SPECIAL BOARD MEETING DT.29-09-2020

Before commencement of the meeting, the Board observed two minutes silence as a mark of respect in the memory and honour of Late Shri Suresh L.Kamble, Member, Cantonment Board, Kirkee, Late Shri Baliram Sawant, Ex.Member of Cantonment Board, Kirkee and Smt.Mangal Sonowne, Female Safaikarmachari of Kirkee Cantonment Board who expired due to Covid Virus.

The Board members also appreciated the tireless services rendered by the Doctors, Staff Nurses, Sanitation Workers and other staff during the Covid Pandemic.

The President, Cantonment Board instructed the CEO that letter be sent, duly signed by the PCB, to those members who are not attending the Board Meeting since long.

Shri Duryodhan Bhapkar stated that one AFK Official be nominated as member of the Board as there are many issues related to Range Hills area which need to be resolved amicably. CEO informed that there is no such provision in the Cantonments Act. However AFK Officials can be called as Invitee members.

Shri Sidharth Shirole, Hon’ble MLA who attended the meeting was welcomed by the Board members. The Board also welcomed Dy.CEO Smt.Mabel Christian.

1. TO NOTE THE FOLLOWING CIRCULAR AGENDAS/APPROVAL OF PCB/CEO WHICH IS REITERATED AS UNDER : a) PUBLIC AUCTION FOR ALLOTMENT OF TEMPORARY STALLS FOR SALE OF FIRE CRACKERS AT SURVEY NO.230.

To note the approval of PCB dated 05/10/2019 on the subject matter . It was decided to allot 20 temporary stalls. Total 17 bidders participated in the auction. Rs. 40,000/- EMD has been collected from bidders in the form of Demand Draft and cash. Also as per the directions of Maharashtra Pollution Control Board (MPCB), Rs. 3000/- per stall has been collected and shall be used towards Conservancy Services.

Accordingly following are the highest bid received for 16 stalls, no offers were received for stall no. 10,11,12& 13:-

As per the instructions of CEO, Stall No. 10,11,12& 13 were called for re-auction vide Public Notice dated 05/10/2019 for which auction was called on 07/10/2019, but no offers were received for the same. Vide Public Notice Public Notice vide letter No. 12/5/TOL(Fire Crackers)/P- 336 dtd. 15-10-2019 3rdcall for re-auction was made and auction was held on 18/10/2019. Only one offer is received for stall No. 11 i.e. Rs. 35,000/- which was approved by PCB.

Last year total bid amount received for 20 stalls was Rs. 12,62,200/- whereas this year total bid Rs. 11,76,000/- has been received for total 17 stalls. As numbers were less in comparison to 20 number of stalls bid amount have been decreased than last year. The 100% of bid amount has been collected along with applicable Goods and Service Tax (GST) and MPCB charges and amount of Trade License form. The Higher Offer for the temporary stalls has been approved .

In this connection, the Note dated 15/09/2019 duly approved is placed on the table.

b) REVISION OF VARIOUS RATES WRT TENDER OF BOARD’S MANGAL KARYALAYAS – 1) SHREE RAM MANGAL KARYALAY, BAZAR AND 2) SAI PRASAD MANGAL KARYALAY, SAPRAS

To note the Circular Agenda dated 20/12/2019 regarding the revision of rates as regards to tender of Board’s two Mangal Karyalayas, namely (1) Shree Ram Mangal Karyalaya and (2) Sai Prasad Mangal Karyalaya. Both the Mangal Karyalays being run and maintained by the Board till the time fresh tender is finalized.

Now, in order to invite fresh tender for leasing out the license rights for running and maintaining the above Karyalaya, following rates are proposed.

Sai Prasad Mangal Karyalaya was recently inaugurated in the month of June 2019 after carrying out renovation work and addition of first floor to the existing structure of Sai Prasad Mangal Karyalaya. Accordingly the above rates has been proposed and approved vide Circular Agenda on the basis of revised rates for not more than three years.

c) TENDER FOR DISPOSAL OF RIGHTS FOR DISPLAY OF ADVERTISEMENT ON HOARDINGS SITES

To note the Circular Agenda dated 05/12/2019 for Disposal of Rights for display of Advertisement on Hoardings at 17 sites within the limits of Khadki Cantonment Board. In this regard, e-Tender was uploaded on e-procurement portal eprocure.gov.in and also Notice Inviting Tender (NIT) was published in the local newspapers SAKAL and INDIAN EXPRESS on 20/08/2019. The Technical Bid was opened on 19/09/2019 and following tenderers participated in the above tender:-

All the above 4 tenderers qualified the Technical Bid and were recommended for Financial Bid by Finance Committee Chairman. The tender period is for two years and the above rates are quoted on per annum basis with cumulative increase of 10% for next year.

Total Base price quoted for above mentioned 7 sites was fixed as Rs. 15,60,000/- while in the Financial Bid total amount quoted for the said 7 sites is Rs. 24,68,800/- i.e; there is an increase of 58.25% (Rs. 9,08,800/-) over base price. The tender has been approved through Circular Agenda.

d) NOTE : CELEBRATION OF REPUBLIC DAY – 26/01/2020

To note the Approval of PCB dated 20/01/2020 on celebration of Republic Day and expenditure to be incurred as under :

e) COST ESCALATION ON PURCHASE OF MEDICINE FROM G.M.S.D

To note the action taken by the CEO on payment of medicine purchased from Government Medical Supply Depot (G.M.S.D), being a government agency.

Medical indent for year 2017-18 was placed on the Government Medical Supply Depot (G.M.S.D) portal dated 11th Sept 2016. The majority of supplies from GMSD were received in the 2017-18, except for Inj Cefotaxime 1gm.

This medicine was received on 11th Nov 2018 with a cost of Rs 2,24,420/- for quantity 7449 injections. There was a cost escalation of Rs 2.59/injection and a transportation charge of Rs 9240/- was added. The hospital had asked for correction in the bill vides Hosp/Med-Store/2019-20/P-81 dated 5th July 2019. GMSD has refused vide their letter No AS/2019-20/1548 dated 17th July 2019 citing revision of rates.

In this connection, all relevant papers are placed on the table.

f) REPAIRS FOR X-RAY MACHINE IN DR.BABASAHEB CANTONMENT GENERAL HOSPITAL,KIRKEE.

To note the action taken by the CEO on the office note of RMO dated 21st September 2019. The X-Ray Machine 500 MA (make SEIMENS) installed in the Radiology Department of Hospital developed a faulty X-Ray tube as reported by AMC technicians vide service report dated 20th Sept.2019.

The machine was installed in the Hospital in 1989 and this is the first major repair since installation.

The details of the rate quoted by manufacturer SEIMENS for replacement of the parts is as follows:-

g) PURCHASE OF MAHINDRA TOURISTER 40 BS4 52+D SCHOOL BUS

To note the Circular Agenda dated 11.12.2019 regarding purchase of Mahindra Tourister 40 BS4 52+D School Bus EXL available on GeM against total Value of Rs. 20,06, 368/- ( GeM cost at 18,77,000/- + transportation cost Rs.8100/- GST on transportation 28% 2268/- +Insurance cost Rs. 87,000/- + RTO cost of Rs. 32000/- ) for Swabhiman Centre, school for Special Children in the premises of Bharat Ratna Dr. Babasaheb Ambedkar Cantonment General Hospital, Khadki. received from Shri Sanjay Kakade. MP-(Rajya Sabha) through MP Fund.

Further an amount of Rs. 7.5 has also been received from MLC Shri Anant Gadgil vide letter No. forj.18-11-2019 for Force Trax Cuiser BS IV FM 2.0 XE3050 (9+D) Hard Top (4X2), ABS (Forc Motors Ltd.) for Special Children in the premises of Bharat Ratna Dr. Babasaheb Ambedkar Cantonment General Hospital, Khadki

h ) Supply of Supporting Teaching Staff for Kirkee Cantonment Board Purely on contractual basis

To note the Circular Agenda dated 16/01/2020 regarding tender received for ‘Supply of Supporting Teaching Staff for Kirkee Cantonment Board purely on contractual basis”.

The Technical Bid was opened on 10/12/2019 and thereafter Financial Bid of the subject Tender was opened on 30/12/2019. The rates received are as under :

This office had quoted estimated rate of Rs.1,91,86,200/- based on the approximate number of teachers required (65 Nos) and number of months (18 months). However, as on date the number of months will decrease to 13 ½ months as the contract will start from 01 Feb 2020 upto 30 April 2020 (3 months) and w.e.f 15 June 2020 to 30 April 2021 (10 ½ months). Also, the HMs of the Board’s schools were again finally asked to give the exact requirement. As per the demand raised by the HMs and when calculated based on 13 ½ month, the estimated rate works out to Rs. 1,25,21,790/- for 13 ½ month for 57 personnel and including the percentage quoted by L-1 Bidder, the amount comes to Rs.1,50,57,452/- for 13 ½ month (Rs.1,25,21,790/- + 20.25% quoted by L-1 Bidder Rs. 25,35,662/-). As on date, the expenditure incurred towards salary of contractual teachers is Rs. 8,50,000/- per month including PF contribution for 46 personnels (Rs.1,14,75,000/- for 13 ½ months ) The comparative statement is given below :

As per the Revised policy on shared communication tower and other telecom infrastructure to extend communication network in Military Stations / Cantonments issued by Ministry of Defence, Government of India vide letter no. 11026/1/2005/D(Lands) dated 26 Feb. 2018 the matter for grant of Right of Way (RoW) permission to Access Service Licensees / IP-1 for laying of Optical Fibre Cables (OFC) in Military Stations / Cantonments has been instructed. As per the said policy approval for laying OFC through A-1 and analogous to A-1 land will be granted by GOC in Commanding/equivalent and in case of OFC passing through Class A-2, C and B-4 land by PDDE concerned keeping in view and accordingly applying relevant provisions of the Indian Telegraph Rights of Way Rules, 2016 as amended from time to time.

Keeping in view the above policy the matter needs to be submitted to Competent Authority for consideration of the permission for laying OFC in Cantonment area. As per the policy as regards the laying of OFC passing through A-2, C and B-4 and as per relevant provisions of the Indian Telegraph Right of Way Rules 2016 of Department of Telecommunications (DoT), notified in the Gazette of India vide Notification No. G.S.R.107(E) dated 15 Nov. 2016 as amended from time to time it will be required to deposit for roads under the management Cantonment Board:-

a) Administrative expenses @ Rs. 1000/- per km Rs. 1,856/- b) Restoration charges Rs. 16,33,280/- .

Matter has been approved through Circular Agenda.

In this connection, Circular Agenda dated 22/01/2020 along with all other relevant documents are placed on the table.

To note the Circular Agenda dated 22/01/2020 regarding estimates for various following works to be undertaken in the respective maintenance contracts;-

The work is of urgent nature as the open plot is prone to be encroached by the stall holders and hawkers of the area. The work will be undertaken through the contractor for Repairs to Cantonment Fund Gardens at various locations.

The Board has accepted the above said contract for an amount of Rs. 25,00,000/- vide CBR No. 33 dated 19 Sept. 2019. The work will be undertaken under budget head D- 2(f). Further, the Budget provision exists for the year 2019-20 (R).

l) FIXATION OF CHARGES FOR USE OF GAS CREMATORIUMS BEING INSTALLED BY KIRKEE CANTONMENT.

To note the Circular Agenda dated 07/02/2020 regarding use of newly installed and which would be shortly commissioned Gas Crematorium at West and East Kirkee by Kirkee Cantonment Board.

The work of supply and installation of Gas Crematorium at West and East Kirkee along with the modification of the existing wood pyre system is almost complete and can be commissioned any time. However the Cremation Ground of East Kirkee is likely to be handed over to General Public on 08 Feb. 2020. Although fixation of charges for use of the Crematorium by general public, an enquiry was made with Pune Municipal Corporation as to the charges being charged by them for use of similar facility in the municipal area. On oral enquiry it has been revealed that PMC is offering services free of charge of Crematorium in their area.

