Military Assistance to the Afghan Opposition Human Rights Watch Backgrounder October 5, 2001 To respond to the attacks on the World Trade Center and Pentagon on September 11, 2001, the United States government has begun to put together what it calls a coalition against terrorism. As part of this approach, the United States has signalled support for the creation of a broad-based coalition to oppose the Taliban, the current rulers of most of Afghanistan. This opposition would include forces that presently constitute the United Front—also known under its former name the Northern Alliance—as well as Taliban defectors. Some commanders with experience in the guerrilla war against Soviet occupation in 1979-1989, but not now in the United Front, may also be drawn into the new coalition. A number of present and former commanders who may be eager to assume positions of leadership in the coalition have a long record of serious human rights abuse in Afghanistan. Human Rights Watch is concerned that unqualified support—military, political, diplomatic, financial—for this new coalition, which may come to constitute the basis for a future government of Afghanistan, will encourage further abuses. In responding to the crimes against humanity of September 11, the United States should not resort to means that themselves violate basic human rights and humanitarian law standards, or provide assistance to forces that do. Support for the Afghan Opposition While the United States says it has so far provided no arms to the Afghan opposition, recent media reports suggest that it is gearing up to provide financial and possibly military support to the United Front and other armed Afghan groups. -

Although some cross-ethnic coalitions have emerged, especially during the presidential elections, these coalitions have failed to survive across elections and branches of government. As for what explains the failure of the consolidation of coalitions, some scholars pointed to the SNTV system and others to the presidential system. This study examines all related institutional designs, including the SNTV system for parliamentary elections, the runoff system for presidential elections, the presidential system, dual vice presidency, and party qualification thresholds. These systems and institutions are designed by three bodies of political laws: the Constitution, electoral laws, and party laws. Analyzing these laws and institutional designs, this study makes three observations. First, the failure of coalitions to institutionalize in Afghanistan is not due to a single political law or institutional design but due to the influence of a number of them. Second, for cross-ethnic coalitions to institutionalize, all related institutional designs must act cohesively or else they fail to incentivize coalition-building, as is the case in Afghanistan. -

MOBASHER 4/18/2016 3:11 PM UNDERSTANDING ETHNIC-ELECTORAL DYNAMICS: HOW ETHNIC POLITICS AFFECT ELECTORAL LAWS AND ELECTION OUTCOMES IN AFGHANISTAN *Mohammad Bashir Mobasher After the fall of the Taliban in 2001, Afghanistan began transitioning toward democracy. The democratization, which began with the Bonn Agreement, was very promising for all ethnic groups in Afghanistan. The Bonn Agreement provided that Afghanistan must establish “broad based, gender sensitive, multi- ethnic and fully representative government.”1 As a part of this agreement, Afghanistan adopted a new Constitution in 2004, which established elections as the foundation for representative government and guaranteed that the elections be inclusive, fair, and representative of all groups and regions. Despite this progress in the laws, Afghanistan has not been able to reduce ethnic tensions. In fact, this article shows that ethnic tensions tend to intensify during elections, a result that belies the vision of the Bonn Agreement. After presenting a statistical and qualitative analysis of voting practices across three presidential elections and 26 provinces, this article makes several observations about the role of ethnicity in Afghan presidential elections. These observations are: (1) people of an ethnic community are more likely to vote for a candidate of their own ethnic group; (2) voters from one ethnic group are likely to vote for a candidate from another ethnic group only when they do not have a candidate of their own; (3) cross ethnic voting is more likely to occur in blocs and in exchange for patronage to the elites of voting groups; and (4) candidates and ethno-political elites tend to prioritize their electoral campaigns by ethnic mobilization, manipulation of laws and political bargains rather than by policy development in order to generate votes. -

