1.6 The sums shown in the column under "Appropriations" are appropriated from the bond
1.7 proceeds fund, or another named fund, to the state agencies or officials indicated, to be
1.8 spent for public purposes. Appropriations of bond proceeds must be spent as authorized by
1.9 the Minnesota Constitution, article XI, section 5, paragraph (a), to acquire and better public
1.10 land and buildings and other public improvements of a capital nature, or as authorized by
1.11 the Minnesota Constitution, article XI, section 5, paragraphs (b) to (j), or article XIV. Unless

5.1 Sec. 7. NATURAL RESOURCES
5.2 Subdivision 1. Total Appropriation $ 120,726,000
5.3 (a) To the commissioner of natural resources
5.4 for the purposes specified in this section.
5.5 (b) The appropriations in this section are
5.6 subject to the requirements of the natural
5.7 resources capital improvement program under
5.8 Minnesota Statutes, section 86A.12, unless
5.9 this section or the statutes referred to in this
5.10 section provide more specific standards,
5.11 criteria, or priorities for projects than
5.12 Minnesota Statutes, section 86A.12.
5.13 Subd. 2. Natural Resources Asset Preservation 71,500,000
5.14 (a) For the renovation of state-owned facilities
5.15 and recreational assets operated by the
5.16 commissioner of natural resources to be spent
5.17 in accordance with Minnesota Statutes, section
5.18 84.946. Notwithstanding Minnesota Statutes,
5.19 section 84.946, the commissioner may use this
5.20 appropriation to replace buildings if,
5.21 considering the embedded energy in the
5.22 building, that is the most energy-efficient and
5.23 carbon-reducing method of renovation.
5.24 (b) Notwithstanding Minnesota Statutes,
5.25 section 16C.33, the Soudan mine shaft
5.26 rehabilitation project shall be permitted to use
5.27 design-build and is exempt from utilizing the
5.28 required designer selection board process in
5.29 Minnesota Statutes, section 16C.33,
5.30 subdivision 5, and from any requirement for
5.31 a minimum number of proposals.
5.32 Subd. 3. Betterment of Buildings 14,000,000
5.33 For acquisition, predesign, design, and
5.34 construction to replace existing facilities that

6.1 no longer meet the business needs of the
6.2 department; for the design and construction
6.3 of a drill core facility in Hibbing; and for the

6.5 Subd. 4. Flood Hazard Mitigation 14,850,000
6.6 (a) For the state share of flood hazard
6.7 mitigation grants for publicly owned capital
6.8 improvements to prevent or alleviate flood
6.9 damages under Minnesota Statutes, section
6.10 103F.161. To the extent practical, community
6.11 levee projects shall meet the state standard of
6.12 three feet above the 100-year flood elevation.
6.13 Of this appropriation, up to three percent may
6.14 be used to implement the program.
6.15 (b) Project priorities shall be determined by
6.16 the commissioner as appropriate, based on
6.17 need and consideration of available leveraging
6.18 of federal, state, and local funds.
6.19 (c) $1,300,000 of this appropriation is for a
6.20 grant to the Bois de Sioux Watershed District
6.21 for the Redpath impoundment project.
6.22 (d) $2,300,000 of this appropriation is for a
6.23 grant the Cedar River Watershed District.
6.24 (e) $1,250,000 of this appropriation is for
6.25 grants to the cities of Perley and Hendrum.
6.26 Local project match may include all costs
6.27 associated with planning, engineering,
6.28 acquisition, and construction. The project
6.29 grants are based on a reimbursable payment
6.30 process and reconciliation of the project's
6.31 shared costs will be finalized upon project
6.32 completion certification.
6.33 (f) This appropriation also includes money for
6.34 projects in the following counties and

7.7 (g) This appropriation also includes money
7.8 for projects in the following watershed
7.9 districts: Lower Minnesota River Watershed
7.10 District, Middle Snake Tamarac Rivers
7.11 Watershed District, Prior Lake-Spring Lake
7.12 Watershed District, Red Lake Watershed
7.13 District, Roseau River Watershed District,
7.14 Sandhill River Watershed District, Shell Rock
7.15 River Watershed District, Two Rivers
7.16 Watershed District, Upper Minnesota River

7.19 (h) For any project listed in this subdivision
7.20 that the commissioner determines is not ready
7.21 to proceed, does not have the nonstate match
7.22 reserved, or does not expend all the money
7.23 granted to it, the commissioner may allocate
7.24 that project's unexpended money to a priority
7.25 project on the commissioner's list.
7.26 (i) To the extent that the cost of a municipal
7.27 project exceeds two percent of the median
7.28 household income in the municipality
7.29 multiplied by the number of households in the
7.30 municipality, this appropriation is also for the
7.31 local share of the project.
7.32 (j) Local project match may include all costs
7.33 associated with project planning, engineering,
7.34 acquisition, and construction. The project
7.35 grants are based on a reimbursable payment