Keeping this in view, since the Gas Crematorium and modified existing wood pyre are ready for use and in the larger interest of general public, if approved by the Board the same can be allowed to be used on free basis till the matter is being finalised by the Board. However, the matter will be placed in the ensuing Board meeting for discussion and decision.

m) DEVELOPMENT WORKS OUT OF LOCAL DEVELOPMENT PROGRAMME OF MP FUNDS 2019-20.

To note the Circular Agenda dated 13/03/2020 regarding placing of work order on the Cantonment Board’s Term Contractor for “Repairs/resurfacing of roads at various locations within Kirkee Cantonment limits” for resurfacing/repairs of road from GF gate to Sylhet in BEG & Centre, Kirkee out of Local Development Programme 2019-20 through MP Funds.

. A request letter no. 13191/KCB/101/Q dated 06 Jan. 2020 was received from the Headquarters, Bombay Engineer Group & Centre, Kirkee addressed to Shri Girish Bapat, Hon. Member of Parliament (Lok Sabha), Pune City Constituency for allotment of funds for resurfacing of internal roads in BEG & Centre, Kirkee out of Local Development Programme as bicentenary function was being celebrated in the month of Jan. 2020 and lot of dignitaries and VVIPs were expected to be visiting the Function.

On the above request Shri Girish Bapat, Hon. Member of Parliament (Lok Sabha), Pune City Constituency had proposed the District Collector and Member Secretary, District Planning Committee for an amount of Rs. 30.0 lakhs for undertaking the work of Blacktopping / concretization of internal roads in Bombay Engineer Group & Centre, Sapras, Kirkee out of Local Development Programme 2019-20 through MP Funds. Accordingly, the estimates and other details were sought by the DPDC vide letter no. 589/2020 dated 17 Feb. 2020 for further process of the proposal. The estimates for the same were submitted by this office to the District Collector and Member Secretary, DPDC vide letter no. 4/1-D/MP Funds/Roads/P-07 dated 04 March 2020. The administrative sanction for the above mentioned work has been accorded by the District Collector and Member Secretary, DPDC vide letter no. 973/2020 dated 12 March 2020.

In this regard the road proposed to be resurfaced from GF gate to Sylhet in BEG & Centre, Kirkee is a MES road for which NOC from BEG & Centre, Kirkee has been accorded vide letter no. 13094/62/Q dated 12 March 2020 and similarly, GE(C) Kirkee has accorded their NOC vide letter no. 2028/B/R-II/1356/E2 dated 13 March 2020.

The estimates for an amount of Rs. 29,95,345/- based on the approved rates vide CBR No. 91 dated 19 Sept. 2019 for the work of Repairs/resurfacing of roads at various locations within Cantonment Limits are placed opposite. Matter along with all the relevant papers are placed opposite for noting and approval for undertaking the work through the above mentioned contract.

n) EXTENSION OF ANNUAL CONTRACTS FOR OPERATION AND MAINTENACE OF SEWAGE TREATMENT PLANTS AT GADIADDA & EAST KIRKEE AND EFFLUENT TREATMENT PLANT FOR CANTONMENT BOARD’S SLAUGHTER HOUSE.

To note the Circular Agenda dated 13/03/2020 regarding extension of contracts for a) operation and maintenance of 8 MLD Sewage Treatment Plant at Gadiadda b) operation and maintenance of 1.20 MLD Sewage Treatment Plant at East Kirkee and c) operation and maintenance of Effluent Treatment Plant for Cantonment Board’s Slaughter office.

The period of Operation and maintenance contract for 8 MLD Sewage Treatment plant, Gadiadda, will be expiring on 31 March 2020. The contract for operation and maintenance was accepted by the Board vide FCR No. 07 dated 19 Jan. 2019 as modified by CBR No.02 dated 25 Jan. 2019 for an amount of Rs. 14,53,920/- p.a (i.e. Rs. 1,21,160/- per month) of M/s Aqua Tech Engineers. In this regard the tenders were invited in Dec. 2019 and opened in Feb. 2020 but only 02 tenders have been received.

The period of Operation and maintenance contract for 1.2 MLD Sewage Treatment plant, Gadiadda, will be expiring on 31 Jan. 2020. The contract for operation and maintenance was accepted by the Board vide Spl. CBR No. 24 dated 30 Nov. 2018 for an amount of Rs. 6,93,924/- p.a (i.e. Rs. 57,827/- per month) of M/s Aqua Tech Engineers. In this regard the tenders were invited in Dec. 2019 and opened in Feb. 2020 but only 02 tenders have been received.

The period of Operation and maintenance contract for Cantonment Board’s Slaughter House has expired on 31 Aug. 2019. The contract for operation and maintenance was accepted by the Board vide FCR No. 07 dated 18 Jan. 2018 as confirmed by CBR No.02 dated 08 March 2018 for an amount of Rs. 5,40,000/- p.a (i.e. Rs. 45,000/- per month) of M/s Green Scientific Development (I) Pvt. Ltd. In this regard the tenders were invited in Aug. 2019 for the first time; in Sept. 2019 for second time and in Dec. 2019 for third time and due to insufficient tenders being received in the all the above calls tenders could not be finalised.

In this matter is placed for approval of extension of the above contracts at the same approved rates till the finalisation of the contracts.

To note the Circular Agenda dated 17/02/2020 considering the Gazette Notification SRO No.01(E) dated 27/01/2020 received vide MoD ID No. 14(6)/2009- D(Q&C) dated 30/01/2020 forwarded vide DG DE, New Delhi letter No. 76/38/Rules/Allowance to member/C/DE/2016 dated 03/02/2020 regarding Amendment to the Cantonment (Payment of Allowances to Vice-President and Elected Members) Rules, 2011.

As per the said Notification, the Central Government has made the following rules to amend the Cantonment (Payment of Allowances to Vice President & Elected Members) Rules, 2011, namely:-

1. (i) These rules may be called the Cantonments [Payments of Allowances to Vice- President and Elected Members (Amendments)] Rules, 2020. (ii) They shall come into force on the date of their publication in the Official Gazette. In the Cantonment (Payment of Allowances to Vice President & Elected Members) Rules, 2011, in rule 3, -

According to above, the Cantonment Board’s Vice President and Elected Members will be entitled for Payment of allowances s above on the following terms and conditions:- (a) No Conveyance allowance shall be payable to the Vice President and Members unless they attends the meeting of the Board or Committee at least once in a month.

(b) Wherever a vehicle is provided by the Board to the Vice-President, the cost of fuel of such vehicle shall be deducted from the conveyance allowance to be paid to the Vice President for that month. Provided that the total cost of the fuel shall not exceed the conveyance allowance to be paid to the Vice-President for that month.

The additional financial implication for the above works out to Rs. 35,560/- per month approx. Necessary Budgetary provision already exists in the Budget Estimate 2019-20 (R) and 2020-21 (O) under the Head A(3).

r) APPOINTMENT OF CONTRACT STAFF FOR DR.BABASAHEB AMBEDAKAR CANTONMENT HOSPITAL,KHADKI

Ref: Circular Agenda Dated 1st July 2020

The hospital has sanctioned posts which have not been filled. Morever this sanctioned strength is from 1999 and older. The hospital since then has added services due to which there is requirement of additional staff.

The Covid pandemic has further strained the staff situation. As the staff has to be given leave after covid duty double the staff is required. The load on the Laboratory has become immense with investigations for Covid as well as Non-Covid increasing.

Due to issue of social distancing some of the interviews were held on telephone and for technical posts by MCQ examination. Nil candidate was available for Gynecologist post.

In this regard the selection proceedings are placed for approval for following posts.

There has been a steady increase in the number of Covid cases in Khadki necessitating increase in the number of Covid care center (CCC) and Dedicated covid health center (DCHC) beds to accommodate the new cases.

In the recent past we have had to take help of Pune Cantonment Board Facility to accommodate our excess cases.

We have made arrangement of additional beds in Lal Bahadur High School. This Facility shall require staff for management of patients, hence the interview.

The selection proceedings are placed for approval for following posts.

t) BIO–MEDICAL WASTAGE DISPOSAL FOR DR.BABASAHEB AMBEDAKAR CANTONMENT HOSPITAL,KIRKEE Ref:- Circular Agenda Dated 21ST May 2020

As per the above referenced note of the RMO,the Bio-Medical Waste(BMW) of the hospital is being sent to MH,Kirkee since 2009 for disposal. As per enquiry MH Kirkee, with the Covid-19* pandemic they engaged the facilities of Passco Environmental Solutions Pvt.Ltd. Pune

This being a paid service if would be proper for the Board to engae similar services for Bio-Medical waste management for its hospital.

A proposal has been received from Passco Environmental Solutions Pvt.Ltd. and the details of the costing involved are as follows.

a. For Covid-19

1. One time registration charges - Rs.5000.00 2 .Daily collection and transport - Rs.45000.00 @ Rs 15000/month for 3 months 3. Waste disposal charges @Rs 100/Kg - Rs.15000.00 (Minimum Rs 5000/-)For 3 Months Total : Rs.65000.00

The Cantonment Board Ahmadabad vide their letter dated 31.01.2020 have forwarded the expenditure details of all Cantonment Boards. The total expenditure on account of Sports Meet in r/o KCB is Rs. 6,93,345/.

The Board vide above resolution (1) above had considered to award bicycles to the students (girls & boys) of Std. VII to IX of Board’s four High Schools. However vide Circular Agenda referred above, it was decided to award Tabs/Laptops instead of bicycles to students of Std.VII to IX, who had secured 75% & above marks with 90% attendance in last academic year.

This practice has since been followed every year on similar terms. This year too report was sought from all the four HM’s to forward the list of those students who fulfil the above criteria. After compiling the received data, the list prepared as under based on said criteria.

It is submitted for information of CEO, that the Principal of Dr.Zakir Hussain Urdu High School has informed that the list of eligible students of Std.VIII could not be forwarded by them as the same has not been put up by the concerned class teacher (Shri. Naseer Shaikh). Shri Naseer Shaikh has not replied till date to the explanation called for the same.

The total no of Students as per lists forwarded are 69 ( 59 Girls & 10 Boys ). The cost of one Tablet & Laptop comes to Rs.8000/- & 30000/- respectively and the financial implication for 69 students and one student for laptop will be Rs. 5,82,000/- approx. Budget provision has been created under Budget Head 920.

To consider the Circular Agenda dated 11.12.2019 regarding purchase of Mahindra Tourister 40 BS4 52+D School Bus EXL available on GeM against total Value of Rs. 20,06, 368/- ( GeM cost @ 18,77,000/- + transportation cost Rs.8100/- + GST on transportation 28% , i.e 2268/- + Insurance cost Rs. 87,000/- + RTO cost of Rs. 32000/- ) for Swabhiman Centre, School for Special Children in the premises of Bharat Ratna Dr. Babasaheb Ambedkar Cantonment General Hospital, Kirkee received from Shri Sanjay Kakade. y) TEMPORARY SHIFTING OF FRUIT AND VEGETABLE VENDORS IN THE OPEN PLOT ON GLR SY.NO.230, KIRKEE

Ref : Circular Agenda dated 07/04/2020.

To consider the matter regarding temporary shifting of fruit and vegetable vendors in the open plot bearing GLR Sy. No. 230, Kirkee due to recent outbreak of pandemic Corona virus COVID-19 and positive detection of a patient within the limits of Kirkee Cantonment area.

