Message from the Minister
From the Government of Khyber Pakhtunkhwa, I am privileged to present the Khyber Pakhtunkhwa province’s very first Action Plan for Human Rights. It reflects the provincial government’s commitment to respect, protect and fulfil the people’s fundamental rights enshrined in the Constitution of Pakistan and international Treaties to which Pakistan is a state party.
The government of Khyber Pakhtunkhwa is striving consciously to bring about political stability, socioeconomic development and to achieve a high degree of respect to the people’s rights. Development of the provincial policy on human rights and formulation of the action plan for human rights is a testament of provincial governments’ endeavours in this regard and its extension to the Merged Districts too.
The Khyber Pakhtunkhwa Action Plan for Human Rights entails a list of actions to achieve the planned outcomes thereby to fulfil the objective for the improvement of human rights protection within the provincial jurisdiction. It will enable the relevant government entities to streamline the process of human rights policy design, delivery and oversight at provincial level.
I extend my sincere appreciation to the entire team of Law, Parliamentary Affairs and Human Rights Department, Khyber Pakhtunkhwa for their hard work and dedication towards achieving this milestone. In this context, I am grateful to the provincial assembly members, officials of human rights bodies, civil society actors and other stakeholders who have extended their valuable support in formulation of the action plan. Message from the Secretary
The Law, Parliamentary Affairs and Human Rights Department, Khyber Pakhtunkhwa is endeavouring to achieve a high degree of respect to human rights in the province. Formulation of the first ever provincial human rights action plan, in follow up of introducing provincial human rights policy in 2018, is another steppingstone towards the improved protection of people’s legitimate rights and fundamental freedom. The department efforts to prioritise the agenda of human rights is primarily aimed to ensure compliance with Pakistan’s domestic and international human rights obligations.
The Khyber Pakhtunkhwa Action Plan for Human Rights sets out targets and pose responsibilities on relevant provincial authorities to effectively spearhead the process of human rights policy design, delivery and oversight at provincial level. Significantly, the action plan envisages active involvement of provincial democratic institutions for their political support and oversight. It further provides a way forward for the improved coordination between relevant provincial government entities to streamline the process of implementation and monitoring of the action plan.
Having realisation of challenges on the way to achieving desired level of respect to human rights in a post conflict situation in the province, the department is cognisant of its responsibilities and has been employing its full potential to entrench human rights in state of affairs of all public institutions.

5 Khyber Pakhtunkhwa Action Plan for Human Rights
Introduction The government of Khyber Pakhtunkhwa is pleased to present its very first Action Plan for Human Rights, in compliance with the ‘National Action Plan for Human Rights’ introduced by the (federal) Government of Pakistan in February 2016.
The Government of Pakistan attaches high priority to achieve respect for people’s legitimate rights and fundamental freedom, enshrined in Constitution of Pakistan, religious ethos and the country’s international human rights commitments.
Following the pledge made under ‘Khyber Pakhtunkhwa Human Rights Policy 2018’ to ensure protection, promotion and enforcement of human rights within the provincial jurisdiction, the Law, Parliamentary Affairs and Human Rights Department, Khyber Pakhtunkhwa has led the process of action planning. As a first step, a stakeholders’ consultation was organised to take stock of provincial human rights situation and to seek their inputs for action planning. Officials of relevant governmental departments, representatives of national and provincial human rights bodies, policymakers and civil society actors participated in the consultation and identified the most pressing issues as well as posed recommendations for the Action Plan.
The Action Plan has been developed based on the recommendations of the stakeholders, and revised to bring in conformity with ‘National Action Plan for Human Rights’, ‘Khyber Pakhtunkhwa Human Rights Policy’ as well as the country’s international human rights commitments.
The Action Plan is primarily focused to bring improvement in human rights policy design, delivery and oversight the improvement of human rights protection, thereby to pave the way for peace and sustainable development in Khyber Pakhtunkhwa province.
Structure The Action Plan consists of the following five (5) thematic areas and seventeen (17) outcomes, in the form of matrix providing description of thematic areas, outcomes, actions, responsible agency/department and timeline;

Implementation The Government of Khyber Pakhtunkhwa, having realisation of the importance and Monitoring of human rights, believes that implementation on the action plan and to achieve desired degree of respect to human rights is possible through active engagement of all the stakeholders. Following key steps are proposed to ensure effective implementation and monitoring of the action plan.
A. The standing committee of provincial assembly on Law, Parliamentary Affairs and Human Rights department of Khyber Pakhtunkhwa and other relevant provincial democratic structures are expected to provide political support and carry out broader oversight of the implementation process.
B. The Law, Parliamentary Affairs and Human Rights Department, Khyber Pakhtunkhwa will make arrangements to ensure active coordination between provincial human rights stakeholders as well as federal relevant structures to streamline provincial human rights reforms in accordance with the country’s domestic and international commitments.
C. The Khyber Pakhtunkhwa Task Force on Human Rights will carry out the overall monitoring on the implementation of action plan at outcome level.
D. The Khyber Pakhtunkhwa Treaty Implementation Cell will collect data and information, develop compliance reports and will share with relevant federal/ provincial stakeholders.
E. Relevant provincial ministries and departments, in close coordination with Law, Parliamentary Affairs and Human Rights Department, Khyber Pakhtunkhwa will ensure implementation on actions proposed under the plan.
Review and Given the fact that Pakistan is a developing country where democratic and Improvement human rights regimes are undergoing a transition phase, hence it requires regular review and improvements at policy design, delivery and oversight levels. The government of Khyber Pakhtunkhwa therefore adopted a realistic approach to outline this action plan, it will be reviewed and improved in a more professional way in years to come.