8.1 process and final reconciliation of the project's
8.2 shared costs are determined by the
8.3 commissioner of natural resources upon
8.4 project completion certification.
8.5 (k) In unique instances where the local project
8.6 sponsor has expended project money for
8.7 engineering, acquisition, or construction prior
8.8 to finalization of a grant agreement under this
8.9 section, those local expenditures are
8.10 reimbursable consistent with the match
8.11 requirements of this section.
8.12 Subd. 5. Canisteo and Arcturus to Hill Annex 8.13 Open-pit Mine Groups 200,000
8.14 From the general fund to expand monitoring
8.15 and modeling of water levels in the Canisteo
8.16 and Arcturus to Hill Annex open-pit mine
8.17 groups, with priority on the latter. The
8.18 monitoring and modeling results must be used
8.19 by the commissioner to develop plans to
8.20 control and reduce the water levels in each pit
8.21 group and ameliorate, mitigate, or eliminate
8.22 the public safety hazards and groundwater
8.23 contamination concerns resulting from rising
8.24 water in both open-pit groups. The
8.25 commissioner must report to the legislative
8.26 committees with jurisdiction over capital
8.27 investment and environment finance by
8.28 February 15, 2020, on the plans developed.
8.29 Subd. 6. Fire Operations Airport Infrastructure 2,000,000
8.30 For a grant to the Chisholm-Hibbing Airport
8.31 Authority to reconstruct the ramps and staging
8.32 areas that support the department's fire fighting
8.33 response operations at the Range Regional
8.34 Airport. Any unspent portion of this
8.35 appropriation remaining after the completion

9.1 of the project, upon written notice to the
9.2 commissioner of management and budget, is

9.6 the replacement of the ramps and staging areas
9.7 that support the department's fire fighting
9.8 response operations at the regional airports in
9.9 Brainerd and Bemidji.
9.10 Subd. 7. Dam Renovation, Repair, Removal 2,000,000
9.11 For design, engineering, and construction to
9.12 repair, reconstruct, or remove dams and
9.13 respond to dam safety emergencies. The
9.14 commissioner shall determine project priorities
9.15 as appropriate under Minnesota Statutes,
9.16 sections 103G.511 and 103G.515.
9.17 Subd. 8. Forests for the Future 5,646,000
9.18 For the Minnesota forests for the future
9.19 program under Minnesota Statutes, section
9.20 84.66.
9.21 Subd. 9. State Trails 500,000
9.22 For predesign and design of the Gateway Trail
9.23 from William O'Brien State Park to downtown
9.24 Scandia. The commissioner must grant at least
9.25 ten percent of the appropriation to the city of
9.26 Scandia for local involvement in the predesign
9.27 and design process and for predesign and
9.28 design of safe connections between the
9.29 Gateway Trail and the Gammelgarden
9.30 Museum, and existing safe cycling routes in
9.31 the city. The predesign and design must
9.32 include suitable connections between the
9.33 Gateway Trail extension and existing facilities
9.34 in William O'Brien State Park.

10.6 available until the commissioner of
10.7 management and budget determines that at
10.8 least $750,000 has been committed from
10.9 nonstate sources to complete the project.
10.10 Subd. 11. Northfield; Local Trail Connection 2,500,000
10.11 For a grant to the city of Northfield for
10.12 predesign, design, acquisition of land or
10.13 interests in land, construction, and
10.14 development of local trail connections to the
10.15 Mill Towns State Trail in the city of
10.16 Northfield. This appropriation does not require
10.17 a nonstate contribution.
10.18 Subd. 12. Rochester; Cascade Lake Regional 10.19 Park 2,750,000
10.20 For a grant to the city of Rochester to
10.21 predesign, design, construct, furnish, and
10.22 equip improvements of a capital nature,
10.23 including a pavilion, an amphitheater,
10.24 performance facilities, picnic shelters,
10.25 restroom facilities, play areas, park access,
10.26 and landscaping. This appropriation is not
10.27 available until the commissioner of
10.28 management and budget determines that at
10.29 least $2,000,000 has been committed from
10.30 other sources to complete the project.
10.31 Subd. 13. Rocori Trail; Phase 3 1,130,000
10.32 For a grant under Minnesota Statutes, section
10.33 85.019, subdivision 4c, to the Rocori Trail
10.34 Construction Board to construct phase 3 of

