MINUTES OF THE MEETING OF PARISH COUNCIL HELD ON TUESDAY 13TH NOVEMBER 2018 IN THE ROSE ROOM, SWALLOWFIELD PARISH HALL, SWALLOWFIELD STREET, SWALLOWFIELD AT 7.30PM

874 QUESTIONS OR COMMENTS FROM MEMBERS OF THE PUBLIC

874.1 Resident – I am here to talk about the field off Part Lane next to Oakleigh House. The owner is importing loads of old timber and other material onto the site. Four weeks ago he fired up a bio-mass boiler attached to a log dryer. The boiler is supposed to burn logs and straw but the smoke would suggest that he is also burning other material such as rubber, plastic or oil. The resultant particulates are damaging to my health I and believe that this is not acceptable so close to residential properties. I have reported this to the Environmental Health Team at Wokingham Council and I would like to understand what the Parish Council can do to help resolve this issue. Cllr. Anderson – we are aware of the situation and will be discussing our stance later in the meeting. Our borough councillor has been talking to the Planning Team at Wokingham to establish whether the occupant has planning permission for the boiler.

876 MINUTES OF LAST MEETING

876.1 It was PROPOSED and seconded that the minutes of the Parish Council meeting held on 9th October 2018 be APPROVED. All in favour. 2

877 CLERKS REPORT

877.1 Update on items from previous meetings

877.2 829.1.1 Fox’s Run – it was NOTED that work has begun. Photographs of the area prior to commencement and initial work have been loaded onto Google. Further photographs will be loaded as received, however, they don’t really do justice to the effort put in. Cllr. McDonald had visited the site and is delighted with the progress.

877.3 833.1 WW1 Memorial – it was NOTED that the “There but not there solider” and a memorial plaque had been installed on the side of the parish hall. A number of residents had complemented the Parish Council on its choice of memorial.

877.4 864.2 Surfacing repaired – it was NOTED that the surface repairs at Swallowfield Recreation Ground had been completed and that all Medium Risk items raised in the Quarterly Report had been addressed as had many of the Low and Very Low Risk items.

877.5 865.1 Advert in the Loddon Reach – it was NOTED that the advert in Loddon Reach has been updated to advertise all our rooms, not just the Rose Room. 3

877.6 867.1 Swallowfield Parish Hall, Portable Appliance Testing (PAT) – it was NOTED that this testing took place on 18th October 2018, all appliances passed.

877.7 Other items

877.8 Loan – it was NOTED that the scouts had paid the final instalment of the loan which Swallowfield Parish Council granted them to pay WBC for the road closure required for the Fun Run.

877.9 WBC Clerk’s Forum – it was NOTED that the Clerk attended this meeting on 30th October. A representative of the Localities Team, WBC gave a very interesting talk about how WBC are going to encourage self-service by putting resources into community hubs (generally libraries). She also explained how they intend to engage with the parish/town councils and create a blueprint for each parish. The clerks also discussed issues with the new planning portal, feedback would be send to WBC.

877.10 Internal Auditor – it was NOTED that the Internal Auditor will make her first visit for the 2018/2019 Audit on Friday 30th November 2018.

877.11 Car Park, Swallowfield Parish Hall – it was NOTED that temporary repairs have been made to the largest potholes in the car park using scalpings. These would be topped up until the car park project can get underway.

880.1 Accounts

880.1.1 Accounts – it was NOTED that the monthly accounts had been circulated. It was PROPOSED and seconded that these were accepted. All in favour.

880.1.2 Bank Reconciliation Statements – it was PROPOSED and seconded that the Bank Reconciliation Statements be signed. All in favour. 7

880.1.3 CIL – it was NOTED that the council had received a CIL payment of £23,609.34, this money would be transferred to the reserved account as agreed on 8th Nov 2016, resolution 388.5.

880.2 Audit – it was NOTED that the audit report had been received and that the auditor had sent an email confirming that item 3 would not have been raised had the auditor considered documents which the RFO had submitted prior to issuing the report. The information requested had also been submitted with the original submission.

It was NOTED that the report had been published on the council website.

The report would be reviewed by the Finance Working Group.

880.3 Accounting Software – it was NOTED that the accounting software, Sage, would require an upgrade at the end of the financial year due to changes in HMRC report requirements at a cost of £350 plus VAT.

880.4 Investment Management – it was NOTED that a letter from Charles Stanley had been received informing the council that the Financial Conduct Authority (FCA) had advised them that the council does not need to renew its Legal Entity Identifier (LEI) on an annual basis.

It was PROPOSED and seconded that the council would accept this advice and confirm to Charles Stanley that renewal of the registration is not required. All in favour. 8

882 PROPERTY (Fieldfare, Halls, Land)

882.1 Commercial Lease – it was PROPOSED and seconded that the commercial lease be amended to exclude the 6 month rolling break clause and the existing tenant be given first refusal under appropriate conditions to sign a new lease following the expiry of the lease currently to be signed. All in favour. 11

882.2 Van Demans - it was PROPOSED and seconded that the rent for Van Demans for 1st February 2019 to 31st Dec 2019 remains at £850 per annum. All in favour. 12

883 RESILIENCE (Flooding/ditches/rivers/Flood Resilience Group (FRG)) Lead Councillor: Cllr. A. King

883.1 Flood Resilience Group (FRG)

883.1.1 Meeting – it was NOTED that the last meeting took place on 29th October 2018. Notes had been received and circulated.