At present the open plots on (a) GLR Sy. No. 108-A, Bharat Ratna Dr. Babasaheb Ambedkar Road (earlier Elphinstone road) (b) GLR Sy. No. 89-A & B near H.No.1 Old Bazar (Sanjay Gandhi Market) are being used for vegetable and fruit retail as well as wholesale trading. Both the above locations are located in the congested residential area and comparatively small keeping in view of the fact for effective maintenance of “Social Distancing” in the present outbreak of COVID-19. Further, the fruit and vegetable being an essential commodity cannot be closed indefinitely in the present lockdown situation. Though with the voluntary consent of the associations of vegetable and other traders of the Cantonment total break down for the period of 03 days i.e. from 06 April to 08 April 2020 except for medical and milk supplies has been observed.

Further, in this regard the Local Police Authorities, Kirkee vide letter no. 149/2020 dated 07 April 2020 (photocopy placed opposite) have suggested for shifting of vegetable market to suitable place wherein proper and effective “Social Distancing” can be maintained and enforced on the vendors as well as buyers as everybody is prone to the attack of the Corona virus COVID-19 as the present location has the constraint of openness.

In view of the above the Defence Estates Officer, Pune Circle, Pune vide this office letter 37/12/COVID-19/P-149 dated 07 April 2020 (photocopy placed opposite) has been requested for according temporary permission for the period up to 15 April 2020 the lockdown period, for use of the open plot on GLR Sy. No. 230, at the junction of Mumbai Pune Road and extended portion of Mula Road, Kirkee classified as B-4 under the management of DEO, Pune being one of the option wherein the entire vegetable and fruit trading can be shifted temporarily with proper and effective maintenance of “Social Distancing” between the vendors and purchasers.

In this connection Circular Agenda dated 07/04/2020, duly approved, is placed on the table.

Z STERILIZATION AND IMMUNIZATION OF STRAY DOGS THROUGH NGO

Reference: i) CBR NO. 20 dated 19.09.2019 and ii) Circular Agenda No. Stray dogs dated 21.08.2020

To note the Circular Agenda dated 24.08.2020 regarding Sterilization and immunization of stray dogs through NGO.

Canine Central and Cure Trust (CCC) a non-profitable organization had given their willingness to conduct dog sterilization, anti rabies vaccination for stray dogs free of cost as per the MOU for the Cantonment Board Kirkee vide their mail received dated 14.10.2019.

Accordingly, Memorandum of understanding for the period 2020-2021 has been prepared and work will be executed after singing of MOU between Canine Central and Cure Trust (CCC) and the Board.

In this connection, the Circular Agenda dated 24/08/2020, duly approved, is placed on the table.

Auction of tree logs was scheduled at 12 pm dated 18.08.2020 at office of the Cantonment Board. Total three bidders were participated and highest rate quoted by token No. 01 (Shri Hussain Qureshi) of Rs. 1,15,000/- has been accepted by this office and further procedure has been completed.

The technical bid of the tender was opened on 14th Aug 2020 and out of 3 Bids 2 Bids were approved by technical bid committee on 27th Aug 2020 and by the FC Chairman on 28th Aug 2020. 1 Bid was rejected as was found not as per technical specifications.

The financial bid was opened on 29th Aug 2020. The details of Bidder are as follows: (Qty 100 box) a) P.V. ENTERPRISES Rs.476000.00 b) Ajay Biotech (India) Ltd Rs 584100.00

The lowest bid is received from P.V. Enterprises (Rs 4760/box) and is reasonable as per past purchase of the hospital (Rs 5841/ per box). In this regard the tender along with all papers is placed before the Board for approval. There is budgetary provision for incurring the expenditure in the funds received from Collector, Pune for Covid.

The technical bids of the tender was opened on 14th Aug 2020 and out of 7 Bids 4 Bids were approved by technical bid committee on 27th Aug 2020 and by the FC Chairman on 28th Aug 2020. 3 Bid were rejected as they were found not as per technical specifications.

The financial bid was opened on 29th Aug 2020. The details of Bidder are as follows: (Qty 12000 Nos) a. Maharashtra Surgical House Rs.1068000.00 b. Austin Health care Rs.1044000.00 c. Nitin Sales Corporation Rs.1200000.00 d. Shriram Enterprises Rs.1476000.00

The lowest bid is received from Austin Health Care (Rate : 87/per No) and is reasonable as per past purchase of the hospital (Rs 89.21/ per No).

In this regard the tender along with all papers is placed before the Board for approval. There is budgetary provision for incurring the expenditure in the funds received from Collector, Pune for Covid.

3. Considered the matter. RMO informed the Board that at the time when the tender was floated, the lowest rate quoted was Rs.87/-. However, the rate has now gone down. The matter was discussed and resolved that as N95 masks are now available in market at much lower price, fresh tender may be floated.

4. APPROVAL FOR PURCHASE OF MEDICINE FOR Dr. B.A.C.G. HOSPITAL, KIRKEE

The above referenced e-tender was done for supply of medicine required in hospital as a rate contract tender. The tender received 7 bids on 19th Aug 2020. The technical bid was evaluated for documents and approved by the technical bid committee on 27th Aug 2020 and by FC, Chairman on 28th Aug 2020. The tender was an item wise tender hence in the technical bid those items not as per Annexure C were not accepted. The financial bid was opened on 29th Aug 2020 as all 7 bids were accepted. 4. Considered and resolved to approve the rates quoted by the L1 Bidders. Shri Manish Anand, Member stated that appreciation letter be given to Shri Sharad Ranpise, Vidhansabha Member who had donated Rs.10 lakhs out of MLA fund for purchase of portable X-ray Machine and Blood Gas Machine, which was agreed to. Shri Manish Anand also brought out that Remdisivir Injections if given at an early stage is very effective in prevention of progression of covid disease. But the MRP is Rs.5400/- per injection which is not affordable for many patients. However, if the Hospital purchase in bulk quantity, then the said injections can be got in concessional rate, i.e Rs.3500/- per injection. He stated that Board can purchase it in bulk in concessional rate and offer to the patients who require it in the same rate. Board agreed and resolved to purchase 60 injections for ten people .

It is submitted that the cases are defended by the CEO as authorized by the Board. However, the rates charged by the above legal firm is not approved by the Board.

Following three Bills have been received from Parinam Law Associates. Part payment has been made and full & final payment will be done after approval of the Board :

In this connection, the Office Note, Bills and other relevant papers are placed on the table for consideration and taking appropriate decision.

5. Considered the matter. CEO informed the Board that all the cases filed in the High Court is being defended by Parinam Law Associates. This firm have changed their name thrice and that their performance is not good as the firm is not putting any effort to win the cases. Also the fees charged by them are exorbitantly high and not as per the fees fixed by the Govt of India, Ministry of Law & Justice. The matter discussed and resolved that the concerned official of Parinam Law Associates be called for examining the cases and the matter be placed before the Board for final decision. Meanwhile, other Advocates may be approached. Legal Cell (LMA) & DEO, Pune Circle is also defending the cases on behalf of Union of India on the rate/charges/fee prescribed by the Govt of India. Hence, those Advocates may be approached and fees may be fixed at double of the prescribed rates by Govt of India. CEO is empowered to defend the court cases and if required, higher charges may be paid to the Advocate with prior permission/consent of President Cantonment Board/ Board.

6. FILING OF THE WRIT PETITION IN THE HON’BLE HIGH COURT MUMBAI. The Regional PF Commissioner vide order No MH/PF/PUN/CIR-I/307755/002 dated 24.08.2017 had ordered Cantonment Board to pay dues of Rs.44,50,115/- towards the EPF of contractual employees. This Board has complied with the order and deposited the entire amount as directed to be deposited as Board had no alternative due to the fact that the Board’s bank accounts were sealed and salaries of the employees and other payments could not be made. Later, in the month of June 2019 the EPF office has issued another notice to this office for payment of Rs. 25,48,302/- as damages against the allied dues towards EPF of employees for the period 2011 to 2015. Now it is noticed by this office that the Enforcement Officer had wrongly calculated the EPF liability and willfully taken the EPF amount of ‘excluded employees’ who were paid salary more than Rs. 6500/- pm. Taking the same ground into consideration, this office has filed Review Application on 22.08.2019 against the order of the Regional PF Commissioner order No MH/PF/PUN/CIR-I/307755/002 dated 24.08.2017. The Review Application filed by this office has been rejected by the Regional PF Commissioner II vide letter No. MH/PF/PUN/COMP/50406/2019-20/822 dated 12.09.2019 on the ground of delay in filing the application. Office had sought legal opinion from service lawyer Adv Shri Sameer Paranjape. In his letter, the lawyer has suggested to approach the High Court Mumbai to file Writ Petition to seek appropriate relief in the matter. Accordingly Office has engaged Parinam Lawyers, Mumbai to defend the case. All relevant documents along with files are kept on the table for recommendation /approval of the Board .

7. FILING OF WRIT PETITION IN THE HON’BLE HIGH COURT MUMBAI AGAINST THE ORDER OF FIRST LABOUR COURT PUNE DATED 19.08.2019

Three contractual staff of this Board was working as “Computer Operator cum Clerk” from 2011 to 2018 with regular intervals /breaks till May 2018. From June-2018 they were not given further engagement as there was no requirement of their services.

Thereafter these contractual staff had filed Application in First Labour Court Pune. The Hon’ble Court has passed an order dt. 19.08.2019 that “ The first party is hereby directed to maintain ante-status quo and allow second party workmen to resume work temporarily on their original post on contract basis as they were working as on 31.06.2018,till final disposal of the reference.

This office is of the view that Writ Petition may be filed in the Hon’ble High Court Mumbai against the order of the First Labour Court dt 19.08.2019.

All relevant documents along with files are kept on the table for approval of the Board.

8. Payment of Dearness allowance to Contractual teachers of Dr Zakir Urdu High School and Moledina Primary School .

One contractual Teacher of Dr Zakir Hussain Urdu High School and four contractual teachers of Moledina Primary School have filed Writ Petition No. 10058 of 2015 in Mumbai High court requesting for permanent employment in Kirkee Cantonment Board.

The Mumbai High passed an order that “the respondents are directed to continue the services of the petitioners , on the same basis as they continue at present, until further order”.

Accordingly the Petitioner are continued on contractual services as directions of the Hon’ble High court. Meanwhile the Petitioners have served another application in the same matter requesting to get the benefits ‘equal pay for equal work’ with reference to the judgment of the Hon’ble Supreme Court in the matter of State of Punjab and others v/s Jagjit Singh and others.

This office inadvertently paid the salary to the Petitioners as per ‘equal pay equal work’ from the month of Nov 2017 and released the arrears w e f 01.12.2016 upto Oct 2017. Later on in June 2019 when it was noticed that the concept of the ‘equal pay and equal work’ is applicable only when the duties and responsibilities, as were being discharged by the regular employee, are same.

As the contractual teachers are engaged only for teaching purpose and are not similar to the duties/responsibilities , as being discharged by permanent teachers, the salary of the Petitioners have been rectified and fixed with that of the other contractual teachers i e for Rs. 16080/- pm. (for D Ed). The Petitioners have filed Civil Application No. 24427 of 2019 for grant of dearness allowance as per the permanent employees. The Hon’ble High Court has ordered that let the Cantonment Board release the salary of Rs. 26,810/- to the Petitioners. Parinam Lawyers, Mumbai is defending on behalf of the Board

8. Considered the matter. The Petitioners are being paid Rs.26,810/- as per the Order of the Hon’ble High Court dated 06/01/2020. CEO/Cantonment officials may defend the case in the interest of Kirkee Cantonment Board.

9. SUPPLY OF PURE SERVICES (FIREMAN &DRIVER) UNDER “FIRE SERVICES FOR CANTONMENT BOARDS KHADKI

To consider the office report submitted by the Health & Garden Superintendent regarding tender for supply of pure service of (Fireman & Driver)

Tender for the subject work was published in Indian Express (in English), Maharashtra Times (in Marathi) and Bharat Diary (in Hindi) on 03rd September 2019 and was also put up on Notice Board and official website.

Documents uploaded by the tenderer were verified in the technical bid by the Committee members and it was observed that out of 04 bidders only 03 were qualified in the technical bid.