11.1 the Rocori Trail, located in the cities of
11.2 Richmond, Cold Spring, and Rockville.
11.3 Subd. 14. Silver Bay; Trailhead Center 1,900,000
11.4 For a grant to the city of Silver Bay to
11.5 predesign, design, construct, furnish, and
11.6 equip a multimodal trailhead center for the
11.7 various hiking, bicycling, snowmobile, and
11.8 all-terrain vehicle trails that converge in the
11.9 area. The center includes separated trail access
11.10 for motorized and nonmotorized users and
11.11 open space for trail users, parking, a wayside
11.12 rest area, and a new trailhead center building
11.13 that includes lavatories and showers. This
11.14 appropriation is not available until the
11.15 commissioner of management and budget
11.16 determines that at least an equal amount has
11.17 been committed from other sources to
11.18 complete the project. The nonstate
11.19 contribution may be made in-kind. In-kind
11.20 contributions may include removal of the
11.21 existing building and site preparation, whether
11.22 begun before or after the effective date of this
11.23 section.
11.24 Subd. 15. St. Louis County; Voyageur Country 11.25 ATV Trail 1,000,000
11.26 For a grant to St. Louis County for design,
11.27 permitting, right-of-way acquisition, and
11.28 construction of Phase I of the Voyageur
11.29 Country ATV Trail connections in the areas
11.30 of Orr, Ash River, Kabetogama Township,
11.31 and International Falls to the Voyageur
11.32 Country ATV Trail system.
11.33 Subd. 16. Unspent Appropriations
11.34 The unspent portion of an appropriation for a
11.35 project in this section that is complete, upon

12.1 written notice to the commissioner of
12.2 management and budget, is available for asset

12.8 Sec. 8. POLLUTION CONTROL AGENCY $ 8,500,000
12.9 To the Pollution Control Agency for a grant

12.12 Statutes, section 115A.54, in order to acquire
12.13 land, design, construct, renovate, and equip a
12.14 new resource recovery campus consisting of

12.21 Sec. 9. BOARD OF WATER AND SOIL 12.22 RESOURCES

12.24 To the Board of Water and Soil Resources for

12.26 Subd. 2. Local Government Roads Wetland 12.27 Replacement Program 10,000,000
12.28 To acquire land or permanent easements and
12.29 to restore, create, enhance, and preserve
12.30 wetlands to replace those wetlands drained or
12.31 filled as a result of the repair, reconstruction,
12.32 replacement, or rehabilitation of existing
12.33 public roads as required by Minnesota
12.34 Statutes, section 103G.222, subdivision 1,
12.35 paragraphs (l) and (m). The board may vary

13.13 qualified private entities to acquire wetland

13.16 Subd. 3. Mankato; Minnesota River Erosion 13.17 Control 6,875,000
13.18 For a grant to the city of Mankato to acquire
13.19 land and to design and construct improvements
13.20 to reduce erosion and improve water quality
13.21 in the Minnesota River-Mankato watershed.
13.22 This appropriation includes money to restore
13.23 wetlands, complete in-channel improvements,
13.24 improve hydraulic performance of the bridge
13.25 at the Indian Creek Diversion, and install
13.26 riverbank stabilization along the Minnesota
13.27 River. This appropriation is not available until
13.28 the commissioner of management and budget
13.29 determines that at least an equal amount has
13.30 been committed from nonstate sources to
13.31 complete the project.
13.32 Sec. 10. AGRICULTURE; HEALTH. $ 20,401,000
13.33 To the commissioner of administration to
13.34 construct, renovate, and equip the Department
13.35 of Agriculture/Department of Health

14.8 Sec. 11. RURAL FINANCE AUTHORITY. $ 40,000,000
14.9 For the purposes set forth in the Minnesota
14.10 Constitution, article XI, section 5, paragraph
14.11 (h), to the Rural Finance Authority to purchase
14.12 participation interests in or to make direct
14.13 agricultural loans to farmers under Minnesota
14.14 Statutes, chapter 41B. This appropriation is
14.15 for the beginning farmer program under
14.16 Minnesota Statutes, section 41B.039; the loan
14.17 restructuring program under Minnesota
14.18 Statutes, section 41B.04; the seller-sponsored
14.19 program under Minnesota Statutes, section
14.20 41B.042; the agricultural improvement loan
14.21 program under Minnesota Statutes, section
14.22 41B.043; and the livestock expansion loan
14.23 program under Minnesota Statutes, section
14.24 41B.045. All debt service on bond proceeds
14.25 used to finance this appropriation must be
14.26 repaid by the Rural Finance Authority under

14.28 participations must be priced to provide full
14.29 interest and principal coverage and a reserve
14.30 for potential losses. Priority for loans must be
14.31 given first to basic beginning farmer loans,
14.32 second to seller-sponsored loans, and third to

14.34 Sec. 12. MINNESOTA ZOOLOGICAL 14.35 GARDEN

15.7 at the Minnesota Zoo, to be spent in
15.8 accordance with Minnesota Statutes, section
15.9 16B.307. Notwithstanding the specified uses

15.12 to replace buildings that are in poor condition,
15.13 outdated, and no longer support the work of
15.14 the Minnesota Zoo and to construct and
15.15 renovate trails and roads on the Minnesota

15.17 Subd. 3. Revitalize the Zoo 21,000,000
15.18 To design, renovate, construct, furnish, and
15.19 equip Minnesota Zoo facilities including the
15.20 closed monorail and portion of the Tropics

