.The Employer willrespond in writingto anyrequest for clarificationprovided that such requestis receivedno laterthan five (05) days priorto the deadlinefor submissionof applications.The Employershall forward copies of its responseto all applicantswho have acquired the prequalificationdocument directly from the Employerincluding a descriptionof the inquirybut without identifyingits source.Should the Employerdeem it necessaryto amendthe prequalification document as a resultof a clarification,it shall do so followingthe procedureunder ITA 7 and in accordancewith the provisionsof ITA16.2.
7. Amendment of 7.1 At anytime prior to the deadlinefor submissionof applications, Prequalification the Employermay amendthe PrequalificationDocument by Document issuingaddenda.
7.2 Any addendumissued shall be part of the Prequalification Documentand shall be uploadedon NHAwebsite and shallbe communicatedin writing to all who have obtainedthe prequalificationdocument from the Employer.
G. Preparationof Applications 8. Cost of Applications 8.1 TheApplicant shall bear all costsassociated with the preparation andsubmission of its application.The Employerwill in no case beresponsible or liablefor those costs, regardless of theconduct or outcomeof the prequalificationprocess. 9. Language of 9.1 The applicationas well as all correspondenceand documents Application relatingto the prequalificationexchanged by the Applicantand the Employer,shall be writtenin the languagespecified in the PDS.Supporting documents and printedliterature that are part ofthe application shall also in same language. 10. Documents 10.1 Theapplication shall comprise the following: Comprisingthe Application (a) ApplicationSubmission Form, in accordance with ITA 11; (b) documentaryevidence establishingthe Applicant's eligibilityto prequalifo,in accordancewith ITA 12; (c) documentaryevidence establishingthe Applicant's qualifications,in accordance with ITA 13; and (d) anvother document required as specifiedin thePDS. 11. Application 11.1 The Applicantshall prepare an ApplicationSubmission Sheet SubmissionForm usingthe form furnishedin SectionlV, ApplicationForms. This Formmust be completed without any alteration to itsformat. 12. Documents 12.1To establishits eligibility in accordancewith ITA 4, theApplicant Establishingthe shall completethe eligibilitydeclarations in the Application Eligibilityof the SubmissionForm and Forms ELI (eligibility) 1.1 and 1.2, included Applicant in SectionlV, Application Forms.

Documents 13.1 To establishits qualificationsto perform the contract(s)in Establishingthe accordancewith Section lll, QualificationCriteria and Qualificationsof Requirements,the Applicantshall provide the information the Applicant requestedin the correspondingInformation Sheets included in SectionlV, Application Forms.
14. Signingof the 14.1 The Applicantshall prepare one originaldocument comprising Applicationand the applicationas describedin ITA 10 and clearlymark it Numberof Copies "ORlGlNAL".The originalof the applicationshall be typedor writtenin indelibleink and shall be signedby a personduly authorizedto signon behalfof the-Applicant. 14.2 The Applicantshall submit copies of the signed original application,in thenumber specified in the PDS,and clearly mark them "COPY".In the event of any discrepancybetween the originaland the copies, the original shall prevail.
D. Submissionof Applications
15. Sealingand 15.1 TheApplicant shall enclose the original and the copies of the ldentification of applicationin a sealedenvelope that shall: Applications (a) bearthe nameand address of the Applicant; (b) beaddressed to theEmployer, in accordancewith ITA 16.1; and (c) bear the specific identificationof this pre-qualification processindicated in thePDS 1.1. 15.2 The Employerwill accept no responsibilityfor not processingany envelopethat was not identified as required. 16. Deadlinefor 16.1 Applicationsshall be receivedby the Employerat the address Submissionof and no laterthan the deadlineindicated in the PDS.A receipt Applications will be given for all applicationssubmitted. Applicants may alwayssubmit their applications by mailor by hand.When so specifiedin the PDS.Applicants shall also submit an electronic copy of their applicationsas specifiedin PDS. Applications shallbe receivedby the Employerat the addressand no later thanthe deadlineindicated in the PDS.A receiptwill be given for allapplications submitted. 16.2The Employermay, at its discretion,extend the deadlinefor the submissionof applicationsby amendingthe Prequalification Documentin accordancewith lTA7, in whichcase all rightsand obligationsof the Employerand the Applicantssubject to the previousdeadline shall thereafter be subjectto the deadlineas extended. 17. LateApplications 17.1The Employermay at its discretion,accept the applicationafter thedeadline for submission of applicationsprescribed in ITA16. 18. Opening of 18.1 Employershall open the applicationsas per its standard Applications proceduresand shall preparea record of the openingof applicationsthat shall include, as a minimum,the nameof the Applicant.A copy of the record may be distributedto all Applicants.

