CALL TO ORDER Chairman, H. Rondeau, called the meeting to order at 9:30 a.m.

John Andrew, Area Planner, Yellowhead Regional Planning Commission attended the meeting at 9:30 a.m.

GENERAL Mr. Andrew informed Council as to what the current status MUNICIPAL is of the General Municipal Plan. Mr. Andrew reviewed PLAN the draft General Municipal Plan with Council and requested feedback. 104/89 Moved by B. Booth that the information provided by John Andrew, Area Planner, regarding the draft General Municipal Plan, be received for information.

CARRIED.

BIRCHKOOD Mr. Stan Bucar, representing Birchwood Village Greens VILLAGE attended the meeting at 9:40 a.m. GREENS Mr. Bucar presented Council with a pamphlet regarding Birchwood Village Greens. He indicated that Phase One should be completed by September and that construction of Phase Three is planned at that time.

Mr. Bucar requested tax concessions on the unsold parcels of land as well as on the Club House.

Mr. Eriksson requested that Mr. Bucar make this request in writing in order that Council may further review this request.

BUCK CREEK By-Law No. 32-89 - To Authorize the Municipal Council LANDFILL SITE of the Municipal District of Brazeau No. 77 to enter into agreements with her majesty the Queen in the Right of Alberta (Represented by the Minister of Environment).

S.R. 620 Additional Passing Lanes Discussion was held regarding additional passing lanes on S.R. 620. Mr. Rondeau indicated that a meeting will* be held on February 1 at 7:00 p.m. at the Violet Grove Hall and shared with members of Council concerns received from ratepayers. 110/89 Moved by W. Tweedle that the information provided by Mr. Rondeau regarding S.R. 620 be received for information.

ROAD NAMING Breton and District Historical Society 111/89 Moved by J. Coombes that the Breton and District Historical Society be contacted in order to find out what roads are to be named and that Administration include these signs in the 1989 budget.

SUBDIVISION N 1/2 33-48-7 W5M - Albert Hodgson APPLICATION Mr. Wardlow summarized the report as presented to Council.

Mr. Andrew indicated that a waiver may be required as this proposed subdivision is within the five-mile limit of Drayton Valley. He also indicated that he would have PI no difficulty in recommending this subdivision for approval.

Mr. Hodgson indicated that he has spoken to Alberta pi Transportation and a resolution is forthcoming.

112/89 Moved by N. Norton that the subdivision of the N 1/2 33-48-7 W5M - Albert Hodgson - be approved SI subject to the following conditions:

1) Taxes to be paid. 2) Access to all parcels to be to the satisfaction of the Director of Public Works (without the requirement of a deposit) and Alberta Transportation and Utilities. 3) Direct Highway 22 access to the existing isolated parcel A as per requirements of Alberta Transportation. 4) Cash in lieu of Municipal Reserve to be paid on the created Parcel A and deferred to the remaining two (2) parcels. 'PI 5) A waiver be obtained of subdivision regulations 20, 22 and 23.

HODGSON SAND Pt. of Sec. 25625 - 47-8 W5M - Mr. B. Hodgson AND GRAVEL Lease Application

Mr. Wardlow discussed the lease application with Council.

113/89 Moved by W. Tweedle that with regards to the lease application - Pt. of Sec. 25625 - 47-8 W5M - PI B. Hodgson:

1) The applicant obtain all necessary permits from Public Lands, Water Resources, and Environment as deemed necessary. 2) The applicant obtain and adhere to the development permit from the Municipal Planning Commission.

Petition for Road Access

p Mr. Eriksson summarized the petition for road access with Council and indicated that the road would have to be brought up to the municipality's standards at the petitioner's expense as required under the Petition •pi and Municipal Government Act.

Mr. Hodgson indicated that the petition was not intended for road construction.

114/89 Moved by N. Norton that the petition for road access through portions of the South East quarter of Section 25 and North West quarter of Section 24, both in Township 47, Range 8, West of the Fifth Meridian be denied.

115/89 Moved by B. Booth that a contribution of $12,208.00 be made to the Breton and Rural Fire Protection Association for the construction* of a fire hall upon signing of a capital contribution agreement.

116/89 Moved by B. Booth that the Municipal Manager be authorized to begin preliminary discussions with the Breton and Rural Fire Protection Association r^j? and the Village of Breton to enter into an operating agreement.