15.23 Sec. 13. ADMINISTRATION

16.31 (d) The plan must compare space available in
16.32 any of the buildings on the Capitol campus

17.17 (b) To qualify for an equipment grant the
17.18 station must meet the eligibility criteria

17.20 129D.12. Before receiving an equipment grant,
17.21 a station must submit to the commissioner a
17.22 list of the equipment the station plans to
17.23 purchase with the equipment grant. The
17.24 commissioner may not require the station to
17.25 purchase equipment before receiving the grant
17.26 money. A station must report to the
17.27 commissioner a list of the equipment
17.28 purchased with the grant.
17.29 (c) "Equipment" means the physical
17.30 infrastructure, hardware, and software used
17.31 for the production, dissemination,
17.32 interconnection, and transmission of digital
17.33 media content, the useful life of which may
17.34 range from seven to 40 years.

62.15 Sec. 27. BOND SALE AUTHORIZATION.
62.16 Subdivision 1. Bond proceeds fund. To provide the money appropriated in this act from
62.17 the bond proceeds fund, the commissioner of management and budget shall sell and issue
62.18 bonds of the state in an amount up to $1,245,528,000 in the manner, upon the terms, and
62.19 with the effect prescribed by Minnesota Statutes, sections 16A.631 to 16A.675, and by the
62.20 Minnesota Constitution, article XI, sections 4 to 7.
62.21 Subd. 2. Transportation fund. To provide the money appropriated in this act from the
62.22 bond proceeds account in the state transportation fund, the commissioner of management
62.23 and budget shall sell and issue bonds of the state in an amount up to $295,022,000 in the
62.24 manner, upon the terms, and with the effect prescribed by Minnesota Statutes, sections
62.25 16A.631 to 16A.675, and by the Minnesota Constitution, article XI, sections 4 to 7.
62.26 Subd. 3. Trunk highway fund. To provide the money appropriated in this article from
62.27 the bond proceeds account in the trunk highway fund, the commissioner of management
62.28 and budget shall sell and issue bonds of the state in an amount up to $102,102,000 in the
62.29 manner, upon the terms, and with the effect prescribed by Minnesota Statutes, sections
62.30 167.50 to 167.52, and by the Minnesota Constitution, article XIV, section 11, at the times
62.31 and in the amounts requested by the commissioner of transportation. The proceeds of the

63.1 bonds, except accrued interest and any premium received from the sale of the bonds, must
63.2 be deposited in the bond proceeds account in the trunk highway fund.
63.3 Sec. 28. CANCELLATION.
63.4 The uncommitted and unobligated amount of the appropriation from the bond proceeds
63.5 fund in Laws 2014, chapter 294, article 1, section 21, subdivision 13, as amended by Laws
63.6 2015, First Special Session chapter 5, article 3, section 20, estimated to be $550,000, is
63.7 canceled, and the bond sale authorization in Laws 2014, chapter 294, article 1, section 26,
63.8 subdivision 1, is reduced by the same amount.
63.9 Sec. 29. BOND SALE SCHEDULE.
63.10 The commissioner of management and budget shall schedule the sale of state general
63.11 obligation bonds so that, during the biennium ending June 30, 2021, no more than
63.12 $1,330,509,000 will need to be transferred from the general fund to the state bond fund to
63.13 pay principal and interest due and to become due on outstanding state general obligation
63.14 bonds. During the biennium, before each sale of state general obligation bonds, the
63.15 commissioner of management and budget shall calculate the amount of debt service payments
63.16 needed on bonds previously issued and shall estimate the amount of debt service payments
63.17 that will be needed on the bonds scheduled to be sold. The commissioner shall adjust the
63.18 amount of bonds scheduled to be sold so as to remain within the limit set by this section.
63.19 The amount needed to make the debt service payments is appropriated from the general
63.20 fund as provided in Minnesota Statutes, section 16A.641.
63.21 Sec. 30. EFFECTIVE DATE.
63.22 Except as otherwise provided, this article is effective the day following final enactment.

63.24 MISCELLANEOUS
63.25 Section 1. Minnesota Statutes 2018, section 16A.641, is amended by adding a subdivision
63.26 to read:
63.27 Subd. 4c. Negotiated sales authority. Notwithstanding the public sale requirements of
63.28 subdivision 4 and section 16A.66, subdivision 2, the commissioner may sell bonds, including
63.29 refunding bonds, at negotiated sale.