Hence, financial bid of 03 qualified bidders were opened and its details are as follows.

Report of HS/GS:-

Lowest rate received from M/s Hi-Tech Services, Pune is Rs. 862/- per day per fireman (inclusive of Basic, VDA, PF, ESI and Service charges, inclusive of all necessary taxes & charges) i.e. Rs. 25860/- per month for 30 days. Rate received is reasonable as per prevailing market price. Present rate of Fireman per month is Rs. 29,582/- which is being hired and is inclusive of all taxes, material charges if any & GST charges). However, now the GST charges is not being paid.

As per letter received from M/s Hi-Tech Services, they are willing to reduce the service charges quoted by them in the tender for “Pure services of Fireman & driver’ vide tender notice dated 03.09.2020. The service charge quoted by M/s. Hi-Tech Services was 15%. Now the contractor has shown his willingness to reduce his services charges upto 5%.

According to CBR NO. 9 dated 15.04.2017 it was resolved that since Fire Brigade staff is presently inadequate, additional posts have to be created and proposal be forwarded to the higher authorities for sanction to appoint them on permanent basis. Shri Abhay Sawant, Member requested that till the time permanent staff are appointed, considering the essential requirement temporary well-trained staff may be engaged till the time permanent staff are appointed.

Accordingly trained fireman and driver were deployed through Agency on rates received through quotation.

Full set up of fire brigade is essential to prevent /fight disaster and for safety of resident of the Board, PMC and PCMC area. In addition, regular works of trimming of road side trees will also be carried out through Fire Brigade staff. Fire training is also conducted in Civil and Military school areas. Hence deployment of trained fireman & driver are essential.

9. Considered & Noted the Circular Agenda dated 02/03/2020 .

10. Necessary correction in Agreement executed between Kirkee Cantonment Board with M/s J.K.Tourist for the year from July 2018 to June 2019 & from 1st July 2019 to June 2020.

To consider the office note submitted by Health and Garden Sudpt regarding Agreement executed for subject matter.

Vide FCR NO. 09 dated 12.04.2018 as confirmed by CBR No. 03 dated 27.04.2018 the Board had hired 38 nos. of four wheeler hydraulic hooper tempos to be used as Ghanta gadies for collection of garbage from house to house in Military, AFK and Civil area of the Board having loading capacity of minimum 700 kg to maximum 750 kg capacity from M/s. J.K.Tourist and Transport, Gadital, , Pune 411 028 w.e.f 1st July 2018

Out of 38 nos. of Ghanta gadi vehicles, Station Headquarters were given total 22 nos. of Garbage collection vehicles of which they have reduced 08 Nos. of Ghata Gadi. Details of Sanction received and service provided is as follows.

Actual services of 08 Ghanta gadi was reduced from Conservancy Agreement w.e.f. May 2019. As per the Administrative sanction letter No. IFA, SC, Consy-Kirkee/ 20-21/AON/4542 dated 17.01.2020 received from IFA,SC,Pune for the period from 1st March 2020 to Feb 2021 is Rs. 89,19,137/-. Accordingly contractor was asked his willingness for the same. In reply contractor has sent letter informing that he is ready to provide only 09 vehicles in sanction rate given by CFA & IFA. Garbage collection vehicles are used for Stn. Hqrs 09 nos, for AFK 08 nos. and Civil area 08 nos.

Though, tender for the subject work was floated for 03 years but Agreement was executed and work order was issued for the initial period of one year which was from 1st July 2018 to 31st June 2019.

Period of subject tender was for 03 years and to avoid interruption in such essential services, the services is continued till date.

During meeting held on 13.01.2020 with IFA along with Adm. Comdt. Stn. Hqrs at IFA, SC, Pune, it was discussed that IFA are ready to give sanction by 5% increase on existing rate for 2nd year and 3rd year. Also they have informed to change the heading of the work of Ghanta Gadi to Garbage Collection Vehicles and to remove the word of “Door to Door Garbage Collection” from the agreement.

As per Municipal Solid Waste Management Rules, Garbage collection has to be segregated in Wet and Dry format for easy disposal, though tender clause is that “The contractor and his employees shall strictly follow MSW Rule” and “The Contractor has to make arrangement for separation of dry and wet garbage and dump the same at site directed by the Chief Executive Officer/Health Superintendent.

As per MSW Rule, the waste generator has to pay necessary charges and Urban local body has to collect separate charges from waste generator in this connection Board has already given the approval vide CBR No. 03 dated 27.04.2018 and it was resolved that amount of Rs. 60 per house be collected from house where services are provided.

It is therefore requested that agreement executed may be corrected in initial year and 02 year period as mentioned above while point regarding collection of charges from house to house for collection of waste into dry and wet format may also be included in the Agreement

In this connection all relevant documents are placed on the table

10. Considered the matter. Shri B.S.Naik, HS/GS informed the Board that in the month of May 2019, IFA in the presence of the then CEO and then PCB clarified that the word “Garbage Lifting Vehicles” should be used instead of “Ghanta Gadi” and again in Jan 2020, the same has been reiterated by the IFA.

CEO informed the Board that the segregation of garbage is not being done properly and Trenching Ground is also not being maintained as per expectation. Hence, HS/GS should pay attention over such issues as Board is incurring expenditure on garbage disposal. Scientific disposal is required and segregation of garbage is mandatory. Col.Anirudha Suryawanshi, Member (Adm.Officer, BEG) informed that Door to Door collection will be implemented in Military area through RWA and Swach NGO is also being approached.

Also, as regards separate charges from waste generator , resolved that a clause be included in the Agreement that the responsibility lies with the contractor to collect Rs.60/- per house where services are provided.

11. DRAFT BYE-LAWS OF SOLID WASTE MANAGEMENT

Reference: Letter No. 76/38/Rules/MSW Rules/C/DE/17, dated 02.12.2019 received from DGDE,

To consider the Office report submitted by the HS/GS regarding Draft Bye-Laws of Solid Waste Management.

The Kirkee Cantonment Board has made Draft Solid Waste Management Bye-Laws on the basis of Delhi Cantonment Board and considering the local conditions/geographic feature of Kirkee Cantonment Board.

Draft bye-laws of Kirkee Cantonment Board is placed on the table for approval.

11. Considered and approved.

12. HIRING LABOURS SERVICES FOR NIGHT SHIFT THORUGH GeM PORTAL

Reference; i) Approval received from President of the Board

With reference to above referred approval received from the President, Cantonment Board regarding Bid received on GeM for 20 labours for night shift for working in Bazaar area, this office had received a list of 29 L1 technically qualified Seller from the system at total price of Rs.59,56,200.72 yearly for 20 labours i,e, Rs. 24,817.50 per labour per month inclusive of taxes and charges. For Safer side “Run L1 Selection” was adopted wherein System automatically select L1.Accordingly System has selected L1 i.e., M/s Ambika Associate, Hadapsar, Pune

Now, total process of GeM has been completed and new contract has also been started w.e.f. 17th February 2020. Therefore the period of existing contractor M/s Shubham Enterprises which was concluded on 31.12.2019 was extended till 16th February 2020 which also may be approved.

13. REMOVAL OF WATER HYCINTH FROM WITHIN KHADKI CANTONMENT LIMITS.

Reference C.B.R No.18 dated 19/09/2019 To consider the office report submitted by Health & Garden Superintendent regarding removal of water hyacinth from Mula river within Jurisdiction of Kirkee Cantonment Board.

Letter was written to Municipal Corporation vide letter No.3/3/Water Hyacinth/P-221 dated 07/11/2019 and letter No.3/3/Water Hyacinth/P-223 dated 08/11/2019 and also the site was visited by HSGS on 13th Feb 2020 and had discussion with Shri Hanumant Dhore, Sr. Clerk, Mob No.9730934639. It was understood that PCMC had floated tender for removal and disposal of Water Hyacinth two times wherein only one and the same contractor had participated in the tender process. Further the proposal is to be considered by the PCMC in their Standing Committee meeting which is expected soon.

It is further informed that the Water Hyacinth has started floating in the river bed passing through KCB limit.

Holkar bridge was visited by the CEO along with Board Members Shri Manish Anand, Mrs Pooja Anand and Shri Abhay Sawant on 15th Feb 2020, and it was decided to clear the bolders/Concrete slab underneath the Holkar Bridge which was obstructing the river water down flow. Accordingly work of clearing the water flow has been started with the help of JCB from 15th Feb 2020.

13. The matter discussed in detail. Smt.Pooja Anand, Member brought up that the water hyacinth flows from PCMC area and get stagnated in Mula river. She suggested that a boom may be erected near Kirloskar Oil Engine which will stop the water hyacinth from flowing to Mula river. She requested the President Cantonment Board to get permission from CME Commandant for erecting boom in their area which was agreed to. Smt.Anand also brought out that Kirkee Cantonment is spending on repairs & maintenance of street lights/roads which come under PCMC area which need to be addressed. President, Cantonment Board informed that he will have a meeting with the PCMC Commissioner and asked the members to prepare the agenda points that need to be discussed.

CEO apprised that for hiring of additional manpower, a letter has been sent to the PD,DE,SC under Section 89(3) of CBAR 2020.

14. STERLIZATION OF DOG

Reference : C.B.R No.20, dated 19/09/2019.

To consider the office reported submitted by HS/GS regarding subject matter.

Canine Central and Cure Trust (CCC) a non-profit organization had given their willingness to conduct dog sterilization, anti rabbies vaccination for stray dog free of cost, on certain terms and conditions for Kirkee Cantonment Board as per their mail dated 14th Oct 2019.

Accordingly Cantonment Dog Canal was visited jointly and as per the request from CCC, certain repair/alternation was to be done at the site, and the same has been done by Engineering Section.

Further a draft MOU was forwarded by Cantonment Board Kirkee to C.C.C on dated 20th Dec 2019 for which C.C.C has replied to this Office vide their mail dated 4th Feb 2020. Two points mentioned in the draft MOU are not included in the draft which CCC has forwarded to this Office as under :

Point No.22 MOU shall be governed by the Indian laws. All the disputes between the parties to the MOU arising out of the MOU other than those for which the decision of the Kirkee Cantonment Board in final and conclusive, after the written notice given by the either party be referred to a sole Arbitrator who shall be the Principal Director, Defense Estate, Southern Command, Pune. The award of the Arbitrator shall be final conclusive and binding on the parties as per the sections 325 to 330 of Cantonment Act 2006

Point No.23 In case the NGO is entitled for any claim towards grant from any Govt/Semi Govt/ any other organization for the above activities it shall be the responsibility of the NGO to keep informed the Chief Executive Officer Kirkee Cantonment Board from time to time. In case of failure on the part of NGO Chief Executive Officer/Board may cancel the MOU with immediate effect without any further notice.

Further this office is also in receipt of letter from Institute of Nature Science (INS) where in they are also willing to give the services free of cost and as per the terms and conditions laid down by Kirkee Cantonment Board.

All relevant papers along with the report of HS/GS is placed on the table.

14. Considered the matter. The Board felt that sterilization of dogs and anti-rabbies vaccination which the NGO had agreed to provide free of cost does not seem to be feasible. Shri Manish Anand, Member stated that he will check the status and give an update to the Board. Shri Abhay Sawant, Member informed that the Board have spent Rs.30 lakhs on sterilization of dogs and vaccination, but there was no proper monitoring. CEO informed that if NGO will charge Rs.500/-, then fresh tendering should be done or the other NGO should be called who already approached the Board for providing services at free of cost.