CARRIED.

PESTICIDE Mr. Eriksson introduced Barbara Shackel, Agricultural CONTAINER Fieldman, to Council. SITE Mr. Rondeau welcomed Miss Shackel to the Municipality.

Miss Shackel indicated that the grant application for the Pesticide Container Site must be submitted by 89 02 01. She also indicated that complete specifications have not been completely developed as of yet.

Mr. Woloszyn summarized for Council the cost and design of constructing a Pesticide Container Site.

117/89 Moved by B. Booth that administration proceed with the grant application for a Pesticide Container Site as presented.

SUBDIVISION SE 1-51-7 W5M APPLICATION /-~"\ Mr. Roberge summarized the subdivision application with Council and recommended that the M.D. of Brazeau not object to this subdivision. 1 118/89 Moved by N. Norton that the Municipal District of Brazeau No. 77 not object to the subdivision at SE 1-51-7 W5M - l-S-89, within the County of Parkland No. 31.

LEASE Sanitary Landfill Transfer Stations - 50-10 W5M; SW 3 APPLICATIONS Cynthia - 47-9 W5M; NW 31 Lodgepole

Discussion was held regarding the above lease applications. 119/89 Moved by J. Coombes that the following lease applications be approved:

1) M.D. of Brazeau - 50-10 W5M; SW 3 - Cynthia 2) M.D. of Brazeau - 47-9 W5M; NW 31 - Lodgepole

for Sanitary Landfill Transfer Stations.

WATER Mr. Eriksson indicated that proposals should be sought EROSION to undertake an Engineering Study for this water erosion P> problem.

Mr. Tatro indicated that this study is necessary. He also indicated that an application for grant funding would be submitted.

120/89 Moved by B. Booth that approval to seek engineering study proposals regarding the water erosion problem is E 1/2 - NE 16-47-7 W5M be given.

BUCK CREEK Request for Funding ^1 HALL Discussion was held regarding the possibility of a donation to the Buck Creek Community Association.

121/89 Moved by J. Coombes that:

(1) A Grant of $10,000.00 be made to the Buck Creek Community Association for floor repair; (2) the Buck Creek Community Association not be considered for a CRC grant for two years. (3) The floor repair be inspected by the Municipal District.

CARRIED. r F.C.S.S. Mr. Coombes indicated that he would like the M.D. to CARE LINE purchase 10 Life Lines for residents requiring this service. 122/89 Moved by J. Coombes that the Municipal District of Brazeau purchase 10 Life Line units for home •pft monitoring.

FIRE Mr. Wardlow summarized a report as presented to Council. PREVENTION TRAINING 124/89 Moved by B. Booth that M. Anderson, and up to two (2) area Fire Guardians, if desired, take the fire prevention 1 Training Course at the M.D.'s cost for mileage, direct course fees and a maximum of $200.00 for other related costs.

SALE OF Mr. Tatro summarized a report as presented to Council. PI CLARK LOADER 125/89 Moved by B. Booth that the Clark 125B loader be sold to R. Angus Alberta Limited for the sum of $24,010.00.

PRELIMINARY Mr. Eriksson discussed a report regarding the budget BUDGET with Council.

126/89 Moved by B. Booth that the interim capital budget in the amount of $492,700.00 requiring $97,200.00 from general municipal revenue be approved as attached.

127/89 Moved by N. Norton that Public Safety Services be authorized a pre-budget approval for uniforms and miscellaneous equipment up to $5,000.00.

128/89 Moved by W. Tweedle that authorization be given for the leasing of six Aurora Cellular phones for Public Works and Public Safety Services.

GRADER Mr. Tatro summarized a report and an analysis regarding ACQUISITION the approval of grader acquisition with Council.

129/89 Moved by B. Booth that:

(1) Blackwood Hodge be awarded the contract to supply one 780A Champion Grader at a cost of $192,300.00 less trade-in of two Champion graders at $65,000.00 for a net cost of $127,300.00.

(2) Blackwood Hodge be awarded the contract to supply one 730A Champion grader at a cost of $133,800.00 to be paid in January, 1990.

(3) Dozer blades be acquired for each machine to a maximum total of $7,000.00.

Area Structure Plan.

