The City Council of the City of Hastings, Minnesota met in a regular meeting on Tuesday, March 4, 2019, at 7:00 p.m. in the Council Chambers at the Hastings City Hall, 101 East 4th Street, Hastings, Minnesota.

Members Present: Mayor Fasbender, Councilmembers Balsanek, Braucks, Folch, Lund and Vaughan.

Members Absent: Councilmember Leifeld

Staff Present: Interim City Administrator Julie Flaten City Attorney Dan Fluegel

Presentation: Dakota County Library’s 2018 Annual Report Pleasant Hill Library Director Julia Carlis presented the report.

Approval of Minutes Mayor Fasbender asked if there were any additions or corrections to the minutes of the Regular City Council Meeting on February 19, 2019. Minutes were approved as presented.

Consent Agenda Councilmember Balsanek motioned to approve as presented, seconded by Councilmember Folch. Ayes, 6; Nays, 0.

Approval of City Administrator Executive Search Firm Flaten introduced the item requesting Council to accept the proposal from The Mercer Group for Executive Search Firm Services to assist with recruiting and hiring a City Administrator. The Mercer Group is a well-respected executive search firm who have conducted numerous nationwide top City official searches. Recently they have conducted City Administrator/Manager searches for the cities of Forest Lake, South St. Paul, and St. Paul. Jim Miller will be the main contact for the City Council and staff during the search process. Council discussion on the quality of the proposals received and the strength of the firms interviewed, availability, dependability, and experience of Jim Miller, staying on track with the timeline of the recruitment/hiring process of the City Administrator. Councilmember Balsanek motioned to approve as presented, seconded by Councilmember Vaughan.

Mayor Fasbender and Councilmembers made the following announcements:  Planning Commission meeting on Monday, March 11th at 7:00 p.m. at City Hall  HEDRA meeting on Thursday, March 14th at 6:00 p.m. at City Hall  Alternative Spring Break March 11th – March 14th at Hastings High School  New employee reception in the Community Room at City Hall at 6:00 p.m. on Monday, March 18th  Councilmember Vaughan will attend the MN High-Speed Rail Commission meeting on Thursday, March 7th  Police Reserve Banquet on Wednesday, March 20th  Councilmember Folch stated the final Diversity, Equity, and Inclusion Lab was held. Appreciation shared for the commitment by the community to this initiative

Eggerprovidedinformationonthetypeofwaterdisinfection methodutilizedbymanypeercommunities.

Staffisrecommendingthegaschlorinationmethodofpermanentwaterdisinfection. This methodiswidelyusedandhighlyeffectiveatprotectingagainstcontaminationwhilewaterisin transportthroughoutsystem. Themethodprovidesconstantchlorineconcentrationwhichwill minimizetasteandodorvariability. Theapproximateinitialcapitalcostis $440,000and ongoingcostsareestimatedat $44,000annually.

Lammerspresentedthreeoptionsforfundingthegaschlorinationmethod. Thepreferredoption utilizesWACfundbalanceandasmallerportionofwaterfundbalance. Thisoptionprovidesfor theleastimpactonutilityrateincreasesinthefuture.

CouncildiscussiononnitratesandPFClevelsinwatersystemandwhenthesemayneedtobe addressedinthefuture. Council alsodiscussedtheoptionof doing“ nothing”or providingno permanentdisinfectionmethod. AttorneyFluegelprovidedhisassessmentoftherisksthat choicemayposetotheCity. Alternative timesofyeartochlorinateandpeople’sperceptionof chemicalingestionwerealsodiscussed. CITY OF HASTINGS DAKOTA COUNTY, MINNESOTA RESOLUTION 03- -19 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HASTINGS REQUESTING COMPREHENSIVE ROAD AND TRANSIT FUNDING

WHEREAS, all Minnesota communities benefit from a sound, efficient, and adequately funded transportation system that offers diverse modes of travel; and

WHEREAS, the integrity of Minnesota’s transportation infrastructure is dependent upon long-term planning and ongoing maintenance, both of which require dedicated and sustainable revenue sources; and

WHEREAS, current funding for roads, bridges, and transit systems across all government levels in Minnesota is inadequate, and this under-investment diminishes quality of life for Minnesota residents and hinders Minnesota’s progress as a national business, economic, and civic leader; and

WHEREAS, Minnesota’s transportation system is failing to meet the capacity needs necessary to sustain population growth and promote economic development; and

WHEREAS, many rural roads are not built to modern safety standards and are not meeting the needs of industries that depend on the ability to transport heavy loads; and

WHEREAS, insufficient state funding has delayed regionally significant road construction and reconstruction projects across Minnesota; and

WHEREAS, transportation infrastructure maintenance and improvement costs significantly contribute to rising property taxes; and

WHEREAS, for every one dollar spent on maintenance, a road authority—and therefore taxpayers—save seven dollars in repairs; and

WHEREAS, Minnesota contains over 141,000 miles of roadway, and over 22,500 miles—or 16 percent--are owned and maintained by Minnesota’s 853 cities; and

