CARIUED. l REQUEST TO Request to Acquire Land - SW 13-50-6 WS - Bert Laiss ACQUIRE LAND Mr. Wardlow mentioned that the M.D. is still waiting for l land titles and further information regarding the above land. He also indic~ted that a another request has come in to lease the above property from Mr. Baldwin. Mr. Wardlow suggested that this land should not be sold at l this time. 421/88 Moved by N. Norton that a request by Mr. Bert Laiss to acquire land - SW 13-50-6 W5 - be tabled until further information is received. l CARRIED. APPROVAL OF (a) Computer Equipment 1 TENDERS Mr. Fleming indicated to Council that he had contacted two companies with regard to computer equipment: Bellamy Software and North American Systems. The quote from 1 North American Systems was $40,610.00 and from Bellamy Software $42,265.00 with additional costs to be incurred. With these additional costs the total price would be well over $60,000.00. 1 Discussion was held as to the adequacy of these systems. 422/88 Moved by B. Booth that the quote of $40,610.00 from North American Systems for the upgrading 1 of the computer system be accepted. CARRIED. l (b) Furniture Mr. Wardlow indicated that a quote from S.M.E.D. Manufac­ turing has been received in the amount of $11,834.00. He indicated that the purchase of this furniture would keep .l the office consistent throughout. 423/88 Moved by N. Norton that the quote of $11,834.00 from S.M.E.D. Manufacturing for the purchase l of furniture for the Directors' offices be accepted. CARRIED. l (c) Venetian and Vertical Blinds Mrs. Andrew indicated that quotes were received for Venetian and Vertical Blinds for the Executive Offices from United l Carpet and Fantasy Flooring. Fletcher from the Western Review attended the meeting at 10:00 a.m. r (d) Photocopier and Fax Machine Mr. Wardlow discussed with Council two different types of photocopier machines: Cannon and Xerox. He indicated

REQUEST FOR Chamber of Commerce r FUNDING Mssrs. Regenwetter, Nelson and Monsiour from the Drayton Valley Chamber of Commerce attended the meeting at 10:05 r a.m. The Chamber of Commerce members discussed with Council the possibility of receiving funding. They asked for r a donation of $5000.00. A brochure and pins were presented. Mr. Rondeau thanked Mssrs. Regenwetter, Nelson and Monsieur for their presentation and indicated to them that Council ' would take their request into consideration. r' Mssrs. Regenwetter, Nelson and Monsieur left the meeting at 10:22 a.m. r Drayton Valley Curling Club Mr. Bruce Clemmer and Mr. Glen Salzl from the Drayton Valley Curling Club attended the meeting at 10:22 a.m. r Mr. Clemmer gave a breakdown of funds received through the Curling Club's fundraising and presented a handout to Council. He indicated that their goal is to get the first phase of this project completed. r Mr. Rondeau thanked Mr. Clemmer and Mr. Salzl for their presentation. r Mr. Clemmer and Mr. Salzl left the meeting at 10:41 a.m. REQUEST FOR Request for Road Construction - Pt. NW 20-50-9 WS and ROAD SE 21-S0-9 W5 CONSTRUCTION r Mr. Henry Watson and Mr. Ray Sass attended the meeting at 10:42 a.m. to indicate their desire to have a road constructed by the M.D. at the above locations. r They indicated to Council that this road was in very bad condition and that at this point the school bus cannot even access it. r Mr. Wardlow asked that further information be supplied r· regarding this request and that Council be presented with this information at a later date. r r' ... /6 l MINUTES - 6 - 88 10 27/28

Mr. Cumming then reviewed Sections 43 to 53 of the Municipal l Taxation Act. Mr. Murray reviewed the Municipal Taxation Act with respect to lands, buildings and structure, machinery and equipment. l Mr. Murray and Mr. Cumming left the meeting at 3:00 p.m. ROAD PROGRAM 1989 Road Program - Recommendation to Alberta Transportation l Discussion was held as to which roads would be priorized for the 1989 Road Program. l 454/88 Moved by B. r FROM: Richard Tatro ~ Director of Public Works~ r SUBJECT: Rocky Rapids Water Management Project RECOMMENDATION: That the Phoenix Group be selected to carry out the Engineering Services for the Rocky Rapids Water r Management Project. REPORT: At the September 15, 1988 Council meeting, authorization was given to request proposals for the Rocky Rapids Drainage and Erosion Problem. This report will review the proposals and r make a recommendation. Three engineering& firms were requested to submit proposals. The following terms of reference were given: r A) The report to be prepared will meet all requirements of Alberta Environment. (A copy of the guidelines was attached). r B) The consultant will insure that they are completely familiar with the requirements and the nature of the problem prior to submission. r C) Personal resumes of the proposal staffing will be included plus a list of similar projects that have been completed. , D) Cost proposals shall be submitted on an hourly fee basis with an upset project cost. Disbursements shall be on a cost plus percent mark-up basis.

