    Over the Years Indra Rai Sharma Over the Years -A Photo Autobiography In 2010 before going to US, I had been going through my old papers. As it appeared, I had wished to pen down my autobiography long back. In my diary on February 10, 1963, I had written that if I would ever write my autobiography, I would caption it ‘My Life and Dreams’. In 1997 again, in my acceptance letter to the notice regarding my impending retirement that I sent on June 23, to Mr. A. Sankara Narayanan, Executive Director, M/S Hindustan Motors, I wrote: “I wish I could pen down my years at HM some day and hope that it would provide useful insight for our budding engineers as Lee Iacocca’s biography or the book ’On a clear day you can see General Motors’ provided to millions of it readers.’ I knew that I was not that great a name in HM or industry, though I aspired to be one. Perhaps I didn’t select the right profession or I couldn’t take advantage of the opportunity that I got to convert the same to become big. I remember my teasing of my grandmother and later on my mother in school days by telling them time and again that they should not expect me to do routine household work, as I would be a big man. Later on I joked with some close friends and their wives that one day I would get into number 1 Rajpath. I meant Rastrapati Bhawan. I failed to become as great or big as I wanted but I did work very hard for every assignment that I got.

Enjoy… There may be trouble ahead… Car production in the UK for the 11 months to November 2019 was just over 1.23m units1, a fall of 14.5 per cent year-on-year. The full year figures (due out at the same time as this book was published) will likely be around 1.32m. The November fall was actually 16.5 per cent, due in part to scheduled shutdowns at some vehicle plants in anticipation of the UK leaving the EU without a deal on October 31. Disappointing sales of old models and planned model changeovers (e.g. the Nissan Juke switch to a new model led to zero output for several months in 2019) did not help the production environment last year. As well as declining production volumes, the vehicle manufacturing sector had – according to the Society of Motor Manufacturers and Traders SMMT – borne Brexit-related costs and contingency measures valued at more than £500m.

So Nissan has decided to remain in the UK; how soon and how much new investment will take place here remains to be seen; but Nissan keeping its existing assets going is good news, for now. How far its operations remain oriented to Europe or become more UK-focused will be interesting to observe. In truth, with even the thin UK-EU deal which was agreed at the end of 2020, Nissan was always much more likely to stay than go. Nissan made clear that without the deal, the plant would have closed; even so, this is not winning the Premier League – it is staying in it, with difficulty, rather like Burnley seems to do each year. So while Nissan Sunderland might be akin to Burnley (in Premier League survival terms!), what of Vauxhall Ellesmere Port? Will it be Burnley Mark 2 (a Crystal Palace if you will) or will it be Nottingham Forest, finally departing the league and seemingly never to return? One way or another, the future of Vauxhall Ellesmere Port will soon be decided. PSA is weighing up whether to invest there to make new models, either the new Astra (which will definitely be made in Germany irrespective of the Ellesmere Port decision) or possibly other models based on PSA platforms. Speaking on the day after the merger of PSA and FCA was confirmed and the new company, Stellantis, saw its shares launched on the stock market, CEO Carlos Tavares said the outcome will be known within a few weeks.

This appeal is about equitable relief from forfeiture. Specifically, the question is whether the court has jurisdiction to grant such relief from the loss (to use a neutral word) of rights to make specified use of neighbouring land granted in a perpetual licence, where that loss of use is occasioned by the exercise of a right of termination for breach of an obligation to pay a sum due under the licence. In the present case the sum due was £50, whereas the annual value of the rights which would be lost upon termination is agreed to be in excess of £300,000. 2. Relief from forfeiture is one of those equitable remedies which plays a valuable role in preventing the unconscionable abuse of strict legal rights for purposes other than those for which they were conferred. But it needs to be constrained with principled boundaries, so that the admirable certainty of English law in the fields of business and property is not undermined by an uncontrolled intervention of equity in any situation regarded by a judge as unconscionable.
