    Strasbourg, 15 December 2009 MIN-LANG/PR (2010) 1 EUROPEAN CHARTER FOR REGIONAL OR MINORITY LANGUAGES Fourth Periodical Report presented to the Secretary General of the Council of Europe in accordance with Article 15 of the Charter SWITZERLAND Periodical report relating to the European Charter for Regional or Minority Languages Fourth report by Switzerland 4 December 2009 SUMMARY OF THE REPORT Switzerland ratified the European Charter for Regional or Minority Languages (Charter) in 1997. The Charter came into force on 1 April 1998. Article 15 of the Charter requires states to present a report to the Secretary General of the Council of Europe on the policy and measures adopted by them to implement its provisions. Switzerland‘s first report was submitted to the Secretary General of the Council of Europe in September 1999. Since then, Switzerland has submitted reports at three-yearly intervals (December 2002 and May 2006) on developments in the implementation of the Charter, with explanations relating to changes in the language situation in the country, new legal instruments and implementation of the recommendations of the Committee of Ministers and the Council of Europe committee of experts. This document is the fourth periodical report by Switzerland. The report is divided into a preliminary section and three main parts. The preliminary section presents the historical, economic, legal, political and demographic context as it affects the language situation in Switzerland. The main changes since the third report include the enactment of the federal law on national languages and understanding between linguistic communities (Languages Law) (FF 2007 6557) and the new model for teaching the national languages at school (—HarmoS“ intercantonal agreement).

    Alpine Common Property Institutions under Change: Conditions for Successful and Unsuccessful Collective Action of Alpine Farmers in the Canton Graubünden of Switzerland Gabriela Landolt, Tobias Haller Abstract: The goal to protect and sustainably manage alpine summer pastures is stated in the Swiss state law since 1996 and direct subsidy payments from the state for summer pasturing have been bound to sustainability criteria since 2000 reflecting the increasing value of the alpine cultural landscape as a public good. However, the provision of the public good remains in the hands of the local farmers and their local common pool resource (CPR) institutions to manage the alpine pastures and those institutions increasingly struggle with upholding their institutional arrangements particularly regarding the communal work, called Gemeinwerk, necessary to maintain the pastures. This paper examines two case studies of local CPR institutions to manage alpine pastures in the canton Graubünden of Switzerland manifesting different institutional developments in the light of changing conditions. Explanations for the unequal reactions to change and their impacts on the provision of the CPR are provided by focusing on relative prices, bargaining power and ideology as drivers of institutional change often neglected within common property research.     Alpine common property institutions under change: conditions for successful and unsuccessful collective action of alpine farmers in the Canton Grisons of Switzerland Gabriela Landolt, PhD-Candidate, Institute of Social Anthropology Bern, Switzerland Prof. Tobias Haller, Associate Professor, Institute of Social Anthropology Bern, Switzerland Abstract It is time to review the robust image of common property institutions in the management of summer pastures called “alps” in Switzerland created by Robert Netting and Elinor Ostrom and to show the challenges local institutions face today. Although the goal to protect and sustainably manage the summer pastures is stated in law since 1996 and summer pasturing payments have been bound to sustainability criteria since 2000, local common property institutions increasingly struggle with maintaining their institutional arrangements especially regarding the collective maintenance work called “Gemeinwerk”, which is necessary to allocate the common resource. Within the framework of Elinor Ostrom’s design principles and Jean Ensminger’s model of institutional change historical processes and the present situation of two local institutions to manage summer pastures in the Canton Grison (Graubünden) of Switzerland are described and discussed. The results show very different reactions to change: the reduction of the number of farmers, the increasing heterogeneity of their interests, shifts in ideology away from agricultural tradition and the decreasing bargaining power of the farmers, in one case, cause institutional collapse while in the other case the positive history of interaction, good leadership and a sufficient number of farmers to find new forms of organization open the doors for adaptation and institutional innovation.