Two years on, this, the third edition of the guide, is also coming out during a tremendous time of change in Afghanistan. For the first time in over two decades, the country is preparing for national elections, scheduled for autumn 2004 (presidential) and spring 2005 (parliamentary). Given the importance of the elections over the next six months, this edition includes a section focusing on elections that provides an overview of the election law, political parties, the timetable for elections, electoral districts and other critical information to assist you in understanding the political process. The elections section also includes a handy question and answer guide to the elections. BACKGROUNDER ON AFGHANISTAN: HISTORY OF THE WAR The U.S- led military intervention in Afghanistan marks the fourth phase in the country’s twenty-three-year-old civil war. In every phase foreign powers have intensified the conflict by supporting one side against another. The First Phase: The Saur Revolution and Soviet Occupation Before civil war erupted in 1978, Afghanistan was a monarchy under Muhammad Zahir Shah, who had come to power in 1933. After World War II, both the U.S. and the Soviet Union used economic assistance to compete for influence. After the US established military ties with Pakistan in 1954, Afghanistan increasingly turned to the Soviet Union support. In 1964 Zahir Shah convened a Loya Jirga, or Grand Council, of tribal leaders to debate a draft constitution that would provide for a more representational government. However, Zahir Shah did not relinquish any power; political parties were permitted to organize but not to contest elections. Zahir Shah was overthrown by his cousin Daoud Khan in 1973; the king has remained in exile in Rome ever since. In staging the coup, Daoud had allied himself with the Parcham faction of the People's Democratic Party of Afghanistan (PDPA), a Marxist-Leninist party that had been formed in 1965. In 1967 the PDPA split into two factions, Parcham (“flag”) which drew its support from urban, educated Pashtuns along with other ethnic groups, and Khalq (“masses”) which had the support of educated rural Afghans, also predominantly Pashtun. (Pashtuns comprise the largest ethnic group in Afghanistan and have dominated the government for centuries. -

This constitutional rule comprises a runoff clause, which prescribes a second round of elections between the two front-runners should no candidate win over 50% of the votes in the first round. While this article agrees with the majority view of Afghan scholars and politicians who see the runoff clause as instrumental to developing trans-ethnic coalitions and governments, it distinguishes between the formation of alliances and their consolidation. -

Nadiri All rights reserved Abstract Why do public institutions decay or break down? And why are they often so difficult to put back together? These questions have been the subject of a large body of academic literature in the social sciences, but we still do not have a good theoretical and empirical understanding of contemporary institutional development in countries with limited human capital, material resources, and the rule of law. External or internal conflicts often do not motivate governments to develop more robust institutional structures. Ethnic differences do not necessarily given rise to institutional dysfunction or conflict. And ideology frequently does not influence whether a government is able to design and implement policies that benefit the public at large, predictably enforce laws and property rights, or develop a monopoly of control over the national territory. In order to gain deeper insight into the processes by which contemporary institutions may develop or decay, this research closely examines a longitudinal case of initial institutional im- provement and subsequent failure that is not consistent with existing explanations: Afghanistan. In this puzzling case, I show that government institutions became progressively more institution- alized during the early and middle periods of the 20th century but ultimately failed to consolidate these gains, developing a recurrently unstable political system and an unproductive economy. -

One has to bear in mind that the harsh and extreme weather conditions of this region made these particular sections of the Silk Road passable for only limited times of the year. Badakhshan' s primary role in this trade route was as a distributor rather than a supplier of goods (see Grevemeyer 1982:101; Raunig 1978:554). Many old caravanserais (rest houses) continue to be used and thus testify to the continued popularity of this ancient trade route. Yet the Silk Road has not only been important for the trade of consumer goods; it has also been a vital means of transmitting cultural practices including those of aesthetic entertainment. Musicians, dancers and actors would have been especially popular at the major caravanserais and chaikhanas (teahouses), since their performances were not reliant upon local languages, but utilised the extra-linguistic media of music, dance and mime (see also Haussig 1988:108- 109). Towards the end of the seventeenth century the discovery of maritime routes between Europe and the East had a significant impact on the monopolistic position of Central Asia and Afghanistan as transit trade centres. These new routes proved to be safer, cheaper, and in many respects faster (see Gregorian 1969:21; Grevemeyer, 1982:1 02), their inevitable popularity thus contributing to the subsequent economic and cultural isolation of northern Afghanistan.