Confidentiality 19.1 Informationrelating to the evaluationof applications,and recommendationfor pre-qualification,shall not be disclosedto Applicantsor any otherpersons not officiallyconcerned with suchprocess until the notificationof resultsof pre-qualification is madeto allApplicants. 19.2 Fromthe deadlinefor submissionof applicationsto the timeof notificationof the resultsof the prequalificationin accordance with tTA 26, anyApplicant that wishesto contacttfe Employer on any matterrelated to the prequalificationprocess, may do so butonly in writing. 20. Glarificationof 20.1 To assistin theevaluation of applications,the Employermay, at Applications its discretion,ask any Applicant for a clarificationof its applicationwhich shall be submittedwithin a statedreasonable periodof time.Any requestfor clarificationand all clarifications shallbe in writing. 20.2 lf an Applicantdoes not provideclarifications of the information requestedby thedate and time set in the Employer'srequest for clarification,its application may be rejected. 2'1. Responsivenessof 21.1The Employermay reject any application which is notresponsive Applications to therequiremenis of theprdquaiification document. 22. Subcontractors 221 Applicantsplanning to subcontractany of the key activities indicatedin Sectionlll, QualificationCriteria, shall specifythe activity(ies)or parts of the works to be subcontractedin the ApplicationSubmission Form. Applicants shall clearly identify the proposedspecialist subcontractors in FormsELI-1.2 and EXp (experience)-4.2in Section lV. 23. Evaluationof 23.1 The Employershall use the factors,methods, criteria, and Applications requirementsdefined in Sectionlll, QualificationCriteria and Requirementsto evaluatethe qualificationsof the Applicants. The useof othermethods, criteria, or requirementsshall not be permitted.The Employerreserves the right to waive minor deviationsin the qualificationcriteria if they do not materially affectthe capability of an Applicantto performthe contract. 23.2 The Employershall also evaluatethe past performanceof the applicantagainst its equipment supplied to NHA. 23.3 only the qualificationsof subcontractorsthat have been identified in the applicationmay be consideredin the evaluationof an Applicant.However, the general experienceand financial resourcesof subcontractorsmay not be addedto those of the PRE-QUALIFICATIONFOR ELECTRO-MECHANICALWORKS OF LOWARI TUNNEL PROJECT 9 Applicantfor purposesof prequalificationof the Applicant. 23.4 ln caseof multiplecontracts, the Employershall pre-qualify each Applicantfor the maximumnumber and typesof contractsfor which the Applicant meets the appropriate aggregate requirementsof such contracts,as specifiedin sectr-onlll, QualificationCriteria and Requirements.
24. Employer'sRight 24.1 The Employerreserves the right to accept or reject any to Accept or Reject application,and to annulthe pregualificationprocess aho releit Applications allapplications at anytime, without ther.eby incuning any tiability to Applicants. 25. Prequalificationof 25.1 All Applicantswhose applicationshave met or exceeded Applicants ("passed")the specifiedthreshold requirements will, to the exclusionof allothers, be pre-qualifiedby theEmployer. 26. Notificationof 26j once the Employerhas completedthe evaluationof the Prequalification applicationsit shall notify all Applicantsin writingof the namesof thoseapplicants who have been pre-qualified. 27. lnvitationto Bid 27.1 Promptlyafter the notificationof the resultsof theprequalification the Employershall invite bids from all the Applicantsthat have beenpre-qualified.
27.2 Biddgrsmay be requiredto providea Bid Securityacceptable to the Employerin the form and an amountto be specifiedin the BiddingDocuments, and thesuccessful Bidder shall be required to providea Performancesecurity to be specifledin the Bidding Documents.
28. Changesin 28.1 Any changein the structureor formationof an Applicantafter Qualificationsof beingprequalified in accordancewith rrA 2s and invitedto bid Applicants shallbe subjectto a writtenapproval of the Employerprior to the deadlinefor submissionof bids.such approvalshill be deniedif as a consequenceof the changethe Applicantno longer substantiallymeets the qualificationcriteria set forth in section lll, Qualificationcriteria and Requirements, or if in theopinion of the Employer,a substantialreduction in competitionmay result. Any suchchanges shall be submittedto the Employernot later thanseven (07) days after the date of the Invitationfor Bids.

During tunnel construction regular weatherrecords were taken which are summarizedhereunder: 1.5.1 Temperature In summer averagetemperatures range between min. 10 to 15 "C and max. 30 to 35 oC. In oC winter avetagetemperatures range between min. -10 to 0 and max. 5 to 15 oC. Durins peak periods thesemin/max values may getexceed. Nalasand other stream-offsare especiallyendangered as a local heavyrain fall eventmay take placein somedistance upside the valley and subsequentlylead to suddenrise of the waterlevel in the proiectarea. The Ziarat area(between the two tunnels)as well asthe areaat southportal of MRT are especiallyto be mentionedin this regard,though the access-and otherroads may be affectedas well. 1.5.3 Snow In winterheavy snow fall may lastover days resulting in snowheights of morethan 2m at the poftalareas and occurrence ofavalanches.