15. NON REVISION OF LICENCE FEES IN RESPECT OF OFFICERS AND STAFF STAYING AT CANTONMENT BOARD QUARTERS.

To consider the office report of the CA dated 21/09/2020. It is submitted that Regional Audit Officer, Kirkee vide their letter No.RAK/508/KCB/Annual Accounts dated 25.10.2019 have raised objection regarding Non Revision of Licence Fees in respect of Officers and staff staying at Cantonment Board Quarters. Approximate Rs.36 lacs to be recovered from Officers and staff staying in Cantonment Board Quarters calculated for about 10 years. Normally the Board is recovering Room Rent Recovery monthly from the paybills as per Swamy’s Hand Book of Licence Fee rates.

This office is deducting the Room Rent as follows per month r category wise as follows:-

Class II = Rs. 143.00 RMO Quarter Class II = Rs. 293.00 New Doctors Quarter Class II = Rs. 217.00 Near Akash Deep Class III = Rs. 143.00 Nurses Quarter Class IV = Rs. 143.00 Gadi Adda

The Quarters are allotted to the Government employees as per the level in the Pay Matrix corresponding to the type of residence. The Licence Fee to be recovered in the revised rates according to type of accommodation, and as per range of living area in Sq.mtr.

The matter is placed before the Board for further decision in the matter.

15. Considered the matter. The elected members informed the Board that being Autonomous Body, Board should consider waiving of the arrears to be recovered from the staff considering the welfare of its own employees. The Board resolved that the audit objection be accordingly replied.

16. NON RECOVERY OF WATER CHARGES IN RESPECT OF OFFICERS AND STAFF STAYING IN CANTONMENT BOARD QUARTERS. APPROXIATE RS.34 LACS TO BE RECOVERED FROM OFFICERS AND STAFF STAYING IN CANTONMENT QUARTERS CALCULATED FOR ABOUT 10 YEARS.

To consider the office note of the CA dated 21/09/2020. It is submitted that observation has been raised by Regional Audit Officer, Kirkee vide letter No.RAK/508/KCB/Annual Accounts dated 25.10.2019 regarding non recovery of water charges in respect of officers and staff staying in Cantonment Board Quarters. Approximate Rs.34 lacs is to be recovered from Officers and staff staying in Cantonment Quarters calculated for about 10 years.

In this regard it is submitted that water to the residents of Kirkee Cantonment is supplied by Pune Municipal Corporation and the bill raised by the PMC for water supply is paid by Cantonment Board for Cantonment Fund Properties.

The matter is placed before the Board for further decision in the matter.

16. Considered the matter. Shri Manish Anand, Member stated that many Quarters are not receiving drinking water and that staff have to come down from third floor to get water from the tap down. When asked, the CEE informed that approx. 50% quarters have water scarcity . Resolved that Rs,10/- per month be charged as Water charges from those quarters who get water. Shri Duryodhan Bhapkar, Vice President informed the Hon’ble MLA that the water pipelines laid in Kirkee Cantt area are very old and PMC authorities should repair and maintain the pipelines . He requested the MLA to get the pipelines replaced where it is totally rusted and to repair wherever required through PMC. VP also informed the Hon,ble MLA that water supply to Kirkee Cantt residents is received from Chatursinghi and the water pressure is very low and that too the water is released very late. He requested Shri Shirole to help Kirkee Cantt area receive water from Holkar Water Works. Shri Sidharth Shirole, Hon’ble MLA informed the Board that he will take up the issue of replacing old water pipelines and regarding scarcity of water in Kirkee Cantt area. He also informed the Board that he has taken up the following issues with the Ministry :

i) To include Kirkee Cantonment member in the DPC ii) To sanction Rs.5 Crores fund for development works iii) To grant GST share iv) To grant Primary School Grant to Board’s Primary Schools

CEO informed that PMC Water Department is habitual to dig the road for laying of water pipelines without the permission of the Board. Recently Kirkee Cantonment Board faced embarrassment before the general public when PMC had digged the road and caused inconvenience to the public. Hence KCB has raised the Bill of Rs. 11.50 lacswith PMC. Accordingly, Board may also calculate the expenditure made towards digging of roads till date and bill should be raised to PMC including the demolition cost of Over Head Water Tank, which was agreed to.

17. ENGAGEMENT OF CHARTED ACCOUNTANT FOR COMPLETE IMPLEMENTATION OF CBAR-2020 AND ACCRUAL BASE ACCOUNTING SYSTEM IN KIRKEE CANTONMENT BOARD

The Cantonment Board Account Rule -2020 has been made functional in all 62 Cantonment Boards in place of Cantonment Account Code 1924. Therefore, there are huge changes in all forms/procedures to be utilized/followed in all Cantonment Boards. Similarly Accrued Based Accounting System (ABAS) I also part of the CBAR 2020. Earlier Cash Based Accounting system was operational. But now Accrued Based Accounting System(ABAS) is followed, which is integral part of the CBAR-2020.

As per instructions received time to time regarding implementation of ABAS, Charted Accountant was engaged by this office to understand the new rule and to make it regular procedure by the staff. Since Accounting is itself very complicated and technical subject and hence there was requirement of Charted Accountant. This office had engaged M/s.Prakash Mahendra Vinod & Co. for the work of implementation of ABAS. Their previous contract got over in the month of June 2020 and they have given their letter for renewal of the contract for further period of one year, ie.01-07-2020 to 30-06-2020, on the same terms & conditions except increase in the remuneration / consultation fees from Rs.35,000/- per month to Rs.40,000/- per month.

Since there are lot of ‘if’s and buts’ in the CBAR-2020 and on each and every step, there is requirement of technically sound person in Accounts system, this Board may engage M/s.Prakash Mahendra Vinod & Co for next one year at the cost Rs.40,000/- per month as their consultation fees.

In this regard Office Report submitted by Accountant and Programmer is placed on the table alongwith their request letter.

17. Considered and approved. The work of Implementation of CBAR 2020 and ABAS be monitored and ensured that the work is being carried out properly. Board further resolved that the service of the Chartered Accountant should be utilised for internal audits also.

Shri Duryodhan Bhapkar, VP stated that considering the present pandemic situation, the Board should allow all the eight applicants to run the Medical Store as it is the need of the hour. CEO stated that the remaining three applications cannot be considered as there is violation and does not fit in the rule. After detailed deliberations, the Board resolved that NOC be granted to the above five applicants only.

CEO also brought to the notice of the Board regarding a Fake NOC submitted by one Shri Wasim Ashfaque Sayyed to Food & Drug Administration. The office have filed a written complaint at the local police station in this regard. A letter has also been written to the Food & Drug Administration intimating them about the fake NOC with a request to consult the Cantonment Board office before issue of any such license in Kirkee, in public interest.

Shri Duryodhan Bhapkar, Vice President, Shri Manish Anand, Member and other members raised the issue that due to objection letter issued by Kirkee Cantonment Board, the Food & Drug Adminitration office is not issuing license. Hence Board resolved to apprise the Food & Drug Administration that objection was raised by Kirkee Cantonment only pertaining to individual case. Hence other cases should be dealt by the said office in accordabnce with their own rules & regulations in public interest.

19. BLACK TOPPING OF ROADS OF ORDNANCE AND OTHER ROADS IN KIRKEE CANTONMENT BOARD LIMITS (II CALL )

To consider the office report dated 06 Dec. 2019 regarding E-Tenders for the work “Black topping of roads of Ordnance and other roads in Kirkee Cantonment limits” (II Call) scheduled to be received upto 16 Oct. 2019 in response to the tender advertisement issued vide this office letter AE/Tender/2019-2020/P-79dated 20 Sept. 2019 and published in Times of India, Pudhari and Bharat Dairy.

Accordingly, the technical bid was opened on 30 Oct. 2019 as per schedule specified in the tender notice in which three tenders were received from the following tenderer:-

1. M/s K R Traders. 2. M/s Paveway Construction Pvt. Ltd. 3. M/s Sunshine Ventures

The financial bid/BOQ of above mentioned tenderers was opened on 02 Nov. 2019. Details of the rates received are as detailed below:- Amount Quoted (Rs.) for an S. No. Name of the Tenderer estimate of Rs.40,00,000/- based MES SSR 2010.

As per the report of the Engineering Section the lowest tenderer M/s Paveway Construction Pvt. Ltd has quoted Rs.59,21,370/- which is 47.94% above MES SSR 2010 as regards SSR items. This lowest rate, when compared with the corresponding lowest rates accepted by the Board in Sept. 2019 works out to 43.76% above. The detailed comparative statement is placed opposite. Further, as compared with the forecast percentage as issued by the Chief Engineer, Pune Zone for the period ending Sept. 2019 which is 70% above MES SSR 2010, the rates quoted by the lowest tenderer seems to be reasonable. However, the funds for the same from the Government of Maharashtra have not been received.

In this connection the office report along with other relevant papers are placed on table for consideration and decision.

19. Considered the matter and resolved that the tender be cancelled and EMD be returned to the contractor as funds have not been received from the State Government.

21. STRUCTURAL AUDIT OF CANTONMENT BOARD’S MARKET BUILDINGS, KIRKEE.

To consider the structural audit report submitted by the College of Engineering, Pune vide COEP/Civil/Cons/IPS/2019/2057 dated 20 Nov. 2019 pertaining to the Cantonment Board’s market buildings.

During the site inspection of the President, Cantonment Board, Kirkee on 17 Sept. 2019 of the Cantonment Board Market Square, Kirkee along with the CEO; Col. K.K.Giri & Shri Kamlesh S Chaskar, Members, Kirkee Cantonment Board; it was directed by the PCB that a Structural Audit of the dilapidated and dangerous structures in the Cantonment Market Square done through Government College of Engineering, Pune for taking further decision in the matter. Accordingly, correspondence was made with the Civil Engineering Department of Government College, Pune requesting for undertaking Structural Audit of Cantonment Board’s market square. In reply the College of Engineering, Pune demanded payment of Rs. 2,00,000/- (Rupees Two Lakhs only) for undertaking Structural Audit of old commercial market building A and Building B at Kirkee Bazar, which was paid on approval of PCB. In this connection the structural audit report submitted by the College of Engineering, Pune along with other relevant papers are placed on table for consideration and decision.

21. Considered and noted. Resolved that final notice be issued to all the occupants for vacating the dilapidated market. Board clarified that after Sturctural Audit, the occupant of shops should be apprised through public notice tht Kirkee Cantonment Board will not be responsible for any casualty occurred in future and the responsibility lies with the occupier if they are willfully not vacating the shops which are in dangerous condition. Further Revenue Section to assess the details of arrears of rent to be recovered from the authorized stall holders. Also to prepare detailed list of all occupants vis-à-vis original allottees of these stalls.

22. SHIFTING OF EXISTING VEF CHECK POST

To consider the Office report of CRS dated 23/01/2020 regarding shifting of existing VEF Check Posts. M/s. Solapur Construction & Fabrication Pvt. Ltd, existing contractor for collection of Licence Fees on entry of Vehicles in Kirkee Cantonment limits, has submitted above letter requesting to shift the below said existing VEF Check Post.

In this regard, it is stated that after carrying physical verification at above VEF check post sites, following points were observed.

1. It is found that vehicles entering from Pune-Mumbai Highway are passing through CAFVD ground / MT Store Yard and further pass through Nehru Road towards Vishrantwadi via Tank Road. Hence it is necessary to shift Check Post No. 11 Opp. St. Joseph School and Check Post No. 1 Range Hills (Near Shiv Mandir) near CAFVD ground / MT Store Yard for entry and exit of vehicles.

2. It is found that vehicles coming from Pune on Pune-Mumbai Highway are entering in Cantonment area and are passing through Raja Bungalow dodging / escaping present VEF check post (Check Post No. 6 {At Burr Road Nr Pump House} & 7 (Pune- Mumbai Road Opp. Post Office). The check post No. 6 can be shifted near CQA (A) Officer’s Mess. This will also avoid traffic congestion near CAFVD.