E) A time frame to complete the report should be r indicated but must be completed by December 15, 1988. Time is of the essence.

F) The number of copies of the report required is in the r range of 10 to 15 copies. All three of the firms are capable of carrying out this study. In assigning the most appropriate firm, there are several r factors to consider including: 1) Fee structure r 2) Company background in similar work 3) Familiarity with project r 4) Our familiarity with consultant 5) Personnel to be used

The fee structure, as per the terms of reference, has been r given on an hourly fee with total fee not to exceed the agreed upset. The submissions are:

There are two ways in analysing the fee structure. The first l is to consider the hourly fee. In theory, if the project takes the same amount of hours by any company the lover per hour fee would be the most eceonomical (Phoenix Group). The second approach is to compare the upset fee (maximum bill). The most economical in this case is Tritek. It is my experience that l the total bill generally is within 5% of the upset.

Between the three submissions, I believe the choice is between The Phoenix Group and Tritek. The fee structures are very 1 close so the other factors should be considered.

The personnel and company backgrounds are approximately equal. Tritek is presently finishing the Hamlet Utility Study which l may make them slightly more familiar with the area. I have dealt with The Phoenix Group on a number of projects and began dealing with Tritek on the Utility Study. l I have reviewed reports for similar projects that the firms would be producing.

In analysing all aspects of the proposals, it is recommended that The Phoenix Group be selected. 1 r l l _l 1 l , l l l r \S ·r

It is the administrations opinion that the submission from R. Angus is the better choi~e. It is the opinion that the cash price should be accepted and the existing unit should l be disposed of on the open market. This is because we feel we should receive at least $20,000 this way opposed to the $16,000 that would be given by R.. Angus. l The reasons for our recommendation are as follows:

1. It is within $1,000 of the lowest price. 2. A S year buy-back is guaranteed at $85,000. l 3. It has au excellent power train warranty essentially covering the unit for the life of the machine. 4. It is the 2nd choice of both the operators and l mechanic. s·. R. Angus support for parts and service is, in our opinion, the better of the five companies. l 6. Further to my September 22, 1988 letter, I ·have now had the opportunity to review your access concern with the Honourable Al l "Boomer" Adair, Minister of Transportation and Utilities. We appreciate that the conveyance of farm implements along modern two lane primary highways with shoulders may pose safety concerns even though J slow moving emblems are utilized. In some cases, fa~ers utilize half ton as pilot vehicles to provide extra warning to highway traffic that slow moving implements are involved. l The matter of developing the lDlopened road allowance would come under the jurisdiction of the Municipal District of Brazeau No. 77 as the municipal district, as the road authority, has responsibility for l management, control and scheduling of improvements of all local and secondary roads under its jurisdiction.

I will provide the Municipal District of Brazeau with a copy of your letter and request that Council review and consider your request. It is noted that the Government provides an annual grant to counties and l municipal districts for improving rural roads at each council's discretion. I believe it is fair to say that the municipal district receives many road requests and that it may not be possible to undertake all the work with the funding that is available for road improvements. l Nevertheless, the municipal district council will priorize your request along with other priority road projects and advise you further on this matter. l

Texaco Canada Resources r 10130 - 112 Street Edmonton, Alberta r TSK 2K4 having filed an application for an EXPLORATION PERMIT is hereby authorized to conduct ground water exploration between depths of 65 and. ·450 feet on r NW 5-49-11-WS to detenmine the feasibility of obtaining 110,000 Canadian r gallons per day for Industrial (Injection) purposes. This Exploration permit is subject to the following terms and conditions: r General Tenms and Conditions 1. The applicant shall do as little damage as possible and shall fully r compensate all persons sustaining damage as a result of the examinations and surveys. , 2. The applicant shall hold harmless the Minister of the Environment or .any other agent of the Government of Alberta for damage or damage claims arising out of examinations and surveys hereby permitted. r 3. When a test well, completed well or other hole is abandoned, it shall be effectively sealed in such a manner as to prevent the entry of surface water and the inter-mixing of ground water from the aquifers penetrated by r the well. 4. Non-potable water produced during the testing program shall be disposed of r in accordance with pertinent regulations under the Clean Water Act. 5. Under the Ground Water Development Act, a licence to drill water wells is required for drilling any water well or ground water test hole. Such a r licence is available from the Director of the Technical Services Division of Alberta Environment. The condition of journeyman driller may be waived r for: (a) Water well installations deeper than 450 metres and producing non-potable water for non-domestic purposes; r {b) Ground water test holes deeper than 450 metres. r ••• /2~ r 0452b J