Dear Sirs: Re: Proposed Subdivision - J.K. Smith & Assoc. Ltd. • YRPC File #88/89YH119-41 (Culshaw) 1 regret that I am unable to attend your Council meeting of February 9th. I offer the following comments on the subject subdivision proposal: 1. There have been no objections to the proposal from responding agencies with the exception of the Town of Drayton Valley. The Town has expressed concern that the proposal is not contained within an approved area structure plan, and that it lies within the 5 mile limit, thereby contravening Subdivision Regulation 20. 2 Both the health unit and Alberta Environment have suggested that a connection to the municipal sanitary sewer line which runs through the subject property be required. 3. The proposal fronts on a road which is likely to remain as it is regardless of how development occurs in the area in the future. The lots themselves could exist without seriously limiting options for future development. However, since landowners immediately to the north are, in part at my suggestion, preparing an area structure plan in support of their applications for subdivision, I find it difficult to support this subdivision in the absence of such a plan. 4 If the lots are to receive municipal services in the future, their size (frontage) is inefficient from a municipal cost/revenue point of view. 15. I recommend that Council not support the proposed subdivision. However, should Council wish to see the P.O. Dear Sir; Re;Culshaw subdivision application 1 N.W.%-Sec.3-49-7-5 YHRPC File No. 88/89Yhll9-41 As per your request, this letter is being written in support of the 1 above mentioned Culshaw application for subdivision in NwVSec.3-49-7-5.This letter will indicate that we have thoroughly investigated and considered the preparation of an area structure plan for this subdivision - and will give our 1 reasoning for not using the area structure plan concept 1n our application. Our reasons for not using the area structure plan are; | (1) When we considered using an area structure pi an,we thought that J we might incorporate it with The River Ridge Area Structure Plan being pre pared for land in Section 10 to the North,,and when given serious consideration, the following facts became quite evident;(a)The River Ridge Area Structure Plan had already been submitted to the Municipal District for processing and con sideration, and we estimated a minimum of six months delay would occur before « it could be presented again and (b)all of the drafting and plan preparation 1 would have to be redone and the extra costs would be prohibitive, and the Culshaw's would have to totally bear the burden of these costs and(c) it was our considered opinion that nothing would change -i.e the Culshaw parcel would 'I be handled exactly as the other parcels in The River Ridge Area Structure J Plan - acreages East of The Town of Drayton VaVIley sewer line and possibly some smaller lots West of the sewer line - h acre to "town lot" size. (2)The owners of the lands between The River Ridge Area Structure Plan and the Culshaw parcel,have,at the last known discussion with::them,absolutely no intention of being a part of, or paying for part of,or contributing to an area structure plan for their acreages - so that trying to add the Culshaw parcel to The River Ridge Area Structure Plan is almost a physical impossi bility, and so a new plan would have to start with the Culshaw's parcel. *1 (3)To further address the elimination of small lots West of the sewer line, it was felt that anyone looking for land as far away from The ^ Town of Drayton Valley as this subdivision is,would be looking for an acre- J age - not a "town sized" lot. The other reason, and by far the most impor tant one is the lack of a piped water supply, and of course the distance of the subdivision from the system of The Town of Drayton Valley. It was felt 1

that if The Town developed in the direction towards this subdivision, it would be many years before the water system arrived in this area, and of course the installation of a line to service one subdivision is much too expensive. It is also not practical to expect a well to be drilled on each " town sized lot".The location of the Culshaw's home would also seriously inhibit the design of small lots in that area. pi (4)The land East of the sewer line in this application is treated in the same manner as that in The River Ridge Area Structure Plan - i.e large parcels(minimum three acres) and intended to be serviced by their own sewage disposal system and a drilled well.Due to the topography, the utilization of the sewer line would require a gathering sewer main and a force main.A lift station would also be required to pump the sewage up hill.This is a very expensive process and contains a continuing mainten ance requirement with attendant costs as well. (5)Due to the proximity of the water system of The Town of Drayton Valley to The River Ridge Area Structure Plan, and due to the probable further development in The Town occurring across the road to the West in the very near future, a piped water system will be available, or can be made available to The River Ridge area, and consequently, the plan was designed with smaller lots West of the Town's sewer line.The difference in the land use concept alone makes it very difficultto combine the two subdivisions in the same area structure plan. We trust that our reasons for not having this proposal exist as part of an area structure plan are self evident, and that this application pi can be accepted by Council, and recieve a recommendation for approval. REPORT: The Municipal Assistance Grant is an uncondi tional grant provided on an annual basis. J Part of the formula in calculating this grant is based on population, equalized assessment and road mileage. The attached correspondence indicates the Department of Municipal Affairs has used 1988 data without consideration of our new territory.