883.1.2 Chair - it was PROPOSED and seconded that Graham Stanley and Mark Binns be appointed as co-chairs of FRG. All in favour.

883.2 Ditch Maintenance – it was NOTED that the outgoing co-chair of FRG, Geoff Stephens, led a walk of the ditches on 5th November and had submitted a report of the work required this year. 13

883.3 Flood Resilience Equipment – it was NOTED that the next training session would take place on Saturday 24th November 2018, 09:30 in the Davies Room.

884 ENVIRONMENT (The Marshes/Van Demans/Swallowfield Meadow/Community/Orchard/ Biodiversity/Footpaths/Waste/NAG/RCAG) Lead Councillor: Cllr. A. King

884.1 The Fields NAG – it was NOTED that the AGM would be held on Wednesday 21st November at 7:30pm in Parish Hall. This would be followed by a committee meeting at 7:45pm. Cllr. McDonald would attend.

884.2 RCAG – it was NOTED that the last meeting was held on 5th November 2018. Cllrs. Dance, King and McDonald attended. Cllr. Dance reported that the meeting was better attended and due to the success of earlier initiatives the focus was shifting towards prevention rather than action. Notes had been received and circulated.

884.3 The Marshes – it was NOTED that the Riseley Common residents had met to discuss the next phase of work and the next working party would be held on 1st December 2018.

885 HALLS (Maintenance/website/involvement with users/Marketing and Entertainment Groups) Lead Councillor: Cllr. M. McDonald

885.1 Riseley Memorial Hall and Sports Pavilion – it was NOTED that the 5 year electrical condition testing had taken place. The report has highlighted areas which should be addressed.

It was PROPOSED and seconded that the work be carried out as soon as it can be scheduled at a cost of £840 plus VAT. All in favour. 14

885.2 Fire Safety Training – it was NOTED that Cllr. McDonald and the Clerk attended this training course on 8th November 2018. The course also covered the use of community buildings as Reception and Rest Centres during emergency situations. Cllr. McDonald would prepare a summary report with recommendations. 15

It was PROPOSED and seconded that the Clerk engages an expert to carry out a full fire risk assessment at Swallowfield Parish Hall, Riseley Memorial Hall and Sports Pavilion and Fieldfare House. 16

886 COMMUNICATIONS (Newsletter/Website/Annual Report/Media) Lead Councillor: Cllr. G. Collender

886.1 Winter Newsletter – it was NOTED that the copy deadline date for the next newsletter is 30th November 2018.

887 TRANSPORT (Road issues/speeding/public transport/police liaison) Lead Councillor: Cllr. J. Wheelwright

887.1 Civil Parking Enforcement – it was NOTED that Wokingham Borough Council (WBC) is planning to make changes to parking restrictions on Spring Gardens at its junction with the Basingstoke Road. Any comments regarding these changes should be sent WBC by 16th November.

888 BOROUGH FORUMS/MEETINGS

888.1 Borough Plan Consultation (WBC) – it was AGREED that the response prepared by Cllr. King would be submitted. It was NOTED that this consultation had been renamed Wokingham Together. 17

888.2 Polling Stations – it was NOTED that as required by the Electoral Registration Act 2013 Wokingham Borough Council is conducting a review of its polling districts and places; any comments should be sent to WBC by 16th November 2018. The council AGREED that the current arrangements for the parish were appropriate so would not comment.

888.3 Wokingham Local Plan Update – it was NOTED that a briefing session was held on 8th November, Cllr. Binns attended. An additional session would be held on Thursday 15th November, Cllr. Wheelwright would attend.

889 OUTSIDE ORGANISATIONS

889.1 Farley Estate – it was NOTED that Cllrs. Anderson, Dance, King and Wheelwright and the Clerk met with Natalie Gaibani, CEO Farley Estate. The meeting was very productive and dialogue would continue in a number of areas.

889.2 Citizens Advice – it was NOTED that the council had received a letter acknowledging the grant and thanking the council for its continued support.

889.3 AWE Local Liaison Committee – it was NOTED that Mr Jeff Moss attended the last meeting held on 7th November, his comments and the Chairman’s notes had been circulated.

890 CORRESPONDENCE

890.1 Mr Max Bowker – it was NOTED that the council had received a letter from the executor of Mr Bowker’s estate informing the council that he had left a legacy of £15,000 to the Parish Council provided that it spends it on an ‘event’ for the Parish. The council would be interested in hearing from anyone with ideas for an appropriate event.

879.1 Current Applications

Swallowfield RG7 1TH The council had hoped that The Crown would be able to provide on-site accommodation at the expiry of the previous temporary permission (VAR/2013/1455), but this has not happened.