64.1 Sec. 2. [116J.417] GREATER MINNESOTA CHILD CARE FACILITY CAPITAL
64.2 GRANT PROGRAM.
64.3 Subdivision 1. Purpose. The purpose of the greater Minnesota child care facility capital
64.4 grant program established in this section is to keep or enhance jobs, increase the tax base,
64.5 or expand or create new economic development in the area in which the grants are made,
64.6 by providing facilities for the child care necessary to support workers and their families.
64.7 Subd. 2. Creation of accounts. Two greater Minnesota child care facility capital grant
64.8 accounts are created. One account is created in the special revenue fund and one in the bond
64.9 proceeds fund. Money in the accounts is appropriated to the commissioner to make grants
64.10 under this section. Money in the greater Minnesota child care facility capital grant account
64.11 in the bond proceeds fund is available until encumbered or spent subject to section 16A.642.
64.12 Subd. 3. Eligible applicant. (a) A city, county, or school district, or a joint powers board
64.13 established by two or more cities, counties, or school districts is eligible to apply for and
64.14 receive a grant from either greater Minnesota child care facility capital grant account
64.15 established in this section.
64.16 (b) A private child care provider licensed as a child care center or to provide in-home
64.17 family child care is eligible to apply for and receive a grant from the greater Minnesota
64.18 child care facility capital grant account in the special revenue fund.
64.19 (c) An applicant must be located outside of the metropolitan area as defined in section
64.20 473.121, subdivision 2.
64.21 Subd. 4. Local government authority. A city, county, or school district may own a
64.22 child care facility and operate a child care facility program that meets the requirements for
64.23 state licensing under .... A city, county, or school district may enter into a lease or
64.24 management agreement with one or more licensed child care providers to operate a child
64.25 care program in a facility owned by the city, county, or school district. A lease or
64.26 management agreement for state bond-financed property is subject to section 16A.695.
64.27 Subd. 5. Eligible project. (a) A grant may be used to acquire land or interest in land,
64.28 predesign, design, renovate, construct, furnish, and equip facilities in which to provide child
64.29 care or for other child care facility improvements that support the purposes for which this
64.30 grant program is established. Money from the account in the special revenue fund may also
64.31 be used to upgrade or expand existing nonprofit child care facilities for purposes of meeting
64.32 state requirements.

65.1 (b) All projects must increase child care capacity in the community that is served by the
65.2 provider, and meet all state requirements for child care facilities or programs.
65.3 Subd. 6. Grants. (a) The commissioner shall make grants to eligible applicants to provide
65.4 up to 50 percent of the capital costs of eligible child care facility capital projects. An eligible
65.5 applicant receiving a grant must provide for the remainder of the costs of the project, either
65.6 in cash or in kind. In-kind contributions may include the cost of project elements made
65.7 before or after the grant award is made.
65.8 (b) The commissioner may also distribute money provided by this section through a
65.9 regional organization within the meaning of section 15.75 to provide grants to eligible
65.10 applicants based on the manner of application and criteria established by the commissioner.
65.11 (c) If the commissioner awards a grant for less than 50 percent of the project cost, the
65.12 commissioner must provide the applicant and the chairs and ranking minority members of
65.13 the senate and house of representatives committees with jurisdiction over economic
65.14 development finance a written explanation for awarding less than 50 percent.
65.15 Subd. 7. Application; criteria. The commissioner must develop forms and procedures
65.16 for soliciting and reviewing applications for grants under this section. An applicant shall
65.17 apply for a grant in the manner and at the times the commissioner shall determine. At a
65.18 minimum, an application must include:
65.19 (1) evidence of the need for improved, expanded, or new child care facilities in the area;
65.20 (2) a description of the new or expanded facility or other improvements to be made;
65.21 (3) a description of the specific state requirements making improvements necessary, if
65.22 applicable;
65.23 (4) estimated costs of the capital project and the sources of funding to complete it;
65.24 (5) estimated costs of the expanded services and the sources of funding to provide them;
65.25 (6) the applicant's analysis of the expected economic benefits to the area in which the
65.26 project would be located;
65.27 (7) other information that the commissioner determines is necessary or useful in
65.28 evaluating the impact of the proposed project on the local economy; and
65.29 (8) the average number of children provided care by the applicant during the year prior
65.30 to the application, if any, and the expected number of children that could be provided child
65.31 care after the proposed project is completed.

66.1 Subd. 8. Maximum grant amount. Grants must not be awarded for more than $500,000
66.2 per project or more than $2,000,000 in two years to an applicant for one or more projects
66.3 in the same city or county.
66.4 Subd. 9. Cancellation of grant; return of money. If the commissioner determines that
66.5 a grantee is unable to proceed with an approved project or has not expended or obligated
66.6 the grant money within five years of entering into the grant agreement with the commissioner,
66.7 the commissioner shall cancel the grant and the money is available for the commissioner
66.8 to make other grants under this section.
66.9 Sec. 3. Minnesota Statutes 2018, section 134.45, subdivision 5, is amended to read:
66.10 Subd. 5. Qualification; accessibility grants. A public library jurisdiction may apply
66.11 for a grant in an amount up to $200,000 $450,000 or 50 percent of the approved costs of
66.12 removing architectural barriers from a building or site, whichever is less. Grants may be
66.13 made only for projects in existing buildings used as a library, or to prepare another existing
66.14 building for use as a library. Renovation of an existing building may include an addition to
66.15 the building if the additional space is necessary to provide accessibility or if relocating
66.16 public spaces to the ground level provides improved overall accessibility. Grants must not
66.17 be used to pay part of the cost of meeting accessibility requirements in a new building.
66.18 Sec. 4. [174.13] TRANSPORTATION FACILITIES CAPITAL PROGRAM.
66.19 Subdivision 1. Establishment; accounts. (a) A transportation facilities capital program
66.20 is established to prioritize among eligible projects that:
66.21 (1) support the programmatic mission of the department;
66.22 (2) extend the useful life of existing buildings; or
66.23 (3) renovate or construct facilities to meet the department's current and future operational
66.24 needs.
66.25 (b) Projects under the transportation facilities capital program are funded by proceeds
66.26 from the sale of trunk highway bonds or from other funds appropriated for the purposes of
66.27 this section.
66.28 (c) A transportation facilities capital account is established in the trunk highway fund.
66.29 The account consists of all money appropriated from the trunk highway fund for the purposes
66.30 of this section and any other money donated, allotted, transferred, or otherwise provided to
66.31 the account by law. Money in the account is appropriated to the commissioner for the
66.32 purposes specified and consistent with the standards and criteria set forth in this section.