The province recently announced a 5% Increase for the 1989 Municipal Assistance Grant program. The government's direction for this year 1s to continue towards the Implementation of the equitable municipal assistance grant formula. However, upon analysis It was determined that the phasing In of the formula should be extended. It was found that too many municipalities would have had to absorb significant decreases 1n their grants in 1989 had phasing in been completed. In continuing to progress towards the Implementation of the equitable grant formula, the celling for grants was reduced from 125% of equitable to 120% of equitable. The "floor" on grants was raised to 95.5% of equitable for 1989 from 91.5% in 1988. Additional funding was added to the Municipal Assistance Grant to address a couple of specific concerns. A number of Alberta's smallest municipalities do not have an assessment base adequate to provide for many fundamental administrative services. Accordingly the government has decided to establish a minimum level of municipal assistance to all municipalities. An additional grant will be r added to the regular grant entitlements to bring these municipalities up to the "minimum grant" level. For urban municipalities, counties and municipal districts the minimum grant will be $25,000. For improvement districts, summer villages and national park school divisions the minimum grant will be $2,000.

Further, under the implementation of the Municipal Assistance Grant program a number of municipalities would be receiving decreases due to the ceiling being reduced to 120%. The overall grant program has been increased to allow for special grants to those municipalities receiving decreases, according to the formula, to ensure their 1989 grant remains P5^ the same as their 1988 grant. The attached worksheet shows your municipality's specific municipal assistance grant, special assistance amount and how they are calculated.

p B. GRANT CALCULATION PROCESS i The process for determining each municipality's specific grant goes through the following steps: t 1. The 1989 "Equitable Grant" is calculated first. Your municipality's 1989 Equitable Grant is $101127. The is formula used to determine this grant is given in section C i below. r2. As the "phasing in" of the equitable grant formula is continued for 1989, the 1989 "Equitable Grant" has been compared to the 1988 Municipal Assistance Grant. F D. PHASING IN PROCESS:

When the Equitable Grant Formula was developed it was p found that many municipalities would be faced with major adjustments in their grants to come if the formula was adopted immediately. Accordingly, the Government decided to "phase in" the formula adoption process over a number of r years•

The "Phasing In" process for the implementation of the JP "Equitable Grant Formula" has three basic elements. First, a "Floor" was established whereby no municipality would receive less than a defined percentage of its Equitable Municipal Assistance Grant. Second, a "ceiling" was created where no municipality would receive more than a defined percentage of its Equitable Municipal Assistance Grant. Finally, all other municipalities who received grants PI between the "ceiling and the "floor" had their grants frozen at the amount received in the previous year. .a\o

These are presently active road allowance leases which have been passed over to us from the County of Leduc No. 25 and the County of Parkland No. 31. All of these leases have been paid up for 1989. I believe these should be shown to Council for recognition and blanket ID approval.

The amount being paid for these leases I believe to be in line with our neighboring municipalities. However, I will be reviewing these in the coming year and submit a recommendation for the 1990 renewals. r ^

We have recently purchased some property in Rocky Rapids along Highway 22. NW 33-49-7 WS Plan 772 2959 BLK 4.

According to the map, between Watson Road and the Government Road Allowance < road plan 250:2 J. Y. ') is reserve area BLK 6. Our neighbors to the North to us are screened from the highway by bush growing on this reserve area. but the area f ronting our proper ty is bare.

We would like to have some trees planted there to serve as a sound w> barrier, and to make it more visually appealing to ourselves, and to d ass i nq i'tio to r is ts .

In the past, trees were available to landowners for windbreaks and yard improvements through the county of Leduc, and I am hoping the Municipal District of ESrazeau No. 77 has a similar program that we may make use of.

Please let me know what improvements may be made.

SUBJECT: 1988 CRC FUNDING

RECOMMENDATION (1) That the amount of $7,037.00 be paid to the D.V. Library as a contribution to 1988 operations.

(2) That the amount of $15,581.00 be held in reserve until an agreement is completed with the Town of Drayton Valley covering cost sharing on the new library facility.