WHEREAS, almost 85 percent of all municipal streets are not eligible for dedicated Highway User Tax Distribution Fund dollars; and

WHEREAS, the more than 700 Minnesota cities with populations below 5,000 are ineligible for dedicated Highway User Tax Distribution Fund dollars, but have benefitted from the creation of the Small Cities Assistance Account; and

WHEREAS, city streets are a separate but integral piece of the network of roads supporting movement of people and goods; and

WHEREAS, existing funding mechanisms, such as Municipal State Aid (MSA), property taxes, and special assessments, have limited applications, leaving cities under- equipped to address growing needs; and

WHEREAS, city cost participation in state and county highway projects diverts resources from city-owned streets; and

WHEREAS, maintenance costs increase as road systems age, and no city—large or small—is spending enough on roadway capital improvements to maintain a 50-year lifecycle; and

WHEREAS, cities need greater resources, including an additional dedicated state funding source for transportation, and flexible policies to meet growing demands for street improvements and maintenance.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF HASTINGS that this Council requests that the Minnesota Legislature pass and Governor Tim Walz sign a comprehensive and balanced transportation funding package that permanently increases dedicated funding for transportation; and

BE IT FURTHER RESOLVED BY THE COUNCIL OF THE CITY OF HASTINGS that this Council defines a comprehensive and balanced transportation funding package as an initiative that permanently increases dedicated funding for state and local road and transit systems in Greater Minnesota and the Metropolitan Area.

BE IT FURTHER RESOLVED BY THE COUNCIL OF THE CITY OF HASTINGS that this Council requests an omnibus transportation funding bill that provides additional dedicated state funding for city streets, including funding that can be used for non-MSA city street maintenance, construction, and reconstruction.

COUNCIL ACTION REQUESTED Council is requested to conduct a public hearing, and to consider the enclosed resolution to adopt the proposed assessments for City Project 2019-1, the 2019 Neighborhood Infrastructure Improvements. This resolution requires a simple majority vote of support for approval. The scope and features for this project were approved by the City Council at the regular meeting on February 19th and the City will be receiving bids for the project on March 20th.

BACKGROUND INFORMATION The proposed project includes two separate geographic areas (Area 1 – Louis Lane neighborhood and Area 2 – Bohlken Drive/31st Street W neighborhoods) and includes either reconstruction or reclamation of the existing street. Concrete sidewalk will be extended along 31st Street W from Highview Knoll to Leroy Avenue. The improvements will also include storm sewer system extensions, repairs, and replacements to facilitate drainage of the new streets.

ASSESSMENT POLICY & FINAL PROPOSED RATES With all roadways within the project area being neighborhood-level streets, abutting properties are proposed to be assessed in accordance with the City’s ordinance policy for non-collector roads. This policy dictates that the assessment rates are based on the estimated special benefit to the assessed properties accruing from the constructed improvements. We also review the proposed assessment rates against other recent assessment rates. In 2017-18, the rate was $84.85 for full reconstruction.  A rate of $77.40/frontage foot is proposed for reconstruction along all properties that do not have modern curb.  A rate of $70.20/frontage foot is proposed for reconstruction along all properties that already have modern curb.  A rate of $56.70/frontage foot is proposed for reclamation properties that are single family and apartment.  A rate of $66.60/frontage foot is proposed for reclamation properties that are twin homes.

The assessment rates were endorsed by the Operations Committee and would result in the City collecting $1,795,991.67 to help fund the project. For a copy of the proposed assessments, please refer to the attached Preliminary Assessment Rolls dated February 21, 2019.

WHEREAS, pursuant to proper notice duly given as required by law, the City Council of the City of Hastings has met, heard, and passes upon all objections to the proposed assessments for the following project:

2019-1 2019 Neighborhood Infrastructure Improvements – The project includes complete reconstruction with new base material and pavement on Manor Lane, Manor Court, 19th Street W from Louis Lane to Manor Lane, 21st Street W from Louis Lane to Pine Street, Ridge Lane, and Edgewood Lane. Full replacement of curb and gutter is included for the areas to be reconstructed. The project scope also includes reclamation, which consists of grinding up and mixing the existing pavement surface with the underlying gravel and placement of new pavement over that mixture, of Louis Lane, 18th Street W from Manor Lane to Pine Street, 19th Street W from Manor Lane to Pine Street, Southview Court, Bohlken Drive from 160 west of Hackberry Drive to Cannon Street, Hackberry Drive, South Park Court, Hackberry Circle, Highview Knoll, Highview Drive, 31st Street W from 70 feet west of Highview Knoll to Cannon Street, 33rd Street W, 35th Street W from 190 feet west of Leroy Avenue to Lester Avenue, Leroy Avenue, and Lester Avenue. Spot repair of the curb and gutter will be completed as needed for the areas to be reclaimed. Concrete sidewalk will be extended along 31st Street W from Highview Knoll to Leroy Avenue. The improvements will also include storm sewer system extensions, repairs, and replacements to facilitate drainage of the new streets.

NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HASTINGS AS FOLLOWS: 1. The proposed assessments for project 2019-1 the 2019 Neighborhood Infrastructure Improvements, a copy of which is filed with the Hastings Engineering Department and with the City Clerk, are hereby accepted and shall constitute the special assessment against the properties named therein, and each tract of land therein included is hereby found to be benefited by the constructed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extending over a period of ten (10) years, the first of the installments to be payable with the first property tax installment of 2020, and shall bear interest at the rate for which City bonds are sold plus 1.5%, per annum from December 1, 2019. To the first installment shall be added interest on the entire assessment from December 1, 2019 until December 31, 2019. To each subsequent installment, when due, shall be added interest for one year on all unpaid balances. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the County Auditor, pay the whole or part of the assessment on such property with interest accrued to the date of the payment to the City Clerk, except that no interest or Dakota County assessment certification fee shall be charged if the entire assessment is paid by November 30, 2019. The owner may, at any time thereafter, pay to the County Treasurer the entire amount of the assessment remaining unpaid with interest accrued to December 31 of the year in which such payment is made. Such payments to the County Treasurer must be made before December 30, or interest will be charged through December 31 of the next succeeding year. 4. The Clerk shall forthwith, transmit a certified duplicate of this assessment to the County Auditor to be extended on the property tax lists of the County, and such assessments shall be collected and paid over in the same manner as other municipal taxes. 5. The amount specially assessed is hereby affirmed to be $1,795,991.67.

City Council Memorandum

Council Action Requested: Council is requested to approve a similar flood fighting policy as adopted in 2011. City forces would provide sand, sandbags, logistical support, and hauling of filled sandbags to curbside locations, but City forces will not be used to fill sandbags or to build barriers on private property. After the flood, City forces will haul away all sandbags that are brought back out to the curb.

Background Information: Early National Weather Service forecasts are predicting that by early to mid-April there is up to a 75%- 90% chance of the reaching a flood stage of about 20 feet, and a 50%-75% chance of reaching a stage of 21.5 feet. Right now, the prediction shows that there is a lesser chance of a stage higher than this. Please see the chart below for the NWS projections as of March 4th. A more current projection may be available by the time the Council meets on March 18th and I will present the latest known information at the meeting.

X-A-02 At 21.5 feet, the stage is about ½ ft. lower than the 2001 flood, which was the third highest flood on record at 22 feet. This forecast needs to be qualified – many variables can significantly change the forecast higher or lower, including how rapidly the snowmelt occurs, and additional snowfall or rainfall events. Over the next few weeks, the forecast can and will change. It is also important to note that the NWS’s forecasts do lean conservative, and our observations over the years are that actual flood stage has ended up being slightly below the forecasted figure made closest to the crest.

Physical Impact At flood stages such as those currently predicted, about 10 homes on the north side of 1st Street in East Hastings can be directly impacted by flooding. In 2001, only three or four of these homes requested sandbagging to protect against that year’s flooding. In 1997, with a flood stage of ¾ ft. lower than 2001, about half a dozen homes sandbagged. In 2011 and under a similar forecast as this year, a handful of homes sandbagged, but the projection was later downgraded and the crest ultimately came to just below 18 feet, making little to no use of the barriers. In 2014, we reached a stage of just below 19 feet, and none of the homes sandbagged despite this having about 1 foot of impact on the lowest of the homes.

There are also a number of public infrastructure impacts that would occur based on the current forecast, including closure of several segments of City roadways, closure of spaces within Jaycee, Lake Rebecca, River Flats, and Levee Parks. I have attached a two-page summary covering notable City and private property locations where impacts may be observed, and will provide a brief presentation that features some photos taken during past flood events that give points of reference.

City Response As flood levels rise, Public Works, Parks, Police and Fire will coordinate efforts and close roadways, trails and parks as appropriate. We will monitor river levels and flood forecasts.

City staff has engaged in preliminary discussions with the Bless Hastings group which in 2011 played an integral role in our response efforts by recruiting and coordinating volunteer efforts that were used to sandbag homes where that was requested. As in the past, City staff proposes to support those efforts by supplying sand, sandbags, and poly sheeting needed to sandbag homes, and to haul sandbags filled by volunteers to curbside locations where they can be accessed by volunteers to construct barriers on private property. In addition, flood update and planning meetings will be scheduled, with the frequency of the meetings dictated by flood forecasts and planning flood fighting needs.

Financial Impact: The financial impact of flood fighting activities is unknown; dependent on level of flooding experienced and the demand for sandbags by the aforementioned property owners. A very rough guess would be $20,000 to $30,000, which would include any overtime that may be needed to support volunteer sandbagging activities. With spring flooding being on the State Legislature’s, Governor’s, and our Congressional Representative’s radars, there is a good possibility that emergency declarations could be made and that certain flood response efforts and public infrastructure damage would be eligible for State and/or Federal reimbursement.