3. As Ammunition Factory, Kirkee has opened the Tank Road for vehicles entering / exiting from / to Vishrantwadi, a large number of vehicles are passing through the area and avoiding entry fee. A lot of traffic congestion is created at Nehru Garden junction and crossing of Commisiorate road and Elphinstone Road. Moreover the matter was discussed in Board vide CBR No. 5 dated 19/09/2019 and it was resolved tht the mtter be taken up with AFK & HEF authorities from safety and security point of view and if necessary, entry post may be shifted near Nehru Garden.

As per tender condition No. 5 and Agreement Clause No.5, CEO in his discretion may allow more Check Posts to be set up or change the location of present Check Post. Further as per tender condition no. 27, the Check Post alongwith Electricity connection is provided by the Cantonment Board to the contractor and accordingly they are handed over.

In view of the above, the request of contractor may be considered to avoid the vehicles passising through Kirkee Cantt area without paying Vehicle Entry Fee and moreover to avoid traffic congestion which is becoming a major problem in Cantt. Area. In this connection all Relevant documents are placed on the table.

22. Considered and resolved that as the current tender period is expiring shortly, additional Check Posts be included in the fresh tender.

23. Considered the matter. Members raised that rates should be revised periodically and not in one instance. It was proposed to increase the existing rates @ 50% and later on the same rates may be increased @ 5% every year . However, after detailed deliberations, it was resolved to constitute a Committee under the chairmanship of Shri Duryodhan T.Bhapkar, VP along with members, namely, Shri Kamlesh Chaskar, (2) Shri Manish Anand, (3) Ms.Kartiki Hiwarkar, (4) Shri Abhay Sawant and (5) Smt.Vaishali Pahilwan who will study and submit their report before the ensuing Board, recommending the rates to be revised for taking appropriate decision.

24. BRIEF DETAILS REGARDING ACTIVITES RELATED TO COVID TRETAMENT / MANAGEMENT IN KIRKEE CANTONMENT AREA.

To consider the office report regrading various activities related to Covid treatment / management in Kirkee Cantonment area.

i) Overall efforts made by the Board, PCB, CEO, Members, staff and volunteers to fight Corona Pandemic. Efforts of PCB – in the role of leader with visionary power

a) Numbers of periodic meetings for appraisal of the situation. b) Moral boosting of all the Members, staff and general public. c) Approval of daily orders of declaration of Containment Zones; operation of trade & business in the Cantonment.

Efforts of Members – as a motivator and on ground warrior

a) Multiple review meetings at various levels for assessing the situation. b) Education and motivation for co-operation from general public. c) Volunteers for door to door contact tracings. d) Instrumental in conducting Mohalla and flu clinics with private doctors who have rendered volunteer services. e) Collection of donations through CSRs and other social workers. f) Active discussions with District Authorities, District Health Authorities; Municipal Corporations, etc. g) Distribution of food packets (raw & cooked), operation of community kitchen was provided free of cost during lockdown period. h) Arrangement of transportation for migrant labours through Police authorities. i) Effective crowd control by way shifting Vegetable market as Role Model Vegetable Market.

Efforts of Cantonment Staff – Corona Warriors

a) Almost 700 health workers including supervisory staff regularly attended and performed their duties with use of regular preventive gears while working. b) Serious note for containment of spread of the Virus in the Cantonment area was taken at the very initial stage without any relaxation. c) Active liaison with all the concerned authorities like police deptt. etc.

ii) Specific activities under-taken on a long-term basis like permitting CGH as COVID Hospital, creating quarantine centers (capacity and facilities provided), action taken as CEO/Incident Commander, help to migrant labours (if any), door to door survey, plant & machinery arranged for sanitation / treatment etc.

Actions of CEO/Incident Commander – Effective Planner; Executor and Achiever.

a) Declaration of around 300 micro-containment zones since April 2020 on daily basis as per detection of COVID positive patients. b) Complete lockdown has been observed in the Cantonment area as per detection of patients. c) Implication of lockdown as per orders issued by Government of India; Government of Maharashtra and District Authorities from time to time. d) Regulation of trade/business in the Bazar area as per number of positive patients at given point of time. e) Issuance of clear and effective multiple orders on day to day basis. f) Setting up of harsh punitive measures against the defaulters of violation of preventive measures like social distancing; use of masks; use of sanitizers; operation of timing of trades/business in the Bazar area. g) Wide publicity among the general public regarding education by use of hand bills, banners, public address system. h) The entire team of CEO, Elected Members & Staff were present for the service of the public on ground for 24 x 7.

Action for creation of DCHC & CCC

a) With visionary approach of KCB team, the Cantonment Hospital was decided to be declared as Dedicated Covid Health Centre (DCHC) at very preliminary stage of the pandemic and accordingly sanction was obtained from the District Health Authorities vide letter no. 5428-32/20 dated 17 April 2020 for DCHC. b) Capacity & facilities – 60 bedded with all ultra-modern equipments & testing facilities with free food with excellent logistics. c) Similarly, with clear conception for treatment of asymptomatic patients the Cantonment Board’s Sports Complex was decided to be established as Quarantine Centre. The CCC was sanctioned by the District Collector and Chairman, District Disaster Management Authority, Pune vide letter no. 146/2020 dated 23 April 2020. d) Capacity & facilities – 40 bedded with free food with excellent logistics & medical facilities. e) Later on Cantonment Board’s School was also converted into Covid Care Centre (CCC) with 72 beds. f) Recently even AFK’s Hospital has been converted into 30 bedded CCC. g) Total 202 bedded capacity as DCHC & CCC. h) In addition to the above tie-up was made with Army Hospital for treatment of serious patients in their ICU.

Sanitization & Plant/ machinery

a) Fogging as well as sanitization with Sodium Hypochloride of area with jetting machines, battery operated rickshaws; battery operated pumps; fire-brigade vehicle for spraying immediately on detection of positive patients. b) All the public toilet blocks, bazar & residential areas were sanitized throughout the day with mechanized jetting machines. c) All the solid/medical waste generated from DCHC; CCCs & patients under home isolation disposed through incineration by a private agency.

Migrant Labours (moving) & Door to door survey

a) Cantonment teachers were allotted duties of contact tracing and establishing of Mohalla Clinics. b) Contact tracing and detection of high-risk contacts. c) Swabs taken on daily basis of all high-risk contacts. d) Distribution of food packets through NGOs to needy residents & moving migrants during lockdown period for restriction of movement of general public. iii) Efforts made with the State Government /LMA to receive funds or services / kits / medicines etc.

a) Entire exercise of Containment and treatment done through the funds received District Authorities. b) An amount of Rs. 50 lacs (under SDRF) & Rs.226 lacs (under DPDC) have been received by the Cantonment Board from the District authorities. c) Additional amount of Rs. 13.50 lacs have been received out of MP/MLA funds. d) Equipment/other material worth of Rs.80 – 100 lacs have been received through donation from various sources. e) Proposal for establishing an ICU in the Cantonment Hospital sought through State Government. f) Request submitted to the District Collector for release of funds of Rs.616 lacs through SDRF for medical kits; food/meals; medical & para-medical staff; etc. Of the above an amount of Rs. 318 lacs is under process.

iv) Total No. of COVID patients admitted in CGH till 21.09.2020, cured, expired and under treatment.

a) Effectively, 202 bedded DCHC & CCC has been established for general public of the Cantonment area as well as adjoining Municipal Corporation area. b) DCHC has 60 bedded capacity with all facilities – oxygen with pipeline & cylinder; X-Ray; Pathological tests; IDSP; food for patients (03 times meals & tea- coffee). c) Manpower and equipment put into service since the very beginning of the detection of positive patients in the Cantonment area. d) Appreciable care is being taken of the positive patients admitted in the Cantonment Hospital. e) In Cantonment Hospital even Non-Covid patients are being treated including Maternity and other OPD cases. vi) Medical staff available for COVID patients.

Prime Minister for the Covid period. c) All the orders are being published through electronic media on you tube and through Whatsapp & public announcements. d) All the orders, information and other details are placed of Cantonment Board official website for general public.

Public notice for inviting objections/claims for proposed transfer has been called vide this office letter No.268-B dated 13/09/2017 by publishing advertisement in Newspaper ‘Sakal Times” in English & “Prabhat” in Marathi dated 06/10/2017 and no claims and objections for the same were received during the notice period.

Although the matter was considered in the Board meeting it was resolved vide CBR No.85 dated 19/09/2019 that legal opinion be obtained from the CLA as prior permission for sale/purchase of the Old Grant rights of the subject property has not been taken and CEO to take suitable action based on the legal opinion. As per CLA’s Opinion dated 15/11/2019 Cantonment Board is competent to compound the issue as per provisions of Sec.81(6) of CA.2006.

In this regard kindly refer Military Land Manual Page No.254 para 2(ii) & (iii)

(ii) For powers of Cantonment Board to sanction the transfer of sites held on ‘Old Grant’ term from one party to another and which are situated in areas in class II cantonments which have been declared by notification under section 46 of the Cantonments Act, to be bazar areas, or which are situated in areas in Class I, II, III, Cantonments which have notified as bazar under Rule 2(b) Cantonment Land Administrative Rule 1937. See Note(vi) to Rule 46, Cantonment Land Administration Rule.

(iii) In areas in Cantonments other than those mentioned in (ii) above, local commanding officers should not accord permission to the transfer until the consent of the Government of India has been previously obtained through the quartermaster General in India.

Further the above intimation read with Government of India, Ministry of Defence letter No.31/3/L/L&C-36/7260-L/D(C&L) dt.16/11/1962, para (2) states-

“(2) Government of India have given carefully consideration to the matter and have decided that hereinafter change in the use of notified areas, shall not be sanctioned by Board without the previous sanction of the Central Government. All cases not yet finalized should be dealt with accordingly)”.

From the above it is clear that the Cantonment Board have authority to sanction the transfer of sites held on ‘Old Grant’ term from one party to another in the case which do not involve change in use or sub-division of site or erection of additional buildings within notified civil area.

However Board as per Section(81(6) of the Cantonment Act 2006 may charge for compulsory late tendering fee, but not for condonation of not seeking prior permission for sale/purchase of the property

Further the above intimation read with Government of India, Ministry of Defence letter No.31/3/L/L&C-36/7260-L/D(C&L) dt.16/11/1962, para (2) states-

“(2) Government of India have given carefully consideration to the matter and have decided that hereinafter change in the use of notified areas, shall not be sanctioned by Board without the previous sanction of the Central Government all cases not yet finalized should be dealt with accordingly)”.

From the above it is clear that the Cantonment Board have authority to sanction the transfer of sites held on ‘Old Grant’ term from one party to another in the case which do not involve change in use or sub-division of site or erection of additional buildings within notified civil area.

However Board as per Section(81(6) of the Cantonment Act 2006 may change for compulsory late tendering fee, but not for condonation of not seeking prior permission for sale/purchase of the property

As per CLA’s opinion dated 30/05/2015, documents on record seems to be correct & recommended for change in name on the strength of Gazette.

34. Considered & recommended to approve the Change in name in respect of House No.41 GLR Sy. No. 280/19 East Kirkee “Shri Arun Mahadeo Kondegal” in place of “Suresh Mahadeo Kodegal” along with other recorded HOR and necessary entries be made in the GLR / Taxation register subject the following and payment of necessary transfer fee.

a) The transferee will not be entitled to have greater right than those of the transferor & as entered in GLR.

b) All the taxes/dues should be cleared till the end of the current financial year.

c) Area mentioned in the GLR only is recognized for mutation purpose and the transferee cannot claim any more land/premises.

d) The Board will not be liable if any litigation arises in due course regarding the. mutation.

e) Admission deed should be executed before effecting the transfer.

f) The Board can cancel the said transfer any time if it satisfied that the said transfer was incorrectly done due to suppression of facts or providing incorrect facts by you.

35) SALE PERMISSION IN RESPECT OF HOUSE NO.57 EAST KIRKEE, SY NO.280/67, KIRKEE, PUNE 411003.