(3) That the amount of $2,000.00 be held in reserve and utilized in 1989 for the preparation of a Recreation Master Plan.

REPORT: The 1988 CRC funding has now been received. The total of $24,618.00 was applied for the following purposes:

1. Master Plan $ 2,000.00 2. D.V. Library Operation 7,037.00 3. D.V. Library Expansion 15,618.00 $24,618.00

The above recommendation provides for the distribution as directed in the original application.

15^ Duane's Auto Service operated a car wash operation until late September 1988. At that time the operation was discontinued and the service closed. A sewer charge of $50.00 for the two month bill cycle was applied to the canmercial operation of the car wash. Mrs. Hazel Bolianatz has advised us in writing of the change in operation and requested termination of the sewer charge.

I recoitiTend the termination of the $50.00 charge and cancellation of the $100.00 of arrears for the period of September to December 1988.

SUBJECT: Bill Fleming's Membership in the Government Finance Officers' Association

RECOMMENDATION: (1) That Bill Fleming's membership in the Government Finance Officer's Association be approved.

(2) That Bill Fleming be authorized to attend the North American Conference of the Government Finance Officers' Association to be held in Seattle, Washington - June 4-7, 1989.

(3) That Bill Fleming be authorized to attend the Western Canada Conference of the Government Finance Officers' Association to be held in Edmonton in September, 1989.

REPORT: Council has always encouraged staff development Mr. Fleming has had a long association with the Government Finance Officers' Association while with the Provincial Government and feels it beneficial to continue in his current position as Director of Finance. SUBJECT: Government Finance Officers Association of the United States and Canada ( G.F.O.A.) Pi

m Having been associated with the G.F.O.A. for the past eleven years, I would request approval for the renewal of my membership for 1989 at a cost of $75.00 Canadian Funds.

The G.F.O.A. holds three conference or meeting sessions annually that are based on the associations organized structure.

The first is the Alberta Chapter meetings usually held in the late spring. pi The second is the Western Canadian Regional Conference held in alternating Western Canadian Provinces and Territories in September.

The third is the North American Conference held usually in late spring in a major North American City.

In 1989 the Alberta Chapter meetings will be held in Red Deer mid June.

The 1989 North American Conference is scheduled for June 4 to 7 in Seattle, Washington.

The 1989 Western Canada Regional Conference is scheduled for Edmonton in September.

This is an appeal to the Alberta Planning Board from a decision of the Yellowhead Regional Planning Commission respecting the proposed subdivision of Lot 6, Block 2, Plan 772-0505 (SE 32-49-7-W5th), M.D. of Brazeau. ipi Upon notice being given to the interested parties, a hearing was held in the Village of Onoway, in the Province of Alberta en Monday, December 5, 1988.

SUMMARY OF HEARING The Yellowhead Regional Planning Commission refused the application to subdivide one 5.52 acre country residential parcel from an approximately 20 acre titled area, citing the contravention of the Subdivision Regulation and of Commission policies relating to the resubdivision of lands within existing multi-parcel country residential subdivisions. The Municipal District of Brazeau recommended refusal of the proposed subdivision, as did the Town of Drayton Valley, which is located 2 miles south of the subject lands. The Yellowhead Regional Planning Commission policy if to discourage the resubdivision of parcels within an existing multi-parcel country residential subdivision. Further, the Commission representative advised that the Proposed subdivision would alter the character of the existing subdivision, without benefit of an overall plan to determine the potential for further resubdivision within the existing country residential subdivision. Alberta Transportation requested that, if subdivision approval is granted, the existing access from Highway No. 22 to the proposed parcel be removed, that the service road along the east boundary of the subject lands be constructed from the northeast corner of the proposed parcel up to Valley Road and that the proposed residual parcel obtain access directly onto Valley Road. The appellant is unable to maintain the full 20 acre titled area. He wishes to retain proposed Lot 11, which encompasses his homesite and to sell proposed Lot 10. The appellant submits that he has spoken with tne neighbouring landowners, none of whom have objections to the proposed subdivision. The appellant objects to Alberta Transportation's request that he construct approxmately one-quarter mile of service road at his sole expense. The appellant submits that he has a formal agreement with Mobil Oil for the use of the access road pi and approach which serves the building site on the proposed Lot 11. The appellant wishes to continue this means of access for proposed Lot 11 with access to the proposed Lot 10 being provided directly onto the east-west internal subdivision road, known as Valley Road. 5H