67.1 (d) A transportation facilities capital account is established in the bond proceeds account
67.2 of the trunk highway fund. The account consists of trunk highway bond proceeds appropriated
67.3 to the commissioner. Money in the account may only be expended on trunk highway
67.4 purposes, which includes the purposes in this section.
67.5 Subd. 2. Standards. Article XIV of the Minnesota Constitution states that the trunk
67.6 highway fund may be used for the purposes of constructing, improving, and maintaining
67.7 the trunk highway system in the state. When allocating funding under this section, the
67.8 commissioner must review the projects deemed eligible under subdivision 3 and prioritize
67.9 allocations using the criteria in subdivision 4. Money allocated to a specific project in an
67.10 act of appropriation or other law must be allocated as provided by the law.
67.11 Subd. 3. Eligible expenditures. A project is eligible under this section only if it involves
67.12 the construction, improvement, or maintenance of a capital building asset that is part of the
67.13 state trunk highway system. These capital building assets include, but are not limited to,
67.14 district headquarter buildings, truck stations, salt storage or other unheated storage buildings,
67.15 deicing and anti-icing facilities, fuel dispensing facilities, highway rest areas, and vehicle
67.16 weigh and inspection stations.
67.17 Subd. 4. Criteria for priorities. When prioritizing funding allocation among projects
67.18 eligible under subdivision 3, the commissioner must consider:
67.19 (1) whether a project ensures the effective and efficient condition and operation of the
67.20 facility;
67.21 (2) the urgency in ensuring the safe use of existing buildings;
67.22 (3) the project's total life-cycle cost;
67.23 (4) additional criteria for priorities otherwise specified in state law, statute, or rule that
67.24 applies to a category listed in the act making an appropriation for the program; and
67.25 (5) any other criteria the commissioner deems necessary.
67.26 Sec. 5. Minnesota Statutes 2018, section 240A.09, is amended to read:
67.27 240A.09 PLAN DEVELOPMENT; CRITERIA.
67.28 The Minnesota Amateur Sports Commission shall develop a plan to promote the
67.29 development of proposals for new statewide public ice facilities including proposals for ice
67.30 centers and matching grants based on the criteria in this section.

68.1 (a) For ice center proposals, the commission will give priority to proposals that come
68.2 from more than one local government unit. Institutions of higher education are not eligible
68.3 to receive a grant.
68.4 (b) The commission must give priority to grant applications for indoor air quality
68.5 improvements and projects that eliminate R-22. For purposes of this section:
68.6 (1) "indoor air quality improvements" means: (i) renovation or replacement of heating,
68.7 ventilating, and air conditioning systems in existing indoor ice arenas whose ice resurfacing
68.8 and ice edging equipment are not powered by electricity in order to reduce concentrations
68.9 of carbon monoxide and nitrogen dioxide; and (ii) acquisition of zero-emission ice resurfacing
68.10 and ice edging equipment. The new or renovated systems may include continuous electronic
68.11 air monitoring devices to automatically activate the ventilation systems when the
68.12 concentration of carbon monoxide or nitrogen dioxide reaches a predetermined level; and
68.13 (2) "projects that eliminate R-22," means replacement of ice-making systems in existing
68.14 public facilities that use R-22 as a refrigerant, with systems that use alternative
68.15 non-ozone-depleting refrigerants.
68.16 (c) In the metropolitan area as defined in section 473.121, subdivision 2, the commission
68.17 is encouraged to give priority to the following proposals:
68.18 (1) proposals for construction of two or more ice sheets in a single new facility;
68.19 (2) proposals for construction of an additional sheet of ice at an existing ice center;
68.20 (3) proposals for construction of a new, single sheet of ice as part of a sports complex
68.21 with multiple sports facilities; and
68.22 (4) proposals for construction of a new, single sheet of ice that will be expanded to a
68.23 two-sheet facility in the future.
68.24 (d) The commission shall administer a site selection process for the ice centers. The
68.25 commission shall invite proposals from cities or counties or consortia of cities. A proposal
68.26 for an ice center must include matching contributions including in-kind contributions of
68.27 land, access roadways and access roadway improvements, and necessary utility services,
68.28 landscaping, and parking.
68.29 (e) Proposals for ice centers and matching grants must provide for meeting the demand
68.30 for ice time for female groups by offering up to 50 percent of prime ice time, as needed, to
68.31 female groups. For purposes of this section, prime ice time means the hours of 4:00 p.m.
68.32 to 10:00 p.m. Monday to Friday and 9:00 a.m. to 8:00 p.m. on Saturdays and Sundays.