The council do not object to the application but ask that the all same conditions are applied, particularly the time limit and restriction that there is no vehicular access. The site is outside the settlement boundary and the council would not like to see permanent development.

It was PROPOSED and seconded that the council should comment as above. All in favour.

879.1.2 182498 Cow City Church Full planning application for the proposed erection of an outdoor manège with floodlights Lane Farley Hill ancillary to residential dwelling, and reallocation of the farm track. RG7 1UP The Council does not object to this application but would like to see stringent specifications applied to ensure that flood lights are masked from Farley Hill House, Corner Cottage and traffic on Church Lane. The Council would also like to see conditions on operating hours which ensures that the lights are not used after 7pm.

Business Park Basingstoke Road Swallowfield Parish Council OBJECTS to this application for the following reasons: Swallowfield • Lack of parking provision – there is already plenty of parking spilling further up on Lambs Lane. Each of these units has a single parking space in front of the shuttered entrance. This is not sustainable and will lead to further parking issues in the locality. • More traffic using the entrance close to the school with associated concerns for road safety of the children and local air quality. • Inadequate provision to mitigate water run-off. The proposal to use soak-away model is not sustainable with the size and scale of the site a s a whole.

879.1.6 182756 Applegarth Householder application for the proposed conversion of existing disused stable building to Basingstoke Road create habitable accommodation annex. Riseley RG7 1QD The council does not object to this application, however, it would like to see conditions to ensure that the use is adjunct to the occupation of Applegarth. The council would also ask that Wokingham confirms that the area is within the residential curtilage of Applegarth as, if it is not, its conversion would set a dangerous precedent.

879.1.7 182808 Winkworth Ltd Unit E Full planning application for the proposed erection of light industrial units M2 and M3 with Lambs Farm vehicle parking and ancillary works within existing Business Park. Business Park, Basingstoke Road Swallowfield Parish Council OBJECTS to this application for the following reasons: Swallowfield • Lack of vehicle waiting area outside the units – there is nowhere to park and open the RG7 1PQ shutters without blocking the site. • Density of units – access through the site would be hugely difficult for any vehicles larger than a small van. This will lead to more challenges for the parking spilling out of the site. • More traffic using the entrance close to the school with associated concerns for road safety of the children and the local air quality. • Inadequate provision to mitigate water run-off. 879.1.8 182824 Loddon Court Farm Application to remove condition 2 and 3 of planning consent F/1999/69401 for the proposed Meadow View Day change of use of farmhouse to day Nursery (D1) for up to 38 children. Condition relates to not Nursery more than 38 children shall attend the day nursery and condition 3 relates to staff Beech Hill Road accommodation bed sitting room shall be retained as residential accommodation only and shall RG7 1HT not be used for day nursery purposes. The council would like to express its concerns about the increased traffic which will result from an increase in children and staff necessary to support that increase. Application 152250 to provide a dedicated car park and drop off area to improve safety for parents and staff was refused (this area would have been on the opposite side of the access road and the Council had expressed reservations about potential conflict between pedestrians and traffic on the road). What provision will be made to ensure the safety of children and staff given this increase? If this application is approved the council would like to see a condition which sets an appropriate limit on the number of children as the application does not specify how many children the nursery is planning to accommodate. It was PROPOSED and seconded that the council should comment as above. All in favour.

879.1.9 182827 Oak Cottage Householder application for the proposed erection of part single storey side/rear extension Basingstoke Road following the demolition of existing storage, part two storey rear extension, alterations to the Swallowfield pitched roof over the proposed and existing rear extensions, insertion of a Juliet balcony and a RG7 1PY balcony on the first floor and changes on the fenestration.

The council has no comment on this application.

879.1.10 182838 Nutbean Farm Householder application for the proposed erection of an ancillary outbuilding following Nutbean Lane demolition of existing shed. Swallowfield RG7 1XL The council OBJECTS to this application. This application is a variation to application 181205 which the council also objected to for the following reason:

"....it is out of keeping with the location, out of keeping with the size of the property to which it is attached. Paragraph 55 of the NPPF restricts building in the countryside except where there is a specific local requirement. None of the exceptions apply in this case."

The council sees no reason why the planning policy would be applied differently to this new application.

This is accommodation that is separate from the main dwelling and is only loosely and artificially linked to the farm business.

879.1.12 182991 Fairlands Caravan Application to vary condition 1 to remove named occupants and remove condition 2 of appeal Site, Church Road, planning consent (F/211/2602). Farley Hill The council strongly OBJECTS to this application. The original Inspectorate appeal decision (Appeal A: APP/X0360/A/13/2195054) that led to the permission in question concluded that the site was not suitable as a gypsy and traveller site as the Inspector noted that a permanent site would lead to “unacceptable planning harm given the conflict with the Development Plan”. Consequently the approval was granted on a temporary basis and based solely upon the personal circumstances of the families living there at that time. The consent was designed to give them time to relocate to a suitable approved site and set a backstop of four years. It is believed that those families moved off the site during 2015. To vary the consent would go against and effectively nullify that original carefully considered and balanced judgement.