Specific Terms and Conditions ] 1. The applicant shall carry out a field-verified survey of all the wells, springs and dugouts within two (2) mile(s) of the proposed production well ] and ascertain where possible the location, ownership, water level, pump intake depth and open intervals of these wells. 2. The applicant shall conduct a pumping test on the proposed production l well(s} meeting the following criteria: (a) At least one water sample for chemical analysis shall be taken during J the pumping test and analysed for the following constituents: Total dissolved solids, Ca, Mg, Na+K, COJ, HC03, S04, Cl, NOJ, F, Fe, pH, hardness and alkalinity. Time of sampling shall be recorded. J (b) The pumping test on each production well shall be conducted at not less than its anticipated maximum production rate. l (c) During the pumping test(s) the maximum variation in pump rate shall be +5". 1 (d) The pumping test(s) shall continue for a period of time sufficient to identify any limiting boundary conditions but shall in no case be of less than 72 hours in duration. l (e) Recovery measurements :are to be taken for at least the same length of time as the well was pumped. l (f) One (1) observation well(s) shall be provided for the pumping test. (g) The observation well(s) described in (f) shall be located at a l suggested distance of from 50 to 500 feet from the pumped well and shall be measured on the same schedule as the pumped well. 3. The applicant shall submit an aquifer evaluation report in triplicate l outlining the conclusions derived from the program complete with all details of test results including, but not limited to, the following items: _l (a) General plan showing quarter-section lines and the location of the proposed production well(s) and works related to the diversion and use of water along with physical features such as roads, river, creeks, 1 etc., and location and ownership of any existing wells, springs and dugouts within two (2) mile(s) of the proposed production well{s). l (b) Detailed plan showing the location and elevation of all wells involved in the pumping test and test drilling programs. (c) Schematic diagrams showing construction of all production and J observation wells. l l O'l5?b r r - 3 -

r (d) Lithologic and where available, geophysical logs, with aquifer zones indicated, of all holes drilled along with copies of any maps drawn showing the extent and thickness of the aquifer being tested and other r aquifers. r (e) Copies of all chemical analyses performed on samples taken. (f) Names of drilling contractors involved in data acquisition. (g) Details of drawdown and recovery in all pumped wells and observations r wells together with an interpretation of the results including graphs of time drawdown and distance drawdown, and all calculations r performed. Copies of raw data should be included. (h) Tables containing the information required in clause 1 of the specific r terms and conditions. (i) Cross sections of approximately NE-SW and NW-SE orientation and about four (4) miles in length through the proposed production well(s) showing geology, springs, creeks or lakes, and the depth, water level r and completion of all water wells on the section. (j) Calculated cones of depression, neglecting recharge, after 1, 5 and 20 r years of production at the rates projected for the proposed production well ( s). r! (k) Table of expected drawdown, neglecting recharge, after 1, 5 and 20 years of production at the location of all wells within two (2) r mile(s) of the proposed production well(s). MOTION by Mr. Dave Lundberg that due to the uncertainty of the final boundaries of the Municipal District of Brazeau, l it is considered premature to proceed with the Meridian Foundation split at this point in time."

The Town of Drayton Valley served notice at this meeting that J they could not support the creation of a new Foundation as recommended earlier, until such time as the Municipal District of Brazeau application for annexation is dealt with. The Municipal 1 District of Brazeau served notice that they supported the creation of a new Foundation at this time, however, appreciated the position now taken by Drayton Valley, given that two (2) l other Foundation boundaries also overlap into the newly created M. D. of Brazeau. The consensus of the Board of Directors was that the 1988 l operating deficit will remain fully recovered from the contributing municipalities based on each municipality's proportion of the total equalized assessment, according to the 1 terms of the existing Master Agreement. It was the further consensus of the Board of Directors that there never was any implied intention in the By-Law, that upon the creation of a new ] Foundation for the M.D- of Brazeau and the Town of Drayton Valley, would the other remaining municipalities be responsible for paying any share of the previous year's operating deficit on behalf of the M.D. of Brazeau and the Town of Drayton Valley. l l ..... The board would like the M.D. of Brazeau to continue these l services. We were told that we would not lose services once we became part of the M.D. of Brazeau. We were told that we would have the saae services and maybe even better than what we have now.