69.1 (f) The location for all proposed facilities must be in areas of maximum demonstrated
69.2 interest and must maximize accessibility to an arterial highway.
69.3 (g) To the extent possible, all proposed facilities must be dispersed equitably, must be
69.4 located to maximize potential for full utilization and profitable operation, and must
69.5 accommodate noncompetitive family and community skating for all ages.
69.6 (h) The commission may also use the money to upgrade current facilities, purchase girls'
69.7 ice time, or conduct amateur women's hockey and other ice sport tournaments.
69.8 (i) To the extent possible, 50 percent of all grants must be awarded to communities in
69.9 greater Minnesota.
69.10 (j) To the extent possible, technical assistance shall be provided to Minnesota
69.11 communities by the commission on ice arena planning, design, and operation, including the
69.12 marketing of ice time and on projects described in paragraph (b).
69.13 (k) A grant for new facilities may not exceed $250,000.
69.14 (l) The commission may make grants for rehabilitation and renovation. A rehabilitation
69.15 or renovation grant for air quality may not exceed $200,000 and a rehabilitation or renovation
69.16 grant for R-22 elimination may not exceed $50,000 $250,000 for indirect cooling systems
69.17 and may not exceed $400,000 $500,000 for direct cooling systems. Priority must be given
69.18 to grant applications for indoor air quality improvements, including zero emission ice
69.19 resurfacing equipment, and for projects that eliminate R-22.
69.20 (m) Grant money may be used for ice centers designed for sports other than hockey.
69.21 (n) Grant money may be used to upgrade existing facilities to comply with the bleacher
69.22 safety requirements of section 326B.112.
69.23 Sec. 6. Minnesota Statutes 2018, section 363A.36, subdivision 1, is amended to read:
69.24 Subdivision 1. Scope of application. (a) For all contracts for goods and services in
69.25 excess of $100,000, no department or agency of the state or public officer or agency subject
69.26 to section 16A.695 shall accept any bid or proposal for a contract or agreement from any
69.27 business having more than 40 full-time employees within this state on a single working day
69.28 during the previous 12 months, unless the commissioner is in receipt of the business'
69.29 affirmative action plan for the employment of minority persons, women, and qualified
69.30 disabled individuals. No department or agency of the state shall execute any such contract
69.31 or agreement until the affirmative action plan has been approved by the commissioner.
69.32 Receipt of a certificate of compliance issued by the commissioner shall signify that a firm

70.1 or business has an affirmative action plan that has been approved by the commissioner. A
70.2 certificate shall be valid for a period of four years. A municipality as defined in section
70.3 466.01, subdivision 1, that receives state money for any reason is encouraged to prepare
70.4 and implement an affirmative action plan for the employment of minority persons, women,
70.5 and the qualified disabled and submit the plan to the commissioner.
70.6 (b) This paragraph applies to a contract for goods or services in excess of $100,000 to
70.7 be entered into between a department or agency of the state or public officer or agency
70.8 subject to section 16A.695, and a business that is not subject to paragraph (a), but that has
70.9 more than 40 full-time employees on a single working day during the previous 12 months
70.10 in the state where the business has its primary place of business. A department or agency
70.11 of the state may not execute a contract or agreement with a business covered by this paragraph
70.12 unless the business has a certificate of compliance issued by the commissioner under
70.13 paragraph (a) or the business certifies that it is in compliance with federal affirmative action
70.14 requirements.
70.15 (c) This section does not apply to contracts entered into by the State Board of Investment
70.16 for investment options under section 356.645.
70.17 (d) The commissioner shall issue a certificate of compliance or notice of denial within
70.18 15 days of the application submitted by the business or firm.
70.19 Sec. 7. Minnesota Statutes 2018, section 363A.36, subdivision 4, is amended to read:
70.20 Subd. 4. Revocation of contract. A contract awarded by a department or agency of the
70.21 state, or a public officer or agency subject to section 16A.695, may be terminated or abridged
70.22 by the department or agency, or public officer or agency subject to section 16A.695, because
70.23 of suspension or revocation of a certificate based upon a contractor's failure to implement
70.24 or make a good faith effort to implement an affirmative action plan approved by the
70.25 commissioner under this section. If a contract is awarded to a person who does not have a
70.26 contract compliance certificate required under subdivision 1, the commissioner may void
70.27 the contract on behalf of the state.
70.28 Sec. 8. Minnesota Statutes 2018, section 363A.44, subdivision 1, is amended to read:
70.29 Subdivision 1. Scope. (a) No department, agency of the state, the Metropolitan Council,
70.30 or an agency subject to section 473.143, subdivision 1, or a public officer or agency subject
70.31 to section 16A.695, shall execute a contract for goods or services or an agreement for goods
70.32 or services in excess of $500,000 with a business that has 40 or more full-time employees
70.33 in this state or a state where the business has its primary place of business on a single day