To consider the office note dated 16/03/2020 . Shri Ajit B.Matkar Residing at 57, Line Bazar, East Kirkee, Pune- 3, vide their application under reference has requested to issue him Permission/No Objection Certificate for sale of occupancy rights of House No.57, East Kirkee.

GLR STATUS: As per GLR the property of House No.57, East Kirkee, situated within the Civil Area under section 46 of the Cantonments Act 2006 measuring 1250 Sq.ft. comprising GLR Sy No. 280/67 stands in the names of Shri Ajit Baburao Matkar and site is held on in Sch. VIII of CLAR 1937 and lease expires on 28/02/2037.

ENGINEERING BRANCH REPORT: As per CEE report dated 04/03/2020, there is no encroachment, no unauthorized construction, no subdivision and no change of purpose.

In this connection, the application is placed on the table alongwith all relevant documents.

35. Considered & recommended to approve on the following conditions:-

a) The proposed sale would not purport to transfer greater rights than those possessed by them in the land as per GLR of this office / conditions of old grant.

b) The proprietary rights of Government of India would be expressly admitted / entered in the sale deed.

c) That the transfer would not involve any Encroachment Un-authorized Construction, Sub –Division of site and change of purpose.

d) That the party should have cleared all the property tax dues till the end of the current year.

Application dated 07/02/2019 received from Shri Satish Pirubhau Bhujbal requesting to delete the name of Pirubhau Mahadeo Bhujbal and include his name by inheritance on the basis of the Property Card Extract issued by the Tahsildar, Pune City.

As per the Assessment List/Register/Record maintained by this office for taxation purpose being outside Civil Area – House No.18, Sangamwadi, Kirkee stands in the name of Shri Pirubhau M.Bhujbal ( On the basis of the documents, it is observed that there are various City Survey Nos. involved from 3463 situated outside Civil Area under the management of Collector, Pune)

In this connection, the application is placed on the table alongwith all relevant documents.

38. INSPECTION OF VEHICLES OF KIRKEE CANTONMENT BOARD FOR ROADWORTHINESS/DOWNGRADATION

Reference: Letter No. 70301/Wkshp dated 16.07.2020

To consider the office report submitted by the HS/GS regarding vehicle inspection report received from Station work shop, EME.

Vide CBR NO. 21 dated 19.09.2019 the Board had sent Board’s 25 nos. of vehicles which have been used more than 15 years to Station Workshop, EME for inspection.

According to the letter No. 70301/Wksp dated 16.07.2020 received from Stn. Wksp, EME, Kirkee that they have inspected the vehicles and they found that the vehicles are not roadworthy and fit for duty due to excessive wear, old vintage and requirement of extensive repairs in all vehicles (Copy enclosed).

After inspection report received, the said vehicles have to be downgraded and the Board has to take further necessary action like replacement of the vehicles deployed under Military and AFK Conservancy Agreement and then Auction of said vehicles need to be carried out.

To consider the inspection of vehicle report received from Station Work shop EME.

All relevant documents are placed on the table

38. Considered and approved. Also resolved that the said vehicles , wherever feasible, be converted into mobile toilet vans, especially for girls/ladies. If not possible to convert into Mobile Toilet Vans, then Board may proceed for conducting auction. Board further resolved to prepare the list of scraps for auction and a Committee be constituted for carrying out the auction.

39. RE-AUCTION AND ALLOTMENT OF OCCUPANCY RIGHTS FOR SHOP NO. 48 AND SHOP NO. 51 KIRKEE BUSINESS CENTER

To consider the note of Chief Revenue Superintendent to dispose of the occupancy rights for Shop No. 48 and re-auction for Shop No. 51 of Kirkee Business Center.

a) Smt Simrandeep Kaur offered the highest amount of Rs. 14,000/- per month for Shop No. 51. Accordingly, allotment letter was sent on 15-04-2013 to Smt Simrandeep Kaur but due to some personal problem she had requested for extension to comply with the terms and conditions of the Board which was not granted and the same was conveyed to her by this office vide letter no. 8/3/KBC/Shop No. 51 /P-64 dated 28-05-2013.

After that there is no communication from Smt Simrandeep Kaur, nor was any action taken for re-auction or allotment.

Hence, it is requested that orders for re-auction of the said shop may please be considered to avoid the further loss of Board’s revenue.

b) The Board vide CBR NO. 9 dated 21-02-2011 resolved that the license of Shop No. 48 Kirkee Business Center in the name of Bhimshankar Gunji be terminated and decided to put it for re-auction.

As per Board’s decision public auction for the occupancy rights of said shop held on 28-01-2013, Shri Samsher Singh offered the highest bid amounting of Rs. 12,000/- p.m and subsequently letter for further process and possession of shop was forwarded to Shri Samsher Singh to execute the agreement & take possession of the shop.

As per terms and conditions Shri Samsher Singh has deposited an amount of Rs. 1,44,000/- ( one year license fees as security deposit) and Rs. 61,000/- (advance license fees for six months) and submitted Stamp paper worth Rs. 100/- alongwith two passport size photos on 30-05-2013, but till date no action has been initiated by this office.

However it is seem from the record that possession for the above shop has not been given to Shri Samsher Singh till date, though he has submitted an application dated 01-03-2016 to hand over the shop to him.

Hence, it is requested that he may be called to take over the possession and execute a fresh agreement of the Shop at the earliest to avoid the further loss of Board’s revenue.

39. The matter discussed in detail. After detailed deliberation, resolved that Shop No.51 be offered to Smt.Simrandeep Kaur if she is willing to take the shop, else put it for re-auction. Further, Shop No.48 be handed over to Shri Samsher Singh after execution of agreement.

Ms.Kartiki Hiwarkar, member, informed the Board that the shop in Range Hills reserved for sports person is lying unutilized. Similarly, the Beef Shop be re-auctioned and put to use as it is lying closed. Shri Duryodhan Bhapkar, VP also brought out that all the shops which are lying unutilized and closed should be re-auctioned and put to use. Resolved that necessary action for re-auction of all such shops be taken.

40. REVISION OF LICENSE FEES IN R/O SHRI. BALAJI TINGARE, HIV COUNSELLOR AT DR. BACGH, KIRKEE

To consider the note of Chief Revenue Superintendent dated 04th August 2020.

It is brought to your notice that Shri Balaji Tingre, HIV Counselor working at Dr. BACGH, Kirkee was allotted Type III Quarter no. B-7, Nurses Quarters, Opp. Ram Mandir, Khadki Bazar vide CBR No. 12 dated 06-05-2009 on a monthly license fees of Rs.1000/- initially for a period of 11 month. The license fee was revised to Rs.2000/- w.e.f 01-10-2013 vide this office letter no. 13/1/Spl/Type-1/P-110 dated 21-10-2013.

As the license fees is not at par with what the Board’s Staff is paying and also has not been revised since 7 years, it is proposed to revise the same to Rs. 5000/- per month. It is also proposed to allot the said quarters on leave and license basis for a period of 11 months with a 10% increase in license fees for every renewal.

The necessary action may be taken to correct the License Fees in the interest of the Board and to avoid any audit objections in r/o of allotment of Boards quarters.

41. FILLING UP THE POST OF HEADMISTRESS AT BOARD’S COL.NANDA PRIMARY SCHOOL

Reference : CBR No.70 dated 19/09/2019.

The Board vide CBR referred above resolved to give additional charge of Incharge of Col.Nanda Pry School to Shri.Sopan.E.Gontala , Asstt.Teacher, in addition to his own duties till the post of HM is filled up, as per rule.

The post of HM does not exist in the said school as per Staff Approval due to less number of students. The post will be filled once the criteria of students ratio is fulfilled.

Smt.Mumtaz.I.Patel , Asstt.Teacher has submitted her application dated 17/12/2019 requesting to consider her name to work as Offg.HM, being Senior most in the D.Ed category. As the post of HM does not exist as of now, the Board vide above referred CBR resolved that till permanent post is not filled up, Shri Sopan Gontala may be asked to work as Incharge in addition to his own duties.

The application alongwith all relevant documents are placed on the table.

41. Considered the matter and resolved that Smt.Mumtaz Patel be allowed to hold the charge of Incharge for a period of six months. The Board will review the case after six months. Also resolved that the post of HM be filled up through promotion based on seniority cum merit on fulfillment of the criteria of student-teacher ratio.

42. BUILDING APPLICATIONS FOR ADDITION / ALTERATIONS IN GLR SY. NO. 268-G, SYMBIOSIS INSTITUTE OF MANAGEMENT STUDIES (SIMS) IN KIRKEE CANTONMENT.

Reference CBR No. 05 dated 29 May 2020 regarding consideration of the matter pertaining to building plans submitted by Symbiosis Institute of Management Studies (SIMS) on GLR Sy. No. 268-G, Kirkee.

To consider revised building plans submitted by Symbiosis Institute of Management Studies (SIMS) on GLR Sy. No. 268-G, Kirkee.

The Board vide above referred resolution had resolved that as regards the matter of part basement parking (partly below ground level) although it is not as per building bye-laws, may be considered by the Competent Authority, if found fit.

Accordingly, the building plans were forwarded to the higher authorities for seeking consent/approval as per lease agreement for the proposed addition & alteration with the above observations.

But now, Symbiosis Institute of Management Studies (SIMS) have submitted the revised building plans wherein the part basement parking has not been proposed revised building plans.

The building Plans submitted are confirming with the prevailing Building Bye-Laws and permissible FSI restrictions. Accordingly, the same needs to be forwarded to Competent Authority for seeking No Objection Certificate u/s 238 (3) of the Cantonments Act, 2006 from land point of view and required consent of the GOC-in-C, Southern Command, Pune under condition I (5) & I (6) of the Lease Agreement for the proposed additions and alterations.

The building plans submitted are conforming to the prevailing building bye-laws and FSI restrictions as per orders of MOD No. 10(75)/2001-D (Q&C) dated 13/09/2001. Total number of stories proposed is Parking plus 04, whereas as per the letter of MOD is stilt + ground + third. Total height of the proposed building is 14.95 mtr (for lift machine room it is 21.15 mtr) as against permissible 18 mtr. Applicant has to submit the undertaking of conforming to the norms of National Building Code, fire safety, earth quake safety, etc. The Guest House proposed for demolition, was earlier sanctioned vide CBR No. 16 dated 10 Dec. 2001.

PDDE, SC vide office note no. 18376/DE/SC/L/Kirkee/III dated 25 Aug. 2020 while forwarding the case to Competent Authority have recommended for removal of part basement floor.

In this connection the letters along with other relevant papers are placed on table for consideration.

42. Considered and resolved to forward the Building Plans submitted by Symbiosis Institute of Management Studies (SIMS) on GLR Sy. No. 268-G, Kirkee for the proposed demolition of the Guest House & construction of a building consisting of Parking plus 04 storeys and second floor of dining hall be forwarded to the Competent Authority for seeking consent / approval under condition I (5) & (6) of the Lease Agreement for the proposed addition & alteration. Further, resolved that the Building Plans will be sanctioned by the Board on receipt of the consent / approval of the Competent Authority.

43. REQUEST FOR REMEBRANCE OF TWO LATE EX.VICE PRESIDENTS OF KIRKEE CANTONMENT BOARD

To consider the proposal dated 28/09/2020 received from Shri D.T.Bhapkar, Vice President, Smt.Kartiki P.Hiwarkar, Chairman, Women & Child Welfare Committee and Health Committee, Shri Kamlesh S.Chaskar, Member & Shri Abhay K.Sawant, Member on the subject matter.

The Proposal is placed on the table.

43. Considered the matter. The VP and other three members have recommended that the recently renovated extension Hospital at East Kirkee be named after Late Baliram Bapu Sawant and the newly constructed ICU Centre at Bharat Ratna Babasaheb Ambedkar Cantonment General Hospital be named after Late Suresh Laxman Kamble. The Board also considered the proposal dated 28/09/2020 proposed by Shri Manish Anand and seconded by Smt.Pooja Anand, Members recommending that the ICU in the Cantonment Boards under consideration be named after Late Shri Baliram Bapu Sawant and the Chowk of Moledina Road and Ordnance Road be named after Late Shri Suresh Laxman Kamble..