The Breton General Hospital are especially interested in being the •Response Centre" for the CARE line users. The funding for l the uResponse Centre 11 we feel should come from the FCSS Funding Project. l We anticipate an early response to this concern as the end of December is fast approaching.

The Law Enforcement Grant, r another major component of APT, will also increase by 5 per cent to $29.6 million. As a result, the total APT grant for fiscal 1989/90 will be $153 million. r A new program providing additional provincial funding for transportation initiatives was announced in October by the Minister of Transportation and Utilities. r The Alberta Cities Transportation Partnership Program will provide $500 million to municipalities over a r three year period. The Alberta Partnership Transfer Program was announced in January, 1988 and consolid~tes individual payments previously made for law enforcement, public transit r operating assistance and municipal assistance into a single, unconditional grant to all municipalities in r Alberta. Mr. Young said, nThe province will also provide municipalities with additional funding through the r Alberta Municipal Partnership in Local Employment Program (AMPLE) which will total almost $67 million in the 1989/90 fiscal year. This is a 5 per cent increase to the basic funding of Alberta's health system, which will r provide for the enhancement of programs and services above the current 1.9 per cent inflation rate in Alberta. r The Minister also announced that the home care program will be expanded du~ing the next year, and that othe~ initiatives to enhance health services will be r announced in the budget address. "During the past year, our health system has made r significant improvements in the delivery of services to Albertans while maintaining responsible fiscal r management of their resources.• "The major increase announced today will enable the board members and staff to continue to meet and enhance the high standards of health services Albertans have r come to expect," said Mrs. Betkowski. •t compliment them for their commitment and contribution to improving r the quality of life in our province." This By-Law will next be circulated to all the contributing municipalities for their review and/or

' comments and ultimately, there must be unanimous support from all r municipal councils in passing the By-Law. The Board of Directors are meeting in Stony Plain on January 19, r 1989 and this item will be placed on the agenda. It must be noted, however, that the Meridian Foundation itself cannot initiate the split, and a course of action must therefore be formalized in approaching the Minister for approval, once the By­ r Law has gained unanimous support of the Councils. In order to expedite the process, I will attempt to have a draft r By-Law mailed to all municipalities for their review prior to the Directors' meeting of January 19, 1989. It would then be expected that each Council representative on the Board of r Directors will bring to that meeting, each municipality's position relevant to the conditions of the Meridian Foundation r split. Reason for saying this are; one , a subdivsion was approved just about 1/8 mile south of our residence, sarething like r eleven lots, another one got approved just to the north of us. All I want to do is subdivide so that I could sell my present residence with the 5.5 acres and build on the north part of r that parcel. Everything in rules and regulations pertaining to subdivision is done, and right now that land is sitting idle r growing weeds. The Mobil Oil road runs along the South boundary of the property . Mr. Fleming reports that the M. D. of Brazeau maintains this road past the subject property for school bus and residential purposes already. It is a high grade gravel road with the ditches in good condition.

3 issues: 1 . S. 20 subdivision Regulations within 5 miles of Drayton Valley however parcel is already fragmented back in 1978.

Please find on the attached map the properties owned by the M.D. of Brazeau that are the subject of Melvin and Gabriel Baldwin (letter dated September 26, 1988) and Bert Lai ~ letter dated October 14, 1988) .

The Baldwins wish to lease or purchase the lands marked in red, while Mr . Laiss wants only to purchase 4 acres of the northern most portion, this is marked in yellow.

It is my recommendation that these properties may be of some use to the M.D . in the f uture (stockpile site, earth borrow pit, etc). We are only beginning to sort out all the properties the M. D. has title to and interest in. The land in question cou~d ~e _ l ease d _ b~t I would not r ecommend the sale of these properties at thls t lme . ~

This conference is also in conjunction with the Federation of Alberta Gas Co-ops. I do not have the full agenda at my disposal due to the fact that I am not a member of the Association yet that would be rectified by attending this conference. The parts of the agenda that I do know are as follows:
