Le Président Zuma a également souligné que les ministres et leurs ministres adjoints ont œuvré pour que les Sud- Africains puissent avoir accès à ces services et que, précisément, après avoir étudié la manière dont fonctionnaient les ministères, il a décidé d’en renforcer certains en leur adjoignant un secrétariat d’Etat. Quatre postes de ministres adjoints ont ainsi été créés. C’est le cas du ministère de l’Enseignement supérieur et de la Formation, l’éducation restant la priorité absolue du gouvernement. Le ministère auprès de la Présidence chargé du Contrôle et de l’Evaluation des Performances et de l’Administration a, lui aussi, en charge un éventail considérable de domaines. C’est la raison pour laquelle le chef de l’Etat lui a délégué un ministre adjoint. Il en va de même pour le ministère de l’énergie et celui les mines, deux domaines d’une importance vitale pour l’avenir. Le gouvernement s’était engagé à électrifier au moins 150 000 foyers par an. Au 31 mars 2010, plus de trois millions de foyers sud-africains attendaient toujours d’avoir accès à l’électricité. Par ailleurs, l’industrie minière constitue depuis plus d’un siècle le fondement de l’économie sud-africaine. En 2009, la part de ce secteur s’élevait encore à plus de 30% du total des revenus à l’exportation, assurant l’emploi de 2,9% de la population active. Sept ministres ont été remerciés et deux autres ont changé de portefeuille. Le chef de l’Etat a ainsi remercié le ministre des Communications, M. Siphiwe Nyanda, haut responsable au sein de l’ANC et ancien chef des Forces Armées, ainsi que le ministre des Entreprises Publiques, Mme Barbara Hogan. Le premier est remplacé par M. Roy Padayachie, qui a toute l’expérience nécessaire en tant qu’ancien ministre adjoint aux Communications, alors que Mme Hogan laisse sa place au ministre adjoint de l’Intérieur, M. Malusi Gigaba, ancien dirigeant de la Ligue de la Jeunesse de l’ANC. M. Membathisi Mdladlana, ministre du Travail depuis juillet 1998, est remplacé par Mme Mildred Oliphant, présidente du groupe des députées ANC au Parlement. M. Fikile Mbalula, lui aussi ancien membre l’ANCYL, passe du poste de ministre adjoint de la Police à celui de ministre des Sports. Le ministre des Travaux Publics, M. Geoff Doidge, est remplacé par Gwen Mahlangu- Nkabinde. Parmi les autres mouvements, figure celui de Mme Noluthando Mayende-Sibiya, qui quitte le ministère des Femmes, des Enfants et des Personnes Handicapées pour être remplacée par l’ancien ministre de la Culture, Mme Lulu Xingwana, laquelle cède sa place à M. Paul Mashatile. Ce dernier est un dirigeant du parti au pouvoir pour la province de Gauteng. Le ministre de l’Environnement et de l’Eau, Mme Buyelwa Sonjica, laisse sa place à Edna Molewa, et le ministre du Service Public et de l’Administration, M. Richard Baloyi, est remplacé par Ayanda Dlodla. En revanche, plusieurs ministères clés comme les Finances, les Affaires étrangères et l’Intérieur gardent leur titulaire. Le ministre de la Coopération et des Relations Internationales, Mme Maité Nkoana-Mashabane, s’est, pour sa part, réjoui de la nomination de Monsieur Marius Fransman au poste de ministre adjoint. Il présidait depuis 2009 la commission parlementaire chargée de l’Enseignement supérieur et de la Formation. Monsieur Fransman remplace Mme Susan van der Merwe, dont le travail à ce poste depuis 2004 a été salué par le chef de la diplomatie sud-africaine. Le ministère de la Coopération et des Relations Internationales comprend un ministre et deux ministres adjoints. M. Ebrahim I. Ebrahim, l’autre ministre adjoint, conserve son poste.     19 November 2018 Zondo Commission: Gordhan describes government’s push to secure nuclear deal Public enterprise minister Pravin Gordhan urged South Africans to connect the dots and learn for themselves how state capture happened – keeping the failed Russia nuclear deal, the bombed out Denel Asia venture and the appointment of former Sars commissioner Tom Moyane in mind. He was testifying before the commission of inquiry into state capture on Monday. The concept of state capture, he said, is understood to be the manifestation of a network of systems that usually have a sole or few ultimate beneficiaries, with players who can be categorised to suit the needs at different levels of the project. Gordhan spent most of the morning explaining the dynamics within which he led the national treasury – during two tenures that were interrupted by a stint in the co-operative governance department (Cogta) – and the level at which its systems were compromised. He was first appointed minister of finance shortly after the 2009 national elections, and redeployed to Cogta in 2014, before returning to the finance portfolio. Gordhan then elaborated on three major processes that happened during his first term and beyond, which raised eyebrows for him and his colleagues at Treasury. First up was the infamous nuclear deal with Russia, to which Treasury was opposed in principle, right from the start. In a late 2013 meeting between Gordhan, his then director-general Lungile Fuzile, Senti Thobejane - advisor to then minister of energy Ben Martins - and Zuma, a compromise was struck between the two departments. Fuzile and Thobejane, it was decided, would work on the framework that would structure a procurement process for the consumption of nuclear power for South Africa, no different from any other tender process entered into by government.

It is also a country run by a government which has itself become increasingly lawless. This is so despite all the commitments to legality set out in the Constitution. Not only is the post–apartheid South Africa founded upon the principle of legality, but courts whose independence is guaranteed are vested with the power to ensure that these principles are upheld. Prosecuting authorities are enjoined to exercise their functions “without fear, favour, or prejudice”. The same duty is laid upon other institutions established by the Constitution, among them the public protector and the auditor general. Everyone is endowed with the right to “equal protection and benefit of the law”. We are all also entitled to “administrative action that is lawful, reasonable, and procedurally fair”. Unlike the old South Africa – no doubt because of it – the new Rechtsstaat was one where the rule of law would be supreme, power would be limited, and the courts would have the final say. This edifice, and these ideals, are under threat. Lawlessness on the part of the state and those who run it is on the increase. The culprits run from the president down to clerks of the court, from directors general to immigration officials, from municipal managers to prison warders, from police generals to police constables, from cabinet ministers to petty bureaucrats.

The emphasis on the right to equality in the Constitution and other related laws discussed in the study represents a guarantee for both men and women the right to equal treatment and benefit of the law. The point of departure is based on the premise that views the law as an instrument that has the potential to effect social change. The primary purpose is to determine various factors that are an impediment to the significance of the law for the promotion of the right to gender equality. The objective is to establish with sufficient certainty the substantive conception of the right to gender equality in post-apartheid South Africa. This dissertation examines and provides a brief overview of the development and the intersection of the principles of non-discrimination at the international and regional spheres and their influence in broadening the scope for enforcement of gender equality in South Africa.