After detailed deliberations, the Board resolved that the East Kirkee Dispensary be named after Late Shri Baliram Bapu Sawant and the Chowk of Moledina Road and Ordnance Road be named after Late Shri Suresh Laxman Kamble. Regarding naming of ICU Centre, resolved to take up the issue after the completion of the Centre.

With the permission of the Chair, the following items were taken up for consideration :

44. FILING OF THE WRIT PETITION IN THE NEXT HIGHER COURT AGAINST THE ORDER OF THE CONTROLLING AUTHORITY UNDER PAYMENT OF GRATUITY ACT,1972 AND REGIONAL LABOUR COMMISSIONER (CENTRAL) PUNE

Twenty three pensioners of this board had filed applications under sub-section 4 of Section 7 of the Payment of Gratuity Act.1972 read with sub-rule of the Rule 10 of the Payment of Gratuity(Central) Rules 1972 against the Cantonment Board Kirkee seeking difference between the Gratuity Act, 1972 and CCS (Pension) Rules.

The Controlling Authority passed Order dated 7th January, 2019 and directed this office to pay the respective Opponents aggregate amount of gratuity of Rs. 25, 71, 176/-. Being aggrieved by the above mentioned order , this office is of the opinion that :

a. OPPONENTS ARE NOT ‘EMPLOYEES’ –The Controlling Authority has ignored the fact and the legal position that none of the Opponent is an ‘employee’ within the meaning of the term as defined under Section 2(e) of the Act as none of them has ever been employed in or in connection with any work of a factory, Mine, Oilfield, Plantation, Post, Railway company, Shop or other establishment as mandated by Section 2(e) of the Act. The Cantonments in India are the creature of statute. The Appellant Cantonment Board is a Statutory Authority, a local body established under the Cantonments Act, 1924 as amended in 2006. As per Section 10 of the Act, in every Cantonment there has to be a Cantonment Board. The Board is not a Factory, Mine, Oilfield, Plantation, Post, Railway company, Shop or other establishment as contemplated u/s 2(e) of the Payment of Gratuity Act, 1972. The services of its Employees are governed by –

- the Cantonment Fund Servants Rules, 1937 (CFSR) which are framed by the Central Government in exercise of the powers conferred by Section 280 of the Cantonments Act, 1924. As per Rule 1(2) thereof, these Rules are applicable to all the persons employed by any Cantonment Board in India. As such, the Opponents cannot claim any right to Gratuity under the Payment of Gratuity Act, 1972. As per Rule 30 of the Cantonment Fund Servants Rules, 1937, all servants who (1) are in permanent service of the Appellant Board on the date of coming into force of the Cantonment Fund Servants (Amendment) Rules, 1982 and who have either opted or are deemed to have opted for the pension-cum-gratuity scheme (2) join service after the said date, shall be eligible for pension cum gratuity [SRO 51 dated 1.2.1983]All these vital legal aspects have been totally ignored by the Controlling Authority while passing the impugned order holding all the Opponents entitled to Gratuity under the Act of 1972. The Controlling Authority has not even taken into consideration the time to time amendments as to the maximum amount of gratuity payable which are as follows –

There are several Opponents who have claimed gratuity over and above the maximum limits prescribed by the Act and the same have been granted without subjecting the same to judicial scrutiny.

b. Opponents retired from the service upon attaining age of superannuation. Upon retirement, the Opponents have duly been paid Gratuity under the ‘Pension cum Gratuity Scheme’. Under this Scheme, in addition to Gratuity, the Opponents, and after their death their heir(s) become entitled to monthly pension regularly. After availing the benefit of Gratuity and Pension under the said Scheme, the Opponents are now illegally and wrongly seeking Gratuity under the provisions of the Payment of Gratuity Act, 1972. As per Rule 31 (g) of the Cantonment Funds Servants Rules, 1937, where any doubt arises as to the interpretation of the Rules or their applicability in particular cases or in cases of doubt, it shall be referred to the Central Government for decision. Therefore, the Opponents have wrongly approached the Controlling Authority under the Payment of Gratuity Act with their grievances.

c. The Appellant submits that the Opponents have opted for Death cum Retirement Gratuity as per CCS Pension Rules, 1972 and therefore the Opponents cannot opt for the best of the terms of Pension cum Gratuity Scheme as well as Payment of Gratuity 1972 as the same would defeat the purpose of Sub Section (5) of Section 4 of the Payment of Gratuity Act 1972. The entire amount of gratuity received by the Opponents under the Scheme is exempted without limit from income tax under Section 10(10) of the Income Tax Act.

Considering the above points, this office has filed an Appeal u/s 7(7) of the Payment of Grtuity Act, 1972 against Impugned Order dated 7th January, 2019 in RLCP – 36/(05 to 28)/2016 with the Hon’ble “Appellate Authority, Mumbai under the Payment of Gratuity Act” and prayed that:

i) The record and proceedings of RLCP – 36/(05 to 28)/2016 from the Controlling Authority (Central) under the Payment of Gratuity may be called.

ii) Till final disposal of the present Appea,l the effect and implementation of the Impugned Order dated 7th January, 2019 in RLCP – 36/(05 to 28)/2016 may kindly be stayed.

iii) The Impugned Order dated 7th January, 2019 in RLCP – 36/(05 to 28)/2016 may kindly be quashed and set aside on its merits in the interest of justice.

iv) Any other orders in the interest of justice may kindly be passed.

All relevant documents along with files are kept on the table for noting recommendation /approval of the Board.

44. Considered the matter. CEO/Cantonment officials may defend the case in the interest of Kirkee Cantonment Board.

45. LEASE OF STALL NO. 322 AT GLR SY. 27/70 TO SHRI V R SHARMA

To consider the office report of Chief Revenue Supdt. regarding lease of stall no. 322 at GLR Sy. No. 27/70 on Kasamali Jumbo Road, Kirkee on the receipt of application of Shri Vivekanand R Sharma for a period of 05 years.

Board vide CACR NO. 04 dated 12 May 2014 as confirmed by CBR No. 04 dated 05 June 2014 had considered the application of Shri V R Sharma for extension of lease for a period of 05 years from 30 Nov. 2013 @ Rs. 500 pm, although applicant had asked for extension of 30 years. It was also resolved that the matter be referred to the Principal Director, Defence Estates, Southern Command, Pune. The matter was referred to the Principal Director, Defence Estates, Southern Command, Pune vide letter no. 8/3/Stall No. 322/P-282 dated 12 June 2020.

As per the earlier Board resolution vide Spl. CBR No. 38 dated 28 April 2008 a similar application for extension of lease for 05 years was considered as per Rule 8 of the Cantonment Property Rule 1925 to Shri V R Sharma after revision of monthly rent of Rs. 500/- pm as against Rs. 440/-.

The application dated 22 Dec. 2017 of Shri Vivekanand R Sharma for extension of lease of stall no. 322 for a period of 05 years may be considered by the Board as per Rule 8 of the Cantonment Property Rule 1925 on revision of monthly rent of Rs. 605/- as against Rs. 500/-.

In this connection the office report along with other relevant papers are placed on table for consideration.

45. Considered and resolved that the lease in respect of Stall No.322 at GLR Sy.No.27/70 be renewed in favour of Shri Vivekanand R.Sharma, s/of Shri R.G.Sharma, Physically Handicapped person for a period of five years w.e.f 01/12/2018 to 30/11/2023 on payment of revised monthly rent of Rs. 625/- as against Rs.500/- per month under Rule 8 of the Cantonment Property Rule, 1925 and agreement be executed accordingly.

46. REQUEST FOR NAMING OF CANTONMENT BOARD’S LIBRARY NEARING COMPLETION AFTER LATE SHRI A.P.J.ABDUL KALAM, FORMER PRESIDENT OF INDIA

To consider the Proposal dated 28/09/2020 proposed by Shri Manish S.Anand, Member and seconded by Smt.Pooja M.Anand, Member requesting to name the newly under construction Library in the name of Late Shri A.P.J.Abdul Kalam, Former President of India.

In this connection, the Proposal is placed on the table.

46. Considered the matter and resolved that the issue of naming the Library be taken up after completion of the Library.

47. REQUEST FOR REPLACEMENT OF EXISTING SODIUM VAPOUR STREET LIGHT FITTINGS WITH LED FITTINGS IN RANGE HILLS & ORDNANCE ESTATES INTERNAL STREETS/ROADS

To consider the Proposal dated 29/09/2020 proposed by Shri Manish S.Anand, Member and seconded by Smt.Pooja M.Anand & Smt.Vaishali K.Pahilwan, Members requesting to replace all the Sodium Vapour street light fittings with LED fittings on internal roads in Range Hills and Ordnance Estates.

In this connection, the Proposal is placed on the table.

47. Considered the matter and resolved that the case be taken up with the AFK authorities. President Cantonment Board asked CEO to fix a meeting with GM,AFK to be attended by PCB,VP,CEO and members for discussing various pending issues pertaining to AFK.

48. REQUEST FOR FINALISATION OF CANTONMENT BOARD’S LOGO

To consider the Proposal dated 28/09/2020 proposed by Shri Manish S.Anand, Member and seconded by Smt.Pooja M.Anand, Member requesting for finalization of official Logo with a official wording depicting the motto of the Cantonment, Board, Kirkee

In this connection, the Proposal is placed on the table

48. The matter discussed in detail. Shri Manish Anand stated that the issue is long pending and official Logo should be finalized by the Board. He brought out that Maharashtra is known for the bravery of the great leader Chhatrapati Shivaji Maharaj and that every Municipal body in Maharashtra has image/sketch of Chhatrapati Shivaji Maharaj in their official logo and even Kirkee Cantonment Board should think in that line while designing the Logo. Shri Duryodhan Bhapkar, VP and Shri Abhay Sawant, Member stated that KCB Logo be designed incorporating the image/sketch of Bharat Ratna Dr.Babasaheb Ambedkar. After detailed deliberation, resolved that design be got made from an agency with combination of image of Chatrapati Shivaji Maharaj and motto of Bharat Ratna Dr.Babasaheb Ambedkar and put up before the Board for taking further decision on the matter.

CEO informed the Board that the present Logo with Ntional Emblem being used by the Office and Members on the Letter Heads , Stamps and Visiting Cards, etc have not been approved by the Board. CEO also explained that Rule 10 of the State Emblem of India (Regulation of Use) Rules,2007 imposes restrictions on the use of Emblem and National Emblem cannot be used by Autonomous Bodies without prior permission of the Ministry of Home Affairs.

49. INVOLVEMENT OF DR.ZAKIR HUSAIN URDU JR.COLLEGE FOR YEARLY REWARD FELICITATIONS OF CANTONMENT BOARD

To consider the Proposal dated 20/08/2020 by Ms.Kartiki Hiwarkar, Member for granting scholarship to students of Std.XII as is being given to Std.Xth students by the Board.

In this connection, the Proposal is placed on the table.

49. Considered and resolved that the matter be placed before the Education, Sports & Cultural Committee and the recommendation of the Committee be brought before the Board for its decision.

The Board ended with the recital of National Anthem.

45. Considered and resolved that the lease in respect of Stall No.322 at GLR Sy.No.27/70 be renewed in favour of Shri Vivekanand R.Sharma, s/of Shri R.G.Sharma, Physically Handicapped person for a period of five years w.e.f 01/12/2018 to 30/11/2023 on payment of revised monthly rent of Rs. 625/- as against Rs.500/- per month under Rule 8 of the Cantonment Property Rule, 1925 and agreement be executed accordingly.

46. Considered the matter and resolved that the issue of naming the Library be taken up after completion of the Library.
