1 Session of 2003 2 3 HOUSE BILL No. 2389 4 5 By Committee on Federal and State Affairs 6 7 2-14 8 9 AN ACT concerning commissioner ; relating to changes 10 in election precinct boundaries; amending K.S.A. 25-26a02 and re- 11 pealing the existing section. 12 13 Be it enacted by the Legislature of the State of Kansas: 14 Section 1. K.S.A. 25-26a02 is hereby amended to read as follows: 25- 15 26a02. (a) Subject to the provisions of subsection (b), election precincts 16 in all of the state shall be established or changed by county 17 election officers in such a manner that: 18 (a) (1) Except as otherwise provided in this section, each election 19 precinct shall be composed of contiguous and compact areas having 20 clearly observable boundaries using visible ground features which meet 21 the requirements of the federal bureau of the census and which coincide 22 with census block boundaries as established by the federal bureau of the 23 census and shall be wholly contained within any larger from which 24 any municipal, or county officers are elected; 25 (b) (2) election precincts for election purposes shall be designated 26 consecutively in the county by number or name, or a combination of name 27 and number; 28 (c) (3) any municipal exclave or township enclave shall be a separate 29 precinct and designated by a separate number or name, or combination 30 of name and number, and shall not be identified with or as a part of any 31 other municipal or township precinct; 32 (d) (4) from and after the time that the legislature has been redis- 33 tricted in 1992, precincts shall be arranged so that no precinct lies in 34 more than one legislative district; 35 (e) (5) a street or other roadway which has been platted but not 36 graded is not a visible or observable feature for the purposes of this sec- 37 tion; and 38 (f) (6) where a legislative district boundary coincides with a municipal 39 boundary which is changed by reason of annexation, such legislative dis- 40 trict boundary shall be maintained as a precinct boundary until the next 41 legislative redistricting regardless of whether such a legislative district 42 boundary uses a visible ground feature or coincides with a census block 43 boundary. 1 (b) Following the adoption of a resolution fixing county commissioner 2 districts as required by K.S.A. 19-204 and 19-204a, and amendments 3 thereto, a county election officer shall not alter the boundaries of any 4 election precinct which would have the effect of altering the county com- 5 missioner district boundaries unless such alteration is approved by the 6 unanimous vote of the board of county commissioners. 7 Sec. 2. K.S.A. 25-26a02 is hereby repealed. 8 Sec. 3.