FINDINGS OF FACT

Upon hearing and considering the representations and the evidence of the parties shown on Appendix A and upon having read and considered the documents shown on Appendix B attached hereto, the Board finds the facts in the matter to be as follows: ,

1. the subject lands are designated Agricultural-Mixed Land Use District, according to the County of Parkland Land Use Bylaw, which is in effect as the subject lands were recently annexed to the newly created Municipal District of Brazeau; the proposal is not barred by the land use bylaw; 2. the subject lands are lcoated approximately 2 miles north of the Town of Drayton Valley and the proposed subdivision therefore contravenes section 20(a) of the Subdivision Regulation, which restricts the creation of country^ residential parcels within 5 miles of an urban centre the size of Drayton Valley; 3. the subject lands are located immediately west of Highway No. 57 and s"ecticn« 23(1)(b) restricts the creation of country residential parcels within .5 miles 1 of a highway unless the lands proposed to be subdivided are included in an J approved Area Structure Plan; 4. there is a private, developed oil company road which originates south of theH subject lands and which presently provides access to the homesite on the I subject lands;

5. Mobil Oil has granted the right of use of the approach and access road to then appellant;

6. the oil company road presently accesses onto Highway No. 57 and is shared by the appellant and Mobil Oil.

In consideration of the above and having regard to the provisions of the Planning Act, the Board makes the following decision for the reasons set out below:

DECISION

The appeal be allowed and the proposed subdivision is approved, subject to the following conditions:

1. any outstanding property taxes being paid or arrangements being made which are satisfactory to the Municipal District of Brazeau;

2. the applicant entering into an agreement with the Municipal District ofr-> Brazeau, with respect to the provisions of section 92(1)(b) of the Act, and to include provision of access to proposed Lot 10 from Valley Road and the J existing access to proposed Lot 11 to remain, as per the appellant's agreement with Mobil Oil; — 1 3. the proposed subdivision being registered in a manner satisfactory to the Registrar of Land Titles; 4. the provision of municipal reserves, if owing as a result of the approved ^] subdivision, being provided in a manner satisfactory to the Yellowhead Regional J Planning Commission. Section 20(a) and 23(1)(b) of the Subdivision Regulation are hereby waived. ^ AND FURTHER, the applicant shall J provide documentation to the Yellowhead Regional Planning Commission to demonstrate that the above noted conditions have been met, prior to the endorsement, pursuant to section,™ 105 of the Act. AND FURTHER, this decision is valid for a period of one year from the date on the face of this Order. 55

REASONS pi The Board finds that the proposed subdivision will not unduly impact on the character of the existing subdivision, nor should it prejudice the preparation of any future outline plan or area structure plan for the subject and surrounding lands. Nor was there any information submitted which would demonstrate a negative impact on the Town of Drayton Valley's future growth options as a result of the proposed subdivision.

The Board does not find the proposed creation of one additional country residential parcel to justify the request for construction of the service road from Valley Road to the northeast corner of the proposed parcel. There is an historical established oil company road which provides access to the proposed Lot 11 and onto Highway No. 57. In addition, the subdivision of proposed Lot 11 will not result in any additional access requirements as it encompasses an established country residential site and the proposed residual lot, which may be developed, will access onto the internal subdivision road.

Further, Mobil Oil has granted the right of the use of the access road to the appellant. The proposed subdivision is not barred by the local planning documents in effect and the Board finds sufficient merit in the proposal to warrant relaxing the relevant sections of the Subdivision Regulation. pi

Fleming indicated that Public Works does not want to become involved in "Custom Seeding" for farmers, since it is felt the farmers are well compensated by the M.D. for crop damage.

AGRICULTURAL FIELDMAN'S REPORT R. Woloszyn reviewed his Decmeber, 1988 report for the A.S.B. and verbally reported on a Beaver Complaint by Mr. Gordon Duce. Mr. Duce was requesting the M.D. to blow a beaver dam on his property. Mr. Woloszyn advised the Board the dam was not blown due to the water being frozen over.