71.1 during the prior 12 months, unless the business has an equal pay certificate or it has certified
71.2 in writing that it is exempt. A certificate is valid for four years.
71.3 (b) This section does not apply to a business with respect to a specific contract if the
71.4 commissioner of administration determines that application of this section would cause
71.5 undue hardship to the contracting entity. This section does not apply to a contract to provide
71.6 goods and services to individuals under chapters 43A, 62A, 62C, 62D, 62E, 256B, 256I,
71.7 256L, and 268A, with a business that has a license, certification, registration, provider
71.8 agreement, or provider enrollment contract that is prerequisite to providing those goods and
71.9 services. This section does not apply to contracts entered into by the State Board of
71.10 Investment for investment options under section 352.965, subdivision 4.
71.11 Sec. 9. Minnesota Statutes 2018, section 462A.37, is amended by adding a subdivision to
71.12 read:
71.13 Subd. 2f. Additional authorization. In addition to the amount authorized in subdivisions
71.14 2 to 2e, the agency may issue up to $120,000,000 in housing infrastructure bonds in one or
71.15 more series to which the payments under this section may be pledged.
71.16 Sec. 10. Minnesota Statutes 2018, section 462A.37, subdivision 5, is amended to read:
71.17 Subd. 5. Additional appropriation. (a) The agency must certify annually to the
71.18 commissioner of management and budget the actual amount of annual debt service on each
71.19 series of bonds issued under subdivisions 2a, 2b, 2c, 2d, and 2e to 2f.
71.20 (b) Each July 15, beginning in 2015 and through 2037, if any housing infrastructure
71.21 bonds issued under subdivision 2a remain outstanding, the commissioner of management
71.22 and budget must transfer to the housing infrastructure bond account established under section
71.23 462A.21, subdivision 33, the amount certified under paragraph (a), not to exceed $6,400,000
71.24 annually. The amounts necessary to make the transfers are appropriated from the general
71.25 fund to the commissioner of management and budget.
71.26 (c) Each July 15, beginning in 2017 and through 2038, if any housing infrastructure
71.27 bonds issued under subdivision 2b remain outstanding, the commissioner of management
71.28 and budget must transfer to the housing infrastructure bond account established under section

72.27 Sec. 11. Laws 2015, First Special Session chapter 5, article 1, section 10, subdivision 7,

73.6 acquisition is completed, the city may use any
73.7 remaining money appropriated in this
73.8 subdivision for construction of the extension.
73.9 Notwithstanding Minnesota Statutes, section
73.10 16A.642, the bond sale authorization and
73.11 appropriation of bond proceeds for the project
73.12 in this subdivision are available until
73.13 December 31, 2021 2023.
73.14 Sec. 12. Laws 2017, First Special Session chapter 8, article 1, section 18, subdivision 3,
73.15 is amended to read:
73.16 Subd. 3. Minneapolis Veterans Home Truss 73.17 Bridge Project 7,851,000
73.18 To design, construct, renovate, and equip the
73.19 historic truss bridge on the Minneapolis
73.20 Veterans Home campus, including asbestos
73.21 and hazardous materials abatement and
73.22 associated site work. The unspent portion of
73.23 this appropriation after the project has been
73.24 substantially completed, upon written notice
73.25 to the commissioner of management and
73.26 budget, is available for asset preservation of
73.27 veterans homes statewide under Minnesota
73.28 Statutes, section 16B.307. Minnesota Statutes,
73.29 section 16A.642, applies from the date of the
73.30 original appropriation to the unspent amount
73.31 transferred.

74.1 Sec. 13. Laws 2018, chapter 214, article 1, section 2, subdivision 6, is amended to read:

74.3 To predesign, design, and renovate the
74.4 Historic Glensheen Estate including but not
74.5 limited to the main house; the site structures,
74.6 terraces, and garden walls; and the carriage
74.7 house. This appropriation is not available until
74.8 the commissioner of management and budget
74.9 determines that an equal amount is committed
74.10 from other sources. A portion of the total
74.11 appropriation may be made available for a
74.12 discrete project or phase that is part of the
74.13 renovation when the commissioner of
74.14 management and budget determines that an
74.15 equal amount is committed from nonstate
74.16 sources that will allow that discrete project or
74.17 phase to be completed.