The Board discussed the procedures the M.D. should adopt regarding the blowing of beaver dams int he winter months. 9/89 Moved by W. Tweedle that no beaver dams will be blown between the period of November 1 to April 1 unless approved on a case to case basis by the Agricultural Fieldman.

DISTRICT HOME ECONOMIST REPORT B. Broks reviewed her December, 1988 report for the Board. B. Broks indicated G. CARRIED. The Chairman reported on an article in the Western Producer regarding a problem pasture in the Lodgepole area and requested a copy of the article be found and reviewed.

VIRULENT BLACKLEG OF CANOLA A letter from Alberta Agriculture, Plant Industry Division, dated December 8, 1988 was discussed regarding the growing problem of Virulent Blackleg of Canola.

PI C. Andersen reviewed the program Alberta Agriculture has started to control the Virulent Blackleg of Canola problem for the new members of the Board. Mr. Andersen indicated that the disease is not yet a problem within the M.D.

WARBURG SEED P CLEANING CO-OP B. Flesher reported on the financial and operating situation of the Warburg Seed Cleaning Co-op and noted from the information provided from the financial reports, that the Seed Cleaning plant is operating extremely well, and is basically self supporting.

Discussions occured whether or not the M.D. should contribute funding to the Seed Cleaning Plant, since M.D. residents are using the facility. A suggestion was made that the M.D. should forward a map to the Warburg Seed Cleaning Co-op advising them of the M.D. boundaries, together with a letter outlining the support if needed, by the M.D. for any funding. 21/89 Moved by C. Flesher also adivsed the Board of a Delegate Meeting occuring on January 30, 1989 at 1:30 p.m. at the Village of Breton office regarding the Breton Grain Elevator and suggested a representative from the M.D. should attend the meeting. A question was raised whether a notice would be placed in the local newspaper inviting surrounding residents to attend and support the Breton Grain Elevator to remain open.

B. Flesher indicated as far as he was aware, there was no indication a notice would be placed in the local new- paper .

A suggestion was made that Administration should place a notice in the newspaper advising the M.D. residents of the Delegate Meeting and encouraging their attendance and support.

1989 BUDGET J. Wardlow advised the Board that the final draft of the A.S.B. 1989 Budget would be going to Council for approval on January 12, 1989 and indicated if budget was approved, the Memorandum for Agreement would be prepared the following week.

FDRP APPLICATIONS A letter received from G. Laarhuis outlining the FDRP program and procedures was discussed. It was noted that any applications after March 1, 1989 would have to follow the new regulations.

It was suggested that the M.D. should not receive any applications until after March 1, 1989 so that new regulations can be followed.

R. Woloszyn indicated that two (2) applications have been submitted from Anthony Heinrichs and Ben Bustin for the FDRP, but action would not be taken until after March 1.

It was suggested that before the M.D. becomes involved in the program, that representatives from Alberta Agriculture should be ask to speak on the FDRP and SCAP programs.

Staff Comments and Implications based on a cursory viewpoint. ""

1. Yellowhead Regional Plan

If it is assumed that the Municipal District of Brazeau #77 will remain within the Yellowhead Region, the annexation of Areas 2, 3, and 4 (as shown on the accompanying map) would add land to the Yellowhead Regional planning area. Because the Yellowhead Regional Plan is a policy oriented document, with a minimum of location-specific provisions, and because it was prepared for lands which are in all respects very similar to the lands proposed to be annexed, the proposed annexation of land between rural municipalities would not be i expected to have a significant impact on the Yellowhead Regional Plan. 1

2. Existing Statutory Plans The Staff is also of the opinion that the practical effect J of the additional land on its provision of planning advisory services and the preparation of statutory plans would be «- negligible.

3. Existing Commission Workload and Subdivision Activity

The successful annexation of any of the four areas would result in an increase in the area for which the Yellowhead Regional Planning Commission acts as subdivision approving m. authority. Area 1 would come from the County of Parkland fs area; Areas 2, 3, and part of 4 from the Battle River Regional Planning Commission's; and the west part of Area 4 from the Red Deer Regional Planning Commission's area. (It should be noted that the majority of that part of Area 4 which is now within the Municipal District of Clearwater is not subject to the Planning Act.) The Staff does not **• anticipate any unacceptable increases in workload as a result of the proposed annexations.

The Staff also notes, with respect to its potential role as subdivision approving authority, that none of the areas proposed for annexation are further from the Commission's offices in Onoway than from any of the subdivision approving authorities now serving these areas. With respect to i municipal government services, each of the areas is considerably closer to the Municipal District of Brazeau #77 «* municipal offices in Drayton Valley than to Stony Plain, Wetaskiwin, or Rocky Mountain House. • 4. ' Y.R.P.C. Annexation Guidelines i In 1982, the Commission adopted "Annexation Guidelines" which set out the policies of the Commission with regard to proposed annexations. These policies are aimed at annexations of rural land to urban municipalities, and most i

are not relevant where rural to rural annexations are proposed. However, a review of the proposed annexations in light of the relevant Annexation Guidelines has resulted in the following comments:

(a) Policy (e) suggests that physical barriers be given consideration in the determination of municipal boundaries. The North Saskatchewan River forms part of the current boundary of the Municipal District of Brazeau #77. However, the location of the municipal offices in Drayton Valley, at a major highway crossing of the river (Highway 22), and the fact that the Municipal District currently lies on both sides of the river substantially reduces the significance of the North Saskatchewan as a boundary feature. There are no other significant boundary features in the vicinity of the proposed annexations which would assist in defining the municipal boundaries.

With this in mind, and recognizing that the proposed annexation areas were defined on the basis of petitions from residents, the Staff of the Yellowhead Regional Planning Commission is of the opinion that its Policy (e) is not a basis for objection * the boundaries proposed. *(* (b). Policy (m) suggests that an annexation should not primarily represent an attempt to increase the municipal assessment base. On the basis of the fact that the annexation boundaries were determined in response to petitions from residents, and recognizing that the Municipal District of Brazeau #77 has specifically excluded a quarter section of industrially developed land (NE 5.46.6.W5M), the Staff feels that the subject proposal does not offend Policy (m) of its Annexation Guidelines.

5. Recommendation In conclusion, the Yellowhead Regional Planning Commission Staff can see no objection to the annexation as proposed. It would note, however, that in the interests of creating a relatively consistent service radius focussed on the Town of Drayton Valley, a "squaring off" of the proposed new boundary and subject to the wishes of the residents, consideration may be given to the addition of the area to the north of Buck Lake, between Areas 3 and 4, and hatched as noted on the attached "Annexation Map" - please note this latter comment would suggest the exclusion of lands adjacent to (say 1/2 to 1 mile) Buck Lake in order that the lake and its far shore remain in one planning region.

This is to confirm that I act on behalf of the Applicant, Gordon McAllister, of Box 2074, Drayton Valley, Alberta, TOE OMO with respect to a proposed subdivision of the S*s of SW ll-50-8-W5th Meridian. This is in regard to Yellowhead Regional Planning Commission's file number 88/89YH079-41.

Further to the decision granted by the Yellowhead Regional Planning Commission of December 14, 1988, ray client, Mr. McAllister, wishes to appeal one of the conditions of approval as granted, specifically being condition number 5, that the balance of Certificate of Title #792236158 (N 1/2) and the balance of Certificate of Title #842148743 (S 1/2) be consolidated into one lot.

I am advised by Mr. McAllister that the reasons for his appeal from this condition being attached to the approval for his subdivision is that it restricts his right to otherwise independently deal with and handle the two parcels of land of which he is now owner, being the north and south half of the said quarter section of land. p Additionally, such required consolidation will in effect reduce the value of such lands. The lands in question stand as marginal farmland and primarily constitute a hobby farm type of use which would be the highest and best use for the same. Bpl Accordingly, the Appellant seeks to appeal the decision as granted or requests the deletion of condition #5 from the decision as granted by the Yellowhead Regional Planning Commission. A BY-LAW OF THE MUNICIPAL DISTRICT OF BRAZEAU NO. 77, IN THE PROVINCE OF ALBERTA, FOR THE PURPOSE OF AUTHORIZING THE COUNCIL TO PURCHASE VARIOUS EQUIPMENT IN THE 1988 YEAR.

WHEREAS, the Council of the Municipal District of Brazeau No. 77 deems it necessary to obtain certain capital equipment to carry out Municipal programs.

THEREFORE, pursuant to the authority granted under the Municipal Government Act, Chapter M-26, Revised Statutes of Alberta, 1980 and amendments thereto, the Council of the Municipal District of Brazeau No. 77 hereby enacts as follows:
